Video: DeMint objects to supermajority protection in Reid’s ObamaCare bill

At first, Senator Jim DeMint starts off with a few points of parliamentary inquiry which seem rather dull, but like any good prosecutor, DeMint is carefully building a case — and his target is a particularly noxious clause in Harry Reid’s ObamaCare bill. On page 1020 of the text, DeMint discovers that Reid has created a rule binding future sessions of Congress to a supermajority requirement to overrule the bill’s rationing board, the Independent Medical Advisory Board, whose purpose (stated on page 1001) is to “reduce the per capita rate of growth in Medicare spending.” DeMint demands an explanation of how the Majority Leader can allow legislation to alter the rules of the Senate, both on the floor and in committee. The Weekly Standard has the key portion of the transcript:

There ‘s one provision that I found particularly troubling and it’s under section C, titled “Limitations on changes to this subsection.”

And I quote — “It shall not be in order in the Senate or the House of Representatives to consider any bill, resolution, amendment, or conference report that would repeal or otherwise change this subsection.”

This is not legislation. It’s not law. This is a rule change. It’s a pretty big deal. We will be passing a new law and at the same time creating a Senate rule that makes it out of order to amend or even repeal the law.

I’m not even sure that it’s constitutional, but if it is, it most certainly is a Senate rule. I don’t see why the majority party wouldn’t put this in every bill. If you like your law, you most certainly would want it to have force for future Senates.

I mean, we want to bind future Congresses. This goes to the fundamental purpose of Senate rules: to prevent a tyrannical majority from trampling the rights of the minority or of future Congresses.

As I recall, Congress is not allowed to pass rules that bind future Congresses. In the House, the rules have to be offered and approved at the beginning of each session. The Senate has standing rules, but they are not in the form of law that requires further legislation to alter — legislation that would be, under this bill, out of order even to introduce. It basically makes Harry Reid the dictator of the Senate, not just now, but in perpetuity.

Is it unconstitutional? The ability of each Congress to govern itself is certainly strongly implied in Article I, Section 5:

Each House may determine the Rules of its Proceedings, punish its Members for disorderly Behavior, and, with the Concurrence of two-thirds, expel a Member.

Clearly the founders did not intend that to mean that the first Congress could set the rules in perpetuity, and indeed as DeMint points out, rule changes have been made consistently without resorting to legislation to accomplish them because of the orders of a prior Congress. Put another way, the elected representatives of today should not have greater authority than those who will follow them. Any attempt to pass this into legislation aggrandizes the power of this Congress at the expense of those that follow.

And as DeMint points out, it sets a very dangerous precedent regardless of which party is in power. What will be next — a Republican Congress declaring any future bill that increases taxes out of order? Would Democrats sit still for that, too?

I told people about this IMAB provision months ago. This is Peter Orszag’s baby. I haven’t had time to read the actual legislation yet to see how close it is to Orszag’s vision, but I’m guessing it’s pretty close. Here is the key section from a letter Orszag sent to nancy Pelosi last August:

This proposed legislation would require the President to approve or disapprove each set of the IMAC’s recommendations as a package. If the President accepts the IMAC’s recommendations, Congress would then have 30 days to intervene with a joint resolution before the Secretary of Health and Human Services is authorized to implement them. If either the President disapproves the recommendations of the IMAC or Congress passes such a joint resolution, the recommendations would be null and void, and current law would remain in effect. The review process would permit intervention if the IMAC’s reforms are not in keeping with the goals of Congress or the President, while retaining autonomy for implementing annual payment updates and other Medicare reforms for the IMAC.

This means that an entire set of recommendations by the IMAB would have to be rejected by Congress or else they would take effect automatically. A future Congress would be given only 30 days to look at what could be a dense, 800-page report full of clinical language about treatments, drugs, procedures, and the like – with special deals sprinkled throughout for key Senators and Congressmen to spare their elderly constituents from the deadly impact of the cuts and denials. Congress would also have to come up with money – possibly very large amounts of it, too – to make up for the “savings” that the IMAB’s report would provide for Medicare.

It’s a huge bailout for future Congresses and Presidents to pass the buck on draconian cuts in Medicare so they don’t ever have to vote for an individual cut ever again. And now Harry Reid is trying to up the ante by requiring 67 votes to reject the IMAB recommendations.

I’m only 14 years away from being eligible for Medicare, and I have four siblings who are older than me, one of whom just turned 65. I am terrified of what this unelected and unaccountable IMAB will do to my health care in the future. If this bill is passed as is and signed by Barack Obama, it is nothing less than an early death sentence for me, my siblinhgs, and the entire Baby Boom generation.

No more than $400 typically but I would highly recommend you go to a local shooting store/range and try some different options. When you’re spending this money make sure your comfortable and then become well practiced. Also don’t just look at price, look at relabiliity because sometimes the extra money is just worth it. Don’t forgot to get extra mag’s and plenty of ammo.

Just remember that Guns are like golf clubs, they all have different purposes and uses. For long range engagements you need an accurate rifle like an AR or an AK.

CQB necessitates shorter barreled and more compact weapons – shotguns and such – maybe a Mossberg 500, etc.

Finally there are personal side arms – handguns.

Point is, you actually need more than one type, and it would be best to have a plurality of each – one for use and one for “Stowage”.

Baldilocks linked a good article on this. The gist is that politicians usually straddle the fence, ride the breeze and avoid ticking off voters (for the most part). When they DO do something that it seems nobody wants, they usually have info that no one else has (I would think some sort of classified intelligence would be an example).

If Reid can do this, can he also draft legislation that limits the ability of voters to eject incumbents???

Arson would not look so tempting right now if I could be sure that the Supreme Court would surely overturn stuff like this that is flagrantly, obviously unconstitutional. Didn’t Bush expect that surely the Supreme Court would overturn McCain-Feingold?

We need a Plan B in case 2010 does not turn out as we expect.

Baldilocks linked a good article on this. The gist is that politicians usually straddle the fence, ride the breeze and avoid ticking off voters (for the most part). When they DO do something that it seems nobody wants, they usually have info that no one else has (I would think some sort of classified intelligence would be an example).

I’d say the questions the article raises can be answered easily enough by the GOP being a bit scared of criticizing The One, not having a razor sharp ability with tactics, and hoping/thinking that if this does past the Democrats will pay for it severely in the next elections. As for the liberals who are supporting it as such a possibly high cost, they see it as their best chance in decades to get their dream.

I’m only 14 years away from being eligible for Medicare, and I have four siblings who are older than me, one of whom just turned 65. I am terrified of what this unelected and unaccountable IMAB will do to my health care in the future. If this bill is passed as is and signed by Barack Obama, it is nothing less than an early death sentence for me, my siblinhgs, and the entire Baby Boom generation.

This is what I have been worried about for months, well one thing.

For those of us who are approaching that age it’s terrifying but not unexpected. Of course, they will “save” money with this legislation. They will simply let people die. You are right in saying that it is an early death sentence. I fully expect that should I need an expensive procedure I will be denied.

I’ve tried to explain this to others my age, but they simply don’t believe it.

My Dad is 63 with heart disease and my Mom just turned 60. The ability to do a test without having to ask the government has saved my Dad’s life several times.

I’m terrified if this passes that they will be deemed “unworthy” to live.

Sir, hadn’t you heard? Death Panels were noted as the lie of the year by Politifact. Such an untruth that the very provision Sarah referred to had to be excised from the House bill. /sarc.

We do indeed live in interesting times when a provision 1,000 pages into a Senate bill, be it a rule or procedure, presumes to supersede the plain language of the Constitution.

If I were a Republican Senator, I would not show my face in the Senate Chamber during these votes. Rather, I would have my mug in front of every camera and microphone proclaiming that part of my oath of office was to protect and defend the Constitution against domestic enemies, too. For me, it would be insufficient to simply vote no. I would not be party to the entire process.

While I am at it, Scott Brown needs your help in Massachusetts to win Ted Kennedy’s seat. He can do it – his opponent is weak. Do what you can.

I don’t know you and don’t want to be rude, but it’s that type of thinking that allows the government to slowly take over. These things have to be vehemently opposed at the time they are taking place. If we fail, we go to the next step. It’s onlyy when all other steps are exhausted that the 2nd amendment takes over.

The problem is that Obama will have made our citizens in the military dependent on him and they will follow his orders explicitly. He will accomplish this by making it impossible for patriots to stomach serving under him and the only people that will serve will be guys like this.

Hell, Beck has already told a relative to not reup under Obama. Well, what kind of turd will take his place under the Obama plan? People who thirst for power and will kill their fellow American irrespective of right and wrong. You put those types behind the controls of an A1 Abrams or an F16 and I don’t care what weapons you have, you will lose. And you can’t expect any help from your lazy f**kwad neighbor because he isn’t involved now! He will sit back and accept the yoke of tyranny as long as he has a morsel of food on his plate. I suspect there will be a vast population of religious folks who will lay down for this and leave it to God. I hate to say it, but our only hope for survival from Americans might be from the secularists and atheists.

I’m beginning to think that maybe they are pushing us to take up arms so then they can have a reason to truly take our guns away.
