Did GOP know about EunuchBomber’s Miranda treatment?

posted at 1:18 pm on February 7, 2010 by Ed Morrissey

John Brennan claims that GOP leadership in Congress had been briefed by the Obama administration about the arrest of Umar Farouk Abdulmutallab and the decision to handle his case through the criminal justice system.  The National Security Adviser told Meet the Press that no Republican ever raised any objections to the decision made by Eric Holder during their briefings:

The two Republicans briefed on the matter immediately objected to Brennan’s characterization of the amount of information delivered by the White House on the EunuchBomber’s situation:

But Brennan’s comment provoked a sharp rebuke from two of the Republicans who received the briefings.

“This was like a three or four minute phone call,” Rep. Pete Hoekstra (R-Mich.) told POLITICO on Sunday. Hoekstra, the top Republican on the House Permanent Select Committee on Intelligence, said, “At no point did he ever talk to me about legal strategies.”

“For this guy to get out there and start saying things like this is irresponsible,” Hoekstra said.

Byron York heard from Senator Kit Bond, ranking member of the Senate Intelligence Committee:

Sen. Bond responds, saying Brennan “never told” him of the plan to Mirandize Abdulmutallab. Bond’s entire statement:

["]Brennan never told me any of plans to Mirandize the Christmas Day bomber — if he had I would have told him the administration was making a mistake. The truth is that the administration did not even consult our intelligence chiefs, as DNI Blair testified, so it’s absurd to try to blame Congressional leaders for this dangerous decision that gave terrorists a five week head start to cover their tracks.["]

It seems ridiculous to claim that Bond and Hoekstra got fully briefed on the strategy for handling Abdulmutallab when DNI Dennis Blair, FBI Director Robert Mueller, and others in the counterterrorist chain of command have already testified that they didn’t get briefed on that decision until it was made. If the White House didn’t consult Mueller or Blair, why would they have picked up the phone and called Bond and Hoekstra? Brennan’s claim that a call giving the two the outline of the attack somehow amounts to acquiescence of the point of Mirandizing a terrorist before fully interrogating him is ludicrous, and obviously self-serving. It’s almost as bad as Janet Napolitano’s “the system worked” spin on the Sunday after Christmas.

Most lying administration ever!

RalphyBoy on February 7, 2010 at 1:22 PM

This is a blatant lie by the administration. We were already in the midst of rabid (and fully justified) complaints about the KSM trial and the various attempts to close Gitmo. To think that any GOPer was okay with having the panty bomber Mirandized and put into the civilian system (from the get-go, yet) is just beyond ludicrous.

neurosculptor on February 7, 2010 at 1:24 PM

Well… if the FBI can get all the intelligence information they need from the bomber in 50 minutes, surely Eric Holder can give a complete and detailed plan legal briefing plus detailed strategies and actions several hours after the incident in only 5 minutes…

Sporty1946 on February 7, 2010 at 1:27 PM

The White House is claiming that the GOP should have been all-knowing with the information that the White House gave them.

The GOP didn’t raise objections because they had nothing to object about at the time.

If the White House would be straight about their information, the GOP would have blasted them right then and there, and the White House knows it.

This administration doesn’t care about their lies. They simply lie to give the dems some talking points. Their brainless followers will simply mimic “GOP leadership in Congress was briefed by the Obama administration about Abdulmutallab and they said ok”. They won’t check the facts, they’ll simply do what they do best… lie.

publiuspen on February 7, 2010 at 1:31 PM

So when did they talk to the republicans about this? Before they read the underwear bomber his right or after?

Since when did Zero’s administration include the republican’s. Is this the only time they contacted the republicans to get their input on a situation. I don’t believe it.

Look at health care the republicans were shut out. I can’t see Holder asking the republicans what they think of this situation. They are just trying to blame them since Americans are getting more pissed off as each day goes by with crap like this.

John Brennan Dick Cheney claims that GOP Democrat leadership in Congress had been briefed by the Obama Bush administration about the arrest of Umar Farouk Abdulmutallab damn near every Al Queda terrorist and the decision to handle his their case through the criminal justice system of kicking asses and taking names. The National Security Adviser told Meet the Press that no Republican Democrat ever raised any objections to the decision made by Eric Holder the CIA during their briefings:

uknowmorethanme on February 7, 2010 at 1:33 PM

And no Democrat ever objected to the Watergate break-in.

Irresponsible Democrats….

JohnGalt23 on February 7, 2010 at 1:34 PM

So, their point is apparently that, since (as they claim) no Republicans or Pentagon or intelligence people warned them NOT to Mirandize Abdulmutallab, that objections now are meritless and politically motivated? Or is it that someone else should have stopped them from being stupid?

This is an awful lot like the argument that “Bush Mirandized the shoe-bomber.” OK, does that mean that Bush did the right thing? Or does that mean that if Obama repeats Bush’s mistakes, no one can object?

Even were they telling the truth, their logic would be seriously lacking….

Once someone is mirandized you can’t unmarandize them. They will usually ask for a lawyer right then and there. It is the reason detectives get pissed at patrol officers for mirandizing a felony suspect before the detective has talked to him. So I am not sure what a Republican could have done in this case. This administration must think we are all fools.

I think this Brennan guy is confused- it was probably GW that he called- this is clearly Bush’s fault.

BKeyser on February 7, 2010 at 2:15 PM

I expressed my opinion in the news section and I will here as well.

They never fail to drown the point with the spin. It pisses me off to no end. Who cares if at the time, no Republican said “whoa”. When the decision was made to send a lawyer; thats where the break down occurred. The point all along has been that he should have been immediately turned over to the military and transported straight to Gitmo to be dealt with in the same manner that we have been dealing with them, tribunals. No lawyer should have ever had contact with him. He gave up his rights the second that he swore allegiance to jihad! See how simple that is?

The shoebomber was a British citizen. He was privilaged to Miranda. I dont know exactly why? I am not so certain that Gitmo and the military tribunals were in place at the time, it was still 2001. All they had was the Clinton policy to go by, (i.e. handling of the first trade center bombing)

The main point is totally lost by these people, these politicians. War’s enemies are presumed gulity, American criminals are presumed innocent. Treat them like they are; unlawful enemy combatants, nothing more.

If it were my choice, they’d have nothing but dirt covering them. Take no prisoners and if you do, execute on the spot.

Boy, I wish I could use that excuse for all my screwups. i.e. It ain’t my fault because you didn’t tell that what I was doing was wrong.

It’s the John Edwards’ “Why Didn’t You Stop Me From Behaving Like an Idiot?” defense.

It probably never occurred to them to ask if they were going to mirandize the “isolated” suspect because in their minds that would be the last thing anyone would want to do with him. Maybe they just assumed that he was going to be whisked off somewhere to be interrogated. What else would you do with a guy who tried to commit a terrorist act? The guy’s botched bombing attempt was nothing compared to the way we botched his capture.
