Senate parliamentarian: House must pass — and Obama must sign — Reid’s bill first

I’ll level with you. I think this is huge, but the procedural chicanery has gotten so convoluted that I can’t be sure anymore. Could mean nothing.
Or, it could be something close to Waterloo.
The Senate Parliamentarian has ruled that President Barack Obama must sign Congress’ original health care reform bill before the Senate can act on a companion reconciliation package, senior GOP sources said Thursday.
The Senate Parliamentarian’s Office was responding to questions posed by the Republican leadership. The answers were provided verbally, sources said.
House Democratic leaders have been searching for a way to ensure that any move they make to approve the Senate-passed $871 billion health care reform bill is followed by Senate action on a reconciliation package of adjustments to the original bill. One idea is to have the House and Senate act on reconciliation prior to House action on the Senate’s original health care bill.
Information Republicans say they have received from the Senate Parliamentarian’s Office eliminates that option.
Remember, Democrats were weighing two strategies. The first, having the House pass Reid’s bill but not send it to Obama for his signature until the Senate passed reconciliation, is eliminated by this, but that’s not a huge deal since it sounds like they were never real keen on it in the first place. But what about the second, the “Slaughter strategy” by which the House would pass the reconciliation fix first and then merge Reid’s bill into it by “deeming” it as having also passed? That would reassure Blue Dogs and the Stupak bloc by making it impossible for the Senate to double-cross them on reconciliation. Reid would be forced to pass the House’s reconciliation fix so that both chambers would finally have an identical fixed “merged” bill, which would then be sent to Obama for his signature. But that strategy’s dead now too (I think): If Obama has to sign something before the Senate can take up reconciliation, the only thing available for him to sign is Reid’s bill. Even if the House tries the Slaughter gambit by passing the reconciliation fix and deeming Reid’s bill passed by implication, Obama can’t sign the fix because the Senate hasn’t passed it yet. He could only sign Reid’s bill, which means Blue Dogs and Stupak would be in precisely the position they are now — having voted yes for a bill they hate, with no assurances at all that the Senate will actually pass a fix in reconciliation.
Time to celebrate? Not yet. Waxman dropped a bombshell of his own a few hours ago when he said they’ve all but given up on the Stupak bloc and will try to get to 216 without them. It’s possible that they could convince enough Blue Dogs to trust the Senate on reconciliation and hold their noses to vote for Reid’s bill, but with the Stupak 12 all (allegedly) flipping to no and another 25 Democrats leaning heavily towards no, they have literally no margin for error. They’re at 216 on the button, with any single member in the caucus capable of killing the bill by flipping. Assuming they can keep the group together, though, that’s one solution to the new parliamentarian headache. Just pass Reid’s bill and hope for the best.
There’s another solution too, of course, although in light of today’s ruling it would require a brazen exercise of ruthless political power. Hmmmmmmmmmm.

By electing a post-partisan uniter who will look to govern with bipartisan support. Probably should be somebody other than your typical white male with a compelling life story and the ability to blur racial lines. Somebody with solid Midwestern roots might also be helpful…… If only one of the folks running in 2008 had been this kind of a candidate.

They say that if the House doesn’t vote, Pelosi doesn’t have the votes yet. But it’s also true that Pelosi can’t have the House not vote. That way, when this bill goes down in flames, Pelosi can still tell the barking moonbats she tried.

Bills that raise revenues (taxes) have to originate in the House, and then go to the Senate, so the only way (at least as I understand it) the Progressives get this through is for them to rubber stamp the Bill passed in the Senate before Scott Brown’s election, OR submit and pass a new bill that they can get a majority on (216?0 and then send it to the Senate.

I agree she has to keep pushing, at least until Easter break. Just because she doesn’t have the votes now doesn’t mean she won’t keep trying. She is a True Believer, as is Obama.
Reid may be able to read the polls, but he is still going to push forward thinking it might somehow help him in the fall or at least get him a good Dem lobbying job if he keeps trying. If he argued now (privately) that they were wasting their time and should pivot to something else, he would be accused of disloyalty or something.
And the failure of Obamacare will be blamed on the GOP, especially in the Senate, the eeeevil insurance companies, the sheeple who just didn’t understand the complexities….
Anything but it was a crappy bill.

No worries, but I do think it won’t be so easy to change the Union deal even through reconciliation after it cost the Massachusetts election. The House Dems and their union enablers will have to TRUST it will get through and not blow up under intense public scrutiny. That is a huge risk on their part, and if it fails the reconciliation route, it won’t matter if Obamacare passes, they will not get a lot of union support for the election.

These are some of the stupidest and most mindless political moves I can remember seeing or reading of in the history books. I don’t believe this to be the work of political advisors since they would know better if out of self preservation if nothing else. Despite the hints of spring here in PA, I have noticed for the past two weeks a tenseness in my workplace, tempers ready to boil over, people seemingly on the edge constantly. My brother said the same thing tonight, noting that the work loads and business climate have not changed where he works, just people’s reactions to them.
I think my country is just plain Obama weary. People are tired of the hype, the lies, the uncertainty, the tricks and tactics and strategies reported to us on a daily basis for so long now. There is no trust left, no faith that we aren’t being lied to on a daily basis, no belief that any of the politicians in Washington make a move without ulterior motives that we will find out about days, weeks, even months from now. I loath Obama and what he and his minions have done to this country in such a very short time.

You’ll have to be more specific. There’s a tiny car full of clowns involved with healthcare reform. Pelosi, Reid, Nelson, the ghost of Teddy Kennedy, Robert Gibbs, and of course the filthy lying coward in the White House and his wide-bottomed racist spouse to name just the head clowns involved.
If “reform” fails, look for the talking points to be how they drove the issue closer than ever. They will omit the fact that they were attempting to drive off a cliff and it was only by the American public dragging at the rear bumber that these criminals were unable to get Obamacare put into law. I still think they have about a 50% chance of cheating the system and actually driving off that cliff so any celebration is premature.

In part, I think they have kept pushing because they don’t have an alternative exit strategy to the filthy lying coward having a big signing event in the Rose Garden followed by jack-booted stormtroopers raiding Blue Cross and all the other insurance providers.
They’ve invested so much time and attention to this faux crisis they cannot simply walk away without it looking like a political defeat. This was supposed to be an easy win in August followed by an autumn for Cap & Tax and a Spring filled with securing the Hispanic vote by giving away citizenship to millions of illegals. It all fell apart with those town hall meetings and we are watching the death throes of the whole plot coming to an end. If Nancy Pelosi does not have a signed bill in her gnarled claws by the Easter/Passover break, I think the whole thing will finally come crashing down around the filthy lying coward in the White House and his co-conspirators in Congress. But that’s a long time off in political terms.

At this point, the bill is starting to look as though it’s not going to pass. The fact is that Obama made his point: Up or down vote. Well, that doesn’t mean we all have to continue to wait forever, hoping people die or retire before Nancy calls for the vote.
If they have lost, they will need to admit it fairly soon. The issue is now damaging business.

Unlike the abortion provision(s), the union tax hike only requires 50% + 1 to remove in reconciliation. In both houses. And also unlike the abortion provision(s), ALL the democrats will do whatever the unions tell them to. Stupak and his dirty dozen will go along with removing taxes on unions. All the progressive caucus will agree. It would take an afternoon at the most.
Point being, once they pass the senate bill, some of the fixes are easy (union tax break) and some are hard (or impossible, see above abortion references). They all know this, and they will pass it. Now. There is nothing to stop them anymore.

This sort of “misinterpretation” is not much different than Marbury v Madison in 1803. What’s to stop some Congress-critter from filing an original action in the Supreme Court? What would Roberts do?
He couldn’t dump it. So it goes to hearing before the whole court. Is Roberts going to follow precedent and do Marbury II? My guess is he would? What would the Indonesian imbecile do? Obey the Supreme Court he just got done insulting in the SOTU address? Or tell them to enforce their own decision, a phrase used after Marbury came down?
This is a deliberate design intended to create a constitutional crisis. The only thing that is not obvious yet is how it is intended to be solved once it’s created.
