Obamateurism of the Day

After the Supreme Court decision on Citizens United v FEC, Barack Obama asserted that the court had overturned “a century of campaign reform law”.  He did it again last night in his State of the Union speech:

“Last week, the Supreme Court reversed a century of law to open the floodgates for special interests — including foreign companies — to spend without limit in our elections,” Obama said tonight. “Well, I don’t think American elections should be bankrolled by America’s most powerful interests, and worse, by foreign entities. They should be decided by the American people, and that’s why I’m urging Democrats and Republicans to pass a bill that helps to right this wrong.”

Actually, as HA reader Mark points out, the Citizens United decision changed less than a decade of law.  The century of law prohibited corporations from contributing to candidates — and the Supreme Court decision didn’t change that at all.  Spending limits on political speech, including a pre-emptive bar on advertising by corporations and special interests within a certain time range prior to the election, only came into being through McCain-Feingold.  And that was in 2002, not 1910.

Bradley Smith at The Corner demolishes the rest of Obama’s argument on the danger of foreign corporations:

The Court held that 2 U.S.C. Section 441a, which prohibits all corporate political spending, is unconstitutional. Foreign nationals, specifically defined to include foreign corporations, are prohibiting from making “a contribution or donation of money or ather thing of value, or to make an express or implied promise to make a contribution or donation, in connection with a Federal, State or local election” under 2 U.S.C. Section 441e, which was not at issue in the case. Foreign corporations are also prohibited, under 2 U.S.C. 441e, from making any contribution or donation to any committee of any political party, and they prohibited from making any “expenditure, independent expenditure, or disbursement for an electioneering communication… .”

This is either blithering ignorance of the law, or demogoguery of the worst kind.

Maybe that’s why the cameras caught Justice Sam Alito shaking his head at the reference.  The Constitutional law professor apparently needs a refresher course on legal research.  Of course, for a man who thought the Constitution was written “20 centuries ago,” maybe eight years from McCain-Feingold seems like almost a century to him…

Alito was the one who laid out all the sleazy details in the Ricci case that Sotomayor ignored in her Second Circuit opinion. The local version of Jesse Jackson/Al Sharpton threatened all sorts of public protest if the city didn’t set aside the results of the promotion exam. Alito made sure the details got into the public record.

Has any other president criticized the Supreme Court during the SOTU? I’ve been watching them since Carter (yes, I’m a nerd) and I do not recall anything like that. Even on something like abortion neither even Reagan or W. criticized the Court. It simply isn’t done.

This SOTU was an epic fail.

Alito did nothing wrong. He said nothing out loud and he wasn’t disrespectful. O, on the other hand, resorted to his community organizing ways and tried intimidation. He is the one who should be apologizing. It was a typical arrogant O saying that he knows better than SCOTUS. The man is a joke.

If that’s the same panel as last night, then it seems to reflect the polls. The young’uns and minorities in the group defended Obama and regurgitated his “hopenchange” nonsense, where as the rest of the people(especially the middle-aged ones) were sick of him and saw him as nothing more than a con man.

And this was in Philly. If Obama’s losing that much support in urban areas, he’ll never win reelection.

Maybe Sarah Palin could put a little reminder on facebook about which candidate disabled the security checks on small credit card donations in 2008? My memory is that a number of foreign donations went into his coffers. Wouldn’t hurt to smack him around a little with that, and try to embarrass him if he tries the same stunt in 2012.

If the President was the scholar he claims to be than he would agree. He was all over the map. His lecturing was annoying. He doesn’t get it. He didn’t change course. It’s now too late. The economy won’t recover. The luster is gone. The pretty package is empty. He will be a laughing stock and it will serve him right.

Taking credit for ending the war in Iraq (which Bush won over his opposition) takes a special kind of gall. Saying he stands up for freedom when he has stood down on Iran since their inchoate revolution started is more gall heaped upon delusion.

Insulting the Supreme court in front of the nation when he knows they can’t defend themselves is beyond the pale but attacking (with lies) those with whom he disagrees is his stock-in-trade.

But this is only the beginning of the end of Obama. Wait it until next year’s SOTU after the GOP sweeps the mid-terms. By this time next year this far left poseur will be unhinged.

Presidents normally get a bump in their approval ratings after the SOTU.

The question this time is, how many were watching (Barry overload is a recurring theme these days.)
Of those watching, how many are still open to persuasion after the past year.

I suspect he will get a small temporary boost in his approval numbers, but it will much less than normal.

Given the increase in life expectancy, the turnover in the court is much less than it was in decades past. For this reason, I wouldn’t mind seeing the size of the court increase. The problem is of course any big jump gives the president at that time the opportunity to pack the court.

One proposal that I have seen that might work, would be to give each new president the power to appoint one additional justice. If the president is elected to a second term, he/she doesn’t get a second extra appointment. Keep this up until the court reaches somewhere around 15 members.

I’m so glad to hear that POTUS is opposed to special interests funding campaigns… Does this mean that he’s going to give back all of that union money??

It wasn’t just when B.O. made this crass comment with the Justices all sitting right there in front of him, but it was when Schmucky Schumer had the unmitigated gall to get up while sitting BEHIND the Justices and applaud what B.O. had just said.

Frankly, it would have honored me to have seen all the Justices get up at that point and walk out of the room in total disgust.
