Holder solves problem of how to interrogate Bin Laden by pretending it doesn’t exist

Not the first time he’s whiffed on an Osama interrogation hypothetical. Graham tossed one at him last November and Holder’s reply was to say that we have enough evidence on Bin Laden already that questioning him wouldn’t be a make-or-break thing. Which is both stupid and revealing insofar as it shows what he thinks the point is of interrogating detainees, but not so stupid that other top Democrats wouldn’t parrot the same line. Five months later, he’s learned enough about this game to simply duck when the pitch is thrown:

Attorney General Eric Holder told a congressional panel Tuesday that the question of reading Osama bin Laden his Miranda rights is absurd – because he won’t be brought in alive.

“Let’s deal with reality,” Holder said. “You’re talking about a hypothetical that will never occur. We will be reading Miranda rights to the corpse of Osama bin Laden. He will never appear in an American courtroom. That’s the reality….He will be killed by us or he will be killed by his own people, so he’s not captured by us. We know that.”

And there you have it. No need to seriously plan for this explosive situation involving the world’s most wanted terrorist since it’s an absolute metaphysical impossibility. Just like a true ticking bomb scenario is an absolute impossibility, just like deriving useful intelligence from enhanced interrogation is an absolute impossibility. In counterterrorism as in health-care policy, there are no truly tough trade-offs to be found if you simply follow the leftist line. ObamaCare will not only accomplish a major policy goal, it’ll actually improve centrist Democrats’ chances in November. Civilian trials and a total ban on coercive interrogation are not only truer to due process, they cost precisely nothing in terms of intelligence lost. No dilemmas. Must be nice.

Actually, here’s the best soundbite from today’s hearing:

Holder also defended the FBI’s handling of Christmas Day bombing suspect Omar Abdulmutallab and said the interrogation that took place before he was read Miranda rights was extensive.

“I’ve heard a lot said that he was only questioned for 50 minutes. That’s a fairly long period of time,” Holder said. “If you look at the report of interview of what was gotten from him in 50 minutes—an hour, there was pretty substantial amount of information gotten from him.”

Makes sense. If we don’t really need to interrogate Bin Laden at all, why would we need more than an hour with some low-level grunt like Abdulmutallab?

Update: Since he’s unwilling to answer the Osama question in a straightforward way, let me pinch hit. If we did capture him and he refused to talk, this is what would happen. With full assurances from the country to which he sent him, of course, that he’d be treated with all appropriate humane protocols. Wink.

Foolish and simplistic. Since one of the more likely scenarios of us actually capturing him would involve someone in his inner circle having an epiffany, crisis of conscience, etc., and deciding to drop the time, it is entirely plausible that said individual is would also be in a position to facilitate us taking him alive. I.e. drugging him or otherwise incapacitating him. $25 million dollars in reward money has made people change religions and get new faces before.

It is not in the wests interest to capture Bin Laden. Right now (if actually still alive) he serves as the main focus of the “problem” so that no one has to stare down the reality of Islam.

During a House appropriations subcommittee hearing, Holder tried to counter Republican arguments that the administration wanted to stage civilian trials that would give alleged Sept. 11 plotters the same constitutional rights afforded to Americans.

“These defendants charged with murder would be treated just like any other murder defendants,” Holder said with evident exasperation. “The question is: Are they being treated as murderers would be treated? The answer to that question is, yes, they have the same rights that a Charles Manson would have.”

While Holder thought the Manson comparison would make Americans feel more comfortable with the idea of civilian trials for terrorism suspects, Rep. John Culberson (R-Texas) disagreed and sensed an opening.

“Osama bin Laden, in your opinion, has the same rights as Charles Manson?” Culberson asked.

“In some ways, I think they’re comparable people,” Holder said.

“That’s incredible,” Culberson replied. “The disconnect between this administration and your mind-set is so completely opposite that of where the vast majority of the American people are,” he said, arguing that disagreement with the Obama administration’s terrorism prosecution policy drove the recent victory of Sen. Scott Brown (R-Mass.).

When anyone can present us with a credible, dated photo or video of the man since then, we’ll talk. The easiest way to do so of course would be for him to hold up a current newspaper front page while making the video.

In his case, being up in the 15,000 foot “hills” (O’bama’s word, not mine) it would take a couple of months to get him a paper, but I would think that had he hoisted a front page from fall 2004 with “Red Sox Win” he would convince one and all that he was still alive.

Fifty minutes to interrogate a foreign national captured in the course of an act of war on behalf of a declared enemy of the United States is simply not enough time to obtain anything like the information we needed to secure the country against incoming additional attacks, especially when the interrogation took place three hours after the plane landed. Three planes hit the World Trade Center and Pentagon in fifty minutes. We’re lucky we didn’t lose several more planes and hundreds more citizens.

If I’m al Queda, I now know that the response time for a hijacking is now no better, if not worse than it was on 9/11. Indeed, I might even pull a false flag operation on us by sending another brilliant underwear bomber our way whose job will be to distract the Miranda crowd now running our security apparatus with false information while I blow a few airplanes out of our airspace.

The Supreme Court has never held that a foreign national captured in the course of an act of war against the United States by a declared enemy of the United States has ANY rights under our Constitution. Ever. This Administration, through this AG, has accorded our enemies rights that do not exist and thus is intentionally hamstringing our intelligence gathering capability.

And don’t get me started on the members of the Gitmo bar now making policy in the DOJ.

So, without reading all the comments above, I will say this. Isn`t this the same thing Obama did when he passed judgement on KSM, that he will be tried, convicted, and executed basically perverting the whole process Obama portends to admire. They are just cutting out the middle men here, not that I mind Osama feeding worms. I do mind the highest levels of government speaking out on these issues in the manner they have so far.

Holder reduces BinLaden to the status of a murderer. The reduction to the absurd ignores the inconvenient facts that BinLaden’s plots involved mass murder in the name of an ideology, an attempt to throw two cities and a nation into chaos, an attack on financial and government nerve centers, and the willful economic destruction of property. The threats to noncombatant citizens by illegal noncombatants is not why Miranda rights and Constitutional protections were put into place.

Sorry. But Bin Laden is not wanted for 9-11, at least by the FBI.

If you look at bin Laden’s FBI Wanted poster, he is NOT wanted for 9-11. When an FBI spokesman was asked about that he said, “There is no direct evidence linking bin Laden to the attacks on 9-11.”

Eric Holder is obviously not very bright. It is entirely possible to take Bin Laden alive. We have a number of non-lethal technologies available that can debilitate combatants to the point of being able to capture them. Our police forces already use a number of them (tear gas, flashbangs, stun guns, sonic weapons, rubber bullets, etc) and better ones are always being developed. This does not even consider the fact that he could be betrayed and turned over to us by his own people.

I do agree with Holder on one count. It is much better for us if we do not capture Bin Laden. Capturing him for trial will only create a worldwide propaganda circus and give him martyrdom. It will cause more problems than it would solve. The best scenario for America is for Bin Laden to suffer the most embarrassing and inglorious death possible at the hands of his own people as they betray him.

Whether OBL is dead or alive, does this newest statement from Holder give anyone else a bit of a chill? IMHO, when you look at the current state of the DOJ and their actions taken as a whole, if I were a soldier or operative, I doubt that I’d have any incentive to bring in a high value target alive much less capture them in the first place.
Has anyone considered whether Holder is bi-polar?
