Dem caucus chairman: The public doesn’t much care what procedure we use to pass this thing

posted at 8:49 pm on March 15, 2010 by Allahpundit

Via the Right Scoop, this is the second time in as many days that I’ve seen a Democrat shrug off the idea of using the Slaughter strategy on grounds of public antipathy. (Axelrod did it yesterday too on MTP.) Normally I’d agree with them — parliamentary rules are baroque and boring — but these aren’t normal circumstances. This is one-sixth of the economy at stake, to pass a piece of legislation the Democrats have been after for decades, with the public already angry about procedural shenanigans involving backroom deals. A former federal appellate judge appointed by Bush took to the Journal’s op-ed page today to declare the Slaughter strategy flatly unconstitutional, which means there’ll almost certainly be a court challenge to try to undo the legislation if they use this procedure to pass the bill. Given the potential downside of all that, I’m frankly amazed that they’re still considering it instead of simply biting the bullet and having an up or down vote on Reid’s bill. In fact, in light of the parliamentarian’s ruling last week, I’m not even sure how they still benefit from the Slaughter strategy at this point. Even if they use it, the only bill Obama can sign is the underlying Senate bill, not the House’s reconciliation fix (which the Senate wouldn’t have passed yet). If something goes wrong in the upper chamber with reconciliation, we’re all stuck with the Reid bill as law. In which case, why doesn’t Pelosi simply avoid the bad optics and potential court problem and just vote yes or no on the Reid bill with a reconciliation fix to follow separately?

Has anyone seen any polling about the Slaughter strategy yet, incidentally? I’m guessing not, as it’s only a week or so old and is hard enough to explain that it doesn’t lend itself easily to questions. But I’d be keen to see how nonchalant the public really is at the thought of health-care reform passing without an actual yes or no vote on the bill in the House.

In which case, why doesn’t Pelosi simply avoid the bad optics and potential court problem and just vote yes or no on the Reid bill with a reconciliation fix to follow separately?

The margin is extremely narrow and they believe that they will be able to peel off a few Democrats by convincing them that their voters will buy the “I didn’t vote for the Senate bill, I voted for the fixes” argument.

Joe Caps on March 15, 2010 at 8:56 PM

Well, if you think the Constitution is a blank page, er “living document”, it follows that you don’t care about legislative procedures either.

To be sure, the Republicans are guilty of much of this too. But not to this degree. Nothing this far reaching.

SteveMG on March 15, 2010 at 8:56 PM

The Slaughter House will go into effect on Wednesday. The likely scenario is that it won’t combine the reconciliation bill and the Senate bill, but will flat out deem the Senate bill as having already passed and send it to the President.

A former federal appellate judge appointed by Bush took to the Journal’s op-ed page today to declare the Slaughter strategy flatly unconstitutional,

Basic common sense, and a passing familiarity with English, is all one needs to understand how illegal and insane this “process” is.

coup noun (TAKE POWER)
/kuː/ n [C]
(also
coup d’état
/ˌkuː.deɪˈtɑː/ (plural coups d’état))
a sudden illegal, often violent, taking of government power, especially by (part of) an army
a military coup

I don’t see what other desdcription there is for a group trying to illegally seize power in government. Everyone knows that this Slaughter Rule is illegal. This is just a matter of plain English and clear Constitutional language. What am I missing, here?

neurosculptor on March 15, 2010 at 9:00 PM

Well he is right.

I don’t care how they pass the bill, I’m apposed to all of them.

clement on March 15, 2010 at 9:00 PM

When they subvert the Constitution, they’re subverting the document that gives them their authority.

If we’re not supposed to care if they respect the Constitution in passing laws then how can they expect us to respect their Constitutional authority to pass laws or the president’s Constitutional authority to enforce them?

But I’d be keen to see how nonchalant the public really is at the thought of health-care reform passing without an actual yes or no vote on the bill in the House.

These guys are whistlin’ past the graveyard. This is the most ANTI Constitutional move I’ve ever seen made. The Constitution is awfully clear on how legislation becomes law, there is really no room for interpretation. Are they continuing to bank on the failure of public schools to properly educate the citizens at-large on Constitutional issues. If so, even the densest of brainstems understands that a bill has to pass the House, futz around futz around, then pass the Senate or vice versa before the big man signs it.

This is a usurpation of power of We the People. The clarion call needs to go out and loudly. You won’t hear it from the MSM, they don’t understand, nor would even say if they did.

At my kid’s soccer games, wherever we go out to eat, getting my oil changed, all people are talking about is how screwed up D.C. is. We’re all so primed out here, and if this Slaughter rule is enacted, this government will have crossed a line that will place this congress firmly against the American people and our Law, and we will not stand for it. Piss off Congress, we’re watching you and we will never forget what you do. Ever.

So, they ignore the will of the people. When it comes down to actually getting members to walk the party line to make BO happy they have to promise them with bribes (our tax dollars). Now, they will try to get it through with a procedure that \”deems\” it passed which will definitely be challenged legally and we know the White House will spend millions more of our tax dollars defending this unpopular legislation? What is happening to our nation?

1) They truly believe they can do anything they want because the folks “don’t understand it”.

2) If this is true, that should be THE reason why they should not go forward with this procedure.

3) They will go forward anyhow.

4) We will then have lost representative government.

You can be CERTAIN that the legal paperwork is being completed, as we speak. The filing will be of the “emergency” nature to get it fast-tracked to the Supreme Court and it wouldn’t surprise me at ALL to learn that the appellate court judge is absolutely correct.

The “Slaughter Rule” defies the entire intent of the framers of the Constitution. And, when all is said and done, Slaughter should be SLAUGHTERED.

macncheez on March 15, 2010 at 8:56 PM

I agree.
This is so much more serious than just the budget or the economy.
Our very lives, how long we may be allowed to live will now be controlled by politicians. What procedures we may be allowed to receive, what surgeries, medicines, care will all now be determined by a few hundred politicians. Whatever party happens to be in power.
This cannot be understated.
Then, it will not even stop there. This will be used as an excuse to invade every other part of our lives. From the products we use to the foods we eat. Everything we touch, do or engage in now may fall under their power if they view it as affecting the cost of health care in America.

JellyToast on March 15, 2010 at 9:20 PM

29Victor on March 15, 2010 at 9:01 PM

That’s the very point of this. What Pelosi doesn’t realize is that once she and her goons in Congress delegitimize the entire legislative process, by “deeming” law to simply “be”, then they have by their own actions severed the Constitutional bonds that tie us, as citizens, to that legislative body. At that point, Congress’ authority is no longer derived by the citizens upon the oath to uphold the Constitution. At that point Congress is illegitimate, it is rogue, and the states MUST push back forcefully in order to protect their citizens and uphold the notion, the very idea, of Law. If Congress utilizes the Slaughter rule, they will have crossed a line that can never be “uncrossed”. The states will need to bring order and Law back to the union, and I will spend the rest of my adult life petitioning the great state of Texas to establish and protect the Rule of Law for its citizens, against all attempts to thwart it.

Seems to me that those who thought up, encouraged and are about to employ the so-called “Slaughter rule” are engaged in a felony, to wit: violating the law of the land and their oaths of office, and abuse of power. That calls for warrants, arrests and trials, not all this namby-pamby political BS that’s going on here and on the pages of NRO.

The time for mindless chatter about the processes and implications of this criminal conspiracy has run out. I’m waiting for someone with some authority — moral leadership, at least — to stand up and call for the dismantling of the current government (NOT the form, just the personnel).

and, re AP’s exit question (“Has anyone seen any polling about the Slaughter strategy yet, incidentally?”) I have to say that’s one of the dumbest things I’ve seen a very intelligent — if sometimes a bit, well, “fuzzy” — person ask. If polls actually meant anything in the case, this farce would have been done with and flushed down the sewer of history last year.

Certain other dictators of the past — whose names would probably get me banned if used here — and their enablers didn’t worry about polls. They faked and outright lied about public opinion. They cared for it as little as Osama Obama does.

They must not be allowed to leave congress and retire with tax payer funded retirement accounts and other perks! Congress has already set the standard by going after CEO’s bonus’s and retroactive tax increases.

We need to be able to go back and strip these people of every penny of tax payer money they made while in office.
Democrats are setting the example that it is ok to change rules, change polices, ignore laws and procedures and shred the constitution.
Then I say, let it be done to them! The standard they are setting now, let it be used on them once they are removed from office! We need to go back and take all of the money they have taken from us! They do not deserve a retirement! They should be made to pay back their salaries! They have not earned it! They have created a financial mess with our nation and do not deserve to leave office with a golden parachute!
It cannot be business as usual when the Republicans take congress in Nov.! Democrats are at war with America! They are abusing their powers! They need to pay the same way they have made other corrupt CEO’s pay!

Aitch748 on March 15, 2010 at 9:54 PM

Ya know, I’m beginning to think I am either a prime candidate for the looney bin, or they are…one or the other.

I’ll start with them: It is insane, (Yes, insane, no euphemisms, just, um, insane!), that they continue to stand up in front of the American people and spout off about how they (Am ‘Peeps) are BEGGING them to get this done.

It is insane, (ditto my above referendum on insanity) that they really think they can say, “We are going to vote on a bill, that hasn’t been voted on, but we will “deem” that it has been voted on, because another governmental body voted on it.”

It is also insane that they don’t think–or more insanely–don’t care that the American people are white-hot furious about this.

This is either the biggest bluff in the world (choreographed by the bluffer-in-chief), or it truly is insanity. I dread it’s the former, but equally pray it’s not the latter. There is no good outcome: NO winnable situation for these clowns, so to what end are they doing this??? There is only one answer. C-O-N-T-R-O-L.

Regarding the bluff, I think it goes something like this:
“Ah, all you have to do. Is, ah, pretend. Ah like everything is hunky-dorry. I mean it. They’re sheeple. Just keep tellin’ em that I’m wearin’ clothes. Just keep tell’en em you know what they want, and you, ah know what’s best for them. Eventually, they’ll buy it, or, my name isn’t Barry Soto—Um Barack Hussein Obama.”

There is strong word out there that the Democrats are going to go down the path of the Slaughter rule to “deem” passage of the bill by Wednesday.

The tea partiers need to get some signs ready to display at the rally tomorrow protesting the Slaughter rule.

My God, is it November yet so that we can vote each and every one of these SOBs out of office?!!!!

Stupak was just on Greta saying he’d be surprised if there are even 200 votes right now.

Now either that’s true and that’s seriously shocking, or he’s out of touch with what’s going on because Pelosi has given up on him e.g. he’s out of the loop.

Will this line be longer then the line at the unemployment office or longer then the line for Government cheese?
There will probably be rehabilitation camps instead.

I can only see one benefit to passage of this health care bill: the drop of impacted colon complaints, due to the constant rectum stretching we’ll all receive courtesy of Washington, DC.

All Congressional members will receive “Assman” vanity plates.

I’m starting to believe Stupak is out of touch, e.g. lost his marbles.

He said he had more people than he realistically does, for one.

So, Jelly, how do you really feel? Don’t hold back now!

I’m kidding…you are eloquent in your anger.

I’m talkin’ myself into the bluff theory though…I certainly never believed any group of people could be more brazenly disingenuous. I was Uber-pizzed about it pretty much all day. But a glass or two of wine, some good pre-St. Paddy’s Day corned beef and cabbabbage (as my boys said when tiny), got me ta’ thinkin.
I’m starting to think this is the “Hail Mary Pass” of all “Hail Mary passes.”
They think if they repeat that the bill will pass enough times, it will: a)Make it so, b)make the American people think it’s so and buy them time to pull something miraculous out of their…orafices.

Don’t stop praying, don’t stop calling, don’t stop fighting…they always howl the loudest before they give up.

By the way,I just finished my first of several paintings I am doing on last year’s 9/12 march on DC. I guess I call this my version of “Obama Inspired Art!”
When I first read some thread here last year on Obama Inspired Art, I knew I had to have my own go at it!
Hope you like it!

About the only way this procedure could be worse is if the House adopted a rule that if a bill is voted DOWN in the House, then the bill is DEEMED to have been approved — a “no-means-yes” rule, in other words.

I’m with JellyToast. I’m about ready to see citizens marching into Congress and conducting mass citizens’ arrests on the whole dirty lot of them. I’m ready to see these swine stripped of all their assets so that we can use them to start paying down the almost unimaginably huge debt that these swindlers have helped pile up.

Larson has been a liar since the day he started running for office. He is a puke and he stains my home state.

The contempt that Democrats hold their constituents in is mind boggling.

I get the nutzi reference, but am compelled to comment that it is a vailed reference to NAZI. The big difference in this “crowd” ahem, that we have representing us in congress and the Nazis?
Sadly, the Nazis didn’t have the American people between themselves and the German population (at least until it was too late).

In contrast, the American people will not let this happen to them! I must believe that! For now, we have the most powerful weapon in the world at our disposal…and it is tool that no other oppressed people in the past have had: our freedom of speech.

(Oh, and that ‘Right to bear arms’ thingy???? It “don’t hurt, neither.”)

Chewy the Lab on March 15, 2010 at 10:23 PM

The Democrats love referring to one of their major gods, FDR. Well, in this case FDR is an appropriate reference “A Day That Will Live In Infamy.”

I went last year and took close to 400 photos with paintings in mind. This was on one of the Grant monuments in front of the capital. I have two other DC 9/12 paintings I am working on now. A few more planned. They are also around the Grant monuments.

I guess we’ll find out in November.

I always like to point out that the NAZIs were National Socialist – and most people can readily figure out who is closet to that moniker.

But the Democrats aren’t just the closet to be National Socialists, they also seem almost insane – doing the same thing over and over again and expecting a different result.
Hence they are ‘Nutzi’
