Gibbs: The DOJ is still reviewing Arizona’s law but let’s call it “fundamentally unfair” anyway

A nice catch by reader Garrett, who reminds me that this wouldn’t be the first time The One has pronounced judgment on police action before he had all the facts. Skip ahead to 1:25, although if you do, you’ll miss Gibbsy’s surprising admission that Arizona’s law is a byproduct of Congress failing to act at the national level. I get why he’s doing that — if they want action on comprehensive immigration reform this year, they need every bit of pressure they can find — but it’s further evidence for my theory that Arizona’s law was intended, more or less, as a bargaining chip that national Republicans can use to demand stricter border enforcement. Either get serious at the federal level or face the states taking matters into their own hands. Nice to see Gibbs playing ball here.

My view is this is about the law of the United States. Liberals are all for laws unless those laws get in their way.

We’re a Nation of laws, of the kind of mention that you, being a Citizen, can’t shoot the pig who raped your daughter. You take him to Court, despite your feelings. The Rule of Law overrides you being able to do to the one hurt you thought the SOB has it coming.

The Justice Department’s Office of Special Counsel for Immigration Related Unfair Employment Practices (OSC) today announced grant funding available for public education programs that provide workers or employers with information about immigration-related employment discrimination under the anti-discrimination provision of the Immigration and Nationality Act (INA).

The program is open to public service and other organizations that provide services to potential victims of immigration-related employment discrimination and/or employers. Recipients will assist discrimination victims; conduct seminars for workers, employers and immigration service providers; distribute educational materials in various languages; and place advertisements in local communities through both mainstream and ethnic media to educate workers and employers about their rights. In 2009, a total of $723,000 was awarded to 12 organizations serving communities throughout the country. The grants ranged from approximately $51,000 to $87,000.

The fact that foreign criminals are permitted to run amok in my state, raping and kidnapping and killing. The fact that law-abiding Arizona citizens have to pay billions of dollars in extra taxes every year to fund the “free” public education and “free” medical care and social services provided to the half-million (or more) illegal aliens who reside here, in open and flagrant violation of U.S. law, not to mention the thousands of illegal aliens serving time in Arizona’s prisons at the expense of Arizona taxpayers. The fact that some of Arizona’s elected representatives, who are supposed to be protecting the interests of Arizona’s citizens, clearly care more about the “rights” of law-breaking foreigners than they care about the rights of Arizona’s citizens. 1) Illegal is Illegal! No matter what! Anyone that acts like they don’t want to get approached by the law must have a reason to act so, right? They did something illegal or they wouldn’t care if a cop approaced them! I hated being approached by police when I still used drugs. Now that I’ve quit, I have no problem talking to law enforcement at any opportunity! I go to them!!! I tell them that they (as well as firefighters) are our local heros, and I thank them.

If you break the law, the police should and will approach you. If they have reason to suspect during that approach, that you’ve broken more then one law they SHOULD check to see if there is anything else you have done or are doing that they need to know about!

2) The only reason the Obama administration is pushing this so hard at this point is to hide the fact that they are working under the table to get Cap and Tax passed because they will make so much money on it themselves along with Goldman Sacks that we will truly see the obvious two Americas. They the ultra rich and we the ultra poor.

How I long for the days of a truly intelligent Press Secretary like Tony Snow. Gibbs is just too unintellectual to perform his job withot stammering and stuttering over everything he tries to say!

Will Arizona’s New Laws Hold up in Federal Court?

(Disclaimer: I am not a lawyer.)

Opponents of Arizona’s attempts to protect its citizens argue, in part, that the Arizona law is “pre-empted” by federal law.

However, the Supreme Court has ruled:

When the text of a pre-emption clause is susceptible of more than one plausible reading, courts ordinarily “accept the reading that disfavors pre-emption.” Bates v. Dow Agrosciences LLC, 544 U. S. 431, 449 (2005).

And the ultra-liberal Ninth Circuit upheld a 2007 Arizona law mandating that employers in the state use the E-Verify system to ensure that they’re hiring legal workers. The Court threw out the pre-emption challenge. But it also threw out a challenge on the basis that the law might lead to unsavory police activities, saying:

If and when the statute is enforced, and the factual background is developed, other challenges to the 13066 CPLC v. NAPOLITANO Act as applied in any particular instance or manner will not be controlled by our decision.

The new law will probably find a similar reception in the courts. It will be upheld.

Mandate that every employer must use the E-Verify system before hiring anyone to ensure that they are in fact legally documented citizens or legally documented guest workers.

They love to demonize businesses but they also need that voting bloc. Down here in Florida we are flooded with illegals; I investigate employers and remarkably they just shrug their shoulders when they’re informed that they have an illegal undocumented worker on their payroll.

I think a lot of this is going to stop when the large PEO’s (payroll companies) and carriers start using E-verify before adding someone to a WC policy or a payroll.

The opposition to this is all politics. Reasonable Suspicion is a very well defined concept in case law and this law expicitly excludes race based take downs.

is that a serious question, or are you being deliberately obtuse? Go google “due process” and/or the 14th Amendment. You may also want to check out the 4th Amendment. The Supremacy Clause is something you should familiarize yourself with as well.
