GOP wins parliamentary ruling in Senate reconciliation fight

Is this significant, or just a momentary hiccup on the road to passage for the reconciliation package?  The Senate adjourned earlier than expected this morning after Republicans successfully identified parliamentary overreach in the House sidebar bill that prevented the use of the reconciliation process.  The errors mean that the Senate must change the bill, which then requires another House vote (via CentristNet):

With the Senate working through an all-night session on a package of changes to the Democrats’ sweeping health care legislation, Republicans early Thursday morning identified parliamentary problems with at least two provisions that will require the measure to be sent back to the House for yet another vote, once the Senate adopts it.

Senate Democrats had been hoping to defeat all of the amendments proposed by Republicans and to prevail on parliamentary challenges so that they could approve the measure and send it to President Obama for his signature. But the bill must comply with complex budget reconciliation rules, and Republicans identified some flaws. …

Senator Kent Conrad, Democrat of North Dakota and chairman of the Budget Committee, said that one problem with the bill was the formula for determining the maximum Pell grant awards. The second issue was a technical matter that Mr. Conrad described as mostly insignificant.

Mr. Conrad said a third issue was under review by the Senate parliamentarian.

The risk for Democrats in a parliamentary challenge is that Republicans could knock out key provisions of the legislation, or win a decision that upends the mechanisms Democrats rely on to pay for the measure.

“We see no impact on the score and very insignificant impact on any policy,” Mr. Conrad said, referring to a cost estimate of the legislation. “This is not going to be a problem.”

If that’s all that gets struck from the bill, the only effect will be to lengthen the debate on health care.  Obviously, that’s exactly what the Republicans want.  With 62% of voters wanting the GOP to keep fighting against ObamaCare, their leadership has no reason to let up.

The big surprise here is that House leadership allowed themselves to screw up on minor points.  The process of reconciliation isn’t that arcane, and they certainly had the time to double-check their work.  They’ve been working on this strategy since Scott Brown won his election in mid-January.  To have the bill boomerang back because of Pell grants in a health-care bill is an embarrassment.

However, it doesn’t change much in practical terms.  The original bill has already passed into law, and the reconciliation bill mainly rearranged deck chairs regarding taxes and fee structures.  Even if the “third issue” turns out to be significant to the health-care system itself, the Senate will just strike it, and the House will agree to it just to get the debate out of the way.  The GOP warning that the Senate wouldn’t act on reconciliation has already been shown to be empty, and the amendment blizzard won’t make any difference on the House, which has much more motivation to pass the new version as soon as they get it.   The GOP won a delay in the inevitable of about a week at most.

The house leadership is a group of cocky, narcissist, immature blunderers. It makes perfect sense that they made mistakes and left gaping holes. They wanted to pass something so bad that they had no problem spending billions of American’s tax dollars to bribe people and of course didn’t sweat the legal details. That’s their mindset.

One of the most amusing aspects of the popular rejection of this legislation has been that it truly turns “up to 11″ the through-the-looking-glass element of lefty spinning. I watched a dem strategist last night, with an admirably straight face, argue that the reason people were so dissatisfied with Congress is because it had taken them *too long* to enact reform. As soon as the cameras turned off he must have exploded into fits of laughter. Or tears.

Keeping this debacle in the news is great. Let the sunlight shine on it.

They’d need a 2/3 majority to override Obama’s inevitable veto…

And because of staggered elections, they couldn’t get a 2/3 majority even if they won every sing Senate race in the country in 2010. So yeah, they’re just blowing smoke. Or they’re ignorant of the way our political system works. What else is new?

It can, but the President would also need to sign it. Repeal will require either a veto-proof majority or a President to sign it. It’s hard to conceive of Obama being chastened enough to sign any significant repeal, but it’s not as hard to imagine that if the GOP gets close to a veto-proof majority that they could repeal some of the more scandalous parts and pick off some of the 24 or so D Senators who will be up in 2012. If 2010 is awful for D’s then some of them could decide they want to brush up on their centrist credentials before 2012. But I wouldn’t hold my breath.

It matters because it shows that the Dems aren’t very good at governing. It makes folks wonder if the bill/law will can possibly work as advertised when it is so poorly crafted that it can’t even withstand parliamentary scrutiny.

Essentially it calls into question the Dems’ competence – since their motives and policy preferences are already well in evidence, it is just another nail in their electoral coffin.

I really wish the Republicans would use this delay to hammer the Democrats over the student-loan takeover. I’m fairly confident that about 90% of America’s families with children have no idea this is happening, and that by next year the only place they will be able to get a college loan for their kids will be the federal government. I would guess that if polling were done on this, there would be upwards of 80% opposed to this.

I already told my husband that we will NOT be applying for a government loan for either of our kids, and if that means they don’t go to college, they don’t. We have one planning to go to college in the fall of 2011, and though we have a small college fund, it won’t pay all of the costs for the private music school he wants to attend.

Newt Gingrich is just about the only commentator I have heard saying anything about this newest socialist power grab.

If this passes, the government will be the sole source of funding for student loans, the source of 90% of all funding for home mortgages, and the major source of funding for auto loans through its ownership of GMAC. If that doesn’t scare the crap out of you, it should!!

Update: A friend of Gladney’s who was apparently there described the incident in the comment section of the Examiner St Louis Buzz blog. According to his report, at least three of the batterers were SEIU reps.

Violence erupted at a townhall meeting hosted by North Carolina congressman David Price, after a protester was punched in the face for voicing his opposition to proposed changes to health care coverage in America.
The assault took place at the end of an opening speech Congressman Price at North Carolina Central University in Durham. Eyewitnesses of the assault say claim the assailant was an African-American woman who openly supported Obama.

I am disabled. I currently have a ruptured spinal wire from a spinal implant and will be having my SEVENTH surgery since 2001 within the next week. I am in such pain it’s difficult to describe, but being there today was important.

That area was for handicapped and elderly constituents of Mr. Schiff’s …) I told her “I need my chair NOW!” as my arm was giving out and I was about to fall. My husband finally screamed “MOVE!” She and her coven screamed, “NO! WE DON’T HAVE TO MOVE ANYWHERE!” I had no choice but to shove her aside with my walker as I was about to fall and SHE STOMPED MY FOOT! I collapsed in the chair and screamed in pain. She and her friends started screaming “She’s LYING! SHE’S LYING! SHE ASSAULTED HER!!”

A healthcare-reform opponent whose finger was partially bitten off Wednesday during a Thousand Oaks rally said today that doctors could not re-attach the severed section.
William Rice, 65, of Newbury Park also confirmed reports that he threw the first punch in the confrontation that claimed part of his left pinky.

Shuster Gloats: Finger-Bitten ObamaCare Protester Treated By Medicare

Check out the Tweet that MSNBC’s David Shuster posted a little while ago.  He apparently sees some significant irony in the fact that the ObamaCare protester who had a finger bitten off by a supporter of Pres. Obama’s plan was treated by Medicare.

“that’s right, it was medicare… a govt run program that represents all the protestor objects to… it was medicare that treated him.”

According to a police report filed at the scene, supported by several witnesses, the following interaction took place between Miss Rose and the uniformed Planned Parenthood escort:


Rose, from the public sidewalk: “Sir, are you familiar with the abortion procedure?”
Escort approaches Rose rapidly from Planned Parenthood parking lot, says, “You idiot. You’ve caused so much trouble. You piece of crap.”
Rose offers to show Escort a picture: “Can I show you a picture of what it really does to a baby?”
The Escort strikes Miss Rose’s hand, knocking literature and Bible to the ground.
Rose steps further back on sidewalk,
Escort steps towards Rose.
Escort, visibly shaking, says, “It’s a woman’s choice!”
Rose says, “What about the baby’s choice?”
Escort says, “It’s not a baby!” Escort turns around and walks away.

Police were called and interviewed the victim and several witnesses. Rose sustained no injuries from the attack. Charges of assault and battery are pending. There have been no apologies.

I read yesterday that a lower court could put an injunction on the bill while the case against its individual mandate is being heard by an upper court, most likely the supreme court. This would keep any of the benefits or taxes from kicking in until the case is decided.

Also, conventional wisdom keeps saying that Republicans need super majorities in both chambers to repeal ObamaCare. This assumes that no Democrat will change their mind or their vote in the next few years. I don’t see how they completely hold together on this as the details and the consequences of this complete mess of a bill begin to trickle out, and public opinion drops even further than it is now. Besides, neither Pelosi nor Reid will likely be in a position of leadership after November.

And remember, there will be many more chances for their constituents to express themselves between now and 2012 as well. They can’t stay in DC until 2012, or even November! The fact that our side is now fighting a passed bill, instead of the passage of a bill, has added fuel to our fire and will keep our side passionate until this thing is killed once and for all.

And don’t forget, 16 states are already getting ready to drop lawsuits on the Fed as soon as they can read this thing. Talk about the mother of all un-funded mandates.

And because of staggered elections, they couldn’t get a 2/3 majority even if they won every sing Senate race in the country in 2010. So yeah, they’re just blowing smoke. Or they’re ignorant of the way our political system works. What else is new?

Anyway, this strikes me like a football team who’s down by 10 at the end of a hard-fought, epic game. They run out of bounds as time expires. Both teams pour onto the field to shake hands (or not!) with media and other personnel mixed in. The fans head for the exits.

So, the government seizure of 1/6th of the American economy is a game? The overt disregard of the will of the people is a game? The passing of 2,000+ plus page bills without reading them is a game? The ballooning of federal bureaucracy and federal deficit when we’re nearly bankrupt is a game?

Tom, the only ones heading for the exits are the incumbents who failed to uphold the Constitution and fulfill their responsibilities to serve the American people.

This just highlights the main point – AFter months of folks telling their representatives to read the bill- THEY HAD THE NERVE TO PASS THIS POS WITHOUT READING THE ENTIRE BILL!Hopefully there is something in it somewhere given what they’ve found so far that may provide an opportunity to send it back to cloture vote -how sweet it would be to hve to go popcorn shopping!
