Oops: O-Care forgets to cover young adults, children with preexisting conditions

Like the man said, this is a big f***ing deal.

Obama made better coverage for children a centerpiece of his health care remake, but it turns out the letter of the law provided a less-than-complete guarantee that kids with health problems would not be shut out of coverage.

Under the new law, insurance companies still would be able to refuse new coverage to children because of a pre-existing medical problem, said Karen Lightfoot, spokeswoman for the House Energy and Commerce Committee, one of the main congressional panels that wrote the bill Obama signed into law Tuesday.

However, if a child is accepted for coverage, or is already covered, the insurer cannot exclude payment for treating a particular illness, as sometimes happens now.

HHS is promising to issue regulations to insurance companies that would close the access loophole. All fixed? Not quite. Turns out Reid never got around to including The One’s highly touted vow to let young adults stay on their parents’ plans until age 26 in the Senate bill, so for the moment, it’s no-go on that promise too. The House stuck it back in as part of the reconciliation fix so presumably it’ll be law next week, but here’s a thought to chew on while we wait for things to play out:

“That’s how politics works,” said Jennifer Tolbert, a policy analyst at the Henry J. Kaiser Family Foundation, a nonprofit that has been closely tracking the legislation.

Tolbert said the president was talking about the package – the law he signed yesterday and the pending reconciliation legislation in the Senate – because Senate Democrats believe they have the votes to pass the bill.

None of the legislation spells out who is supposed to pay for the coverage.

“I don’t know that employers have thought it through,” said Paul Fronstin, director of health research for the Employee Benefit Research Institute in Washington. “Now they have to think it out.”

As MKH reminds us, Pelosi said we’d have to pass the bill first before we could find out what’s in it, didn’t she? Little did we know. Given that this Congress passed bills in which “placeholder” sections existed that got filled in after the vote (e.g., House Cap-n-Tax bill), I wouldn’t be surprised if a “lo-and-behold” discovery occurs and a miraculous recovery from the “oversight” occurs.

Here is my take… our Founding Fathers gave us a Constitution so we do not have to resort to violence to win this political battle.

However, there are many lunatics out there. People who have the attention of the public on a national level get threats all the time. Reagan actually got shot by a lunatic. This is nothing new. That is why they have the security measures in place, especially at our Capitol. But if an average American gets a death threat the best we can do is get a restraining order.

I agree with Sandee, they will use anything as a distraction so the facts of what they just did to our country are ignored. I do not wish anyone ill will, but we must not lunatics distract us from working hard to undo this mess civilly. Therefore, let the Capitol Security and Secret Service find the lunatics and let us keep hammering home what is really in the bill so we can take back the House in November.

There never has been a guarantee that a pack of crooks would not mangle our laws–just eternal promise that we would be able to elect a contrary majority to reverse the trend. Even if it takes 3 years to assemble this majority we should not reject the project. Tearing this up in 2013 is in all ways the least damaging prospect.

This is just the beta version of ObamaCare. It may crash a few things, stall out an economy or two, force some massive closures and cutbacks, but don’t worry. The cost in human lives will be minimal, and the cost in actual dollars immaterial, since the debt will never be repaid, anyway.

“Free” ongoing fixes for bugs and security breaches should begin shortly.

Soon, this will be running as smoothly as Windows Vista.

Um, what’s the point of Congress and laws and stuff? Obama decides he wants a change, he tells an organization, and the legal rules change without a vote required?

Man, I completely misremember my Constitution class in High School… I thought the process worked somewhat differently. the President can overrule a law whenever he chooses?

That is exactly why they left it out. The basic liberty they killed was that I can’t offer someone an insurance policy based on my own calculations of risk/reward.

The Democrats so effectively demonized the insurance companies that Republicans were afraid to protect this basic fundamental liberty. All of the Republicans pretty much said “well, we agree with destroying the basic liberty of creating an insurance policy based on the policy writer’s judgment of risk/reward, it’s just the other stuff we oppose”. The thing is, that was the lynchpin liberty that once lost opens the door for taking away all liberty. You can no longer on principle defend any salesman offering his product for sale at the price he chooses after you take away that liberty.

This is amusing. My daughter is 25 in four days, and drops off of my employee policy on the day after. We’re all set to buy alternative (catastrophic care) coverage from Kaiser for $125/mo. and then one of my wife’s liberal friends says “Guess what? Your employer needs to take her for another year! You conservative nutjobs are going to benefit from ObamaCare!”

We called my employer’s health insurance administrator to get more information, but she said they have no idea what’s in ObamaCare and are frantically trying to figure it out.

Maybe I’ll call her back and point to this article. And I’m going to really love the conversation with liberal friend tonight.

This is law making, not interpretation of existing law. I doubt it will fly in court, until the laws are fixed by the Democrats to “make it so”.

My splitting headache just got worse. The One and two and three went on and on about this part of the bill and then ‘forgot’ to write it in. If it didn’t make my head throb, I’d be laughing. What competency, what thoroughness, what over whelming effectiveness. So much for Obama bothering to read the bill at any rate. And since the GOP had no input this towering idiocy is squarely on the head of the Dems. What a bunch of ditzes! and they think they can run the country!

Remember those kids in wheel chairs and with chronic conditions etc etc that they trotted before the cameras and told all those sob stories about and they forgot, yes forgot to actually write it into the law. Carries incompetence to a new level and these are actually in charge of the country. Next thing you know they’ll cover their behinds by saying, yes, it was there all the time but we couldn’t find it right away and pre-date it and sneak it in!!! Oh this is just one for the books.
