O’Keefe: “The truth shall set me free”

The boss is skeptical, as am I. Remember when I said earlier that their defense would likely be that they never really intended to tap any phones but were simply trying to show how easy it would be to do so? Well, er…
An official close to the investigation said one of the four was arrested with a listening device in a car blocks from the senator’s offices. He spoke on condition of anonymity because that information was not included in official arresting documents…
ACORN spokesman Kevin Whelan said the arrest calls O’Keefe’s credibility into question, and used the opportunity to point out that he “edited (ACORN videos) to make things look as bad as possible.” He said, for instance, that O’Keefe actually wore a normal dress shirt when he was in the ACORN offices, but spliced in shots of him dressed as a pimp in the final videos.
O’Keefe, Flanagan, and Basel were all inside the building, according to the FBI affidavit, so the one with the listening device must have been Dai. Hugh Hewitt interviewed Breitbart about the arrests this afternoon, and while AB is crystal clear about that he didn’t know any of the other three men involved or what O’Keefe was up to, it’s less clear what the employment relation between them is.
AB: When the story came to us, what I wanted to do was to make sure that the ACORN story got as much widespread dissemination as humanly possible. The videos that he independently produced went on YouTube. And so Huffington Post, every single site put it out there, including my sites. What he does for the site exclusively is he tells his life rights, basically. So when he puts a story out there, it’s on the Brietbart sites, the Big sites, that he can tell people what transpired. So…
HH: Do you pay him for that?
AB: Yes.
HH: And are you free to tell me how much you pay him?
AB: I’ll…perhaps at another date, but he’s paid a fair salary.
HH: Is he…so he is an employee?
AB: I’m not sure that’s technically the thing, but yes, he’s paid for his life rights. And he’s, you know, he’s still…we reserve the right to say yes or no to any of the stories that he puts up on our site as we do to any other contributor who comes to the site.
It sounds like he’s an independent contractor, not an employee. Any criminal lawyers want to weigh in on whether and how employment status might affect potential criminal liability? Anyone? Patterico? Bueller?
Update: Re: the “listening device,” it’s possible that it was linked up to a mic on O’Keefe or one of the two fake repairmen, not to some bug that was meant to be planted in Landrieu’s phone. But it’s potentially important evidence, needless to say.

1. “listening device” is so ambiguous as to include a cell phone, and
2. Brietbart would have to have knowledge of a crime, and consent to it (or do some overt thing to further it), to be complicit under criminal law.

On that point, if the “listening device” was equipment for wire-tapping, or “bugging”, they would have been charged for illegal wire-tapping. They were not.
They were only charged with entering federal property under false pretense (which is a true charge, the two claimed to be something they were not… and O’Keefe was only charged with aiding and abetting the false pretense.)
I’m learning towards believing that the “listening device” was the audio recording that O’Keefe used in the ACORN videos.

Given the move towards ever-’smarter’ phones, that would make sense. Even a phone with no more onboard static storage than its SIM card could contain a wealth of contact information.

Sorry but I truly can’t believe that someone who did such an awesome job with the ACORN videos would miscalculate an important operation this badly.
He waited to release more video tapes until ACORN and Dems screamed foul. He was patient. James has another card up his sleeve and is waiting for the right moment.

On the “listening device” thing vis-a-vis a cell phone…
Cell phones could be defined very fluidly to make them fit into the “magic words” in a statute: listening devices, data storage devices, photographic equipment, computing devices, triggering devices, etc.
On the crime thing; you don’t have to be anywhere near a crime, or in any way act in the commission of the crime, to be liable under a lot of laws.

This is not good, and I think Michelle Malkin has laid out the case well.
O’Keefe did a great service with his ACORN videos, at least some of which, I believe, were within the laws of the states in which they were filmed.
However, you have to know when to pull back, particularly when a Democratic Congress is making (attempting to make?) alterations to existing law in order to target you and other, similar investigative journalists.
If this pans out as it looks to be headed towards (and no pre-judgment can be made), then there is no defense, in my opinion. Not only would O’Keefe have stifled his own credibility and effectiveness, he would have given an eager left the opportunity to discredit all of the work which has been so important in exposing and circumscribing ACORN and its associates.

Exactly. He has to have had something on them before going through with this. The odds of this plan actually working was very slim and they had to have known that the repercussions would be huge. If it did work and they found information that proved she was corrupt, they would’ve still faced legal problems. I too am amazed at the number of “holier-than-thou” comments on here of people rushing to judgment.
I expect the Michelle Malkins of the world to quickly denounce these tactics because they are under such scrutiny from the left already and must maintain “integrity” in their reporting as to at least remain consistent, no matter what their off-the-record opinion is.
We at least owe O’Keefe a little latitude to hear his side of the story and not chalk one up in the loss column already.

Hey … for me … I stand with O’Keefe on this.
He’s an extreme activist but he’s not stupid. There’s something going here and a nuclear response from ACORN and the MSM may be a part of his plan. He’s already proven he thinks several steps ahead of them.
The things that get me are the fact that, as the story is told, he was actually RECORDING the crime. That doesn’t make sense to me and I think he was actually doing it for a reason. Additionally – one of the accomplices was the son of a big U.S. Attorney for Western Louisiana. If that doesn’t set off alarms that there’s more to this story – I don’t know what does.
I do know that one of the things that James tries to do is to interrupt enemy operations through instilling paranoia and fear – thereby cramping their style and ability to carry out future crimes. This was one of the reasons for the ACORN sting – since now ACORN will not be able to be so “open” in their lawbreaking lest they end up on YouTube again.
James looks at this as a “war” … as do I. We already know that the Socialists will use any legal or illegal tactic against us – and then cover it with their propaganda media. We’re going to have to get dirty to get this nation back. Some may not like that fact – they may say it makes us just like them. Well – we’re not wearing Che T-Shirts yet (like them) so I say we can worry about that when it becomes a problem.

Landrieu is pretty much the only downside to living in conservative louisiana from a political point of view these days. The rest of the state is cleaning up, jindal is the man, vitter will be reelected, and new orleans is nutty as always. However, landrieu is a member of the old democratic guard that we have to get rid of.

In the end, it won’t matter much what O’Keefe’s intentions were going in. It will only matter how good his legal team is, because when you screw with a US Senator, any US Senator, they have the machinery at hand to screw you over pretty good.

Thing is … after the scene in the office – the gang went to the GSA maintenance department when they should have known they’d be asked for ID which they didn’t have. It’s almost like they were looking to get arrested for some reason.
And now – after the arrest, facing 10 years in a federal prison – they willingly admit to entering under false pretenses … then O’Keefe says the “truth” will set him “free”. LOL – there is something going on here. Maybe he going to sting Eric Holder now!
In any case – let’s watch this. I wonder if Eric Holder will “drop” this case the way he did the Black Panthers? If he does – it’s because O’Keefe has some dirt.
