WaPo: TSA nominee misled Congress, violated security protocols

After the EunuchBomber attack fizzled on Christmas Day, both Republicans and Democrats wasted no time in pointing fingers, primarily battling over the Department of Homeland Security, even though DHS had little if anything to do with the security issues involved in that attempt.  Republicans called for the resignation of Janet Napolitano after her ridiculous insistence two days later that “the system worked.”  Democrats blamed the attack on Senator Jim DeMint for placing a hold on Barack Obama’s nominee to head TSA, Erroll Southers, even though Obama hadn’t even bothered to nominate Southers until late September, and TSA had nothing to do with the decision to allow Umar Abdulmutallab onto the Northwest flight he attempted to destroy.

Yesterday, the Washington Post reported that DeMint may have done everyone a favor anyway.  According to documents obtained by reporter Robert O’Harrow, Southers misled Congress about an incident in which he violated privacy laws to investigate his wife’s lover:

The White House nominee to lead the Transportation Security Administration gave Congress misleading information about incidents in which he inappropriately accessed a federal database, possibly in violation of privacy laws, documents obtained by The Washington Post show.

The disclosure comes as pressure builds from Democrats on Capitol Hill for quick January confirmation of Erroll Southers, whose nomination has been held up by GOP opponents. In the aftermath of an attempted airline bombing on Christmas Day, calls have intensified for lawmakers to install permanent leadership at the TSA, a critical agency in enforcing airline security.

Southers, a former FBI agent, has described inconsistencies in his accounts to Congress as “inadvertent” and the result of poor memory of an incident that dates back 20 years. He said in a Nov. 20 letter to key senators obtained by The Post that he had accepted full responsibility long ago for a “grave error in judgment” in accessing confidential criminal records about his then-estranged wife’s new boyfriend.

When testifying to Congress, Southers said that it had only happened once, when he asked a friend to check out the man’s criminal background at the San Diego PD.  After his testimony, Southers wrote to Joe Lieberman and admitted that he had himself twice checked the database.  He also copied the records and handed them off to his friend at the SDPD, apparently hoping to have the wife’s lover harrassed.

There are two problems with this, both of them serious.  First, TSA has access to serious, sensitive information that is far more open to abuse than the records at the SDPD.  Putting Southers in charge of that would be akin to putting a tax evader in charge of the IRS (or Treasury, for that matter).  Second, if Southers cannot give honest testimony the first time in front of Congress about an incident from twenty years ago, what confidence can we have that Southers will tell the truth when things go wrong at TSA under his watch?

Obama needs to find another nominee for TSA, and fast.  DeMint needs to maintain his hold on Southers until the White House replaces him.

this is a huge story. the public is really scared about security nwo, and not tolerant of lying ass coverers like this guy.

the southers LIE to Congress was that he had someone else check for him, and it was only one time. the TRUTH, which he admitted right after he got thru the committee vote, was that southers PERSONALLY ran info checks on the new boyfriend TWICE, AND printed out stuff, handed it out to his buddy cops to hassle the guy. southers claims he “forgot” that he personally did the checking

we’re talking three total felonies here:

2 felonies for accessing the info for unlawful nonofficial purpose
1 felony (at least) for perjury before congress.

this perjury case is actual cut and dried. southers admits he personally did the illegal accessing over a two year period in 87-88 now. in his testimony, he said he only asked a buddy to do it for him, and answered this question this way – there is no way this isnt perjury straight up, he was trying to cover up the extent of his illegal activities, no doubt.

here’s a quote of explicit perjury by southers, and hsi affidavdit was also perjurous

“If you’re confirmed, you’re going to have the access to databases that have personal information on many, many individuals, such as through the secure flight program, and it’s going to be important for the public to have confidence that you would not, in any way, misuse your access to the personal information in those databases. So, let me first ask you: Have you ever in the past misused your access to databases that the government maintains, other than this one incident that led to this censure?”

“No, Senator, I have not,” Southers replied.

This incident ENDED Southers’ FBI Career – how can ANYONE claim he would “forget” that he accessed FBI computers twice personally, as that is what led to his resignation?

Jim DeMint (R-S.C.) has blocked for the past four months over worries about TSA employees being able to unionize. Reid will file a cloture motion to overcome DeMint’s block.

If DeMint had a hold on this nomination, how did it get out of committee? How is Dingy Harry able to schedule a vote later this month if a senator objects and places a hold? Obviously, I misunderstand the definition and meaning of a hold. sigh.
It is obviously a different kind of hold (it’s a republican hold, not a democrat hold) like those that were placed by democrats on various Bush appointees to the courts (I speak of Janice Rogers Brown and Miguel Estrada) that prevented any further action on said nominees.

How is this reasoning at all logical? Using this logic, as long as an individual admits his/her previous crimes, s/he is therefore suitable to head a federal agency. Barry’s perverse logic must be contagious, because more and more members of congress are infected with it.

Here is what gets me –

I have a security clearance. If I EVER had that “error in judgement” not only would I loose my job, but I would NEVER have a security clearance again… EVER!

It is one thing to make a mistake as it is possible, but to initiator of an action such as this? Security concerns are NOT what they were 20 years ago. Every day that progresses, this continues to be the worst presidency in US history!

I’ll be the first to admit that when it comes to national security, I want people who have the stomach for waterboarding, profiling, or worse, to get to the bottom of something. But this guy is a stalker. And he’s re-lived this experience every day of his life for the past 20 years. As far as he’s concerned, it happened yesterday. It’s one of his most vivid life experiences.

Kind of reminds me of another guy who couldn’t recall 20 years of another experience–Obama (“attended regularly, every week, 11 am service”) and Wright.

This guy Southers will be a complete and total disaster.

The TSA is nothing short of an SS arm of the Federal Government as it stands now. They are responsible to no one and report directly up the Executive Branch.

They have constantly overreached their authority time and time again by issuing unconstitutional “Security Directives” that can be implemented immediately with no legislative approval (not that it would matter anyhow now).

However, it has ALWAYS been the precedent in matters of FAA mandates to issue an NPRM (Notice of Proposed Rulemaking) allow a comment period for insiders that are fully aware of tthe consequences of enacting proposed legislation and then tempering any NPRM into a final rule.

Not so now with the TSA! They can do anything they want under the guise of “security” and by-pass everyone in order to further their agendam justify their existence and further trample on our freedoms and liberties.

Just imagine how bad it will become once these worthless TSA slugs are unionized! This madness has got to stop.

The mask is off these Marxist bastards. The camel’s nose in under the tent and they will cripple our individual freedoms until we have none left.

These incidents of running police file checks occurred in California. California law is very clear on such abuses by law enforcement personnel. If you access the databases without a direct law enforcement reason you must be fired. No ifs, ands, or buts. And if your supervisor doesn’t fire you, he/she must be fired also….no discretion is allowed.

1. The issue is Southers lying explicitly in testimony to Congress. If, as you say, its okay to excuse his two felonies in accessing the databases personally, and probable felony in disseminating the info to his cop buddies to hassle the boyfriend, then how can you also defend his claim to “forget” that he did it?
Seriously? He “forgot” what got him fired (allowed to resign officially)?

2. The ONLY reason Southers admitted to lying to Congress is the documents that were delivered to the committee by the FBI regarding teh investigation which lead to his resignation from the FBI. The docs clearly showed that Southers personally did the searches, twice, over 1987-88 AND distributed printed info from those searches. Dem members of the committee gave OBama the heads-up that the documents contradicted Southers testimony, so he issued the letter “correction” … You really want a guy like that in chrage of US security at airports? Really?

Only a blind partisan who is drunk on Obama Koolaid could ever support this nominee Southers, who committed three felonies in 1987-1988 (two illegal uses of federal databases, one (or more) for distribution of documents from illegal searches) and at least two felonies in 2009 (affidavit claiming he did not personally search the database submitted to Congress = perjury, and his testimony to Collins also perjury)

here’s a quote of explicit perjury by southers, and hsi affidavdit was also perjurous

“If you’re confirmed, you’re going to have the access to databases that have personal information on many, many individuals, such as through the secure flight program, and it’s going to be important for the public to have confidence that you would not, in any way, misuse your access to the personal information in those databases. So, let me first ask you: Have you ever in the past misused your access to databases that the government maintains, other than this one incident that led to this censure?”

“No, Senator, I have not,” Southers replied.

This incident ENDED Southers’ FBI Career – how can ANYONE claim he would “forget” that he accessed FBI computers twice personally, as that is what led to his resignation?

waPo treated McDonald in Va. during the governor’s race? They printed his twenty year old graduate thesis, which contained opinions that feminism and working women were harmful to the family, over and over again pointing out how bad it was. They rehashed it just before the election for it to be as much of a negative influence as possible. He broke no laws! Lets see if the WaPo does the same thing to Souther and he broke the law. Also, is this the BEST person for this highly sensitive job? Can it be because he is not like all of the other men on the US money?

1. Violations of the federal privacy act are felonies. Southers committed at least two he admitted to in the letter sent AFTER his committee vote, and perhaps several more in disseminating the info, also a felony

2. Perjury is a felony. Southers committed perjury by LYING TO CONGRESS and saying in an affidavit that he ordered a third party to access the database once adn that was his only wrongdoing, when in REALITY, there was no third party (Southers just invented this as a cover story) and Southers himself accessed the database AT LEAST TWICE AND distributed the printouts to cop friends to hassle the ex wife’s boyfriend.

What happens the next tiem this Southers asshole gets a girlfriend who dumps him? Does the new bf of his ex get a body cavity search? What if Southers doesnt like some Repuoblican politician? Does he end up in custody of the TSA for a few days?

Where does it end when felonies are excused by an Administration nominee for a security position?

This country is going to Hell in a handbasket, and people like palinforamerica are cheering. Sad.
