New excuse for not seating Brown: Biden’s out of town

The excuses for Democrats not to seat Scott Brown if he wins today’s special election to replace Ted Kennedy in the Senate have become rather threadbare.  As CQ Politics reports, now Democrats insist that they can’t give Brown the oath of office until VP Joe Biden, also President of the Senate, is available to give the oath of office to Brown.  The only trouble with that excuse is that it’s flatly false:

The office of Majority Leader Harry Reid says there will be no attempt to swear in a new senator until Massachusetts gets all the right paperwork to Washington. Appointed Sen. Paul G. Kirk Jr. , a Democrat, in the meantime will keep the job and cast the votes. “When there is a certified winner in Massachusetts, the Senate has received appropriate papers, and the Vice President is available, the successor to Sens. Kennedy and Kirk will be sworn in,” said Regan Lachapelle, a Reid, D-Nev., spokeswoman.

Actually, Vice President Joseph R. Biden Jr. isn’t essential to the process, even though he is president of the Senate; there’s plenty of precedent for a swearing-in to be handled by substitutes.

What’s next?  Do they expect the Senate dog to eat the paperwork, too?

Brown supporters have pointed out that the House had no problem rushing Niki Tsongas into her seat after a special election win.  Democrats needed Tsongas to override a veto, and so allowed her to take the oath of office with a statement from Deval Patrick and William Galvin that she had “appeared” to win the election.  However, CQ notes that the Senate and House have different rules — and that Republicans demanded that Harry Reid wait to seat Al Franken until he had received the proper certification, which he did.  That seems to be the clearer precedent, and is certainly a fair point — assuming Massachusetts doesn’t delay certification.

It will take about 15 days at the longest for certification to occur, especially if the margin of victory makes recounts or challenges moot.  First, let’s see if Brown wins, and the margin of victory if he does.  Anything above two points would mean certification should be a pro forma exercise, and an inauguration ceremony just as routine.  The excuse-making has become rather pathetic.

If Brown wins by a large enough margin, it won’t matter that much when the Democrats seat him. Various “Blue Dog” Democrats will peel off from the bill. His vote may not be needed.

First, let us hope that Brown wins. If it is a close election, then it opens up the possibility of Brown getting “Frankened”. Second, let us hope that the Brown victory is of sufficient margin so that recount machinations don’t even come into effect.

Even if Brown cannot be seated until certified, there are genuine questions about whether Kirk can continue to serve in the meantime, especially given the language of the Massachusetts state legislation that put him there.

(Or, if one is to continue the Coleman/Franken comparison, did the incumbent — Coleman — retain his seat until the election was decided?)

Coleman’s term ended on 12/31/08. After that, Minnesota only had one Senator pending the recount. I think Harry changed the locks on the Coleman office door on 1/1/09.

I need to learn more, but seems to me that MN and MA races are not comparable – unless the MA race is close. Then there needs to be a re-count before certification, which was called for in MN almost immediately, due to the close results.

Has MA ever had this type of thing happen before? When Kennedy was ill, no one took his place…..prior to him, perhaps (47 years ago)? What about the other senate seat in MA? What do the MA laws state? I know that the Republicans have already declared that it is unconstitutional to hold off on seating the winner. Also, once there is a clear winner and he/she is proven qualified, Kirk loses his temporary seat. Period.

Certification should NOT take 15 days, if the race is not close.

Don’t fall for the spin!

By precedent accepted in 1938, Kirk is out today; his term expired once the election was held.

Brown cannot be seated until the election is certified according to Senate rules.

Those are two separate procedures. Reid is trying to confuse them.

There is nothing impossible about a federal office remaining vacant. It has happened every time a President has died in office–there is no President until the Vice-President takes the oath.

I have a question, if the vote is close and there is a delay in certification…that does not mean Kirk can vote..right? It took awhile to get Franken seated, but the Democrats were short until he was seated. So even if they jerk Brown around, Kirk is out. Is that true?

A Massachusetts law says that Kirk’s tenure expires today when the special election is over. In Minnesota, the incumbent Coleman’s term expired on January 3, 2009. The seat was vacant until a winner was determined and certified, which was well after that. In a close special election in Massachusetts, that would also be true.

When a seat is still vacant, no one can vote until a winner is certified. But Kirk’s last day to vote on anything is today.
