Chaos: Pelosi reaches deal with Stupak for Senate abortion vote?

The deal calls for Stupak to have a vote on his amendment either before or after the House votes to confirm the Senate bill on Sunday. Stupak is confident that he has the votes to pass the measure, and is happy to have the vote after the House passes the Senate bill. He believes that by using a “tie bar” measure, his amendment would be “tied” to the health care bill — which would require just 51 votes in the Senate.
Pro-choice members of the House, however, are demanding that the vote on the Concurrent Resolution happen before the House confirms the Senate bill. If in fact it passes, they plan to vote against confirming the Senate bill. They want Rep. Diana Degette to release the names of the 41 cosigners to her letter who pledged to vote against any bill that restricts a woman’s right to choose, and they are angry that the White House has been whipping to push through the Stupak deal…
Alan Grayson, who voted against the Stupak Amendment when it went before the House last October, now has 80 cosponsors for his public option amendment, but has not been granted a floor vote.
There are many more pro-choicers in the House than there are members of Stupak’s bloc, so Pelosi would actually lose votes by agreeing to this unless one of two things is true. (1) It’s all for show. The pro-lifers want nothing more than a vote in the Senate. They expect to lose, but the political cover they’ll gain for making a minor stand on principle is enough to make it worth their while. Except … if it’s true that Stupak only needs 51 votes in the Senate, not 60, then this might actually pass. (If you’re wondering why they need only 51, cross your fingers and read this primer on “enrollment corrections bills.” Essentially, you’re allowed to make minor technical changes to a bill even after it’s been passed. Is this a minor technical change? Why, no. But Stupak will try anything, I guess.) (2) The pro-choicers are planning to cave. They caved in November, didn’t they? Problem is, this is the final bill and they … sure don’t sound like they’re going to cave. Diana DeGette, leader of the pro-choice caucus, claims she has the votes to kill it if Stupak gets his way, and given how close the margin is, it’d only take three or four stalwarts to walk to torpedo the whole thing. Drama!
The good news here is that it surely means Madam Speaker doesn’t have the votes yet, right? Not so fast: A friend of the site e-mailed us about an hour ago to say that he spoke to a Democratic congressman he’s pals with earlier tonight. Quote:
He tells me with certainty that they have plenty of votes and that some yes votes will be allowed to vote no if they choose for their protection. He says that everyone’s internal polling has been much better than expected. He says at this point that last sticking point is whether to give Stupak a separate vote, which Pelosi is considering.
Lest you think this is a sketchy “I’ve got this friend, see…” tip, I assure you that he did give us the name of his congressional source. Assuming our tipster’s right, the only reason I can come up with for why Pelosi wants to bring Stupak’s bloc onboard is that she thinks most of the Stupakers occupy safe-ish seats in November — especially if their abortion language passes — and therefore adding them to the tally would let her cut loose some Blue Dogs who are less safe and really need to vote no. But of course, that only makes sense if all of the pro-choicers stay onboard. And given the anger being expressed, if they’re onboard right now, they’re doing an amazing job of hiding it.
Exit question: Is this all just lefty spin being fed to Firedoglake by peeved pro-choicers? We’ll find out at Stupak’s presser tomorrow. 11 a.m.!

Even if they do, I’m heartened to hear that lawsuits by the dozens are waiting to be filed. I also suspect that the GOP still yet has cards to play to foul up the process of paying for any of it.
I joined Heritage Foundation earlier today and gave quite a bit more than the $25 joiners fee, in fact my wallet is wide open and waiting for Levin or anyone else who needs the cake for a legal fight.

In the end, a Dem is a Dem. They’re too close to the 80 year dream. Hitching our wagon to the Stupak group was our only hope, really, but it was folly to depend on a Dem to actually stand on principle.
Stupak knows what corrupt scum he is surrounded by. He knows any abortion language that is extracted by his amendments will simply find its way back in a later bill.

If Stupak is pro-life why didn’t he vote to defund Planned Parenthood? Stupak’s answer: Planned Parenthood “provides healthcare.” You can read his answer here ninja. As long as PP doesn’t perform abortions in his district he’s okay with them receiving money. Sounds more like someone pretending to be pro-life for his job’s sake, than a principled and consistent pro-life position.

There is only one way to stop this mess… (And I mean after this crapsandwich is signed into law) and that is a plain and simple TAX REVOLT. These people only know one thing, power, and without funds (our money) there is no way for them to get what they want. Unfortunately, state level challenges won’t override a federal mandate. Because they are exploiting the commerce clause (a favorite pasttime of Libs), they claim that this falls under the enumerated powers, hence no 10th Amendment challenge.
The real challenge will be at the level of the Supremes, regarding the constitutionality of the federal mandate. That’s where we need to aim.

The GOP won’t be able to gut a single thing while Obama is in power. And there is no guarantee that we’ll win in 2012, so that means potentially 6 years for people to grow accustomed to it (meaning accustomed to the idea of it, not to the actual effects of the law). When the bill’s full effects actually start to be felt, we may well be at the point where “repealing health care” sounds like some crazy radical proposition.
That’s why it’s so important to strangle this thing in its infancy. Unfortunately, the Dems are much better at that kind of thing.

That’s nonsense and your “friend of the site” loses all credibility with me. I have it on good authority that this mess is polling WORSE, in fact much worse, in Democratic internal polls in the Northeast than in the media-sponsored polls, and I have no reason to doubt the same is the case elsewhere.
The elderly hate this piece of legislation. In fact, they are scared as hell of it, and are making their feelings known. And in turn, that is scaring the hell out of the Democratic party, particularly flippers like Arcuri (who has a very high percentage of elderly in his district), and DeFazio (who is a gerontologist, and as such is very much aware of how the elderly feel about this bill).
In fact the left is so ticked off about this that the Working Family Party in NY State is talking about running Les Roberts (the infamous Lancet Iraq Casualty Study clown)against Arcuri in a primary-a suicidal and silly move. And they are not just pretending in order to make it look good, believe me.

It upset me so much thinking internal polls were better than expected. I am relieved to hear of your internal poll information. I do think whatever information came from the “friend of the site” was coated in spin but the underlying kernel of truth is likely with Stupak they will have spare votes which would free some more vulnerable from walking the plank.
I personally think it is delusional to think that Coates will let anyone forget Ellsworth was a yes before he was suddenly against it. It is not beyond Dems, however, to think everyone will buy whatever happy horsesh*t they sell though. My guess is that they were still short votes and had to deal with Stupak anyway so why not try to get them all hoping they could set a few free.

Assuming that all those Democrats who have come out publicly as “no” votes aren’t lying through their teeth (a big assumption), it looks like the fate of the health care bill, and possibly the rest of the Obama agenda, rests in the hands of the Stupak bloc. If they hold firm and refuse to vote for the bill after the rest of the Dems kill their abortion provision, or if they refuse to go along with a promise from Reid to push through that provision at somepoint in the future, then I think it dies. If Pelosi already had the votes she would have (a) already called a vote and (b) continued to ignore the Stupak bloc like she has for the past several weeks. This whole thing stinks of desperation. She does not seem to be negotiating from a position of strength. There is no other reason why she would go courting after Stupak. This move totally enrages the rabidly pro-abortion part of the caucus, seriously endangering final passage. I doubt she is trying to get Stupakers to serve as replacements for red state Dems. She has shown no interest in protecting the seats of vulnerable members before; why would she show any now? How does Pelosi win, assuming that there isn’t a kamikaze squadron of “no” Democrats ready to vote yes and the Stupak bloc doesn’t fold?

There is no way that Stupak will get his bill through both the House and Senate. They already tried. Even if the pass his bill first and it passes and they pass the demon bill the Senate is not going to pass his bill the Senate already voted on it Stupak should know this. If he changes his vote tomorrow he’s going to be another sell out unless the Senate votes on his bill before the house votes on the Senate Bill.
This whole thing sucks. I am so ticked off at this whole mess.

Normally, SCOTUS is not concerned with how this beast passed, only that it did and whether or not it is constitutional. So on this note, questioning the constitutionality would not be easy to do.
However, since king Barry put SCOTUS front and center so he could belittle them for their earlier decision, I have to wonder if trashing BarryCare in front of the country would be moved to the front of the line.

Either you think the bill is bad, or you don’t. Saying that he is OK with its passing w/o his vote is an indication that he is more worried about the optics of the thing than the substance. I am not impressed.

The economy is really bad. We have added to the debt largely by borrowing. Americans haven’tseen there taxes change significantly because of it yet. When the marginal tax rate starts to go towards the 70% Jimmy Carter Era, and people realize what this actually means, there won’t be any squishy Independents. People want hand outs. They just don’t want to pay for them. With the economy as it is there won’t be enough rich people to cover it all. More Americans will need to be taxed. What happens then? President Obama wins re-election and we stay with the status quo. Naw. Whatever you believe, the psyche of Americans is not like Europeans. Never has been.

I am praying, Nancy, for the freedom fighters who will be in Washington, D.C. today. Maybe, just maybe, these patriots will jog the memories of our representatives about which country and which people they are suppose to be representing.

How many does it take for a constitutional amendment?
I don’t know what the amendment would say exactly… but you need two-thirds to pass one.
Something like “The Democrat party is outlawed forever” would be fair I think.

Total BS. There is no way she’d be dealing with Stupak at this late hour and risk ticking off the pro-choice bloc if they had the votes to pass it without him. He may cave and it may pass, but she needs him now as much as she needed him in November.

Last summer-hundreds of tea party protests-they ignored us
Last fall-governors fall New Jersey/Virginia-ignored us
Last winter-senator change Massachusetts-ignored us
This spring-thousands phone calls/emails-ignored us
Today-thousands will rally in DC-they will ignore us
Tomorrow-Heathcare Bill will pass whether you like it or not
This is going to be bad, very bad!!! Prepare yourselves for rough sailing this spring/summer. It’s going to get worse before we can start making real changes in November!

She set off a sh!t storm by the Stupak addition even coming into the news, so she must be desperate.
But if anti abortion language gets tacked onto this thing somehow, it won’t be him who caved, it’ll be her who caved.
She would not have needed to work with him and (probably) lie to him if she was fine with the vote count.
I don’t buy them having more then they need then Pelosi knocked on Stupak’s door to work with him. BS.
I still think it’ll pass, but she’s scraping the bottom of the barrel to get it done.

Democrats claim internal polling is great, sure, just as this bill will reduce the deficit. She doesn’t have the votes.
