Open thread: House votes coming; Update: Ryan, Pence videos added; Update: 219-212; Update: GOP’s hail mary fails; Update: Roll added

posted at 8:37 pm on March 21, 2010 by Allahpundit

The big one on the Senate bill should come sometime around nine or thereafter, but since no one knows precisely when, let’s play it safe by opening a thread now. Once the Senate bill passes, they’ll move on to the GOP’s hail mary to try to kill this thing, and if that goes down then the game is over and they’ll mop up with the reconciliation fix. Then, tomorrow, at long long last, the future after health care begins.

I can’t bring myself to be eeyorish on a night when so many others are down, so read Powerline’s list of reasons why all is not lost. There will, of course, be constitutional challenges too; the attorneys general of Florida and South Carolina have the papers ready and are waiting for The One to put pen to paper on it so that the suits can begin. Beyond that, though, never forget: The entitlements crisis is coming regardless of what happens tonight. This will accelerate it — according to former CBO chief Douglas Holtz-Eakin, the real numbers on O-Care mean $562 billion added to the deficit — but no matter what speed it’s traveling at, the train is still racing right at us. Now Congress will be forced to decide whether to derail it or stand there and get hit a little earlier than it might have.

Finally, let me repeat a note of caution from earlier: Frustration over the bill is not an excuse to violate the site’s terms of use. The more time Ed and I need to devote to moderating comments, the less time we have to post updates. Please take a breath and observe the rules before you post. Thanks in advance.

Update: Pro-lifers show Stupak what they think of his executive order:

Susan B. Anthony List Candidate Fund President Marjorie Dannenfelser said the group was revoking its “Defender of Life” award to Stupak, which was to be awarded at its Wednesday night gala.

“We were planning to honor Congressman Stupak for his efforts to keep abortion-funding out of health care reform. We will no longer be doing so,” Dannenfelser said. “Let me be clear: any representative, including Rep. Stupak, who votes for this health care bill can no longer call themselves ‘pro-life.’”

Update (Ed): Let me add another warning to those who want to play semantic games about the ToS and dancing on the edge of violations.  We’re not in this to be lawyers or to get into long, drawn-out e-mail debates.  Don’t play with fire if you don’t want to get burned, and don’t expect a lot of mercy after we’ve spent most of the weekend having to pore over the comment threads.  Once the ban hammer falls from either of us, it’s final.

Update: Rave reviews in the comments for Paul Ryan’s and Mike Pence’s floor speeches. Click the image to watch.

ryan

pence

Update: Looks like the ending will be dramatic after all: LifeNews is hearing that the GOP will indeed force the Dems to choke on Stupak’s abortion language in its motion to recommit.

Update (Ed): Senate bill passes the House in the first vote, 219-212.  Stupak’s surrender made the difference.

Update (AP): I’m honestly surprised they had more than 217. I figured Pelosi would cut everyone else loose.

Update: The hail mary falls incomplete in the end zone as the Stupakers avoided the temptation to vote on the GOP’s motion to recommit on the abortion language. 232 no’s, 199 yeses. Now it’s over, except for the reconciliation mop-up fix.

Update: 220-211 on reconciliation. I wonder which Democrat who voted no on the Senate bill flipped to yes on this one.

Update: The Hill has the 34 Dems who voted no on Reid’s bill. We’ll know more tomorrow about which voted on principle and which were released by Pelosi.

I still would like to know who the 2 Democrats were who waited until the last few seconds to vote NO on the 1st bill were. Does anyone know?

A reason I sometimes listen to David Frum and others of his ilk is because of one of the great principles of warfare: Know thy enemy. That principle is a Bible principle of warfare as well as a principle of warfare of such secular warfare classics as the Art of War

Just the same lies designed to mislead the public on just how horrific socialized medicine is going to be. All passed in the middle of a Sunday night after weeks of cutting deals and, with that, a purely partisan takeover of the system. Democrats must be so proud of their efforts this morning.

Well, fighting the Dems on this is just like fighting radical islam. We had to be right, on guard, and on the top of our game 100% of the time. They were going to keep chipping away at our defences, but instead of IED, suicide bombers and such, they use bribery, extortion and special favors.

I don’t know which I despise more – left-wing liberals or radical islamist.

Obama has said repeatedly all along that he would include good ideas from the Republicans. He said it at the Obama -Republican lovefest that you clowns mistakenly allowed to be broadcast in its entirety.

Fox news would never report that Obama was up for such a thing.

You watch Fox, so you never saw it.

That’s your problem, not anybody else’s.

Boucher and Shuler definitely voted “no” to keep their seats. I’m not sure about the other VA and NC reps.

ladyingray on March 22, 2010 at 7:55 AM

It doesn’t take a genius to figure you could go to their official Congressional web page to see if they had a statement on healthcare on the front, even today. If there’s nothing, chances are they wanted to keep their seats when they saw it passed. In Chet Edwards (D-Texas) defense, at least a month ago he wrote on his opening page he was not going to vote for it.

You must have read the bill to be so sure that I am wrong.

sherry on March 22, 2010 at 7:47 AM

It doesn’t mean anything. The federal government will be dictating the terms of everyone’s insurance contract. They will mandate what coverage is available. It won’t matter where you buy your insurance. It’ll be the same in every state, so saying you can now buy insurance “across state lines” is utterly meaningless.

AZCoyote on March 22, 2010 at 8:06 AM

Food for thought here.

Who is to say that some companies won’t cut their employee’s pay (or cut the staff by th equivalent dollar amount) to make up for that 8% if they end up having to pay a fine for not offering insurance?

Does Congress really think that companies are going to add 8% to their bottom line?

Right now our start up company doesn’t offer insurance, but we plan to eventually. However, if we have to pay the fine first, that will come out of our payroll budget, so no one will get any raises this year. We don’t have enough employees to be subject to this, right now, but who is to say those greedy a’holes in Congress won’t amend this thing and apply it to all employers right away, regardless of how few employees they currently have?

One of my employees voted for obamabot. Her husband is now unemployed and her house value has dropped like a stone. Trust me, I get my digs in about obama, good thing it is someone i have known all my life, otherwise I would have to bite my tongue clean off. By the time the election rolls around, I am making it my mission in life that she opens her eyes. She lives in a blue dog Dem district who voted YES on this thing last night. She needs to wise up and get him voted out.

karenhasfreedom on March 22, 2010 at 8:06 AM

Who do we blame for last night? Well George W. Bush, of course:

The question conservatives should be asking though, is how did we get in this position in the first place? How come, over the course of two elections, Democrats were able to take back the White House and amass substantial majorities in both chambers of Congress, allowing them to enact this sweeping legislation with no Republican votes – and huge defections in their own party? How could a generally right-of-center nation be taken over by liberals from Chicago and San Francisco?
The answer, of course, is that none of this would have been possible without George W. Bush — or more broadly speaking, Bush era Republicanism. While they were in power, Republicans squandered an opportunity to push free market health care solutions. When they did use their power to pass major legislation, it was for policies like the big government Medicare prescription drug plan, which was (until today) the largest expansion of entitlements since the Great Society. They took earmarks and doled out farm and energy subsidies. They earned a reputation for fiscal recklessness and corruption and incompetent governance. President Obama ultimately forced through the health care bill in spite of the political consequences to his party because he’s ultimately a true believing liberal. But it was only because of the failures of Bush-era Republicanism that an ideological liberal with little experience was able to capture the presidency on the abstract notion of change.
Today will be largely remembered as the biggest legislative victory for liberals since Medicare in 1965. But it should also be remembered as the day that Bush cemented his legacy as one of the most destructive presidents for advocates of limited government.

Based on my understanding of the bill, these type of high deductible plans won’t qualify under the new deal. Only the insurance that pays for office visits, etc will qualify. Remember, this is not about health care, but CONTROL. They don’t want you to have control over your money.

If you look at Heath Shuler’s voting record you will see he is a conservative. He could have caved to the party like some of the others but he stayed with his constituents. His vote was him being true to his base. You can bet he is going to keep his seat because he is a conservative. Too many times we see people voting for party rather than principles. Heath Shuler is a real conservative who care about the people who elected him. Don’t confuse him with a party hack. He is far from that. He is a true conservative hero.

From National Association for Uniformed Services on military TRICARE:

Congressman Promises to Protect TRICARE
3/19/10 – House Armed Services Committee Chairman Ike Skelton (D-MO) intends to introduce legislation to explicitly state in law that TRICARE meets all of the health care requirements currently under consideration by Congress for individual health insurance. Although the health care reform legislation passed by the House explicitly exempted TRICARE from being affected, the Senate bill did not include such specific language presuming that existing IRS Code language is sufficient protection for TRICARE, and the parliamentary rules of the reconciliation process underway this weekend did not allow for the inclusion of the House language that specifically protects TRICARE. Skelton said he will also include the language in the FY2011 National Defense Authorization Act.

Glad to know the bill just passed overlooks military TRICARE… but from the GOP via the Corner, we find that survivors and dependents of the uniformed services may not be covered by Obamacare and lose benefits from TRICARE.

Mind you TRICARE has its problems… but that is the coverage we should be affording to those who have served honorably in the military and their families, especially to those family members of deceased members of the military. Yet the Senate bill did not include such protections, and it is unclear if the current regulatory statutes from the Senate Bill will endanger that coverage.

Too bad Congress didn’t bother to take its time and write a good bill. But that’s authoritarianism for you: get it in place as fast as you can so you can tell the little people what to do.

I’m adding a new line to my intake sheet for new patients. It will read, “Do you support your congressman’s stand on health care legislation?” They may wait a loong time to see the Dr. depending on how they answer.

I may go to jail for that or face a big fine. So what? Since it’s federal I’ll probably be in a country club and meet up with all the lefty ex-Congressmen finally having to face up to their crimes. Then, if I can just get staff privileges for the medical ward…

But that’s authoritarianism for you: get it in place as fast as you can so you can tell the little people what to do.

ajacksonian on March 22, 2010 at 8:26 AM

They passed a TRICARE fix prior to this bill passing. It passed 403-0:

FOR IMMEDIATE RELEASE
March 20, 2010
Contact: Jennifer Kohl or
Lara Battles at (202)225-2539
House Approves Legislation to Protect TRICARE
WASHINGTON, D.C. – Today, House Armed Services Committee Chairman Ike Skelton (D-Mo.) delivered the statement below on the House floor urging his colleagues to support his legislation, H.R. 4887, which would explicitly state that TRICARE and nonappropriated fund (NAF) health plans meet all of the health care requirements for individual health insurance currently under consideration by Congress. While beneficiaries of these programs will already meet the minimum requirements for individual health insurance and will not be required to purchase additional coverage, the TRICARE Affirmation Act would provide clarification by changing the tax code to state it in law. The bill was approved by a vote of 403 to 0.

reason minded folks will as soon as it’s possible, cancel their own health insurance, pay the IRS fine if caught, and then if/when sick, join a health plan and pay the premiums while actively seeking care. Once that condition is remedied, immediately drop the insurance again.

Thank you demoncrats, you’re going to put thousands of dollars back in my pocket each year. Starting in 2014 or so, eh?

Hey Drywall, where are you Canadians gonna go now for your life-saving healthcare treatments? Our rationing is gonna be just as bad as yours before long especially when we see doctors getting out because they won’t have the ability to earn a decent income or be required to perform procedures they find morally objectionable.

That would be about the best thing that could happen to the democrats. It would get about 5% of the vote (even most devote Christians wouldn’t vote for it) and take almost all of that 5% from the Republican candidate.

right2bright on March 22, 2010 at 9:13 AM

I don’t think you’ve noticed recently but many of the “Christian” churches are no longer conservative.

Take a look at Pelosi and Stupak’s language and the Catholic church’s schisms in this last debate.

Competition is evil, excellence is not rewarded and hard work is now punished by giving your rewards to the people who didn’t work as hard to make it “fair”. It is RATIONAL in this day and age to be a “sheep”. We need to turn that around.

Skywise on March 22, 2010 at 1:45 AM

That’s because liberalism has taken over much of the “church” and Christendom. But I am not talking about aligning with such people. I am talking about a return to true Christianity like that of the Puritans, who were really the first founders of this nation.

I’m sorry this crap needs to be put to bed.

Keep your religion to your self and start fighting for fiscal sanity, honest to goodness conservative governance informed by the Constitution and the rest will take care of itself.

rickyricardo on March 22, 2010 at 1:59 AM

You’re not being honest. You yourself have moral premises upon which your political philosophy rests, even if you don’t realize it. Do you think the free market is “good” and communism “bad”? I’m sure you do. You’re legislating your own morality but then turn around and tell me I can’t do the same.

So let’s put our presuppositions on the table for all to see. I have a Biblical, Christian worldview. What’s your worldview? What drives your sense of what’s right and wrong in politics, your sense of what the government should be and what it should not be? Put your cards on the table. But don’t sit there self-righteously as though I am the only bringing religion into the conversation.

Your godless, secular government is doomed to fail.

Unless the LORD builds the house,
those who build it labor in vain.
Unless the LORD watches over the city,
the watchman stays awake in vain.
It is in vain that you rise up early
and go late to rest,
eating the bread of anxious toil;
for he gives to his beloved sleep.

The wicked shall return to Sheol,
and all the nations that forget God.

Via Michael Reagan’s radio show just now:

“How’d that reaching across the isle work out for ya last night Big Tenters?”

Although all R’s voted no on this bill, the spineless let’s-get-along philosophy of the McCains, Snowes, etc. played a big role in fast-tracking the agenda of the DemoSociacrats.

No more big tents!

noworldcitizen on March 22, 2010 at 9:25 AM

Thank you, PatriotVet!

Has that passed the Senate, as well?

And my criticism still stands: anything that needs to be ‘fixed’ of this nature by a bill rushed through Congress demonstrates that it is poorly thought out legislation. The more ‘fixes’ it needs, the worse it becomes as it creates a more and more complex system with more failure points, not fewer. When a system is so complex that you cannot say, for certain, what any single change will do to it, then it is ripe for failure.

He did it by standing firm on the principles established by our Founders. In his own way he said – your either with us or you are against us – and he won in a landslide!
