Doctor tells ObamaCare supporters to find another urologist

posted at 12:55 pm on April 2, 2010 by Ed Morrissey

One doctor has decided to make his opposition to ObamaCare as public as possible.  Dr. Jack Cassell put a sign on his door telling patients who supported the health-care overhaul bill to find another urologist.  He’s also stocking his waiting room with information on the problems in ObamaCare — and so far, most of his patients have agreed with him:

A doctor who considers the national health-care overhaul to be bad medicine for the country posted a sign on his office door telling patients who voted for President Barack Obama to seek care “elsewhere.”

“I’m not turning anybody away — that would be unethical,” Dr. Jack Cassell, 56, a Mount Dora urologist and a registered Republican opposed to the health plan, told the Orlando Sentinel on Thursday. “But if they read the sign and turn the other way, so be it.”

The sign reads: “If you voted for Obama … seek urologic care elsewhere. Changes to your healthcare begin right now, not in four years.”

Critics raised questions about Cassell’s ethics.  Doctors are not allowed to refuse treatment to patients on the basis of race, ethnicity, religion, or sexual orientation in Florida, but political differences aren’t covered by the ethics regulations.  Cassell says he wouldn’t refuse to treat supporters of the new law, but he wants to make his displeasure with it publicly known so that those who disagree can choose to get treated elsewhere.

How has that played in terms of Cassell’s business?  His wife, who is running for local office as a Republican, says the doctor has gotten three complaints since posting the sign and publishing criticisms of the bill in his waiting room.  The majority of the feedback has been “overwhelmingly supportive,” she claims.

Doctors have the right to free speech, and if critics think that doctors should just shut up and treat people, then they haven’t been to the local family practice lately.  Doctors and nurses have been buzzing about this bill with patients (and anyone else who will listen) over their concerns about ObamaCare.  They may not have gone as far as Cassell and posted their feelings on the door, but my experiences over the last few months suggest that they’re not much less shy about their skepticism and alarm over the bill.

The Orlando Sentinel has their own interactive poll on this, so be sure to read the article and cast a vote there, but let’s ask a somewhat different poll here:

Thank you dear leader for restricted speech. I would hate for any post I attempt to make here get past the politburo’s watchful eye.

Thank you Dr. Cassell for your courage. We need more, not less, of Americans like you.

russcote on April 2, 2010 at 3:17 PM

It would be awesome if doctors all over the country made similar visible protests.

The blithe assumption of ObamaCare supporters has always been that all doctors would simply acquiesce meekly to becoming federal bureaucrats.

The AMA was “brought on board,” after all!

ObamaCare supporters need to be made well aware that doctors all over America want dearly monkeywrench this detestable and grotesque government intrusion on American medicine, however they can.

I just spoke to a doctor who says he can’t stop being angry with the many new ways that he will now get screwed, and is starting to worry about his own health. He may be one of those who wants to quit altogether.

America needs to hear, and hear loudly, from its hometown doctors. It would be great to see a country full of Dr Cassells speaking out.

This is just the beginning. A doctor friend of mine plans to drop all insurance patients and only accept cash payments.

Reimbursements from MediCare is just awful, which is why so many doctors refuse to accept MediCare patients. ObamaCare compounds the problem even worse.

Norwegian on April 2, 2010 at 4:06 PM

I’m a physician. I’d love to have the same sign. But I think it’s disrespectful to my black patients…..

So its better to treat someone with kid gloves because they voted according to skin color? Really?

dominigan on April 2, 2010 at 2:20 PM

How funny people think this economy has not trickled down to physician’s offices and that they’d (I’d) be willing to offend maybe one-third to one-half of our patients? I’m in a rather affluent section of Texas and there is not one doctor who has not had a significant loss of patient load to begin with. I don’t practice in Fantasy Land and have close to zero patients requesting their records be transferred to another doctor. I have a black nurse who voted for the guy and share call with a black female colleague who did as well – write them off, too? Tough love, huh.

BTW, every OB in my area is now accepting medicaid, to stay afloat. Every one. (fortunately the reimbursement rates in Texas are quite reasonable and rapidly paid).

A healthcare provider has every right to see whoever he/she wants to see.

That patient is free to see another provider or sue.

The government cannot force a doctor to see a certain patient. This goes the heart of the objection to the insurance mandate part of the healthcare bill. It is unconstitutional for our government to force a citizen to purchase a good or a service from another private citizen or entity. If this part is allowed by the Supreme Court, all is lost, because there are NO LIMITS on the CONSTITUTION. If they can direct transactions, tell you what to buy, where to buy it, then our country has been fundamentally changed…….for the worse.

Mark7788 on April 2, 2010 at 4:27 PM

The good doctor is simply falling back on a old, old saw:

The burned hand teaches best.

CPT. Charles on April 2, 2010 at 4:35 PM

I guess the thing that worries me most about OCare is not the health aspect, but the being forced to buy a product we may not want. If the government is allowed to get away with this, what will they force on us next? At first they’ll be careful(maybe!)but sooner or later they will use it as they did reconciliation with the justification that it’s been done before so we can do it again. This precedent is so very dangerous that it should keep you awake nights. If the Commerce Clause allows this horrendous abuse of personal rights then it is a very sick law and needs immediate repeal. It is a negation of every principle upon which this country was founded…and undermining of this country’s freedoms at foundation levels.

jeanie on April 2, 2010 at 4:38 PM

jeanie on April 2, 2010 at 4:21 PM

What? The majority of my patients on Medicaid are white or hispanic. And I can say without doubt the majority of my black patients voted for Obama. As did every black MD I know. “If you voted for Obama, get lost” would offend people who I wouldn’t think it would offend, and would maybe not offend those who I thought it would, but what’s the point of chancing it to begin with. I’ve had patients ask my front staff “Is he pro-choice or pro-life” and told them they could answer that with the truth and had patients walk out without me seeing them. If that’s their biggest concern they can go. And when they ask me about ObamaCare I don’t hold back.

Like I said, the doctor in question here is already backing down. As painful as it is, he may have done more harm than good.

The original issue was not about color, for this particular Doctor it was about ObamaCare. It matters not the color of those who voted for it or not–it is a matter of this particular Dr.’s preference. Apparently he has the luxury of making his own statement. ‘Twas you who boiled it down to color not us or him. You are free to do what works for you and your preferences for now. the doctor in question here is already backing down

Hardly that. He is simply noting, as he has all along, that he would not actually refuse care to anyone if they came in, as that would be unethical. But they will sure as hell know how HE feels about it. That is his right as an American. And if they don’t like it, they can go elsewhere, as is THEIR right. He welcomes that.

Dirty Creature on April 2, 2010 at 5:09 PM

Patients can easily find another doctor. There is no law or rule of ethics that says a doc must take new patients and it’s not the same as being on call to the ER.

And speaking of taking new patients, didn’t obamacare require that docs take a certain amount of medicare patients? Low reimbursement plus there is so much paperwork, it eats into your time to see patients plus you have to hire someone to handle the paperwork in your office plus it takes almost a year to get paid. Such a deal!

Blake on April 2, 2010 at 5:10 PM

He is simply noting, as he has all along, that he would not actually refuse care to anyone if they came in

That is NOT what his sign says. And what doctor is not going to say how they feel about ObamaCare if they are asked what they feel about it.

Marcus on April 2, 2010 at 5:13 PM

For those who think this doctor is backing down, you are mistaken.

He is saying the same thing he has been saying from the start.

He knows it’s unethical to refuse to treat a patient in direct need of his specific services and he is not agreeing to be unethical.

But when people have a choice of doctors, he wants ObamaCare supporters to know that they have already acted in contempt of his profession and his livelihood and he would prefer as a result that they would choose another doctor.

That’s the proper stance for a physician who opposes ObamaCare.

Edouard on April 2, 2010 at 5:14 PM

You will love this news report. They found a person not happy with the sign. The news is a joke and always looking for the angle that suits the left.

I do love the doctor’s response: the law will be more detrimental to health than his sign.

So? As soon as he was asked about it, he confirmed he would continue to uphold his professional ethics. By the same token, though, he will NOT wait for people to ASK what he feels about it. They will know up front.

You’re reaching awfully hard to try to claim it is some kind of backpedaling.

Last fall, I went to an orthopedist. He had articles posted throughout the office with warnings about the danger of Obama’s proposed healthcare plan. I visited with him about the articles, and he was more than willing to explain his position which opposed the bill. He was getting a gut full of the heavy hand of government controls. Unless this travesty is overturned, our healthcare will be set on a course of disaster long before everything is officially enacted.

In Canada, the scripts may be regulated and cheap, but the Pharmacists charge $12 per Rx “dispensing fee” which is NOT covered by insurance. If you have several Rx per month it begins to add up.

My daughter worked as a Pharm Tech during HS and College, and is going to start Pharm school as a Pharm D candidate in the fall. TN Mom, I think it is equally important to make it clear that Ocare does NOT apply to Congress. They made sure to exempt themselves.

They really are building a two-tier system a la USSR.
The current Admin has already worked hard to establish a bonafide Obamenklatura — and this is just but one wee slice.

Platinum healthcare for the Obamenklatura; death panels and “Community Health Centers” for the rest of us

Elite private schools for the O-class (Sidewell Friends, Georgetown Day School), failing public schools for the rest of us

Tactical 870 Remington armed IRS agents enforcing the tax and new healthcare provisions; a slap on the wrist for the Obamenklatura (Timmy Geitner et al)

Czars, czars, czars every where you look, but endlessly extended UI benefits for the proletariat

Goldman and Citi and JP bailed out, oh my, little Joe gets foreclosed on without knowing why

Just keep reminding people that this is just but one small step into a true two tier nation. O-care is a key piece in the control and management of the distressed and dissatisfied masses.

Hunger and famine are also two favorite weapons and tools of control for the klatura …..got EBT Food Stamp card?

The funny thing is that if you tried to do the same thing to lawyers like has been done with Obamacare, Obama and company would be kicking and screaming.

MeAlice on April 2, 2010 at 7:42 PM

I don’t see a problem with it. If a patient walks in and asks for care, he will treat them. If they read the sign and turn away, he hasn’t refused them care. To refuse care to them, they would first have had to ask for it. If that had happened, you better believe we’d have heard about it by now. The news would be screaming about it over any other story.

Another thing coming in 2013…ICD-10. Forcing hospitals and practices to revamp all computers, paying systems, etc at great expense. ALL socialized countries have been on ICD-10 for years. AMERICA is the last one.

A local talk-radio guy had a show requesting doctors to call and every single one hated O-care. He searched for just one doctor who supported it and he could not.

We talk about business owners going Galt. Just imagine doctors doing that. It’s a good thing I’m healthy.

[cough]

AaronGuzman on April 3, 2010 at 1:02 AM

I talked to both of my doctors about Obamacare, if ether one had been in favor I would have bolted for the door.

Slowburn on April 3, 2010 at 1:57 AM

Does the fact that someone posted he changed the sign mean he’s changed the sign? I saw the Cavuto interview. He’s not telling his patients who supported ObamaCare and still support it to find another urologist. Like the sign used to say.

Marcus on April 2, 2010 at 5:43 PM

He was just clarifying his position. He gets at least one clarification. Most politicians get too many to count. I think Biden has already gotten about 5,000 on various issues. Obama doesn’t really need nearly that many as his words all have that expiration date in invisible ink.

MB4 on April 3, 2010 at 2:17 AM

Democrats are right to punish doctors. doctors are racist bigot homophobes and are greedy as well. Democrat policy will make fair the difference between doctor and patient. I love democrats.

daesleeper on April 3, 2010 at 2:21 AM

I think the good doctor is doing his patients a favor by standing up to Obamacare. Do any of you want Democrats in Washington (think Phil Hare, Maxine Waters, Pelosi and Hank Johnson) deciding which medical care is best for you?

TN Mom on April 2, 2010 at 7:17 PM

Damn! I wouldn’t trust any of those maroons to pick out my color of socks.

That local talk-radio guy needs to give equal time to morticians. Almost all of them support O-care.

MB4 on April 3, 2010 at 2:28 AM

I think it is unseemly. There are better ways to protest.

lexhamfox on April 2, 2010 at 5:56 PM

This is precisely what Martin Luther King Jr was told by 8 Birmingham clergymen when MLK wanted to exercise his right to peaceful assembly in that city.

Read his “Letter From Birmingham Jail” for MLK’s great response, based in Christian principles.

When a group or class of people is under direct threat of their lives and their livelihoods, such as physicians in the aftermath of the tragedy of March 21st, I’d say that a little “unseemliness” is readily forgivable.

MB4 on April 3, 2010 at 2:28 AM

As indeed morticians should be. Liberals seem to be absolutely wetting themselves over the prospect of ObamaCare’s creation of inroads to benevolent euthanasia and to government denials of care to the old and infirm. Recall Newsweek’s notorious “The Case for Killing Granny” op-ed by Evan Thomas.

New York Times uber-lib Paul Krugman, of course, eagerly anticipates increased die-offs due to ObamaCare being a great cost saver.

Who doesn’t love Democrats. They know so much better than you do what’s “fair” for you. ///////

If it’s one thing you can count on Democrats for, it’s their slavish love for artificial, purely academic and theoretical “fairness.”

America just suffered one of the most grievous self-inflicted wounds in its history — in the 2700+ pages of “fairness” by the Democrats’ magical decree.

Edouard on April 3, 2010 at 3:02 AM

Only a liberal could believe one has a “right” to another’s labor.

I really am not interested in my doctor’s political opinions, so I disagree that this move makes much sense. I prefer to imagine my doctors are objective and treat everyone the same, regardless of differences of opinions.

I guess the good news is that people now know just what this guy is about.

AnninCA on April 3, 2010 at 7:10 AM

He is stupid. He is opening his self up for some serious malpractice lawsuits. Now the claim can be made that he didn’t treat someone properly because they were a democrat or supported Obamacare because they weren’t on equal level as his other patients or that he was punishing them. He has also created a hostile environment for his current patients that voted for Obama or support Obamacare.

Also the person that said they wouldn’t hire a liberal democrat is also opening themselves up for a suit. How would they know unless they ask questions during the interview that could be perceived as discriminatory, religious based, political, or personal?

Magnus on April 3, 2010 at 9:00 AM

Thank you Dr. Cassel. I’m in need of a good urologist and if I lived within 200 miles of you, you would have my business.

If I supported a direct frontal attack on your livelihood, you probably would, and should, confront me about it. That’s mainly what this is about. It goes beyond politics and is personal and fiscal for this doctor.

How inane. First, he would need to make a mistake that constitutes malpractice. And when that fact can be proven, it doesn’t matter the reason why. The case is over. Period. No reasons need to be given as to why the malpractice occurred. Just that it did.

ButterflyDragon on April 3, 2010 at 2:15 PM

As a proctologist I think I’ll do the following just before I insert the probe:

Say, what do you think of Obamacare?

You love it? Great!

As it does not cover anesthesia I’ll need cash now or I’m going in.
Nurse, get the extension cord please.

So, what’s good for a teacher is not good for a doctor. An argument can be made for the idea that teachers influence our daily lives and the future of our country much more than any doctor ever could.

Indoctrination (whether from your doctor or your teacher) is the same. Period. At least with a doctor at the most you might have to deal with 15 or 30 minutes of rambling every 6 months. Teachers have the ability to do it on a daily basis for hours at a time influencing more than one person at a time for months at a time.

I think the doctor is the lesser of two evils when it comes to politics and professions mixing. By a long shot.

ButterflyDragon on April 3, 2010 at 2:26 PM

Doctors are in the maw of the socialist Democrat beast.
The results are as predictable as the sunrise, with fewer and lower quality docs- and a cadre of docs for whom their field is no longer a labor of love.

Docs didn’t start the war. The Democrats did, with the aid of those citizens who feel perfectly justified in punishing and stealing from those who have worked hard to achieve success- all in the name of social control and some twisted and perverse view of fairness.

They want docs to be indentured servants and slaves?
Sure.
What could possibly go wrong?

Fight socialism with every weapon at your disposal.

Screw the evil left, the libs, the socialists and the Democrats.
Screw them hard.

Well,it looks like everyone’s favorite lunatic Congressman, Alan Grayson, is now going after this doctor.

Guess Grayson noticed he hasn’t seen his own name in the news lately and figured it was time to do something about it.

He does not need to make a mistake. It has to be perceived as a mistake or negligence. It is also standard that un- foreseen complications can arise from any course of treatment or procedure. The perception that ANY negative outcome is a mistake on the drs part is why malpractice suits are out of control. This is ammunition for someone looking for a payday or someone that is looking to punish someone for things not going as well as they had fantasized.

Teachers shouldn’t be doing it either! And because its wrong doesn’t allow for it to be right because someone you like is doing it.
