Awesome: GOP congressman to delay resignation so he can vote no on ObamaCare; Update: Another Dem flipping to no?

Yesterday they needed 216 to pass it, now they need 217. Like Ace says: Nomentum.
U.S. Rep. Nathan Deal will delay his resignation from Congress by three weeks, citing intense pressure from House Republican leaders to remain and vote against President Barack Obama’s plan to overhaul the nation’s health care system…
News of Deal’s decision was inadvertently broken by U.S. Rep. Phil Gingrey, who congratulated Deal on his decision.
On Monday, before 100 supporters at the Gainesville Civic Center, Deal said he would leave Congress, effective March 8, in order to devote all his time to his campaign for governor.
Obama could in theory push the vote back into April or May to wait Deal out and force him to resign before the bill comes to the floor, but after Gibbs set a deadline of March 18 for passage this morning, he’ll look like an even weaker chump than usual if he does that.
A quick Democratic head count: Shelley Berkley, who voted yes in November, is a likely no this time. Stephanie Herseth Sandlin and Frank Kratovil — who was named in that dopey AP piece a few days ago as a possible flip to yes — voted no last time and say they’re voting that way again. The only way to flip all three? The Senate has to pass Obama’s “fix” to Reid’s Senate bill before the House votes on anything. If they do it the other way, with the House passing Reid’s bill first, there’s a chance that reconciliation could collapse in the Senate, leaving the House stuck with the Reid bill they pretty much all hate (albeit for different reasons).
Geraghty’s been doing yeoman’s work trying to figure out precisely what has to happen for Pelosi to get to 217. According to his latest calculation, every last pro-life Democrat who’s threatening to vote no with Stupak this time would have to flip to yes; if even one of them votes no — which seems exceedingly likely — it’s all over. And that assumes that House progressives will fall in line and stick with their yes votes from November. By no means is that a sure thing; remember, Raul Grijalva says he’s “pretty certain” that several liberals are ready to walk away this time. In fact, Roll Call claims they were pestering The One at last night’s White House health-care huddle about possibly reviving, er, the public option. Good luck with that, champ. The long and short of it is, unless I’ve missed a story somewhere, not a single Democrat who voted no before has committed to flipping to yes this time. The momentum is entirely the other way.
One thing I don’t get: Why can’t the Senate pass Obama’s “fix” to Reid’s bill before the House votes on anything? It would solve all their problems with wavering House Democrats. The argument, as I understand it, is that the fix can only be “reconciled” with existing legislation, which means Obama would have to sign something into law first. But if they’re willing to go this far to pass this travesty, why not go a little further and ignore that detail? If the GOP takes them to court, the Dems can plead separation of powers to try to keep the Supremes from intervening. Why not do it? What else do they have to lose? Our leader told us yesterday that passing this is the right thing to do. That should be enough, no?
Exit quotation from lefty Sherrod Brown, vowing pushback if the GOP tries to obstruct reconciliation: “If they’re going to try to filibuster in the traditional sense or the more modern sense that they do, they’re going to have pain, too.”

Republicans are trying to turn up the heat on House Democrats who may be wavering on health-care legislation, including freshman Rep. Kurt Schrader, D-Ore.
Schrader’s office said Wednesday that the congressman has not yet made any commitments on whether he would vote for the Senate-passed version of health-care reform. “Kurt’s commited to moving forward on health care,” said spokesman James Atkin, but he wants to study the bill first before making a commitment.
Schrader made some noise about voting no in November too before ultimately voting yes, but if the dam starts to burst, expect him to bail early this time.

You can’t reconcile a law that doesn’t exist. According to Redstate (I think), the parlimentarian has made that very clear. You can’t fix something that technically doesn’t exist.

I have to wonder if some House Republicans are doing an end-around Pelosi, making promises to House Democrat swing voters regarding the Senate HC bill. Despite the press, these folks are a chummy group. I wonder if there is a lot of ‘hey, vote ‘no’ of HC and I’ll support your pet projects xyz when they come up for a vote’ going on? Hope so…

If they pass obama care via reconciliation, I’ll have no problem with this. I’ll be pushing to see a couple solid years of the GOP using reconciliation to systematically strip every vestige of liberalism from the federal government; department of education and other departments, social security, welfare, earmarks of every stripe, tax code changes, end gerrymandering, purge the bureaucracy, etc.
Let’s get back to what the fed govt is supposed to be – a thin, lean, efficient, low-taxation, leave-us-alone entity.
And use reconciliation to do every bit of it, over the howls and bitter tears of the Democrats. Just queue up the iPod with sound and video bites of the current crop of Democrats talking about how great reconciliation is and how they’re going to use it over the protestations of everyone else, how it’s been used countless times before, yadda yadda.
You’re going to own it, and eat it, Democrat beeyotches.

For all the talk about the Republicans having used reconciliation more than the Democrats, it is important to remember a few things:
As Erick at Redstate noted, the parliamentarian is apparently holding firm on the rule that reconciliation can only be done to an enacted law.
They would have to have Greasy Joe overrule on this issue, and that might be a bridge too far. Kent Conrad has come out and said the same thing that the parliamentarian has. Conrad is the Dem Chairman of the Budget Committee and he know his rules (he also needs to look squeaky clean for his election in 2012 when the Countrywide “Friends of Angelo” comes up.
The House (and no doubt some Senate) Dems are afraid that they will pass the unchanged Senate bill with no Stupak, but with the Cornhusker Kickback, Cadillac tax and Louisiana Purchase, and Obama will sign it….and lose interest rightthere because he got his win. The GOP (Graham, Gregg) is doing what they can to feed this fear to stop it in the House.

Earmarks aren’t extra money, it’s specifically allocating the money that is already appropriated in that bill. You can either hope to God that your district gets some of that cash, or you can guarantee your district gets some of it by earmarking a portion for a specific program in your district.

The simple answer of why the Senate won’t bring a fix up is that it would not be party to reconciliation as it would be a policy change, not a budget change. As a consequence it would require 60 votes to pass. Reid already knows that won’t happen. Even Byrd would vote for that simply on procedural grounds.

Of course. Stupak is a democrat. We know that democrats are whores and all have a price (see the Louisiana Purchase and the Cornhusker Kickback). Stupak is just waiting for them to meet his.
Still, though, even if they pass this monstrosity, they are going to have to deal with the immediate negative consequences of the taxes pummeling people IMMEDIATELY while any benefit that can be perceived being YEARS away. Plenty of time to repeal it.
In fact, while I want this thing killed dead, and dead NOW, I can make an argument that passing it will almost certainly be worse for the democrat party than NOT passing it.

Gotta give Graham a lot of credit on this one. He was “on fire” last night with Greta Van Susteren, saying that there was a contest for the “most stupid Democrats” between the House and the Senate, and that the Democrats “think the American people are stupid” by trying to transfer the cost of the “doctor fix” to the jobs bill, and have the CBO estimate the cost of a bill with 10 years of taxes for 6 years of benefits.
Obama thinks he hasn’t explained his bill to the American people well enough. We should let Graham ‘splain it clearly, once and for all, and be done with it!

Tuesday evening he came on and said he was feeling sad because they were using the word “checkmate” on Greta’s show. I thought the wording was a little strange because people haven’t felt “sad”–the word is too mild–they’ve been really angry or really upset.
Well, I caught Greta’s rerun later that night, and it was pretty obvious she was just using the word “checkmate” to do a little hype as she interviewed Republicans about health care.

Because the entire Senate reconciliation ploy is what we observers of politics call a “lie.” Once the House passes the Senate’s bill verbatim, which you’ll note is always the first step of all these scenarios, BAM, Obama signs the Senate bill and it’s game over. Why would anyone in the Senate go through the grief of all that reconciliation nonsense once there’s a signable bill sitting on Obama’s desk? Sure, the House Dems will scream about their “betrayal,” but what the hell can they actually do about it?

Obamacare is a federal law compelling insurance purchases without clear constitutional authority. An argument can be made that liberty and property have been seized by way of faulty process. The Supremes could void the law on due process grounds because the legislature departed from its own procedural precedents.

Yep, and that’s why there aren’t enough votes in the House right now to pass the bill. They know they’re going to get screwed by the Senate. This has nothing to do with Republicans. The Senate won’t bloody itself to make the House happy, and the House knows it. That’s why the House wants a reconciled bill passed first, which is impossible.
