Breaking: Lincoln will oppose reconciliation

It appears that the lesson of Scott Brown’s surprise victory did not go completely unnoticed by Senate Democrats from red states. Blanche Lincoln (D-AR) announced today that she will not go along with the rumored plan to use reconciliation to push ObamaCare through Congress, making the plan much more complicated for Harry Reid and Nancy Pelosi to succeed:
Sen. Blanche Lincoln (D-AR) will oppose Dem efforts to move health care legislation through Congress using budget reconciliation, hurting Dems’ chances for using the controversial parliamentary maneuver to pass a reform bill.
“I am opposed to and will fight against any attempts to push through changes to the Senate health insurance reform legislation by using budget reconciliation tactics that would allow the Senate to pass a package of changes to our original bill with 51 votes,” Lincoln said in a statement on Tuesday. “I have successfully fought for transparency throughout Senate deliberations on health care, and I will continue to do so.”
“I will not accept any last-minute efforts to force changes to health insurance reform issues through budget reconciliation, and neither will Arkansans. We have worked too long and too hard on this reform effort – we need to get it right,” she said.
Translation: I hear footsteps. Lincoln no longer clears 45% in state polling against any of her likely Republican opponents for her re-election bid. She is in serious danger of losing her seat, thanks to her cave-in to Reid late last year in her vote for cloture — on a bill that won’t wind up being law anyway, even if reconciliation succeeds.
The question will be whether Reid needs 60 votes to get through reconciliation. If he truly strips the bill down to budgetary items, he won’t. But what Lincoln’s statement does is put pressure on the other red-state Democrats in the Senate, who also see their political ruin written in the results of losing a seat in bluer-than-blue Massachusetts. If Lincoln balks, so will Ben Nelson, almost certainly Evan Bayh, and perhaps even Snarlin’ Arlen Specter, whose prospects of victory look bleak in Pennsylvania.

Something to remember is if the House votes for the Senate bill as is, the Senators are all exposed for their cloture vote … and off the cliff they go.
It’s not going to be pretty at the bottom of that cliff.

But even if Lincoln, Ben Nelson, Bayh, and Specter vote against reconciliation, there are still 55 votes left for it (maybe 54 if Lieberman balks), and it still passes the Senate.
The action is now in the House, because they can try to vote the Senate-passed bill as is. How scared are the Blue Dogs right now, and when will they start to howl?

Reconciliation gives the minority party in the Senate a chance to force a separate roll call vote on every line of the bill. The requirement that every single provision in a reconciliation bill have budgetary impact means that the bill cannot address regulatory issues, consumer protection issues, or items like abortion. The open-ended limitations on deficit increases sharply curtail any additional spending in the bill and mean that most changes made by reconciliation that affect spending and revenues must expire in ten years. And the requirement that congressional committees hold a new two-stage markup process, combined with the usual (if time-limited) floor consideration and conference processes, means that using reconciliation would occupy all of Congress’s attention until late February, at a time when legislators are anxious to shift their public focus away from health care and back to the economy.

I am not so sure. First, they can pass pieces of it through reconciliation. Second, they might try the whole hog because they did some fancy maneuvering to get the bill passed in the first place. Remember the provision that prevents changes to the bill? The Democrats claimed it wasn’t a rule change, but a procedural change. I am not putting it past them to try something like that. Remember, healthcare is the Holy Grail of all liberal causes, so them letting it die a quiet death is very unlikely. I won’t breathe a sigh of relief until a wooden stake has been driven through the heart of this beast.

This is a crock. If the Democrats try to use the phony reconciliation they know they can have 9 Senators save their skins, so now they’re lining up.
According to what I’ve read, Reid has told the House, if they pass the Senate version, he has 51 Senators signed on to vote for the changes they want, after Obama signs the bill. The Democrats will put on a show of non-support, but if they start, I would assume it’s a done deal.
It looks like it’s time for the pitch-forks.

If the House passes the Senate version of the bill unchanged then it goes right to the precedents desk and doesn’t need another Senate vote.
Reconciliation can only be used to pass budget items (taxes and spending). It then doesn’t matter what the house passes overall because only the taxes and spending items can be taken through reconciliation. Every thing else must be passed as separate items and are subject to the filibuster rules.

People remember they put a rule in this bill that said future senates could not repeal it with out 67 votes they did not have the authority to do that but they did it anyway .This senate is capable of doing just about anything regardless of rules or past tradition.

I’d be a huge fan of Tar and Feathering some Congresspeeps (helloooo, we’re looking at you Barney Frank!) but I think this Lincoln announcement is both totally predictable and totally meaningless. Since reconciliation only takes 51 votes, anyone not in a safe seat will vote against it. It’s nice to see the vote for totalitarianism breaking up, but it’s no victory.
