Did GOP know about EunuchBomber’s Miranda treatment?

posted at 1:18 pm on February 7, 2010 by Ed Morrissey

John Brennan claims that GOP leadership in Congress had been briefed by the Obama administration about the arrest of Umar Farouk Abdulmutallab and the decision to handle his case through the criminal justice system.  The National Security Adviser told Meet the Press that no Republican ever raised any objections to the decision made by Eric Holder during their briefings:

The two Republicans briefed on the matter immediately objected to Brennan’s characterization of the amount of information delivered by the White House on the EunuchBomber’s situation:

But Brennan’s comment provoked a sharp rebuke from two of the Republicans who received the briefings.

“This was like a three or four minute phone call,” Rep. Pete Hoekstra (R-Mich.) told POLITICO on Sunday. Hoekstra, the top Republican on the House Permanent Select Committee on Intelligence, said, “At no point did he ever talk to me about legal strategies.”

“For this guy to get out there and start saying things like this is irresponsible,” Hoekstra said.

Byron York heard from Senator Kit Bond, ranking member of the Senate Intelligence Committee:

Sen. Bond responds, saying Brennan “never told” him of the plan to Mirandize Abdulmutallab. Bond’s entire statement:

["]Brennan never told me any of plans to Mirandize the Christmas Day bomber — if he had I would have told him the administration was making a mistake. The truth is that the administration did not even consult our intelligence chiefs, as DNI Blair testified, so it’s absurd to try to blame Congressional leaders for this dangerous decision that gave terrorists a five week head start to cover their tracks.["]

It seems ridiculous to claim that Bond and Hoekstra got fully briefed on the strategy for handling Abdulmutallab when DNI Dennis Blair, FBI Director Robert Mueller, and others in the counterterrorist chain of command have already testified that they didn’t get briefed on that decision until it was made. If the White House didn’t consult Mueller or Blair, why would they have picked up the phone and called Bond and Hoekstra? Brennan’s claim that a call giving the two the outline of the attack somehow amounts to acquiescence of the point of Mirandizing a terrorist before fully interrogating him is ludicrous, and obviously self-serving. It’s almost as bad as Janet Napolitano’s “the system worked” spin on the Sunday after Christmas.

the drill sgt on February 7, 2010 at 3:21 PM

Maybe they just assumed that he was going to be whisked off somewhere to be interrogated. What else would you do with a guy who tried to commit a terrorist act? The guy’s botched bombing attempt was nothing compared to the way we botched his capture.

scalleywag on February 7, 2010 at 3:18 PM

You are EXACTLY right…. Nobody in their right mind would have thunk for a nanosecond that this terrorist would be given Constitutional rights. And the whole blame game thing is a bit late in coming.

Wait for the Republicans involved in this story to hit back hard early next week, and then Chocolate Jesus and his merry band of lying thugs will drop another three points.

If bin Laden was arrested in the US and mirandized, would the miranda be irreversible so that we couldn’t interrogate him?

If Brennan were telling the truth [I'm purposely using the subjunctive mood because Brennan's "telling the truth" is a condition contrary to fact], wouldn’t the Dems be telling the world about this weeks ago when conservatives began complaining.

Seriously, these guys don’t even lie well.

Beyond that, when are Republicans going to hammer back at Obama about this second round of questioning. We are never going to stumble on another terrorist whose family puts its arm on their family-member terrorist to come clean–or somewhat clean. This will never happen again…and it will still yield only stale intelligence.

When are heads going to roll?

BuckeyeSam on February 7, 2010 at 3:32 PM

The Left has been playing “political football” with national security since W Bush acted decisively after 9/11. Brennan is just continuing the Left’s projection to blame others for their very own MO.

onlineanalyst on February 7, 2010 at 3:39 PM

If Brennan informed the Republican senators then he surely needs to be fired for not informing Blair, Napolitano, Mueller, etc. Their defense that Bush did it too, when referring to mirandizing the shoe bomber is ridiculous. There were no military tribunals established at the time of Reid’s attack on 12/22/01. Bush had just issued the order three weeks prior, on 11/29/01, to establish military tribunals. Surely they wouldn’t expect Bush to have something established within 3 weeks when it took Obama nearly a year to staff his HIG.

This administration is a pathetic bumbling amateur circus and I keep wondering who is driving the clown car.

Ahhhhhhhhhhhhhhhhhhhh, didn’t they make that decision on Christmas Day like after about 50 min?

The National Security Adviser told Meet the Press that no Republican ever raised any objections to the decision made by Eric Holder during their briefings:

Seriously, are they NOW claiming in their “ever changing” story that :

Holder briefed the Republicans within that 50 min window of time on Christmas Day,

And

Really?

Why do I find this sooooooooooooooo hard to believe?

Buckeye has it right, these guys don’t lie well. Add that to the list of other things they don’t do well. They all covered their asses last week when they affirmed the country would be attacked within 6 months. More lame excuses from an administration headed by an emotionally arrested infant who can’t take responsibility for his own actions.

Obama should try a job in the private sector and then blame all his screw ups on his predecessor, customers and competitors. He’d be out on his arse in five minutes.

RadClown on February 7, 2010 at 4:06 PM

This is a PR mistake. I saw a comment on another thread here on HA for the article where someone makes the great point. “I don’t know why Mom didn’t know if I was talking to Mary that I was going to the Mall because that is what we always do! And do I have to tell her EVERYTIME I am going to be late? We never get home on time from the Mall?

It makes a great point this is the kind of jubbled logic a teenager tries to get out of responsiblity after the fact where they did something they knew didn’t meet with their parents approval. In the case of the Obama administration this demotes them to irresponsible teenagers that need to be policed by Republicans to the nth degree. The PR mistake I refer to is the action the voters will take if they want to make the Republicans responsible for their actions is to just DIRECTLY make Republicans responsible for governing i.e vote them all out of office! Stupid move, watch for Obama’s reputation as a leader to take another hit.

I forgot the guy’s name but he was the head of the Bin Laden unit at the CIA when asked on Fox about this guy he said he is a loyal administration guy not a loyal to the mission guy. He is a climber who pleases the people above him and that would be an excellent explanation of what you see here. The whole goal of these statements can be seen to give cover to the Obama admin and apparently that is all this guy is good at according to the former Bin Laden head. Not combating and capturinf terrorist as his 1st priority and only priority. That is a secondary concern he performs as a function of making his bosses look good. Bad for the country with an Obama instead of Bush. Funny how the Obama people picked him. It is almost like they had research he would be a guy to act like this and not a guy to point out what a disaster liberal policies are.

None of those individuals raised any concerns with me at that point. They didn’t say, Is he going into military custody? Is he going to be Mirandized?

And let me be clear about this also: at NO TIME did they ask me “Are you a total dirt-bag that is going to use this conversation to try to shift blame for his incompetence to someone else?”

So as a Democrat national security official, I went ahead and did so.

drunyan8315 on February 7, 2010 at 4:54 PM

sooooo, if the Republicans had told Holder not to Mirandize the defendant, he wouldn’t have done it? HAHAHAHAAAAHAHAA

What a complete crock of you-know-what!

@profitsbeard

According to the official report (DoD 1978, pp. 51-54), the “East Wind” code was never broadcast. A STOP code was sent, but added little useful intelligence to the less ambiguous bombing-the-f*ck-out-of-the-Arizona cipher.

The Pearl Harbor History Associates have copies of all five volumes of the “Magic” report available online at http://www.ibiblio.org/pha/magic/.

The pace of lies, missteps, arrogance and speechifying no-nos, seems to be speeding up. The negligence and attempts to shift responsibility would indicate the ability to retreat to an alternative universe. The problem is the rest of us non-liberals are stuck here with terrorists, crippling debt and an awful economy.
This level of incompetence, like their policy is unsustainable. Where this tailspin leaves us will be the progressive legacy for decades.

PH: We’re also gonna object to a California jury trial.
JB: Right.
PH: No good having New York state try him first and then follow up with a federal civil rights trial if necessary.
JB: Well-
PH: Resettlement in Bermuda is not an option, as far as we’re concerned, whether the Brits agree or not. We also don’t want him pardoned, pensioned, or given a post in the Obama Administration as some kind of czar.

When the December 25 Detroit panty-bomber event occurred, too many of the decision makers were on vacation and/or incommunicado, including President Doodad Pro, who spent the next several days on the Hawaiian links.

After all of the ObaMao hoopla about closing Gitmo only a day or two after his ascension to the throne and his decision to take away interrogation capability from the CIA and give it to Justice, no High Value Interrogation Unit was formed. It still doesn’t exist, as far as we know.

Who are these people charged with national security answering to and what exactly is their function? We have a lack of accountability here that is a major dereliction of duty.

The Obama Administration had previously made statements that to ensure there was no harsh treatment that all interviews of “high value targets” would be done by the FBI, instead of the CIA.
So, even if Brennan had told GOP leaders that the FBI was interviewing Abdulmutallab, there was no reason for the GOP leaders to infer that this “high value target” had been or would be mirandized.
