Senate parliamentarian: House must pass — and Obama must sign — Reid’s bill first

I’ll level with you. I think this is huge, but the procedural chicanery has gotten so convoluted that I can’t be sure anymore. Could mean nothing.

Or, it could be something close to Waterloo.

The Senate Parliamentarian has ruled that President Barack Obama must sign Congress’ original health care reform bill before the Senate can act on a companion reconciliation package, senior GOP sources said Thursday.

The Senate Parliamentarian’s Office was responding to questions posed by the Republican leadership. The answers were provided verbally, sources said.

House Democratic leaders have been searching for a way to ensure that any move they make to approve the Senate-passed $871 billion health care reform bill is followed by Senate action on a reconciliation package of adjustments to the original bill. One idea is to have the House and Senate act on reconciliation prior to House action on the Senate’s original health care bill.

Information Republicans say they have received from the Senate Parliamentarian’s Office eliminates that option.

Remember, Democrats were weighing two strategies. The first, having the House pass Reid’s bill but not send it to Obama for his signature until the Senate passed reconciliation, is eliminated by this, but that’s not a huge deal since it sounds like they were never real keen on it in the first place. But what about the second, the “Slaughter strategy” by which the House would pass the reconciliation fix first and then merge Reid’s bill into it by “deeming” it as having also passed? That would reassure Blue Dogs and the Stupak bloc by making it impossible for the Senate to double-cross them on reconciliation. Reid would be forced to pass the House’s reconciliation fix so that both chambers would finally have an identical fixed “merged” bill, which would then be sent to Obama for his signature. But that strategy’s dead now too (I think): If Obama has to sign something before the Senate can take up reconciliation, the only thing available for him to sign is Reid’s bill. Even if the House tries the Slaughter gambit by passing the reconciliation fix and deeming Reid’s bill passed by implication, Obama can’t sign the fix because the Senate hasn’t passed it yet. He could only sign Reid’s bill, which means Blue Dogs and Stupak would be in precisely the position they are now — having voted yes for a bill they hate, with no assurances at all that the Senate will actually pass a fix in reconciliation.

Time to celebrate? Not yet. Waxman dropped a bombshell of his own a few hours ago when he said they’ve all but given up on the Stupak bloc and will try to get to 216 without them. It’s possible that they could convince enough Blue Dogs to trust the Senate on reconciliation and hold their noses to vote for Reid’s bill, but with the Stupak 12 all (allegedly) flipping to no and another 25 Democrats leaning heavily towards no, they have literally no margin for error. They’re at 216 on the button, with any single member in the caucus capable of killing the bill by flipping. Assuming they can keep the group together, though, that’s one solution to the new parliamentarian headache. Just pass Reid’s bill and hope for the best.

Agree with the huge … the trick to assuring the shaky votes in the house of success in the Senate was Pelosi holding onto the House passed Senate Bill until the Senate passed reconciliation.

This is all such a corruption of our very political foundations it is sickening.

And how the hell do you deem something to have passed when you haven’t even had a vote. I know each House of Congress gets to set its own rules, but this just seems to be blatantly unconstitutional. I don’t think the House Dems want to run in the fall having to defend:

1) a stimulus that didn’t stimulate anything but the deficit;

2) job-killing Crap & Trade vote;

3) vote for Senate bill with Cornhusker Kickback, Lousiana Purchase and no Stupak; and

4) “Culture of Corruption” ads with Rangel, Massa and a picture of themselves (just like the ones the Dems ran in 2006 with Abramoff, Foley and any relevant GOPer).

This is analogus to asking someone to marry you. If you don’t absolutely, without a doubt know the answer, you’re better off not asking the question.

This means Nancy is not confident of her “216″ magic number. The risk is huge for her. If all she has is 215, the bill dies. There’s no second vote.

When this vote occurs, I pray that someone monitors for the vote changers just before the gavel falls…ala Brownback on Immigration a few years ago.

Before people dismiss the Slaughter Option as some brand new, and obviously unconstitutional trick, be advised that it’s already been used by this same Congress:

The Rules Committee Can Do Just About Anything‘:

Last year, House Democrats used a “self-executing rule” to push through the controversial Waxman Amendment to the cap-and-trade bill.

This, of course, did not involve the Senate, so that adds a wrinkle, but it’s unclear exactly what that wrinkle means.

In my opinion, it won’t be truely dead until a new congress is sworn in, January, 2011. On that day, all bills passed by the old congress but not sent to the president, die.

It can’t go to the Senate to be passed, because of X and the House can’t pass it because of Y, so now they’re in this weird (and slightly hilarious) Catch 22 situation.
It’s clear that the Dems are not only far outside of Constitutional boundaries but that anything they pass will easily by swatted down by SCOTUS should they try to “pass” it.

Smart of the Republican leadership to wait till practically the last minute before asking the parliamentarian for a ruling. If this ruling had come down a month or two ago, the Democrats would have had that much more time to find some other way around it.

If a member who voted no, requests a motion of reconsideration, the bill can be brought back and voted on again.

Don’t take this the wrong way but,

HAhahahahahahahaha! Isn’t that decided by the “opinion of the Chair” in a voice vote? Of course, one could then move for the yeas and nays on the motion to reconsider, but then that gets pre-empted by the a motion to table (or something).

What about the stuff about immigration in the bill? I read somewhere that some of the Democrats are not going to vote for it unless it allows illegals to buy insurance in the exchanges. Rock and a hard place.

That’s another issue that would have to be fixed by the reconcilliation bill, that can’t be started until after Obama signs the senate bill.

Add the Hispanic Caucus to the list of Democrats who will have to rely on Reid keeping his word.
