Jobs bill could contain Card Check
posted at 2:55 pm on February 8, 2010 by Ed Morrissey
At first, this report from the Las Vegas Sun sounds as though conservatives have mostly won the fight against Big Labor to keep the Obama administration from stripping the secret ballot from organizing elections. They pushed hard on ObamaCare and appear to have lost that battle. No one in Congress has touched the Card Check bill as people grow more angry over employment losses. Unions themselves have slipped in standing with the American electorate to their lowest level of support ever recorded. With their political power waning, conservatives have focused more on the ObamaCare debate and the lack of action by Democrats on the economy.
However, deeper within this report lies a new strategy by the unions to use the latter to get its Card Check legislation out of Congress (emphasis mine):
Still, those moves don’t easily lend themselves to a campaign mailer or political rhetoric. Even key parts of the economic stimulus package, such as tax credits and unemployment assistance, don’t pack the populist punch of health care or labor law reform.
“Saving jobs is invisible,” said Nelson Lichtenstein, a labor historian at the University of California, Santa Barbara. “You need an accomplishment that is clear. No matter what unions try to do, their members and the friends of their members will be demobilized.
“That’s why something like health care is so important. People will say, ‘What have you done for me?’ And the answer is, ‘Nothing or not much.’ ”
On labor law, Bill Samuel, the AFL-CIO’s legislative director, said the union would try to enlist moderate Republicans but acknowledged the difficulty of achieving a bipartisan bill. He said the federation might consider “other tactics,” meaning the card-check legislation or key parts of it could be placed into a larger jobs bill this year.
Perhaps the big surprise here is that the Democrats didn’t think to attach it to Porkulus. They only had 58 Senate votes at the time, as Al Franken didn’t get seated until June, but they perhaps figured they could get enough votes to get it out of the Senate on its own. Despite having 60 votes, though, the Democrats never made the attempt as they wound up tying themselves in knots to get all 60 votes to support ObamaCare.
If Harry Reid introduces Card Check as a rider on another bill, it has to be somewhat germane to the core legislation. That makes the upcoming second stimulus bill — what Democrats insist on calling a “jobs bill” to avoid admitting that Porkulus flopped — the most likely target for such a strategy. Republicans and conservatives need to keep a sharp eye on the bill as it passes through committees in both chambers to ensure that Card Check doesn’t end up in an obscure amendment, especially its waiver of secret balloting and the government arbitration clauses that would wreck American businesses.

KILL THE BILL!!! (again)
abobo on February 8, 2010 at 3:01 PM
That makes no sense. The Dems would be handing the GOP(and a bunch of Blue Dogs) a legit reason to kill Porkulus II. Not to mention they’d be furthering the narrative that they’re in bed with the unions. Not a wise move in an election year.
Doughboy on February 8, 2010 at 3:01 PM
All these leftwing scams are like Dracula; you can’t ever really kill them for good. I just “love” the irony of the Democrats putting in a crippling job killing measure into their “jobs” bill.
jwolf on February 8, 2010 at 3:01 PM
This is why no bill should ever be more than 10 pages. These mega-bills that include everything under the sun have to stop.

Key West Reader on February 8, 2010 at 3:05 PM
Expect Card Check in the Democrat legislation. It’s Obama’s agenda to facilitate Marxism and to placate Unions and enable thuggery.
“Jobs Bill” oxymoron. Been there and done that with FDR who made America’s recession last over a decade with socialist programs like Obama’s that forced most Americans to suffer The Great Depression.

I agree. Dems would be stupid to include it. Instant failure.

They are Socialist/Communists. Because they can…and yes. This is exactly what Obama means, by hope, and change.
capejasmine on February 8, 2010 at 3:06 PM
Republicans must take the attitude that unless they are given time to review the entire bill before a vote, they vote no.
MarkTheGreat on February 8, 2010 at 3:07 PM
Democrats have convinced themselves that the only reason they are trailing right now is because they haven’t given their base a reason to support them.
They honestly believe that if they manage to pass this stuff, the country will start loving them again.
MarkTheGreat on February 8, 2010 at 3:08 PM
We’re going to see some really ugly politics for the next three years, and most likely longer than that. The left are merely annoying when the get what they want. When they don’t get anything, they get ugly.
Skandia Recluse on February 8, 2010 at 3:09 PM
Great idea. America grows ever more distrusting of unions so some genius decides to make it easier for them to corrupt any business they choose; way to win friends and influence people.
Bishop on February 8, 2010 at 3:09 PM
I’m certain some of them have bought into that nonsense. But you can tell others are well aware of what’s coming. Blanche Lincoln being the most recent example.
If they try to push far left legislation like crap-and-betrayed, card check, or amnesty this year, they’ll risk losing 100 seats in the House.
Doughboy on February 8, 2010 at 3:10 PM
They will not succeed in their craven agenda. I think they have something very big planned for us because they apparently do not fear us. Someone said that we’d be collapsed from within.
Can we make it to November?
Key West Reader on February 8, 2010 at 3:11 PM
These stupid tricks are so tiring. You can never trust a Democrat bill because their agenda is so disgusting to the majority of Americans that they have to hide it amongst other desirable items.
They make me sick.
skree on February 8, 2010 at 3:12 PM
Just give them an inch and they will continue to try and cram this crap down our throats. Who really is surprised? I’m kind of surprised they haven’t tried this end run earlier.

tarpon on February 8, 2010 at 3:16 PM
I do like the idea of a 10 page maximum bill. Anything 11 pages or larger gets flushed down the crapper. And adjusting font size and margin spacing doesn’t count.

This congress has got to go!
petunia on February 8, 2010 at 3:17 PM
Wrong. Those two were just pigs at the trough. The GOP is benefitting from Obama’s fecklessness and stupidity, not the death of Democrats.
Extrafishy on February 8, 2010 at 3:18 PM
True, but consider this:
1. The Dems’ leadership in Congress, along with the administration, is very ardently leftwing and probably buys the HuffPo spin that they’re unpopular “because they aren’t left enough.” Supposed centrists like Lincoln are not among this leadership cadre.
2. Even for the supposed moderate Democrats, they had their chances to stand firm against truly radical legislation and hold out for a compromise version. But they didn’t. They either crumbled under pressure (Lincoln) or allowed themselves to be bribed (Ben Nelson, Landrieux). Now it’s in for a penny, in for a pound. They’ve supported the radical leftwing agenda enough to be marred by its unpopularity and it seems unlikely that they could redeem themselves with their voters before November. So I don’t put much faith in the ability of any “moderate” Democrat to rein in the radical leftwingers during this legislative session.
jwolf on February 8, 2010 at 3:19 PM
I pray that we can. Why don’t they fear us? What do they know that we don’t know.
People rule this country not the unions!
petunia on February 8, 2010 at 3:19 PM
So apparently the Democrats are shooting for 20% unemployment.
Because this is a job-killer and a business-killer. Businesses will chuck it all rather than have some Goomba giving them orders.
Sort of like the scene in Goodfellas where the restaurant owner, thinks that having Pauley as a partner would help him. How’d that turn out?
NoDonkey on February 8, 2010 at 3:20 PM
So does Murtha’s district now become winnable for the GOP?

For any weak-kneed Republican that wants to vote to create jobs:
The best way to create jobs is to get the private sector economy moving.
To do that, we need to cut spending, give the markets something that allows them to believe we will someday pay our debts.
The way to do that is to vote against the current ridiculous budget and to kill Son of Porkulus. Killing Card Check would just be a bonus.

Aren’t humans a curious bunch?
What a world.
Dorvillian on February 8, 2010 at 3:50 PM
This is just more Democrat rank ignorance at “work”.
They seem to believe that businesses are impervious to economic incentives.
They campaigned and are governing as the most anti-business/private sector, administration and Congress in American history.
At the same time, they’re pleading with the businessmen they’re kicking in the crouch, to hire more workers.
NoDonkey on February 8, 2010 at 4:00 PM
No, not the “jobs bill” – better not to let the left frame it so advantageously. Stimulus 2 or Porkulus 2 or some such makes more sense politically and has the benefit of being more accurate because what they’re talking about so far certainly isn’t going to create any more jobs than the first one did.
Laura on February 8, 2010 at 4:02 PM
Republicans must take the position that Card Check = Filibuster. No ifs, ands, or buts. Forced unionization = lost jobs, and jobs need to be CREATED.
Steve Z on February 8, 2010 at 4:16 PM

UNREPENTANT CONSERVATIVE CAPITOLIST on February 8, 2010 at 4:37 PM
Of course they do. The new opinion among the Dems and their Media puppets is that they lost in the 1994 midterms because they failed to pass HillaryCare – not because they attempted it, but because they failed to pass it and “let down the American people”. I can’t count the number of times I’ve seen the talking heads repeat that distortion of history.
Spiny Norman on February 8, 2010 at 4:48 PM
If they try to sneak it in, Republicans should use it as a shining example of “The Machine vs. The People”.
This is what voters are SO MAD about. A cunning, pampered, privileged plutocracy using their “isider” advantage to sneak through provision they KNOW the public has shunned. They do it with their pension sweetnerners. They do it with their pork projects. And God only knows what all was in the 2000 page health care bills.
Let us please refuse to use the term “public servant” anymore. They’ve all become “self-servers”, helping themselves to our money while looking down their elitist little noses telling us what’s good for us.
jeanneb on February 8, 2010 at 4:50 PM
There shouldn’t even BE a second porku f’n luss until those morons in DC can prove that the first one has done any good. What do they think, that we have money to burn and can afford to take chances? Oh yea, they couldn’t care less.
“Saved or created 3 million jobs. Er, wait, maybe it was 600,000. Um, I think it was around 1.5 million. Yea, that’s it…” Dumb and dumber. No offense to the dumb.
scalleywag on February 8, 2010 at 4:52 PM
Everybody wants jobs, right? No one would ever think of voting against a stimulus, excuse me, jobs bill, right? What a perfect little place to slip in a little Card Check amendment. WATCH THEM CLOSE FOLKS. Stand firm, even if it means they, Progressives, say that we are standing in the way of jobs.
pjean on February 8, 2010 at 4:53 PM
I think all SPENDING BILLS SHOULD BE SINGLE STAND ALONE BILLS, so these slimeballs can’t sneak in their underhanded bills, and then say the R’s won’t vote for say a Defense bill. I also agree they should be no more than 10 pages.
It is wrong and sneaky, “hate” is a strong word but I’m starting to use it more and more lately with these scumbag DEMS, and there is no moderate Dem. deceit is their middle name.

So now the Dems say the cure is “targeted tax cuts” for small business (never mind the tax increase from letting Bush’s cuts expire!).
Republicans should answer: Dems apparently recognize they got it wrong with their huge stimulus bill last year….and now want to adopt tax cuts. SO CANCEL THE REST OF LAST YEAR’S BILL…use those fund for tax cuts, now that Dems admit it was the wrong approach.
jeanneb on February 8, 2010 at 6:32 PM
If they manage to pass it, there will be noway to get rid of it until Obama leaves office in 3 years. He’ll veto any bill contains such language, and even if every Democrat Senator up for election this year losses, there’s no way the Republicans get 67 seats in the Senate. If they can’t do it in the senate, it doesn’t matter how many seats they have in the house.
MarkTheGreat on February 8, 2010 at 7:25 PM
If the “jobs” bill contains Card Check buried in the dross, then the Republicans need to hammer – and I mean hard - the fact that it’s no longer a Jobs Bill, it’s Stealth Card Check. That’s all there is to it. Like Cap’n Tax, Card Check was so unpopular that the Dems dropped it last summer in favor of something “easy” they could pass, like ObamaCare – we need to remind them exactly why they thought Waterloo was going to be their very own Wounded Knee against the GOP, compared to the Stalingrad that they rightly percieved Card Check to be.
