Kitchen sink: GOP claims Senate parliamentarian will throw out House reconciliation bill
posted at 5:52 pm on March 21, 2010 by Allahpundit
I won’t pretend to have an opinion on the merits of the argument. Like Ace says, the claim seems to be that you can’t use reconciliation to touch Social Security, and since the Dems are crowing about O-Care raising SS revenues, they’re supposedly pinched by their own admission. Hmmmm:
Senate Republicans say they can get the whole package of reconciliation fixes – the fix-its that make the Senate plan palatable to House Democrats – thrown out with a trump card procedural motion. And they say Democrats are slow-walking a decision from the parliamentarian until the House passes the Senate bill…
This afternoon Senate Republicans say Democrats won’t meet with them and the parliamentarian – a charge Democratic staffers call “absurd”…
For an appetizer, take a look at Senate Budget Committee Ranking Member Judd Gregg’s statement tonight.
“Immediately after receiving the final reconciliation bill language, Senate Republican staff was ready and willing to meet with Senate Democratic staff and the Senate Parliamentarian to discuss the fact that the House reconciliation bill may be brought down by the 310(g) point of order in the Senate. Senate Democrats are mysteriously unavailable until after the House votes on the health care bill tonight. The Senate Democrats appear to be pushing off this meeting so that House Democrats will remain in the dark about what is likely to happen to the reconciliation bill on which many have staked their careers in Congress. House Democrats should be alarmed by this latest development, since the survival of the reconciliation bill is clearly at risk in the Senate.”
The fact that this story has been red-fonted at Drudge for the past several hours has cured the “in the dark” problem, I’d imagine. The point of this move, of course, isn’t actually to derail the reconciliation bill in the Senate, it’s to frighten House Dems into believing that they might end up with Reid’s bill without a fix and therefore they should rethink their vote while they still have time. But look: If this was something other than a hail mary, wouldn’t the GOP have floated it yesterday or the day before, when waverers hadn’t yet tied their own hands by publicly committing to yes? It feels desperate, even if there’s something to it, and no one wants to run away from an enemy who they know is desperate. Which is another way of saying don’t count on any Stupakers getting cold feet over this.
Exit observation: Let the lawsuits begin!

First of all you should critique the content and not the missing keystroke; I know it’s “melodrama.” It means that failure to correct the underlying problems will lead to similar conditions, therefore, this country will not work through “the hand we have just been dealt” . . . ergo, “doomed.”

The House will get screwed by the Senate and Obama.
And they deserve every epithet that will be coming their way from their constituents when they don’t get all of the goodies that they were promised in the reconciliation bill that will NEVER be taken up by the Senate.
Any bets being taken on how many political appointments will be gone with the wind after BamBam is out of office and no longer has any influence? It’s going to be priceless to see their faces as each of them realizes that they have been played for fools.
I hope that they understand that their 30 pieces of silver were always only made out of worthless tin….

I had no intention of correcting keystrokes. I was stating that your first sentence was melodrama. My point is that going down the path of doom is a slippery slope. There are a multitude of issues that should be corrected and may or may not be in this lifetime. So while I’m still here, it does not benefit me in the least to focus on the negative while I could be focused on what is at hand and work to change it as best I can. Also, I refuse to think that the deceit, corruption and arrogance that has permeated this administration will survive in the long run. We are in for a long bumpy ride which will be filled with utter disappointment as well as many bright spots. The public is angry and anger is a motivator. Things will change.

Doom is defined as the loss of individual liberty, forced to exist under the dictates of bureaucrats whose sole interest is more bureaucracy because that guarantees them power and control.
What really makes it bad is these people believe using the environment as a rational for control is the best thing since sliced bread. They won’t need to justify anything under the constitution because it will all be for Gaia.
They don’t really believe all the environmental mumbo jumbo, but under environmentalisn you can justify anything … even murder.

I think a lot of this can and will be turned back. There is more support for the reform of entitlement programs, and the easing regulations and high taxes now than there has been in many years.

When lefties suffer a setback they don’t just throw up their hands and say “We’re doomed.” When lefties suffer a setback they begin planning and working to undo it. It inspires them to even greater acts of moronitude. They see it as a challenge instead of a defeat.
That’s why the country has been going backwards for the past 100 years. The left never, ever, ever gives up. If America is ever going to get back on the right path we’re going to have to adopt the same attitude. Nothing is over until we decide it is! Was it over when the Germans bombed Pearl Harbor? Terrye on March 21, 2010 at 7:02 PM
With all due respect I think you are delusional. Once this bill becomes law it will only be added to. Even if Repubs get super majorities in both houses they will not repeal this bill, all chest thumping aside.
The difference between Repubs and Dems, and Pelosi knows this, the Dems will, by the millions, violently take to the streets to prevent an entitlement being taken away. The current Repub leadership would wilt in one day.
If this bill passes it will only get bigger as most insurance companies go out of business. Pelosi and Waxman have already told you they will be adding the “public option” before November. Afterwards, a few years down the road the entire system will be converted by default to a “single payer” health system akin to Canada’s, the UK, Taiwan and Australia.
patrick neid on March 21, 2010 at 7:04 PM
The State courts in New Jersey have ruled so far that a recall of Federal representatives may proceed. Nine states provide for a recall, and 17 of the 18 Senate seats in those states are currently held by Democrats. As I recall, 4 of those 18 Democratic Senators stand for re-election in 2010, but 12 of those 18 are Democrats whose terms expire in 2012.
Emperor Norton on March 21, 2010 at 7:05 PM
Judicial appointments was a big difference between McCain and Obama. McCain would not have nominated a liberal like Sotomayor.
And defense and foreign policy. McCain would not have sucked up to terrorists, sold out the Poles and Czechs (and the defenses we needed in their countries) and beat up on Israel and Honduras.
Wethal on March 21, 2010 at 7:06 PM
In this case, millions are ready to take to the streets to repeal it. Never before has this happened. This is a different ball game and people are much more aware and involved.
And I don’t exactly know what “entitlement” they would be taking away … the right to buy an expensive policy or face a fine?
The whole thing does nothing but give illegals health care, if they want to riot … that’s fine with me. Be easier to round them up.
darwin on March 21, 2010 at 7:09 PM
This has always been their full intention Patrick. Many of us understood this in 2006 and cringed to think what could possibly happen. Now our worst fears are realized. OUR only hope now is the Supreme Court—followed by a November twice as large as 1994.

The only problem with Nov elections is that we will be at the 50% level who do not pay taxes who may be voting; a good thing is that it will not be a presidential which brings out more voters and coat tails; that is if we even have elections. Remember,,,to quote a Dem “we make the rules up as we go along”. These people would love to have a “chaotic moment” so they could “suspend” elections. I do not trust them.
retiredeagle on March 21, 2010 at 7:17 PM
Health care for folks under a certain threshold would be subsidized=free health care. The Unions get to keep their special packages. We are talking about tens of millions of people.
As for the millions that may or may not take to the streets for repeal they will be peaceful. As such they will continue to be mocked by Pelosi and the Press, having no effect on legislation.
patrick neid on March 21, 2010 at 7:18 PM
IMO, the only chaotic moments would occur in urban Dem strongholds.

I’m not a lawyer, so can someone answer this, if the lawsuits are successful isn’t only the offending portion stricken from the law, ie- the mandate to purchase?
Then this still forces the insurance Co’s to accept the additional burdens without the benefit of added revenues. Thus driving them into bankruptcy and leaving the guv insurer of last resort, or single payer. The stated end game of the Dem’s all along!
As I’ve warned for months, these people are not amqatuer or stupid, but are incredibly devious.

Interesting question. I’m not a lawyer so I can’t answer your question but there would be another severe complication. Initially, increased federal revenues will provide seed money for the insurance program but after a few years it will allegedly be self sustaining through the payment of mandated premiums. if there is no mandated payment option then there is no revenue stream to support the program and therefore it could not be funded. It appears to me that without mandated payments the program could die a natural death.

I’ve read some precedent where only the offending language is stricken from the legislation, yet the case was not nearly as ambivalent as we are facing now. Further, if this portion of the bill is deemed, (god, now I suddenly love that word), illegal, it could destoy the funding mechanism. Like the Dems did to the Viet Nam war, no funding, no war.

News flash: Why do Democrats hate retirees and people who rent?
Nearly a 4% tax (3.9%) on unearned income, meaning retirees with fixed incomes invested in dividend producing investments will have to send an extra tax to the government. Are you lower income, fixed income or just starting out and rent? Congratulations. Your landlord will be raising your rent by nearly 4% as they pass along the cost of the Democrat renters tax.
Just the beginning.

However, Darwin may be on to something. At Restate I argued for turning up the heat. Obviously threats of being voted out, protests, signs and calling were ignored. How about a little civil unrest and disobedience. The left claims HC is a “civil right” Didn’t they march for civil rights back in the sixties? Except this time we’ll be marching to get ours back. Worked for them. More funny, can you imagine some of those sixties left overs who now run things seeing a civil rights march coming up the street at them? They’d be thinking they were having a LSD flashback.
