Hidden cloture in reconciliation?

For the past few weeks, Democrats have attempted to strategize to get ObamaCare through Congress without invoking cloture, especially after losing the Senate seat in Massachusetts in a shocking setback. They have mainly attempted to find a way to make the budget reconciliation process work for even non-budgetary components in order to get as much of ObamaCare as possible through with the minimum number of Senate votes, in order to accommodate House Democrats being forced to accept most of the Senate’s compromises. However, Republicans have done their own research and have discovered a way to force reconciliation into a cloture vote:
As it turns out, Senate Democrats may not be able to force healthcare legislation through the chamber on a simple majority vote.
Republicans say they have found a loophole in the budget reconciliation process that could allow them to offer an indefinite number of amendments.
Though it has never been done, Sen. Jim DeMint (R-S.C.) says he’s prepared to test the Senate’s stamina to block the Democrats from using the process to expedite changes to the healthcare bill.
Experts on Senate procedural rules, from both parties, note that such a filibuster is possible. While reconciliation rules limit debate to 20 hours, senators lack similiarconstraints on amendments and could conceivably continue offering them until 60 members agree to cut the process off.
Republicans warned that an attempt to use reconciliation would spark a firestorm in the upper chamber. Most people assumed that the GOP quiver would be limited to the end of unanimous consent, thus requiring repeated full readings of bills and amendments, which would slow the Senate to a crawl and keep other business from being heard. This new twist would mean that Republicans could continue offering amendments to the bill throughout 2010 and push the vote closer and closer to the fall, when desperate red-state Democrats on Capitol Hill would see this as a Sword of Damocles about to drop on their collective noggins.
In this case, though, the strategy depends on one vote — and that isn’t Scott Brown. The Senate Parliamentarian will have to rule on whether the GOP can continue offering amendments, as Harry Reid will undoubtedly invoke a point of order to limit amendments. The reconciliation rule itself doesn’t have any limitations on amendments, only on debate on the main bill.
Reid will argue that infinite amendments violate the “spirit” of the 1974 budget agreement that created the reconciliation exception to cloture, but parliamentarian Alan Frumin has no precedent from which to work. He could side with Reid, but that would put Frumin in the position of creating a Senate rule by fiat. Frumin would be more likely to point out that the rules don’t preclude the GOP strategy and leave Harry Reid to find a political solution to his problem — which was what a few Democrats told The Hill anonymously.
So even reconciliation has its problems, and Democrats may find themselves in the unique position of manhandling the rules to get to a finishing line and seeing Republicans already there. They would be much better off opening a dialogue with the GOP and creating a new reform bill with their input.

So far, from what I can see, Republicans don’t want a reform bill that allows the government to overhaul the health system here, and thus, a government take over of our lives.
Democrats want all that, and more, and dont’ want any of the Republicans ideas. If they did, they would have considered them months ago.
Dems are the party of ….our way or the highway.

The longer the Republicans can drag this out, the worse things will be for both ObamaCare and the Democrats.
The public is already opposed to ObamaCare by 55+% according to most polls, so obstinately trying to force it down their throats by a long, circuitous process will anger voters even more, when the Senate SHOULD be doing something about the economy. Some vulnerable Democrats might decide that the effort isn’t worth the trouble, and bail out of ObamaCare. If it does pass, close to the election, voters will be furious at Democrats for pasting nearly a whole term of Congress passing something they don’t want.

This actually isn’t new. In Senate parlance, this is the “vote-a-rama,” and has arisen somewhat accidentally in the past when debate time expired but there were sill amendments to be considered. The Senate has found itself in the position of considering many amendments with no time for debate whatsoever. Ultimately, the parties would agree to limit amendments and put a stop to the “vote-a-rama.”
What would be new would only be the deliberate application of this to delay a final reconciliation vote as long as humanly possible.

They’re not delusional, except at the level of their own concept of self-worth. But when that concept is is threatened, they’ll switch-up. Which, of course, will be lies.
Then, that’s where we nail them. Put enough pressure on them to make them ‘change’, then later nail them hard for their flip-flopping.
It’s tactics–to ruin them where possible. Their egos are their strength, in ways outside their own egos. But nothing is more incinerating than using an enemy’s strength against him. Again, tactics.

The bad news is the Parliamentarian’s role is strictly advisory. The fact that The Dingy One appears ready to go through with the double-finger-to-the-eyes (the House passing the Senate abortion-and-bribe bill unchanged plus reconciliation) is a strong indicator that even if he decided to allow the Parliamentarian to offer an opinion, the ‘Rats will ignore it.

Even if a bill never ever gets to be voted on, you can count on the Dems forever trying to piecemeal this thing through. Eventually they will get what they want unless every single budget item introduced is made public. I doubt that will happen even if conservatives have a majority.
Watch for significant changes to Medicare to be offerred up next.

I realize that Obamacare equals a long term power grab for the Left but since the “benefits” for the great unwashed don’t kick in until 2013 or 14, I don’t see any upside for members fo Congress in their coming elections. This just seems stupid on their part to me. Let’s crank up some townhalls/tea parties.

I called Monday, they said they were waiting on 19 cities and county clerk recorders to certify, I mentioned being seated in 48 hours. They said that was because the House voted to ignore the rules in that case but in this case, the Senate is slowing everything down.

Brown should have been seated immediately, and 10-days (for absentee ballots) at the latest. That was the 29th of January.
Dems are delaying trying to use Kirk’s vote to get as much done as possible, and Kirk shouldn’t even be in the Senate since the 19th.

This will brand the Democrats forever as power hungry autocrats intent on imposing their will on the people against the people’s will. Which is, of course the truth.
Conservatives have let up some on exactly why this is a bad bill.
I would like to see some of the provisions highlighted again. And the way they got around the promises made about not raising the deficit or taxes or why they don’t really mean they are going to send people to jail… I am starting to forget and I bet others are too.
We need a review.
Right now Democrats are being somewhat successful in their arguments that they are making the bill better, they took out the public option… and so forth… they claim they are listening to their constituents. I heard a Congress woman this morning claim they are listening to the people and making the changes…
A lie no doubt but it should be answered with a review of the facts.

Brown demands to be sworn in earlier than planned
Sen.-elect Scott Brown says he wants to be sworn in immediately, not next week as planned.
In a letter today to Gov. Deval Patrick, a Brown attorney said he wanted the results of the Jan. 19 election certified by 11 a.m. Thursday, so they could be forwarded to U.S. Senate officials for immediate action.
The demand reverses Brown’s prior statements on the issue. He has been saying he was content to wait until Feb. 11 for his swearing-in, so he could hire a staff and be prepared to assume his new duties.
Now he says he has been told there may be votes in which he wants to participate.
Brown upset Democrat Martha Coakley to win a Senate seat held by the late Edward Kennedy for over a half-century.

I think those town halls and tea parties showing up on the news on a regular basis let the folks who don’t bother with the news know what was going on. It’s sad how many people don’t know until it’s too late what goes on in D.C.. More speech and more sunshine can only help.

No there just going to try to attach lil bits and pieces of it inside bills that are indispensible, and then cast the Rep’s as the “party of no“.
Which, quite frankly, is a label that I heartily endorse given Whiskey Tango Foxtrot they’re mercilessly trying impose. Keep an eye on Sebelious, she already showed the inclination using the military as a stepping stone on the way to assume enforced responsibility. She stated it quite clearly when she said in regard to banning smoking in the services, “As we have to assume to the costs of their health, we have the obligation maintain their health.” She was then asked if could mean if the same could be said of ice cream? She replied, “Oh, I would hope so.” quite a matter of factly.
The “costs” she is talking about is the are the ones she is slated to assume for all of us as Sec of HHS. There are military spending bills coming up that pertain to veterans, and the Govt’s “obligations” to them. Under the rubric of VA Reform will lie the framework for what they have in mind to hang all of us from.
Just because they’ve run into last year‘s resistence to their agenda, does not they will allow us to thwart the precise moment the last hundred years of incrementalism has been building towards. They really did go all-in quite a while ago, and as the polls showed today they are damned equally if they do & damned if don’t. They are going to win the battle, lose elected office and get appt’d to one the 118 new agencies in HHS’s umbrella and pays them more than they make now, or just lose office.

No is a beautiful word sometimes… it’s quite liberating.
If it’s no to the wrong things for this country… I’ll vote no every time.
‘No’ usually releases us from liabilities and commitments which can ruin or bankrupt us.
‘No’ can protect us from harm in ways ‘Yes’ cannot.
‘No’ allows us to assert our independence… especially when everyone insists we say ‘Yes’.
That’s not to say ‘Yes’ is an ugly word. It has it’s uses and places… but ‘No’ can be equally beautiful at times… it’s just a manner of connotation.
So how ’bout ‘No’ if it saves the country? I’ll agree with that all the time.
