Exclusive: The new federal menu mandate meets the real world

Yesterday, I spent a little time at a local pizzeria to find out more about the impact of the new federal menu mandate in the real world. Davanni’s has 21 locations throughout the Twin Cities, a smaller, local chain that suddenly must now comply with this federal requirement to publish the caloric content of each of its menu items on all of its printed presentations. However, these restaurants have a problem when they offer their customers a wide range and high number of options — as most pizzerias do. Ken Schelper, a Vice President of Davanni’s, sat down with me yesterday to explain just how costly this new mandate is, and how difficult compliance will be:
This is just a part of the long discussion I had with Ken about the problems faced in this law. We both speculated whether a calorie disclaimer amounted to advertising, and whether restaurants would have to put lawyers on retainers as consumers (and perhaps competitors) drag them into court to substantiate the claims. For that matter, how will restaurants calculate these calorie counts? Can they simply use the numbers from their suppliers to calculate the nutritional data for the end product, or will they have to get lab testing done? As the video notes, every time they have an ingredient change, or even just a supplier, they have to recalculate everything — and then reprint all of their menu boards and literature in every location.
The pressure of this law will eventually force restaurants like Davanni’s to reduce consumer choice as a way of managing the overwhelming burden of maintaining their disclosures. Smaller chains that succeed in satisfying their customers and managing their business used to be rewarded with growth, but this law will put an artificial cap on expansion at 19 locations. That means that fewer people will find jobs, and even in existing stores, money that may have funded more jobs will instead go to reprinting the same menu boards over and over again. And all of this comes because political elites think that people are too stupid to know that a pizza is fattening or how to access information that already exists in much more efficient formats than menu boards.

Here’s a bit of harsh reality:
The Waxmans and Boxers and Pelosis (and Obama) infest public offices and wield power because they were voted in, over and over again, by our friends and neighbors and teachers and business associates who function as enablers. These enablers face little or no direct, personal consequences for their destructive behavior, so they will not change it. Spontaneous enlightenment is not in their future.
And we others, by being “nice” and “understanding” and “tolerant” towards these enablers become ourselves enablers. Until this changes, until we can truly see the enablers for what they are and treat them accordingly, face to face, along the lines of interventionist “tough love,” there will be no lasting movement back toward permanent sanity for this great country.

The National Restaurant Association lobbied for this and won their prize.
This is one of the necessary evils of the free enterprise system. Big companies know that by forcing all restaurant chains to do this, they can put a burden on the smaller chains and hence gain a competitive advantage.
When big business figures out it can use the arm of government to increase profit, they will choose socialism.
What a paradox.

The luxury hospitality industry never recovered from 9/11. In the past two years it’s been further hammered (note The Ritz-Carlton, Las Vegas will be shutting its doors in May ). If a restaurant wants to meet the Mobil Five Star Standards to achieve the highly coveted fifth star, then one of the requirements is to create a new menu daily. This foolish law is hurting everyone.

Sure they call you crazy for saying it, but doesn’t everything they do move us towards everyone eating the same gray caloric-controlled cup of slime (like the matrix)? No vices whatsoever. No booze because it’s bad and costs money in healthcare. No smokes. No sex except if the gov deems you worthy through DNA testing. 1 kid per. No burgers. No shakes. No nothing except gov mandated items and gov controlled labor, economy, etc.
They call you a kook and say it can’t happen but by god, there’s yet another story of a slow march towards exactly that.

OK, I am starting to get confused. They are going to eventually force everyone to eat a non-fat, non-salt, low calorie diet so that we are “healthier”. We’ll be starving skinny sickly little runts, but we’ll be “healthy”. The cost for this diet will be much higher because the food suppliers (restaurants, grocery stores, farmers markets, etc) will have to comply with arcane regulations so we can be “informed”. Then, they are going to ration health care for the supposedly healthier citizens, where we will wait 6 months to get a mammogram or a cat-scan while we are dying from malnutrition or the cancer is spreading. When we get to be 60 or 65, we will just get denied anything medical and told we need to hurry up and die and get out of the way for the next generation of skinny runts.
So, which is it? Do they want us to live or die?
What they really want is 45 years of forced service before offing us at 62 when our usefulness is deemed done. I firmly believe that is what the end goal is by these evil people.

These two laws, the calorie count inclusion and the private room for women employees to express breast milk, is going to affect every chain restaurant in the business. Sure the big ones like Mickey Ds and Pizza Hut, etc. will be able to absorb some of the cost but smaller chains will be hardest hit. And did these idiots in congress even consider that there are drive thrus? And what about the convenient store chains and truck stops?
And why do I get the feeling that there are going to be some high end restaurants leeting employees go to stay under the 50 number so they don’t have to do this? I mean who wants to know what the calorie count of creme brulee or quiche is?

As a foodie who spent 20 years in the restaurant biz, married to a woman who grew up in the biz, and whose family is still in it, this outrageous government stupidity is pissing me off to no end.

If the federal government’s business is “health” and obesity is a problem, they could mandate that businesses allow customers to purchase food items up to a maximum amount of calories (one that the govt determines). Where will they stop? (apologies if this has been said, I haven’t read through the thread).

The Restaurant Association lobbied in favor of this for two reasons:
One they are dominated by huge chains like Yum foods who can absorb the cost and pass it on to the consumers or reduce the number of employees wiht little consequence.
Two: They were trying to avoid a state by state mandate that would require different things, and be more costly. I think it was NY’s effort to pass such a bill that got them scared.

Hmmm.
This will also require extensive training of the cooks involved *and* expensive pre-portioning. Any significant deviation from the ingredients and portions of ingredients used will cause the calorie and nutrition numbers to be off.

You have to look at this from the government’s point of view: If this bill means that 10,000 restaurant workers get fired, but 100 government inspectors get hired, that is a net INCREASE in “jobs saved or created.”

The progressives have always been against the little guy. Imagine if these rules had been in place when Domino’s or Papa Johns had started, they never would have risen to be national competitors with Pizza Hut. And how about Chick Fil A – every kid prefers it to KFC… and it’s a good organization. It’s growth would have been stunted by the federal government.

And here I just use CalorieKing for free to find out the rough lowdown on stuff… and if someone has web access on their mobile phone you could use that to help make your decision. And if you are extremely A-R you would look it up before you went out.
That is if you CARE about what you eat when you go out.
If you can afford it.
If there are any non-national chains left to go to.
Soon we will no longer be able to afford anything but Marxist burgers full of soylent green. They never will tell you the protein source, however… but it is ‘all natural’ of the best sources they can starve. It’ll be served at the ‘Its For Your Own Good’ cafe with the best Postum they can scrape up.

AH! Hamburgers ARE healthy.
Grass fed beef is HEALTHY!
Our hamburger from our critters has virtually NO fat in the pan left when you’re done cooking it.
In fact, in order to stop my hamburgers from sticking to my cast iron skillets, I have to spray them with a little Vegaline.

& I heard a blurb on the news this morning about soda taxes-wherever they’ve been implemented (& I have no idea where this might be), they have noticed the taxes have not lessened the desire for people to purchase soda products.
Kinda like tobacco & alcohol.

In a similar vein, we recently passed a restaraunt smoking ban here in Va.
One rest. in town built a phone booth around a 4-topper and seperately ventilated it. This is their “non-smoking area.”
Others have just said “come get me.”

I would advocate that restaurant owners do a little civil disobedience, by following the state example (gasoline taxes). Imagine a large disclaimer at the bottom of the menu that read…
*** Cost of each pizza includes a $1 surcharge to cover mandated costs imposed on this business by Democratic Congressmen. Vote as you see fit.

Everything ends up being natural bcs the atoms that things are made of are ‘naturally’ occurring.
Strichtnine (sp?) is natural.

Honestly, I think people will just quit eating out & eat at home more, which is not really a bad thing in itself.
But then again, more people will be staying at home more permanently bcs they lost their jobs in the rest. business.
Living in the country, we eat out maybe once every 3-4 months, if that & it’s a treat.
But then again, when I go to the city, I am absolutely amazed at how the restaraunts are seeimingly always full to capacity.
I just can’t believe how much city people eat out.

solution? Register several different corporations with the sate and change Davanni to a dba. Once a legal entity (corporation) hits 19 outlets, then simply begin using a new corporate entity to begin building another 19 locations, and so forth.

I’m not surprised really. A lot of those may be business-related meetings, client appreciation, prospecting, etc., reimbursed by the payer’s employer :-)
Indeed, when you’re surrounded by asphalt and high-rises, there’s a restaurant for every taste: Mexican, Thai, Ethiopian, sushi, whatever. When it’s a short walk away, it’s easy for city-dwellers to not eat at home…in their condo which contains expensive stainless steel appliances and an 8-burner range. ;-)
I work with people who buy lunch EVERY day – they NEVER bring anything from home. That adds up after a while.

I used to eat out ALL the time and I mean ALL the time, but now that I’m married and have a stable day job my wife and I eat out for lunch on the weekends (usually just fast food after church) and we do fast food, Steak ‘N Shake, or Buffalo Wild Wings for dinner on Wednesday nights because my wife teaches 6th grade girls at church and the church is close to my office.
With all of the people that take their kids all over the place, part of the reason is just to save time.

Well, the Senate used to run several restaurants. They lost $18,000,000 in 15 years. After dropping over $2,000,000 in 2008 they voted to privatize them all.
What did they get for their money all those years?

But please, DJ from MA, let’s be careful not give the feds any more ideas about warnings!
By doing so, we could inadvertently be playing right into their mindset!
For example, with the future passage of, say, the “Electronic Media Subsidization and Implementation of Fair Media Publication Standards for Non-MSM Media Outlets Control Act of 2011,” 42 USC §987(a)123(a)1(A)1 et seq., some brandy new federal bureaucrat might start thinking as follows:
