More poll fun: 64% oppose super-president’s decision to close Gitmo

posted at 9:32 pm on December 16, 2009 by Allahpundit

65 percent opposed it six months ago, so hey — he’s making progress. Look past the pure schadenfreude of this one, though, and you’ll see the potential political issue that’s looming. Unless I’m mistaken, The One still needs Congress to fully lift the ban on transferring Gitmo detainees to the U.S. They’ve already lifted it with respect to detainees, like KSM, who are on their way here to stand trial. What about those who are being sent to Illinois for indefinite detention without trial, though? Given the political climate these days and the objections civil libertarians will have, I wonder how interesting this could get in the Senate if polls like this start trickling in.

Since we’re talking polls (again), have a look-see at the comparative job approval numbers for Obama, Hillary, Gates, and um, Robert Gibbs. 51/45 for The One versus 50/33 for his belligerent, oafish press secretary? This is the same guy who, on a day when NBC was teasing a poll showing more people now prefer the status quo to ObamaCare, stood up at the press briefing and said, “I don’t think any rational person would say killing a bill is better at this point.” Granted, the bar is infinitely lower for a mouthpiece than for the C-in-C, but really, America? Obama’s doing worse than someone who wracked his brain and simply couldn’t recall any Bush/Hitler comparisons over the past eight years? This really is Waterloo.

Just thinking, but could this be a move just so groups like the ACLU will have cause to get the indefinite detention undone? I mean, once they are on American soil things will change legally. This could be part of the plan from the far left, not because they really want terrorists let go, but because they think these detainees aren’t terrorists who were part of an act of war, and should have the same rights as a common criminal in America.

Obama’s doing worse than someone who wracked his brain and simply couldn’t recall any Bush/Hitler comparisons over the past eight years?

Part of the reason I let Gibbs slide (and would rate him higher than Obama) is because his job is all about misinformation. I know that every day he must wake up and think, how will I lie today? and that’s fine, it’s why Obama put him there. Is he doing his pathetic job correctly, yep.

OTOH Obama’s job is be a good president. At this, he’s failing.

A handful of jihadists enter a rural Illinois town, take over a school and we have an American Bezlan…and the jihadis demand the immediate release of their fellow jihadis from Gitmo-North.

OK, Mr. President…voting “present” won’t work this time.

A handful of ACLU lawyers enter a federal court in Illinois, and demand the immediate release of all jihadis from Gitmo-North, on solid legal and Constitutional principles.

OK, Mr. President…what now?

This move by the Obama Administration to remove the jihadis from the Guantanamo detention facilities and re-locate them to Illinois is not going to end well…for anyone…except for the jihadis.

[Side note: Once the detention facilities in Gitmo are closed, and Gitmo is finally BRAC'd, will Obama return Gitmo to Cuban sovereignty to placate his Leftist friends in Latin America? He made such a mess over that minor Honduran thingie...he needs to make amends somewhere.]

Techically, they are

not

prisoners of war.

Explicitly described in the Geneva Conventions.

They are bandits, brigands, saboteurs, terrorists.

Technically, they are entitled to two things….they choice of a blindfold and the choice of a cigarette before summary execution is completed. The entire reason why Gitmo was chosen goes back to Johnson v Eisentrager [USSC 1950] that held that foreign combatants not of a national army engaged in hostile acts upon US forces overseas and captured overseas are not entitled to access to American courts nor the American judicial system, and cannot be brought to US soil.

Once any of these clowns arrives in the US two things happen. The first, they are under our present Constitution entitled to full access to the US judicial system as landed immigrants. Second, since the US government was responsible for their arrival on US soil, the US government is totally responsible for all their needs for the entire time they are within the US, and in certain cases, afterward. And, to add another, if released under a writ of habeas corpus, they cannot be deported from the United States without a full and complete judicial review of their status, a lengthy process at times taking several years.

Dr K is a brilliant man. He knows, even as some of us with lesser intellects know, that the abomination will pass.

Neither Osama Obama, Harry Reid or Nancy Pelosi give a flaming rat’s hindquarters what Americans think. I’m coming to the conclusion that they have something in mind for 2010 that will seal the deal for their continued power.

A few years ago, Porkulus, a president bowing to terrorists and throwing away our ability to defend ourselves and the nationalization of major U.S. companies would have been considered tinfoil-hat stuff. Guess what? All those things have happened.

And I don’t think the traitorous thugs in D.C. are through with us. Not by a long shot.

MrScribbler on December 16, 2009 at 10:54 PM

Holger on December 16, 2009 at 10:17 PM

POW status conveys certain guaranteed legal protections as well as certain rights, all a matter of recognized law.

Enemy combatant, terrorist, brigand, bandit, saboteur…none of these are offered nor owed any legal protections nor rights under Geneva.

Yes, they were scarfed up during military operations, war, but to even use the term Prisoner of War when talking about the detainees lends to the myth that they are, somehow, POW’s and thus, entitled under law to a panoply of guarantees and protections and rights.

Semantics? Legalisms? Neither.

Jihadis who have committed acts on US soil are to be adjudicated under our federal courts systems with all rights and protections implied or explicitly detailed as a matter of law. Hence, no jihadis captured on US soil has been sent to Gitmo, but reside instead in whatever appropriate federal facility stateside. That a few have ended up in a naval brig has muddied that necessary separation, but as a matter of expediency and protection of the populace as a whole, in certain cases naval brigs have been chosen. The dirty bomber guy, Padilla, I seem to recall, is in a naval detention facility.

Bottom line, if Obama believes that sending all or a select few from Gitmo to Illinois is going to stop a presumed “recruiting tool” for jihad, he is dead wrong. AQ and others were recruiting long before Gitmo became a common household name. If Obama believes that he, as president, can hold jihadis or presumed jihadis indefinitely in a stateside detention facility without there being serious legal issues raised, and serious Constitutional issues inviting challenge, he is, again, dead wrong. If a president can hold jihadis in a federal facility without federal charges and arraignment, and without benefit of the full scope of legal rights afforded all US persons, then what is to prevent a President, any President, from this point forward from detaining US persons, US citizens, indefinitely in federal facilities in the future?

And, Obama has offered the jihadis a an open and little protected venue for future actions within the United States. Be it a classic prison break, or a Bezlan-like scenario, rural Illinois is now a target set for jihad.

In his zeal to close Gitmo, Obama has opened a can of worms that will be with us long after he is gone from Office.

I totally agree with you here. There is no way this is going to end well for the American people. In fact, this is a win for the jihadis. The sad thing about it is, obama knows this, knows that it’s bad for America, and that is precisely why he is doing it. Never let a good crisis go to waste! Socializing the economy, bringing capitalism to it’s knees, wrecking the pillars of our foundations and rebuilding some third world country in it’s place. That’s what Obama is all about. Those who fail to see that are either extremely naive, or are in on it. My 2 cents.

Careful, honey. I found a pic of you.

With so little support for this why does he feel it is so important. Gitmo is really a non issue to most Americans.

Are we to believe that when the prisoners are moved to Illinois the Taliban will just say,”Well okay then, we won’t kill you anymore and by the way, it’s okay for little girls to go to school since the prisoners are in Illinois and all!

Obama is insane.

petunia on December 17, 2009 at 12:40 AM

probably doesn’t help that the sleepy ole terrorist prison site is less than 25 miles from a nuclear power plant

tarpon on December 16, 2009 at 11:00 PM

Now there’s something I wish I didn’t know!

petunia on December 17, 2009 at 12:42 AM

Chucky Schumer should be sent to Gitmo immediately, since he is a threat to airline safety.

Really Right on December 17, 2009 at 12:44 AM

As we all know Gitmo was a recruiting tool for al Qaeda propaganda tool for the Democrats.

Basilsbest on December 16, 2009 at 10:50 PM

Yeah I seriously doubt that if the American Left had not seized the issues Al Qaeda would have thought about it for more than a month. They knew it hurt American moral that is why it became a issue for them.

America’s worst enemies are now in the Whitehouse.

Just wait and see; the UNIONS will build the buildings, cook the food, laundry service, hospice care…it’s the first step to having unions in our military!

TN Mom on December 16, 2009 at 11:42 PM

Heck, I wouldn’t be surprised if some deal were to be worked out so that SEIU was the union for the guards. How wonderful it would be to know that the people in charge of keeping these animals locked in their cages couldn’t get a job with the TSA.

By the way, if Obama is intent on filling empty prisons with Gitmo detainees, where is he gonna put all the people who don’t buy health insurance?

Left Coast Right Mind on December 17, 2009 at 1:31 AM

To the extent that Gitmo is a recruiting tool, it is the Democrats’ fault.

Imagine all of the civilians within the judicial system and connected to this dibacle that will now be marked for death over the next 10 or more years. This is a horrible decision and will take decades to discover the full and yet unknown affects.

Youngs98 on December 17, 2009 at 6:41 AM

Robert Gibbs is the result of Obama reaching out to the brain-dead demographic and hiring University of South Carolina graduates.

Previously, Gibbs was valet parking cars at the Mustang Ranch in Vegas, which was his entree into the political world.

At U South Carolina, he was the second-place Homecoming Float named “Porky Pig”, sponsored by Johnsonville Sausage.

He is looking forward to his first date sometime soon.

Should “Obamaturism” be renamed B+?

marklmail on December 17, 2009 at 8:13 AM

I’d be so disappointed to hear if Dr. Krauthammer is still “Oh, they’ll pass it anyway.”

Marcus on December 16, 2009 at 9:35 PM

He says that every night, or rather he pronounces it, as if he had read it chiseled in stone somewhere.

Charles is a DC insider. He gives the insider’s view, and cannot fathom that people on the outside can make a difference.

And don’t forget, Dr. K thinks nat’l health ins. is a “moral imperative,” so there is at least a little bit of advocacy in his insider’s pronouncements.

Buy popcorn, kids.

And all the upcoming televised trails will NOT be a recruiting tool?

And there is a nine hundred pound gorilla in the room which the most have forgotten about but left is quietly giggling about, and nobody is talking about:

I think people are a lot more practical and commonsense than the politicians realize.

People wanted the shady CIA junk to stop at GITMO. That embarassed a lot of people.

But GITMO cleaned up its act, and the storm has passed. Now, it doesn’t make sense to spend millions in IL when we have GITMO.

Oh well, maybe this is a case where money will flow into IL for jobs, etc. That’s worth something.

Emergency – I’m out of popcorn. Help.

Worth something?

This will be gold for the WH — or that is what they hope.

They haven’t had a half dozen goups working on this for a year just for the sake of the ‘lil darlings we have locked up.

At a minimum, they have a nice, shiny object for the media to focus on. Which, compared to the real situation the country is in, is a good thing. As Martha Stewart might say.

They placate their base. (A single!)

They show the international left that The One deserved the NPP. (A double!)

They are hoping to put the Bush administration on trial. (A triple!)

They staunch the poll bleeding and hope that the Republicans fall flat while running to the ball. (An ‘in the park’ home run!)

Yea, but I don’t know anything about all this stuff. I am just guessing.

Any polls on what the Land of Lincoln residents think about Gitmo-Illinois?

conservative pilgrim on December 16, 2009 at 9:35 PM

I’m curious about this as well. Even my most lefty friends out here in Chicago think this will be a complete disaster.

As someone else mentioned, the Great Lakes Naval Base is not far from Thomson Correctional. Great Lakes is one of the largest Navy training spots.

Illinois also has 6 nuclear power plants, more than any other state.

Not to mention Sears Tower, Wrigley Field, Soldier Field, and a whole slew of other possible targets.

I can’t imagine any sane Illinois resident wanting the Gitmo detainees transfered here. I hardly think the couple hundred jobs it will bring to the area will be worth it.
