Video: Bachmann calls for probe into WH judicial appointment
posted at 1:40 pm on March 4, 2010 by Ed Morrissey
Via the Right Scoop, based on the rather, er, timely appointment of Scott Matheson to the 10th Circuit Court of Appeals at the same time Barack Obama hosted his brother, Rep. Jim Matheson (D-UT) at the White House to convince him to switch to a yes vote on ObamaCare. Alan Grayson calls this “weapons of mass distraction” and a “tangent” from the real issue, which is health care. But as Michele Bachmann says, corruption is never a “tangent”:
Besides, which candidate for President promised to change the way Washington works? Which candidate promised “Hope and Change,” and a new era of transparency? Which political party promised in 2006 to provide “Open, Honest Government”? Those weren’t “tangents” in 2006 or 2008.
That being said, the likelihood of an independent probe into this is about the same as Barack Obama suddenly announcing that he’s converted to supply-side economics and proposing the elimination of the Department of Education. The Department of Justice under Eric Holder will treat it with the same urgency as voter-intimidation tactics in Philadelphia, and the current Congress will get right on this obvious bribe immediately after looking into Nancy Pelosi’s power grab on Ways and Means.

I don’t think you understood what I was getting at. The POTUS, no matter who it is can hire or fire US Attorneys (not judges) at his pleasure.
Nuts4koi on March 4, 2010 at 2:11 PM
As usual, you are a moron, that makes irrelvant comparisons that have nothing to do w/the subject at hand. As someone pointed out already, the attorneys are political appointments, therefore they may be hired and fired for any political reason the president wants. If he doesn’t like their shoes, he can fire them. Clinton fired most of his when he came into office.
So crr6, have you found Obama’s grades yet? Still waiting for your proof of his superior intellect. Didn’t think so. Next.

Well at least I’ve gotten you to admit you’re a hypocrite.
Anyway, the difference between this and the Bush DOJ scandal is that this guy was going to be appointed anyway. Plus, he’s qualified, and he’s probably a Republican.
crr6 on March 4, 2010 at 2:12 PM
Nah. See, I can accept that these cats are corrupt. It doesn’t bother me none to admit that…what makes me curious is why people are insisting that corruption is an inherently democrat tendency, when the reality is far from that. Its all self serving, self congratulatory willful ignorance.
ernesto on March 4, 2010 at 2:12 PM
True! No one’s disputing that. However, Matheson was up for this appointment. Who else was up for it as well? Why was Matheson chosen? Why at this point in time, when Obama’ was charming his brother for a vote, did suddenly Matheson recieve the appointment? Perhaps not illegal, but questionable…and fair to be scrutinized.
I don’t begrudge you your outrage….but where is yours toward Obama’s decision?

You *did* scream and shout about the illegality of willy doing that for political reasons, didn’t you?

This issue, of Matheson, happened yesterday, when Obama was wining, and dining certain dems, to garner their vote. Again I ask….where is your outrage?
capejasmine on March 4, 2010 at 2:14 PM
U.S. Attorneys are political appointees. Bush needed no defending as all of these individuals served at his pleasure.
Was Bush’s move improper? Ask Bill Clinton, who fired every U.S. Attorney extant when he came to town. That’s why people are calling you ignorant.

daesleeper on March 4, 2010 at 2:18 PM
It’s a testament to your collective idiocy that you guys are still reciting this long ago debunked talking point. Most of you no you’re being disingenuous. But for those who are ignorant rather than dishonest, here’s the difference…
At the beginning of a new presidential administration, it is traditional for all 93 U.S. Attorneys to submit a letter of resignation. When a new President is from a different political party, almost all of the resignations will be eventually accepted.[175] The attorneys are then replaced by new political appointees, typically from the new President’s party.
In contrast to the 2006 dismissals, Presidents rarely dismiss U.S. attorneys they appoint. In recent memory, during the Reagan and Clinton Administrations, Presidents Reagan and Clinton did not seek to remove and replace U.S. Attorneys they had appointed, but instead permitted such U.S. Attorneys to serve indefinitely under the holdover provision. There is no precedent for a President to dismiss several U.S attorneys at one time while in the middle period of the presidential term in office. The few examples of forced dismissals available are based on misconduct, not political considerations.

I love the Liberal troll force here. “It’s not vote buying! It’s just like Bush! Matheson was up for the judgeship! The timing is sheer coincidence! And Matheson is a Republican!”
Except, for the teeny tiny problem that indeed, this same Matheson was the Democratic candidate for governor for the state of Utah not too long ago. Hard to see how that makes him a Republican. And his brother is a Democrat. Of course, I doubt he worships Marx so perhaps both Mathesons would be eliminated (literally!) in our trolls wish view of the world, but rest assured–they are democrats.

JAM on March 4, 2010 at 2:29 PM
Who gives a crap about Bush firing attorneys, or Clinton, or even the Socialist-In-Command buying a vote with a judgeship to a Representatives brother. It’s corrupt Washington politics; all of it.
What is important, whether by ‘fire with fire’ or any other possible tactic, is that this expansion of Federal government is stopped. Is the current administration corrupt? Yes; but the corruption is insignificant compared to the authoritarian ambition.
That anyone could see this expansion of power as a boon -especially given the perfect track record of the Federal government’s inability to administer such a program, competently, or, with integrity- simply because it’s proposed by one’s political ‘side’ is a display of ignorance so profound it beggars belief.

So? They are still political appointees who can be fired at any time for any reason. The fact that it did not happen or did happen previously does not change that inconvenient little fact. So your point is idiotic.
With that said, nobody is going to be able to prove whether Obama nominated this guy b/c of his brother or not. I really don’t see this going anywhere and, aside from pointing out the hypocrasy of the left, not worth much time.

Proof doesn’t really matter this afternoon if you are Jim Matheson. Whether there was a bribe involved or not, Matheson has to run for re-election in November, in a conservative state, in an environment that is really toxic to Democrats. And now he has to defend against accusations of quid pro quo. My guess is that he will vote against Obamacare for his own survival.

heh. Can a president nominate judges or not?
crr6 on March 4, 2010 at 3:09 PM
Again, your “debunking” is that, according to you, Presidents have not in the past fired sitting U.S. Attorneys. And? that does not change the fact that they are politically appointees serving at the pleasure of the president and can be fired at any time for any reason. Precedent means nothing. Yes, the dems were able to make political hay out of it, b/c as always, the media carried their water and never pointed out that the president is fully within his rights to fire the U.S. attorneys for any reason.
If they are fired to interfere with a criminal investigation or prosecution, then congress, or the next U.S. attorney can look into it and get to the bottom of it. And there can likely be a political price to pay. Note, that nothing came from the U.S. attorney firings, aside from allegations that it was “inappropriate”.
With that said, both sides do this type of quid pro quo appointing. Most aren’t so blatant about it. And, as I said earlier, the Media and dems (and you, CRR6) would go nuts if a republican president did this.
With that said, I still doubt this story has much legs. At most it would be a problem for the congressman if he does vote for the bill. But, he is already likely to lose if he votes for the bill, so I don’t know how much he will care.
