Homeowners association to let Medal of Honor recipient fly flag

A happy ending to one of our more heavily trafficked Headlines items today. The HOA objected to a 21-foot flagpole on his property, Jim Webb and Mark Warner ended up getting involved, and the issue eventually trickled all the way up to the White House press briefing. It was a thermonuclear PR nightmare, in other words. And now, at last, the nightmare is over:
A 90-year-old Medal of Honor recipient can keep his 21-foot flagpole in his front yard after a homeowner’s association dropped its request to remove it, a spokesman for Democratic Virginia Sen. Mark Warner said Tuesday.
The Sussex Square homeowners’ association likewise has agreed to drop threats to take legal action against retired Army Col. Van T. Barfoot, Warner spokesman Kevin Hall said.
The association had threatened to take Barfoot to court if he failed to remove the pole from his suburban Richmond home by Friday. It had said the pole violated the neighborhood’s aesthetic guidelines.
There’s a brief description of why he was awarded his MOH at the link, but I’m omitting it from the quote so that you’ll listen to Mark Levin’s retelling of it instead. Take seven minutes. You won’t be sorry.

Second Lieutenant Barfoot’s official Medal of Honor citation reads:
For conspicuous gallantry and intrepidity at the risk of life above and beyond the call of duty on 23 May 1944, near Carano, Italy. With his platoon heavily engaged during an assault against forces well entrenched on commanding ground, 2d Lt. Barfoot (then Tech. Sgt.) moved off alone upon the enemy left flank. He crawled to the proximity of 1 machinegun nest and made a direct hit on it with a hand grenade, killing 2 and wounding 3 Germans. He continued along the German defense line to another machinegun emplacement, and with his tommygun killed 2 and captured 3 soldiers. Members of another enemy machinegun crew then abandoned their position and gave themselves up to Sgt. Barfoot. Leaving the prisoners for his support squad to pick up, he proceeded to mop up positions in the immediate area, capturing more prisoners and bringing his total count to 17. Later that day, after he had reorganized his men and consolidated the newly captured ground, the enemy launched a fierce armored counterattack directly at his platoon positions. Securing a bazooka, Sgt. Barfoot took up an exposed position directly in front of 3 advancing Mark VI tanks. From a distance of 75 yards his first shot destroyed the track of the leading tank, effectively disabling it, while the other 2 changed direction toward the flank. As the crew of the disabled tank dismounted, Sgt. Barfoot killed 3 of them with his tommygun. He continued onward into enemy terrain and destroyed a recently abandoned German fieldpiece with a demolition charge placed in the breech. While returning to his platoon position, Sgt. Barfoot, though greatly fatigued by his Herculean efforts, assisted 2 of his seriously wounded men 1,700 yards to a position of safety. Sgt. Barfoot’s extraordinary heroism, demonstration of magnificent valor, and aggressive determination in the face of pointblank fire are a perpetual inspiration to his fellow soldiers.[7]

Sean Linnane’s blogspot Warbringer has been following this closely, and posted a copy of the letter sent by the HOA’s attorneys. They made the error of including an email address, which I’m sure resulted in a deluge of messages like mine:
Sirs:
You should hang your dreary heads in shame over harassing this great American in order to placate a bunch of unappreciative Yuppies.
Further, every member of your “community” should stand head bared at every ceremonial raising and lowering of this man’s flag, if only as a grossly inadequate gesture of gratitude and respect for all those that made their “lifestyle” possible.

Actually, a homeowner’s association could NOT have stopped Col. Barfoot from displaying his flag, display of the American Flag by anyone in POSSESSION of Residential Property is protected by the Freedom to Display the American Flag Act of 2005.

Here is some info that his MOH citation does not tell you.
(From the book Medal of Honor he is on page 16).
Later is his life Van Barfoot would be hailed as one of the most significant Native American heroes of WW2.
He took part in the landings at Sicily and Salerno and Anzio
In May of 1944 Barfoot’s unit was in a defensive position near Carano, during which Barfoot conducted day and night patrols to probe the German lines, mentally mapping out the terrain and minefields in front of the enemy positions.
On May 23rd his company was ordered to attack. As the lead squads approached the German minefields, they came under heavy fire. Because he knew the lanes through the minefields so well, Barfoot asked for permission to head a squad….
He was given the option the choice of returning to the States for the ceremony or receiving the medal in the field, he chose the latter so that his men could be present.
Lt General Alexander Patch awarded him the medal in Epinal France on Sept. 28th 1944.

I would be sorry as on my system it would be closer to seven hours.
But even sans that I do know this – If someone signs an agreement then they should keep it. I have never lived in a home subject to a homeowners associated and have no intention of doing so but if I did I would keep to the rules and would expect others to also.
We are suppose to be a nation of laws not men and as I understand it when you sign on to one of these things you have legally pledged to follow the homeowners association’s rules.

One of the reasons I was happy to leave Virginia.
Most of the developer driven planned communities are run by unimaginative anal retentive busybodies with too much time on their hands, and the tendency to get their jones on by being as snobbish and big a bunch of a-holes as possible, and intruding on as many of their neighbors lives as possible, about the most petty things they can come up with. A real estate transaction to buy a property in one of these communities usually has about three times the bulk of paperwork as one outside a HOA controlled area, with 2/3 of that mass being codicils, covenants, rules, addendums, and other underemployed lawyer generated bullshit thick enough to choke a water buffalo.
Control freaks gone wild. Good to see a bunch of them being told to go pound sand with a sledgehammer.

I once went to play golf on an Army base with some friends and a big-brass type came in the clubhouse (really big brass type) and complained that someone had parked in one of the designated-parking slots for the base bigwigs. The guy behind the counter told the brass-guy to go outside and check out the tags on the car. The brass-guy stormed out and came back in a few secs later and said nothing more.
He actually spoke softly and head his head a bit lower than before.
As us noncoms walked out to go to the first hole, I checked out the tags on the cars in the reserved-parking slots. Sure enough, one of them had Medal Of Honor tags.

MB4: Given that you have never liven in an HOA, you can not appreciate just how capricious and whimsical they can be. For example, our HOA guidelines state no one is to have a satellite dish as they are eyesores…you have to highlight and initial same in the bylaws at closing …but there are several in our neighborhood, most of whom are owned by members of our board who are sports fanatics…ergo, no “enforcement” ….it takes six-eight months for “approval” for even the most innocuous changes to your house……we live in HOA hell and cannot wait to move.
That being said, the man is a real life American HERO. I am glad that the HOA came to their senses. God Bless you, and Thank you, Col Barfoot!

That was very magnanimus of that HOA. But then again, maybe someone pointed out a law passed in 2006 that states that an HOA cannot prohibit a resident from displaying of the American flag.

I think the HOA’s position was with respect to the size of the flagpole, not the flying of the flag itself. We had the same issue here, and they forced the homeowner to take the flagpole down.
That being said, I think it speaks volumes about the tyranny of some HOA’s. This should never have reached the point it did….IMHO, the biggest issue is the lack of respect the HOA board showed to the good Col …. at what point do we not value these veterans the way they deserve to be valued and treated? This whole little spat has unearthed a side to our current culture that I don’t like very much.

That is why I am violating all sense of neighborly decorum when I reviewed the HOA by-laws and found that nothing prevented me from displaying a Gadsden flag (First flag of the USMC) from my house mounted flagpole (pics available on request).
If a neighbor complains then I will gladly remove it. If the HOA complains I will tell them to STFU nothing in your by-law prevent me from doing that.

I guess that depends on which historian you consult. Many consider the “Continental Colors” to have that honor.
The Gadsen flag and the Culpeper colors have both increased in popularity as political statements lately. My Marine prefers to fly the First Naval Jack in recognition of GWOT. Each to their own.

It’s already been noted but Col. Barfoot did not “win” a MOH (as if it were at the bottom of a ceral box or the grand prize in a raffle at the local VFW). He “received” a MOH for his actions. I know that this kind of nuance doesn’t bother some but it bugs the heck out of me. Both Ed and Allah in their own ways show ignorance when it comes to military matters which is often a weakness in their threads. I don’t understand why they don’t tap some of the talent on this site to offset their ignorance in these matters (just some constructive criticism from the Peanut Gallery).
That being said, I knew from the beginning the outcome of this story. The HOA is dead right on the law, including the fact that the covenants were in place before the Colonel moved into the neighborhood. BUT….. You simply don’t tell a 90-year-old MOH winner that you’re going to sue if he doesn’t cease and desist flying his American flag. This was more than a PR nightmare, it was the wrong thing to do since surely they could have reached a compromise that didn’t violate the asthetics of the neighborhood.
My personal approach would have been to throw in a covenant that allows MOH winners to have a flagpole in recognition of their service.

Even people who hate HOAs with a passion are quick to say they are necessary in the next breath. I’m not so sure I agree but that’s just me. I hate “communities” where unelected martinets get into a tizzy over paint colors, flag poles, and whether or not you have a boat parked in your driveway. I’d much rather live in a “neighborhood” where you have a mix of houses (as opposed to one of five models all from the same architect and in the same style) and along with that the understanding that pride of ownership not the local Nazi organization would determine things like whether or not one puts up a flagpole.
Best neighborhood I ever lived in was a 1930′s area in Michigan. Worst community I ever lived in was in Southern California where the HOA snuck peeks under the neighbor’s garage door to see if there was room to park a car (a covenant).

Maybe the 21 foot flag pole should have been allowed, but he did have an honor and duty to uphold his end of the contract.
They do have provisions that he can fly the flag, just not on a 21 foot flag pole.
That being said, if that happened in my Association, I would grant a temporary permit to allow because of his meritorious service…but not a wholesale changing of the CC&R’s, next thing you have an American flag flying upside down, or some other nonsense…

My dad would have been pleased Sgt. Barfoot won this battle too. He was a Sgt. as well and he had a flagpole in his front yard. Raised the flag every day. My dad was, and still is, my hero. Sgt. Barfoot is a hero once again, for all of us. HOA should be ashamed of themselves, glad they were embarrassed enough to back off.
