“Not true”: Alito mouths words as Obama hammers Supreme Court
posted at 10:44 pm on January 27, 2010 by Allahpundit
He’s on the far left of your screen, seated to the right of Sotomayor. Politico’s calling it his Joe Wilson moment.
When you hear the president of the United States demagoging the First Amendment, you sit there and you take it, son.
Update: CBS screwed up the embed code initially. If you’re seeing the bit about Afghanistan, try refreshing. You should see the Supreme Court clip then. If not, click here. That should do it.

On a lot of the lefty blogs, they have been suggesting that the SCOTUS should be impeached ever since the ruling on Campaign Financing.
Don’t know exactly how you constitutionally impeach members of SCOTUS but we are talking about the swamp of the lefty mind . . .

What’s even scarier is the fact John Paul Stevens is going to resign before Nobama’s term is over.
Stevens has hired only one law clerk for this term, where he normally hires four. He’s 90, so time is not on our side on this one….
Granted, he is left leaning, but he has sided with Scalia and Thomas from time to time. His replacement will NEVER side with the conservative justices.

For me this just fits the “57 states” legacy. Obama has no knowledge base of American history, or for that matter the American people. No President in American history has ever called out the Supreme Court during the SOTU. Not in this humiliating manner! It was truly cringe worthy!
I am stunned at this. Absolutely stunned! What arrogance!

From the Corner. The SCOTUS ruling on one clause doesn’t invalidate the other, so foreign investment/donation/etc. weren’t affected.
Oddly Obama couldn’t figure that out… doesn’t he have some Law degree or something? Or do 441a and 441e really look the same to him? Weird that he wasn’t clever enough to know the difference.
Well, that or he lied on purpose to try to get people upset with the ruling by deliberately misstating what the decision was…
Any guesses which it was? Is he lying on purpose, or too stupid to know better?

ya2daup on January 28, 2010 at 12:54 AM
Nothing in the First Amendment allows restricting freedom of speech to citizens only. The three freedoms mentioned in the first portion of the First Amendment apply to everyone within our borders, including “foreign” corporations. Obama really had to reach to demagogue against foreign corporations, but foreigners are, for better or worse, allowed freedom of speech in this country.
This guy graduated from Harvard Law, but doesn’t seem to remember what he learned there.
I’m not happy with the Court’s decision, but it is perfectly correct from a Constitutional standpoint — just as Dred Scott was perfectly correct from a Constitutional standpoint in its time. We fixed Dred Scott with an Amendment, and, if this fully expanded freedom of speech seems onerous enough, we’ll fix it the same way.
unclesmrgol on January 28, 2010 at 12:55 AM
Obama certainly doesn’t seem to know much about the law. Or separation of powers does he.

There is nothing in the constitution that prevents the Supreme Court from criticizing the executive branch. However, judges are forbidden by their cannon of ethics from getting involved in politics. More likely there will be some pointed language criticizing the adminstration’s position in some future cases. I think there will be plenty of outsiders that have the Court’s back, just based on the inappropriateness of Obama’s remarks.
Ted Torgerson on January 28, 2010 at 1:04 AM
He needed to seek America’s reaffirmation tonight and he not only came up well short he proved how clueless he really is.
Mr Purple on January 28, 2010 at 1:20 AM
Actually they can’t. The caps on direct donations is left in place, but what has been removed is the muzzle McCain-Feingold placed on third party speech associated with an election.
That means that all those companies (including the foreign ones giving Obama the big wedgie) can buy ads in support of their favorite candidates, but they still cannot coordinate those ads with the candidates.
That’s why this is a freedom of speech issue rather than a freedom to fling money wherever flinger wants issue.
unclesmrgol on January 28, 2010 at 1:21 AM
If Congress is stupid enough to pass abominablecare then I am sure that Alito will make sure that he finds the parts that make it unConstitutional. I do not think Sotomeyor will disagree with Obummer, but some of those other justices are not about to roll over for this dreadful man.
maggieo on January 28, 2010 at 1:21 AM
He lied. He’s a liar. They tried to hang George Bush for his 18 words on yellowcake in Niger, which was the truth. In eight years of SOTU speeches that was the best the Left could do. But this was a plain out-and-out lie. Obama is a liar.

Miss Molly on January 28, 2010 at 1:30 AM
Gotcha, thanks. I sheepishly admit I didn’t read the decision, but even more reason then to wonder what his problem is with it. I fail to see how lifting the restriction grants any greater access to “influence” elections. I maintain that if corporations are going to be taxed by the government, and subject to their laws, they have a right to voice their opinions on various candidates.
NoLeftTurn on January 28, 2010 at 1:30 AM
Not sure about that. From NRO –
The Court held that 2 U.S.C. Section 441a, which prohibits all corporate political spending, is unconstitutional. Foreign nationals, specifically defined to include foreign corporations, are prohibited from making “a contribution or donation of money or other thing of value, or to make an express or implied promise to make a contribution or donation, in connection with a Federal, State or local election” under 2 U.S.C. Section 441e, which was not at issue in the case.

disa on January 28, 2010 at 2:10 AM
McCain, who co-authored the law, doesn’t know either since I saw him on Larry King say the President had merit in pursuing the foreign contributions.
My take is that since this decision affirmed that:
1. corporations equal individuals; and,
since it is currently:
2. illegal for foreigner individuals to donate to US campaigns; then,
it follows that:
3. foreign corporations are equal to foreign individuals.
Thus:
4. Foreign corporations cannot contribute to US campaigns.
Make sense?

I have long believed that the only reason Obama studied Constitutional Law was to try to find the loopholes he could work to exploit.
On the subject at hand, I am a Judge’s daughter. The worst affrontery another lawyer can make is to insult a Judge to his face. Certainly a President has the right to disagree with a decision made by the Supremes; however, to debase them during the State of the Union while they are sitting there as invited guests . . . ?
Well, I hope he wasn’t figuring this would work to shame the Court into subservience to him. (the Chicago Way).
I think he will be in for a rude awakening.
Obama is definitely not a student of the Dale Carnegie method.

Our leaders on the Right must stand up and explain this Supreme Court decision to the American people. They’re hearing a lot of spin on this…and it’s just complex enough that even some right-thinking people are coming down on the wrong side of this issue. Obama said he didn’t think America’s elections should be bankrolled by its most powerful interests. That’s exactly what has been going on, only until now the bankrolling was restricted to one side (labor unions). This decision levels the playing field. We need to shout this from the rooftops and make sure that everyone we know understands this issue correctly.

Saw it on Fox & Friends this morning. To basically put down another branch of government in this forum and have ALL those ELECTED officials stand up and clap this publicly chastising wherein SCOTUS has no ability to respond in kind like the GOP gets to with their rebuttal is beyond hubris. It’s not just a horrible moment for the President but any of them who stood up.
How ackward even for the Justices that voted his side to sit still while he demeans them and have a large political body clap? Could you imagine during a graduation speech and professor openly quoting a student’s brief and calling out sections he felt were wrong then handing him a diploma? That’s how it felt to me. Not the time and place to have THAT discussion. All of them are POSs for doing that.
I’m heartened that J. Alito refused to simply sit there and take it. I’m even more heartened by the fact that he and Scalia, and Roberts, and Thomas will be there LONG after Pres. Obama’s end of his mediocre one-termer presidency and definitely MUCH long than all those ELECTED Democrat Representatives & Senators. I suspect their political opinions will have a short and less inpactful effect on our society than SCOTUS over the next decade. I’m thankful that J. Stevens saw the light on thus one. And I suspect he’ll see the light if ObamaCare ever comes before the President foe a signature!!

iceman1960 on January 28, 2010 at 6:24 AM
I read somewhere that Obama’s calling out of the SCt is unpresidential. Why is the insult to the SCt a surprise? IMO, it’s of a piece with Obama’s entire demeanor since assuming the POTUS. His very attire is unpresidential and signifies his disdain for the importance of the office; it is no wonder that his words are, too. His lack of respect for and disdain of America is exhibited in everything Obama does and every word he utters.
SilentWatcher on January 28, 2010 at 6:45 AM
Is everyone forgetting that Obama’s campaign knowingly turned off checks on credit card donations so that foreign based credit cards and stolen credit cards and gift cards could be used to fund his campaign and that there were whole operations in place using this hole to raise money for Obama in foreign countries by foreign enitities? Or is my mind mistaken here.
Obama is a FRAUD through and through. He broke the law to win the Presidency. We all know it. He did it KNOWINGLY.
