Fox News whip count: 212-219; Uh oh: Markey flips from no to yes
posted at 5:25 pm on March 18, 2010 by Allahpundit
I have no idea where they’re getting these numbers — the highest guesstimate I’ve seen for either side is 208 — but we need some good news today. And this almost qualifies as news:
Urgent: Update on House vote tally
Per Pergram, Brandt-Capitol Hill
The new tally is 211 yeas to 220 nays. Rep. Stephen Lynch (D-MA) was a yes on the November bill and now is a no.
However, he has a meeting with the president later this afternoon.
In addition, the tally could switch again. Rep. Luis Gutierrez (D-IL), who was on the record last week as a no, is holding a presser at 1500 et outside the Capitol. We will be there.
Gutierrez, to the great surprise of no one, ended up choking on his threat to vote no over amnesty and confirmed that he’s a yes. So much for La Raza’s saber-rattling this morning. As much as we on the right grumble over the Blue Dogs being paper tigers when it comes time to break from the leadership, it’s an open question to me whether the progressives aren’t even worse. Gutierrez folded, completely predictably, when the White House called his bluff on immigration, and one liberal after another has utterly crumbled on their promise to vote no on a bill that doesn’t have a public option. I wonder if Pelosi is a genius at twisting arms or whether most Democrats are simply too gutless to stand on principle — Bart Stupak being a very glaring exception.
Also to no one’s surprise, retiring Dem Bart Gordon has decided to vote yes. Any reason for optimism amidst this sudden support of momentum? Why, indeed. Behold:
President Barack Obama on Wednesday asked Rep. Anh “Joseph” Cao, R-New Orleans, to take a fresh look at the language on abortion in the Senate health care bill to see whether he could, in good conscience, support landmark health care legislation now days from a final vote.
Cao, the only Republican to vote for the health care bill in either the House or Senate, said he would take another look.
“He’s asked if I would restudy the Senate language and that I would approach it with an open mind. And I promised that I would go back and study the Senate language again,” Cao said after meeting with Obama in the Oval Office for about 10 minutes Wednesday.
Yeah, look. If they’re so hard up for votes that they’re begging a Republican to cast the deciding ballot on universal health care, they’re in seriously deep shinola. He voted yes in November because of Stupak’s amendment and because, after all, it wasn’t the final bill. Given the stakes this time and the lack of anti-abortion language, if he caves he’d get the mother of all primaries and then quite possibly have to contend with enraged conservatives donating to his Democratic opponent in the general just to punish him for his betrayal. He might as well switch parties, especially considering how blue his district is. Exit question: Is Cao really a softer target for The One than Altmire or Lynch?
Update: So much for optimism: Betsy Markey, who was a no in November, is a yes now. I said yesterday that the CBO score was likely to start the dominoes falling one way or another, and now maybe it has. Gird your loins.

CBO Gets Minority Quota Mandate
Last Updated: Thu, 03/18/2010 – 2:24pm
The overwhelmed federal agency that provides Congress with crucial economic data on pending legislation appealed for much-needed new staff this week and instead got a crazed minority quota mandate from the Democrat who controls its funding.
Overworked evaluating health care reform plans, the Congressional Budge Office (CBO), which has the task of writing official cost estimates for bills, desperately needs more manpower. Its stressed-out staff is working inhumane 100-hour workweeks and demands are only increasing with President Obama’s packed agenda, according to a Washington D.C. newspaper report. After all, the nonpartisan agency provides figures and estimates required in the Congressional budget process.
During a pitch to a House Appropriations subcommittee this week to add new staff, CBO Director Douglas Elmendorf was ordered to hire more women and minorities by the congresswoman who allocates its funding. Florida Democrat Debbie Wasserman Schultz instructed Elmendorf, who is appointed by the Speaker of the House and the President pro tempore of the Senate, to essentially create a quota system at the CBO.
The CBO director said he’s tried hiring more minorities by recruiting at historically black colleges and universities but claims there aren’t many women and minorities who qualify to work at the agency, which requires candidates to be U.S. citizens due to the delicate nature of the work. Not many U.S.-citizen women or minorities are earning doctoral degrees in economics, which makes the hiring pool small, Elmendorf told Wasserman Schultz.
The notoriously liberal lawmaker from south Florida insisted, telling the CBO director that he’s “got to reach down much further” by taking a “leadership role” in raising awareness of math and economics as careers for women and minorities. She also told Elmendorf that he needs to start a program to get children well before college because by that age women and minorities have already decided against math and economics.

Markey probably just sealed her fate. She lives in a conservative district, and Colorado is trending back to sanity this election cycle. People will be motivated. One interesting thing about Colorado these days is that a lot of outside money is coming into the state to help swing elections. I don’t think that will happen this time. If you’re Blue, you’re through.
ObjectionSustained on March 18, 2010 at 6:15 PM
Let’s not kid ourselves. It’ll pass.
Possibly it may run into trouble in the Senate or in the courts, or in subsequent years when there is a new and probably much more Republican Congress.
But for now, Sunday will be another win in Pelosi’s column. Really, was there ever any doubt?

deidre on March 18, 2010 at 6:18 PM
I think focusing on the Stupak Dozen was a red herring. The real action was with the ultra-liberals who voted against the bill because it wasn’t left-wing enough. They were the ones who could be flipped, and they have been.
And why not? From their point of view, a big step in the direction of single payer is better than no step at all. They can always push the “reforms” even further to the left later.
sauropod on March 18, 2010 at 6:23 PM
Rep. Betsy Markey is a Freshman Congresswoman in a district that had been Republican since 1973.
Rep. Markey had been listed as leaning NO on the health care bill on Hannity.com http://download.premiereradio.net/seanhannity/temp/whip7.jpg
Who is running against Rep. Betsy Markey in Colorado’s 4th District?
If an opposing candidate wants to raise national campaign contributions before the 3/31 FEC reporting deadline, they need to get on the local and national media to apply pressure to Rep. Markey to switch back to voting NO on the health care bill.
In the meantime, flood her office with calls:
Washington: 202-225-4676
Nothern Regional: 970-221-7110
Central Regional: 970-351-6007
Southeast Regional: 719-931-4003
Northeast Regional 970-522-0203
Next we need to find out what Nancy Pelosi promised Rep. Markey to buy her vote.
wren on March 18, 2010 at 6:25 PM
Of course there was ‘any’ doubt. That’s why we’re still dealing with this every day. Zero wanted this whole thing wrapped up last August. Since that didn’t happen and it’s now March of the following year, people had every reason to doubt the outcome of this mess. And, if they push this through using the Slaughter Rule, it still won’t be over, and the outcome will continue to remain in doubt.
joejm65 on March 18, 2010 at 6:33 PM
If they had the votes they would be voting right now. Ergo, they don’t have them yet.
KSgop on March 18, 2010 at 6:38 PM
Geez … this is exactly how they want you to feel. They don’t have the votes just because they act like they do.
Everyting they’ve said and done is intentional and designed to make you do exactly what you’re doing. They’re nasty creatures.
Don’t give up. Call, protest, whatever
darwin on March 18, 2010 at 6:38 PM
Exactly. They don’t give a crap about posting it for 72 hours. They do that only because they don’t have the votes.
darwin on March 18, 2010 at 6:39 PM
The vote today was a test vote. If 222 Dems were willing to vote for the Slaughter House Rule, it’s a sign they’ll get to 216 on the final bill.
The key here is to keep the pressure up and try to get traction on as many negative messaging points as possible. The media will black a lot of it out to help ObamaCare but we’ll have to fight through it. We need to redouble our efforts, folks.
Outlander on March 18, 2010 at 6:40 PM
The tea party folks prefer far left dems over moderate republicans.
Quit trying to pass the buck because you nutjobs still support that theory. This is what you get. This will pass on Sunday, and be signed into law shortly after, and just like that, “conservatives” turn America into a socialist country.
Incredible.

Fox now has 214 to pass
ladyingray on March 18, 2010 at 6:48 PM
I disagree. Today’s vote was ‘inside baseball’ stuff. It had more to do with the majority party flexing their muscle and preventing the minority party from dissing them with a tactic. If Obama is trying to woo Cao, it means the Dims don’t have the votes. Yet. The Dims may get to 216, but today’s vote won’t have any bearing on whether they get there or not.

Imagine what could have been accomplished if the far right tea party nuts hadn’t been trying to divide the Republican party for the last year. Every Republican around my parts has a primary challenger from a tea party nut. The left is united for this bill, while the right is left trying to fend off challenges from people who don’t even get 10% of the vote. The problem isn’t with the left. It’s with the tea party nutjobs.
I remember back during the Dede/Owens race, the far right encouraged people to support the democrat over Dede because she was a moderate Republican. They forced her out, supported that idiot Hoffman, and split the vote. Hoffman wouldnt have a chance in a regular election year, but he had thousands of dollars thrown to his race from outside of the district. Owens won and gave this bs another vote.
Yeah, keep trying to pass the buck. As far as I’m concerned, the far right is just as bad as anyone on the left.

I’m not so sure it’s gonna pass. I think one reason Barry postponed his trip is that knowing that it’s quite possibly going down, he did not want to face foreign leaders and press with this huge failure at hand. The loss of face would be just too much for the O!.

I am truly confused. I have to admit I don’t understand the Slaughter thing, and I don’t get what they are voting for on Sunday…is this a yea or nay vote on the Senate bill, or is this where the Slaughter thing comes in?
Please explain slowly and use small words. A good link would be much appreciated as well.

Well, I’m certain Markey isn’t going to get re-elected. I finally did get through to her office today and told them it wasn’t wanted. My father in law tried no less than twenty times and couldn’t get through. I guess she’ll just have to hear from us in November.
boomer on March 18, 2010 at 7:55 PM
Defeated is knowing that, if this bill passes, you’re one of the first ones who will literally die as a result of it. Myself, and millions of Americans, will be those on the front line, at the chopping block, watching the medications that we need to survive be trimmed, or, more likely, denied to us; and our only recourse is to filter though a bureaucracy much like the DMV or the IRS to appeal for an exception–one that may end up in our favor months, or even years, too late.
Not an exaggeration. Not melodrama. Absolute fact. That’s why I’m speaking up, here and now. For those of you who think this is just a practice of political curiosity, or amuse yourself by the “you’re not being consistent”, I ask you politely, but firmly: GTFO. You don’t understand what is actually at stake here.
Merely feeling “defeated” is not a luxury we have.

boomer on March 18, 2010 at 8:04 PM
If they can get it, they’ll vote in the Senate bill. If they don’t have the votes, they’ll try to vote on the reconciliation package and “deem” the Senate bill passed.
Now it looks like they’re going to have the 216 votes needed just to pass the thing.
I’m livid. But I have one consolation. When I die of ObamaCare, this can be on my tombstone:

I’ll believe Cao is a no when he actually F’ing says “NAY”. Until then, he could fold at any minute.
If they have anywhere near 214, then they have 216. The problem is some people like Arcuri flip because a harder left member like Gutierrez comes back home. So the voting block shifts back-n-forth between which group will put it over – Blue Dogs or Hard Left. Pelosi and Waxman wanted an all-Progressive front which is why they cut Stupak loose, but they can’t get the normally reliable East Coasters like Lynch to fall in, because
their constituents never really trusted a black marxistof abortion and procedure. At this point, if Obama signs and says “We’re done” then get ready for the Stimulus Dumptruck to start unloading on weak Dems who voted yes, such as the Southern Ohio Blue Dogs. AND THAT IS OUR NEXT FIGHT.
Let Coburn, Levin, Heritage, Newt, etc…go into the legal weeds on this. Our new job is to find the payoffs, bribes and other bullshit – and expose it.
