Senate parliamentarian: House must pass — and Obama must sign — Reid’s bill first

I’ll level with you. I think this is huge, but the procedural chicanery has gotten so convoluted that I can’t be sure anymore. Could mean nothing.

Or, it could be something close to Waterloo.

The Senate Parliamentarian has ruled that President Barack Obama must sign Congress’ original health care reform bill before the Senate can act on a companion reconciliation package, senior GOP sources said Thursday.

The Senate Parliamentarian’s Office was responding to questions posed by the Republican leadership. The answers were provided verbally, sources said.

House Democratic leaders have been searching for a way to ensure that any move they make to approve the Senate-passed $871 billion health care reform bill is followed by Senate action on a reconciliation package of adjustments to the original bill. One idea is to have the House and Senate act on reconciliation prior to House action on the Senate’s original health care bill.

Information Republicans say they have received from the Senate Parliamentarian’s Office eliminates that option.

Remember, Democrats were weighing two strategies. The first, having the House pass Reid’s bill but not send it to Obama for his signature until the Senate passed reconciliation, is eliminated by this, but that’s not a huge deal since it sounds like they were never real keen on it in the first place. But what about the second, the “Slaughter strategy” by which the House would pass the reconciliation fix first and then merge Reid’s bill into it by “deeming” it as having also passed? That would reassure Blue Dogs and the Stupak bloc by making it impossible for the Senate to double-cross them on reconciliation. Reid would be forced to pass the House’s reconciliation fix so that both chambers would finally have an identical fixed “merged” bill, which would then be sent to Obama for his signature. But that strategy’s dead now too (I think): If Obama has to sign something before the Senate can take up reconciliation, the only thing available for him to sign is Reid’s bill. Even if the House tries the Slaughter gambit by passing the reconciliation fix and deeming Reid’s bill passed by implication, Obama can’t sign the fix because the Senate hasn’t passed it yet. He could only sign Reid’s bill, which means Blue Dogs and Stupak would be in precisely the position they are now — having voted yes for a bill they hate, with no assurances at all that the Senate will actually pass a fix in reconciliation.

Time to celebrate? Not yet. Waxman dropped a bombshell of his own a few hours ago when he said they’ve all but given up on the Stupak bloc and will try to get to 216 without them. It’s possible that they could convince enough Blue Dogs to trust the Senate on reconciliation and hold their noses to vote for Reid’s bill, but with the Stupak 12 all (allegedly) flipping to no and another 25 Democrats leaning heavily towards no, they have literally no margin for error. They’re at 216 on the button, with any single member in the caucus capable of killing the bill by flipping. Assuming they can keep the group together, though, that’s one solution to the new parliamentarian headache. Just pass Reid’s bill and hope for the best.

There’s another solution too, of course, although in light of today’s ruling it would require a brazen exercise of ruthless political power. Hmmmmmmmmmm.

When out of power, the Left becomes shrill, almost hysterical. When in power, they’re dangerous.

The Dems now face the worst of both those worlds. That, to me, adds up to desperation.

The Dems are still a full and total threat to our personal liberty, but they’re hanging on to a branch over a precipice (check out a Bugs Bunny cartoon for reference).

I say we keep hammering them on their own stuff, to push their final collapse. But carefully, too, lest they circle their wagons.

Remember–these are the people who, years ago, tried banning Bugs Bunny cartoons because it makes children ‘violent’. If you have nothing better to do than fret over a stinking cartoon, you have no business thinking you can run a great Nation.

I keep seeing people saying that we need to kill the bill. While I agree…of course…I can’t help but think of a scene I saw in Scream 3, which just aired on tv this past week or so.

One set of scenes dealt with what the rules are in the final chapter of a trilogy. See if this rings a bell:

“The killer is going to be superhuman. Stabbing won’t work. Shooting won’t work. In the third one, you have to cryogenically freeze his head, decapitate him, or blow him up.”

When watching this scene, this is what crossed my mind:

After the pain and agony Obama and the Senate have endured over this thing, there is no way they will keep any promises Nancy is making to the Blue Dogs and Stupak bloc. If anything comes to O’s desk, he will sign it, declare Victory and move on to the next battle: Amnesty.

There will be no reconciliation. Nobody in the Senate wants to pull that trigger, knowing it changes the rules and knowing their shaky majority is probably toast come November.
What’s good for the Democrat goose is good for the GOP gander. Just think of all the changes a 51 seat GOP majority could accomplish (that’s what their losing sleep over – not healthcare)

I’m waiting for the “West Wing” trick of pretending to have the democrats leave town on a Friday, all the while secretly gathering somewhere in the Capitol. The hope would be for the Republicans to begin leaving. All this prior to adjourning. Once enough GOP’ers have left to ensure a Dem majority but enough for a quorum, the vote is called.

I think the American public has gone beyond dissatisfaction with the bill and into outright OUTRAGE over the way Democrats have been willing to skirt the rules to pass it.

I really don’t think the bill itself is the big issue any longer – it’s the tactics.

If Waxman and his folks can get 216 votes … it’ll be a miracle … but if they somehow manage it – then the Senate bill will be the FINAL bill. Reconciliation will be a mess – nothing will come of that – even if Joe Biden greases the skids and … I’ll tell you why …

Phone calls to Senators are going to flip from “vote no” to … “how in the hell can you support reconciliation like this?”.

And the Senators are going to be perfectly fine with standing up and saying – “No, I’m not going to have anything to do with this 51 majority reconcilation thing” … and I can even see Senators like Barbara Boxer pulling this stunt – because she’s not going to like the “fixes” the house will propose anyway. It’s an easy out for her and others. They get the bill they wanted to pass, and did pass – without any modification whatsoever – and they also get to look like … “hey see! WE aren’t power-grabbers afterall!”

In short – expect to see the Senate TURN ON reconcilliation the moment the house passes the bill.

This is all pretty confusing. So now senate dems will have to change or ignore the current senate rules to use 50 plus Joe to get health care passed. If that’s the case then all they need to do is forge an agreement that Stupak 12 and 50 senators will agree to. And get ready to take the heat from the republicans. But now there is absolutely no reason for Stupak 12 to pass senate bill.

The whole point of the conference committee is to have “identical bills.” That they are bending over backwards not to have the respective houses vote again says volumes about how honest and trustworthy these creeps are. I think the parliamentarian interprets the Senate rules. In order for the senate to change the current rules, including reconciliation process, the senate would have to vote on it.

I’m still not giving up on my earlier (and unwavering) prediction. They will pass this in the house and it will become law. They’re too close, they’ve waited a century, they will wait no longer.

All this talk about reconciliation is mere puffery, no democrat really cares if the senate version gets changed. The senate version has the minimum required to get by (a total govt takeover of the US healthcare system) and they know it’s just a matter of time before they get back enough power to “fix” whatever they want. The damage will already have been done, the fat lady will already be back off the stage.

So count on just enough democrats falling on their swords to get this crap shoved down our collective throats. Oh, and don’t count on the supreme court to bail us out either. Separation of powers is moot when all 3 branches of govt want totalitarianism.

Thinking back, if Specter hadn’t switched, the Dems would have been forced to come up with a less leftwing bill in the first place, and it would in all likelihood have been passed and signed already and Scott Brown Mr. 41 wouldn’t have had such a terrific campaign issue to get elected on. Ironic.

There will be no reconciliation. Using it has been a ruse to the House all along. Obama will sign the Senate bill and rest on his…laurels. He has no appetite or stamina for any more wrangling about this. Even Grim knows and admits Obama likes the Senate bill. Obama said yesterday he’s “tired of talking about this.”

There will be some straggly attempt to convince the House Dems that reconciliation would be futile, but they will go under that bus!

Rep. Paul Ryan says that Democrats are ready to ram a “shell” health care bill through the Budget Committee, on which he serves as ranking Republican member, to use as a vehicle to impose national health care.

In a phone interview with TAS Thursday afternoon, Ryan said that he expects Democrats to begin the complex process on Monday, under which they would have the Budget Committee approve a phantom bill by midnight, which they will then send over to the Rules Committee. At that point, the Rules Committee will strip out all of the language in the phantom bill, and insert the changes to the Senate bill that Democrats have negotiated.

“They don’t have the votes right now, but they’re creating the vehicle so that they can airdrop in whatever changes they want,” Ryan said.

He said that Republicans are outnumbered 2-to-1 on his committee and don’t have the votes to stop the bill there. He said he expected Democrats to dust off last year’s health care bills from the Education and Labor and Ways and Means Committees, to use as the vehicle for reconciliation changes.

Ryan said that the Senate parliamentarian’s ruling that President Obama must sign a health care bill into law before the Senate can change it through reconciliation largely renders moot the attempt by Rep. Louise Slaughter to shield members from a direct vote on the Senate health care bill. He said the idea would also violate Obama’s call for an up-or-down vote. “That’s not an up-or-down vote, that’s sweeping it under the rug and into law,” Ryan said.

He also warned against focusing too much on the reconciliation process in the Senate. “Reconciliation is a distraction,” he said. “Once the House passes the Senate bill we have the massive new entitlement.”

As far as I understand the shell bill bit, wouldn’t the Senate bill be changed in the House, so the Senate would have to vote on it again by regular procedure, and get past cloture? It doesn’t sound like the House is voting on the unchanged Senate version.

However, taking your comment as fact for the sake of argument, don’t forget that the “cadillac” tax provision is clearly within the reconciliation rules, they would be able to take those high union taxes out the next day if they wanted. I guarantee you they have the 50 votes (plus plugs biden) to do it.

So even if you’re right, it don’t matter. I’m not trying to be argumentative, and I love your commentary, but reality is what it is.

“Here’s what they’ll do: They will take the House health-care bill and mark it up so that it can become a reconciliation vehicle. Republicans will make runs at this via motions to instruct, but since we’re outnumbered, their package will get through the committee. Then they’ll send that shell of a bill to the House Rules Committee. Apparently this new bill is the reconciliation one, and the House Dem leadership still thinks it can pass the unchanged Senate version, and hide all the crooked deals in other bills, so they are not obvious, like the Cornhusker Kickback, etc., were in the text of the Senate bill.

Waxman was bragging that they had the votes for the Senate bill.

Still don’t see how reconciliation gets through the Senate, so the original Senate bil is signed by Obama and becomes law. So the fixes must just be bribes to get them to vote for the Senate version, without Stupak.
