How about Hillary as next SCOTUS justice?
posted at 10:12 am on April 12, 2010 by Ed Morrissey
Did Orrin Hatch really hear Hillary Clinton’s name get floated as a potential Supreme Court nominee? The New York Daily News reports that the Senator from Utah briefly discussed the idea on Meet the Press yesterday, without noting whether he’d support Hillary’s nomination if Barack Obama offered it:
Sen. Orrin Hatch says he’s heard Secretary of State Hillary Clinton’s name mentioned in connection with the Supreme Court vacancy brought about by the retirement of Justice John Paul Stevens.
Hatch didn’t elaborate in an interview Monday. Appearing with Senate Judiciary Committee Chairman Patrick Leahy on NBC’s “Today” show, the Utah Republican said only, “I heard Sen. Hillary Rodham Clinton’s name today and that would be an interesting person in the mix.”
Jammie Wearing Fool notes that the idea isn’t so unreasonable:
Let’s face it. She’d breeze through confirmation hearings since she’s a known commodity. It would also spare Obama any further political damage rather than going the far left route that’s sure to rifle feathers in an already heated atmosphere.
Unless he’s really itching for a fight, it would be a safe pick. Whether her legal acumen is up to snuff we’ll let the lawyers out there decide that.
A Hillary nomination actually solves a few problems for Obama. The Senate usually likes to confirm current and former members of the club, which would take a lot of the sting out of the confirmation process. While Republicans in the upper chamber probably won’t vote for Hillary, they also would be very unlikely to filibuster her nomination. Her relative lack of a top-line legal career will get trumped by her political career, so even the “legal acumen” argument can be bypassed.
Politically, Obama gets a win by puting another woman on the court. Unlike with at least one of the apparent short-listers (Elana Kagan), no one will doubt Hillary’s liberal bona fides. But best of all, Obama would be dispatching the one Democrat who could conceivably win a primary race against him in 2012 if his numbers continue to fall. Once on the Supreme Court, Hillary would not step down to run for President, and Bill Clinton would be effectively neutralized as well.
There are only two flies in the ointment. First, Hillary is a little old for SCOTUS picks. At 63, she might only get 20 years tops on the court, where a younger pick could have twice that amount, extending the Obama legacy further. The bigger problem would be nominating a new Secretary of State. Hillary has been a disaster from the start, with her “reset” button fiasco, and American diplomacy has been botched around the world. A confirmation hearing for State in this circumstance would give Republicans a platform to lay out the administration’s disastrous record in excruciating detail.
Would that be worth it to keep Obama from facing a primary challenge? With any other President, I’d guess no. With Obama, the personal is the ultimate in political calculation, so I wouldn’t rule it out.

Frankly I think it much more likely Obama would nominate Bill Clinton. That’s been the liberal fantasy for a while now: a liberal court member who could match up against Roberts and Scalia.

Nah. Obama follows the old rule…..Keep your friends close and your enemies closer.
Won’t happen. He’ll use her as another scapegoat when things really end up in the toilet. Watch out for the 5:15 O-Bus, Hillary. It’s coming some day. Those tires leave one heck of a mark.

Seriously, just as Orin manages to worm his way back into my “Ok, He’s not crazy” thinking circle, he simply can’t stay there.
What utter nonsense.
Hillary is not only not qualified, she’s not interested.
Hillary Clinton is a politician. A life-long politician. Like her politics or not, she’s never, ever presented herself to any of us as anything other than just that…and that is NOT remotely close to being appropriate for a Supreme Court justice appointment.
This story makes me especially nuts, because it’s so far “out there,” that it make me wonder if the true middle has a grip on the real politics of this country.
Seriously. I’m not interested in either far-left or far-right.
It makes me crazy when they try to take over the discussion.
We have real issues. And those sure aren’t whether Hillary is a Candidate for Supreme Court justice.
Heaven forbid, and I adore her, btw.
AnninCA on April 12, 2010 at 10:18 AM
An impeached President nominated for SCOTUS. Yea, that fits the pattern for Obama picks.
Syd B. on April 12, 2010 at 10:18 AM
If Hillary’s offered this, she’d be crazy not to accept. I think her shot at primarying Obama was destroyed the moment she accepted the SoS position. She’s now tied to his administration(at least in terms of foreign policy).

A perfect example of governmental meritocracy in action. You make a shambles of the Secretary of State gig; you get promoted to Supreme Court Justice.

I’m a little old-fashioned when it comes to SCOTUS nominees. I tend to believe that they should have a) experience, b) experience, and c) experience. Hillary would be an awful choice to replace Stevens. Why is she a more credible candidate than, say, Harriet Miers (sp)?

I floated this idea when Stevens retired. It’s a Ten-Strike for Obama. Kills the Clinton Dynasty in DNC land and destroys the DLC caucus, with only Bill able to wander the Democratic Party like Morley’s Ghost reminding Dems how great he was.
This is a no-brainer for Ogabe. He MUST do this to destroy the “centrists” in the D Party and finally kill off the Clintons for his patron, Dr. Evil (aka, George Soros).
victor82 on April 12, 2010 at 10:22 AM
First of all, this is a ridiculous suggestion by a far-right politician.
Second of all, Hillary isn’t Bill.
And finally, can’t you people distinguish the two?
After all this time, seriously?
Do Not tell me that you all think your wives/husbands are identical to you.
Please, that really would disrupt my serenity.

Cicero43 on April 12, 2010 at 10:22 AM
Maybe Hillary might not be so bad. A reliable liberal vote, but that’s what they had with Stevens. She doesn’t solve the problem that the left doesn’t have much intellectual horsepower on SCOTUS. Not one of them writes better than Scalia, Roberts, or Alito.
BuckeyeSam on April 12, 2010 at 10:22 AM
No way. I don’t think he’ll nominate her. Zero will only serve up to 8 years as President, there is no way that he’ll give all that power to Hillary for as long as she wants it, if she wants it.
Just because she said she’s not running in 2012, if Zero keeps screwing up and she has to come out and fix it, I have a feeling she will primary against him. All she has to do is say see I told you so.

BuckeyeSam on April 12, 2010 at 10:25 AM
Totally foolish idea.
Yes, it would remove his #1 political opponent from the mix, but it would also be a nomination with NO judicial record, a Whitewater case that has never been resolved, not to mention a zillion and one other pieces of embarrassing baggage that would all surface again during hearings.
Might as well nominate Joe The Plumber. At least he’d have a clean record.
GoldenEagle4444 on April 12, 2010 at 10:27 AM
I agree with Ed and other posters; it won’t be BC because he’s kinda frail, isn’t female, and isn’t of color.
Hillary would marginally be ‘better’ (ha), because she’s female and less frail, but I still don’t (hopefully) see that happening.
I suspect we’re going to see a minority, probably female. Then again, what’s his college prof buddy Skip Gates doing nowadays?

The only reason not to do this is to cause further dissension in the nation.
This is the only nominee that would have a chance of being accepted without a blood bath.
All the others that Obama would choose would almost be certainly far left ideologues.
Not my first choice (second, third, fourth, etc), but a logical one…

As much fun as it would be to watch Justice Scalia toy with her in oral argument, those 63 reasons will probably stop the nomination.
As far as qualifications go, she’s every bit as qualified to sit on the SCOTUS as she was to be a senator or run State.
EconomicNeocon on April 12, 2010 at 10:36 AM

DrStock on April 12, 2010 at 10:37 AM
It would never happen, because given the right circumstances, it would give Hillary Clinton power over Obama. Right now she has none, and I think that’s Obama’s clear preference when it comes to the Clintons.

It would also be a way of Obama bringing up how utterly stupid and criminal Hillary is.
This would bring up all of her…”I don’t recall” statements.

Concur w/ AnninCA – HERSELF! is a politician from the word ‘go’ and is far more interested in moving into the White House.
Hillary has two other formidable obstacles to overcome for SCOTUS – her legal history is sparse and suspect (as in the Whitewater/Castle Grande kerfuffles) and her legal reasoning on the Constitution is shallow to non-existent. True, her former Senate colleagues would push hard for her, but HERSELF! would make Sonia Sotomayor look like a Scalia.

I can see it now, one of the real fun questions that can be asked of Hillary:
Q: Sen. Clinton, what is your connection to Chen Kai-Kit and the Soviet aircraft carrier Varyag?
Or… any question about Hsu should be lots of fun! Or Gupta! Or Peter Paul! Or her view of abortion rights and support of NARAL! Or the Chinagate/Donorgate scandals… like that fellow “Charlie Trie” or Ng Lapseng or Wang Jun or Johnny Chung …
Hey the Lippo Scandal and John Huang ought to be interesting!
Plus that James Riady fellow…
Or Roger Tamraz!
Why I’m sure the Senate would just LOVE to get into Hillary’s connections and knowledge of organized crime figures local and global… that would take up a couple of weeks right there!
So, yes, PLEASE nominate Hillary Clinton to the SCOTUS! I need an excuse to buy more popcorn!

Why not, she’s got more experience then the occupier in chief. She actually worked as a lawyer in Arkansas for awhile and dabbled in commodity trading and land deals. Also worked on presidential pardons and got elected senator although she didn’t propose any major legislation, she did finish her term, I think. Why, yeah, she’s overly qualified.

I can easily see Obama doing this.
Every member of his “official” cabinet is only there to act as a sacrificial lamb; to take the flak for all of the wildly unpopular moves he’s making. And Hillary Clinton was deliberately put in the hottest hot seat.
Obama needs a clay pigeon to take the hits before he appoints his REAL pick. And a Senate Confirmation hearing will be the perfect pillory for Hillary. Her all-too-public record will provide all the ammunition Republicans will ever need to completely humiliate her.
For Obama, this is a win-win situation: If Hillary gets shot down, her career will too damaged to show her face in public again, let alone pose a political threat. Then he can appoint his REAL hard-core radical pick. After their heroic victory against Hillary, they will look bad picking on “unconfirmed” (i.e., not on TV) evidence. So a hard-core anti-American Black Liberation Theologist will be on the court forevermore.
On the other hand, even if Hillary does get on the court, she’ll be out of his Obama’s hair forever.
That’s a win-win situation for Obama.

I have heard Hillary’s name mentioned as a member of the SCOTUS. I sure isn’t a good idea and I do not think she would “sail” through the confirmation hearings. She is a “known” quantity and lies just like every other Democrat.
I don’t consider her particularly hard working as she just coasts through anything she does. She would probably work her underlings to death. Whatever the cause she is not looking like she is really into working for the government. She isn’t taking care of how she looks in public appearances and we aren’t getting much out of her as a SOS. I am not that much impressed with her work ethic. She has RETIREMENT written all over her.

How about the Clinton’s connection to the TotalFinaElf network? An entire network of financial, political, industrial, natural resources and criminal contacts meant to obfuscate where money went… like in Angolagate.
That money laundering network might remind a few folks of Oil For Food and get into some of the other contacts involved between the TotalFinaElf network and the OFF network. Including that swell fellow known as Marc Rich. Of course if you dig in that too long you run across an Obama backer or two… so Obama might get some second thoughts if even one Senator breathed the hint of a financial background investigation and personal affiliation investigation of Hillary with some of those network members.
Weren’t the Clinton years fun? And since Hillary was the barnacle attached to Bill, she got to see, meet, greet and hobnob with some of the richest lowlifes on the planet. What a lovely rolodex to look over… or is that ‘overlook’? It would be lovely if Hillary was put up for SCOTUS, because the ties she has will also tie to the President. All it takes is just one Senator to bring that up… just one… and then the questions get very interesting, indeed.
