The chair of the House Armed Services Committee has sent a letter demanding the appearance of Attorney General Eric Holder to explain his decision to try Khalid Sheikh Mohammed and four co-conspirators in federal court.

Does Holder have to show?
donh525 on November 21, 2009 at 9:48 AM

Yes.
If Congress really cared (which the Dem members don't) they could solve this problem really easily. In the separation of powers, the founders gave Congress the power to determine what the courts could hear, i.e. the court's jurisdiction. A federal court can only hear what Congress allows it to hear. Therefor Congress could remove the power of the federal courts to even hear terrorist trials. Problem is the Dems would never do that.

[...] Ed Morrissey sums it up: This is the first significant public pushback from a Democratic Congressman, although some in the Senate expressed at least reservations during Holder’s appearance this week. It probably won’t be the last. After all, it was a Democratic Congress that passed the current military commissions system, working with a Republican President, to find a system that would get the blessing of the Supreme Court while maintaining security for our war efforts in intelligence. Without the Democrats in 2007, there would have been no military commissions system at all. That default would have forced KSM and everyone else at Gitmo into federal court eventually, an outcome that few wanted to see … at least in 2007. [...]

I agree this is a gutless ploy by Skelton. For God's sake, KSM already PLED GUILTY! There's no need for any trial. That ass Bush could have shot the son of a bitch and saved $75,000,000 any time over the last two or three years.

Regardless his "aggressive" questioning I think Graham's a horse's ass not to call Holder out. We've got Jayson Blair running the Dept. of Justice. I'm f'g sick of all this Miss Manners crap when you're facing off with lunatic, commie idiots. Bloody the bastards every time they speak. Lindsay should have laughed in his face. The guy didn't even check precedence on his case. He couldn't be a clerk in a decent law office. Holder was sweating bullets. I bet our gay little JAG could have got him shedding tears if he'd cut loose on him.

Speaking of trolls, P.J. Gladnick, who blogs at Newsbusters, also has a hilarious blog called DUmmie Funnies. He bravely wades into the Fever Swamps known as Democrat Underground, DailyKos and PuffHost so we don't have to soil ourselves, and has collected a great bunch of quotes from Kos Kidz re. the KSM trial:

http://dummiefunnies.blogspot.com/2009/11/kommies-hail-ksm-trialas-weapon-against.html

These trolls are absolutely ecstatic of the prospect of this turning into a show trial not of KSM, but a show trial of the evil Amerika and its former Hitlers, Bush and Cheney.

But of course, they "support the troops". In Kos' own words, "screw them".

I wondered why in just the last couple of days they started running ads about Skelton's ties to big oil and his vote against a clean energy bill that would "Make 38,000 Missouri jobs and save Missourians money" Kinda funny when they turn cannablistic.

Chicago Boyz has an interesting take on the KMS trial.

How Obama is Bringing Martial Law to America

The greatest danger posed in the trial of Khalid Sheikh Mohammed (KSM) isn’t that he will go free. The greatest danger is that he will be convicted and that during his appeals the courts will ratify all of the extraordinary measures used to capture and convict him. The great danger is that the courts will ratify the rough, inaccurate and ambiguous norms of martial law as applying to all civil criminal trials.

After a couple of decades of these court decisions reverberating throughout the legal system, we could end up living under de facto martial law.

Skelton, like many, cannot determine how Holder and Obama decided which went where, and implies that it seems arbitrary and not based on any legal considerations.

As much as I welcome any chance for Holder to get further scrutiny for this poor decision, nothing will come of it. Either it will be a sham of a hearing, or there will be no hearing at all. Congressional hearings are mostly worthless--the real work gets done behind the scenes out of the public eye. It is Congress, after all--why would they do any real work in public?

It seems like a few of the DemoRats are noticing that the ship is starting to sink. I believe that the clever ones will jump ship soon so maybe they could make it to shore by '10 or in some cases '12. The rats always know first when something's going wrong and wisdom dictates that we watch what the rats are doing. They know.

These are the people in the middle that Ayn Rand talked about. They're "good guys" but they are the ones who are bringing us the evils of socialism. Here's her full quote:

There are two sides to every issue: one side is right and the other is wrong, but the middle is always evil. The man who is wrong still retains some respect for truth, if only by accepting the responsibility of choice. But the man in the middle is the knave who blanks out the truth in order to pretend that no choice or values exist, who is willing to sit out the course of any battle, willing to cash in on the blood of the innocent or to crawl on his belly to the guilty, who dispenses justice by condemning both the robber and the robbed to jail, who solves conflicts by ordering the thinker and the fool to meet each other halfway. In any compromise between food and poison, it is only death that can win. In any compromise between good and evil, it is only evil that can profit. In that transfusion of blood which drains the good to feed the evil, the compromiser is the transmitting rubber tube . . .

When men reduce their virtues to the approximate, then evil acquires the force of an absolute, when loyalty to an unyielding purpose is dropped by the virtuous, it’s picked up by scoundrels—and you get the indecent spectacle of a cringing, bargaining, traitorous good and a self-righteously uncompromising evil
.

I know many people out there who can walk and chew gum at the same time. Though, for the time being, I question the timing of the KSM issue. Holder has stated boldly that it is time to address it. Boy, did he ever. Why all of sudden now? Holder's presentation was very poor. For all of his resources, he did not seem to be prepared to answer direct questions on his decision to try these men in a civilian court. One of the rules set forth for a lawyer is to know in advance the answers before the questions are asked. Holder was not ready to do that. Is this just another political distraction? Did the inner circle of people [Rahm, Axelrod & some DNC strategest Carville] in the Obama administration ask themselves "What is out there that would make the Republic's heads explode while we get this Health Care power grab accomplished?" "What can we manufacture that seems like a crisis?" "What can be done that will change the healines for the next news cycle "a headline grabber" while this legislation in the senate is going on?"

Is this all just a high stakes political manuever? Is Holder bluffing? Will Holder reverse his decision once the Health Care legislation has been accomplished? Is Holder just taking one for the team? The #1 priority of the Obama administration and the Democrat leadership is this Health Care legislation. They must have a win this year or the momentum will be lost.

Ed, and everybody else: Please get out of the habit of using the word “democratic” instead of “democrat”. There is nothing democratic about these goons. Please?

Well, a couple of things on Skelton. Hes always been an old-time Democrat, like Truman. His district is almost completely rural just outside of Kansas City, and has always been very good to the military, I know some who have personally had problems with military pay, etc, solved by a call from him.

And, he in for the hardest fight he's ever had in his long career of Congress. There are at least two Republicans, one of them very popular (forget the name) vying to challenge him.

This bit with the KSM trial is going 180 from the KC (Red) Star Editorial Board. Wonder if they'll endorse the other guy instead of him this time? (HAHAHAHAHAHA)

This is the first significant public pushback from a Democratic Congressman, although some in the Senate expressed at least reservations during Holder’s appearance this week.

Obama’s numbers are down and he needs to remind people why they voted for him by demonizing Bush again. He wants to appease the “Bush as war criminal” folks as well. Not even really about Bush – its still all about Obama. I wish he would find another way. This way is wrong.

As much as I miss the guy, the best thing Bush has been doing is laying low and out of the spotlight. The less people see of Bush now, the harder it is for Obama to blame him for all today's issues. Obama "owns" these unemployment numbers, terrorist issues, foreign policy screwups, gov't spending, etc.

Graham made Holder look bad, so this could possibly be trumped up between Skelton and this Administration. It works in two ways: 1)It gives Holder a chance to redeem himself after he has time to know the questions and be prepared this time, and 2)It makes Skelton look good to the majority of his constituents, since a majority of Americans don't like Holder's plan for a civilian trial. I smell a rat. . .
