Schumer, 2001: 9/11 terrorists won’t get courtroom trials

Kerry Picket at the Washington Times unearths this artifact from when Democrats considered a terrorist attack by a foreign cabal a little more important than a gangland shootout.  Ten weeks after the attack, Sen. Chuck Schumer insisted that the US had to have military tribunals for terrorists discovered and captured through intelligence assets rather than law-enforcement personnel, and for the same reasons that most people object to the Obama administration decision now:

There are also those prisoners of war who we have captured and will capture in Afghanistan and other countries who will receive a trial of some sort. It is clear we need to try those suspects in a forum that achieves two primary goals—two goals, I might add, that may not conflict. First, the Government must have the power to use even the most sensitive classified evidence against these suspects without compromising national security in any way, shape, or form. In addition, those who commit acts of war against the United States, particularly those who have no color of citizenship, don’t deserve the same panoply of due process rights that American citizens receive. Should Osama bin Laden be captured alive—and I imagine most Americans hope he won’t be captured alive. But if he is, it is ludicrous to suggest he should be tried in a Federal court on Center Street in Lower Manhattan.

Ludicrous?  Of course it is, just as it was almost eight years ago this week.  Yesterday, however, when challenged by the Washington Times, Schumer defends his flip-flop by saying that he wants the 9/11 plotters executed:

Schumer not only believes a 9/11 terrorist suspect like Khalid Shaikh Mohammed should be tried in a civil court six blocks from the ruins of Ground Zero, he also wants seventy-five million dollars a year reimbursement for the city New York, which he says would cover the costs of terror trial security.

Well, there are easier ways to get $75 million, especially for Senators who have no compunction about shoveling pork into home states, and Schumer more than qualifies for that. I can also allow for the possibility of a legitimate change of mind, but that requires some explanation. All Schumer offers, though, is a series of non-sequiturs.

For instance, when asked by the reporter why Schumer now backs criminal trials over military tribunals, Schumer says he wants to see them executed. But if that’s what Schumer wants, why didn’t he press Obama to allow Khalid Sheikh Mohammed to file his offered guilty plea in the tribunal? The military tribunal could have passed sentence immediately, and thanks to the streamlined appeals process, the execution may have taken place this year, and certainly no later than next year. We won’t even get to trial in 2010.

And the track record of trials for terrorists hasn’t exactly been a confidence builder for death-penalty sentences, either. The Blind Sheikh is doing life in Stillwater, Minnesota for leading the conspiracy to attack the World Trade Center in 1993, which killed six people. None of the defendants got a death sentence. Zacarias Moussaoui will also spend his life as a guest of the US after a jury failed to return a death sentence for his role as an al-Qaeda agent. The Department of Justice has an o-fer on executions.

So the questions Schumer has to answer are these: What has changed in eight years to transform KSM and his cohorts into people who do “deserve the same panoply of due process rights that American citizens receive”? And if Schumer wants them executed, why did he pick the least-likely and slowest manner in which to pursue that goal? Non-sequiturs such as “I wrote the death-penalty law” will mean that Schumer doesn’t have an answer for either.

Nothing changed as far as KSM. The Dems changed with Bush Derangement Syndrome, and are obsessed with publicizing as much as they can about interrogations so Bush and Cheney can be indicted by some country or the ICC as war criminals. Since they could never impeach Bush & Cheney, that would be the next best thing.

Similar goal with Rumsfeld, Yoo and Bybee. Rumsfeld is retired, but Yoo is a tenured law professor at Berkeley and Bybee is a federal appeals court judge appointed for life.

It’s not enough that the Dems won the election. They have to destroy the lives and reputations of the previous administration to satisfy the hard left that has become increasingly important in their party.

Yes, the money is probably one of the reasons, but as you say, it is most likely not the primary reason. As with any politician, they need the lime-light, and this trial in New York keeps him in that light. It keeps him in the media, in the papers, on the news…free publicity. He is up for re-election in 2010. And with his supporting Obamacare, he also needs to change the focus. What better than a year long trial (or longer) to keep people occupied.

Far, far be it from me to defend Schumer, but I heard recently that while the military does have people on death row, it has not executed anyone in a long, long time. So, there could be a germ of logic in this position however, I believe the military tribunal path would be easier to control and make far more sense from a legal standpoint.

A group of CIA agents has already been convicted in absentia in Italy for grabbing a man in a rendition and later turning him over to his Middle Eastern home country.

The agents were accused of abducting Hassan Mustafa Osama Nasr, known as Abu Omar, from Milan and sending him to Egypt, where he was allegedly tortured.

The trial, which began in June 2007, is the first involving the CIA’s so-called “extraordinary rendition” programme.

The Obama administration has expressed its disappointment at the convictions.

“We are disappointed by the verdicts,” state department spokesman Ian Kelly said in Washington.

He declined to comment further pending a written opinion from the judge, but said an appeal was likely.

Three Americans and five Italians were acquitted by the court in Milan.

The Americans were all tried in their absence as they have not been extradited from the US to Italy.

“For us, this first case puts the war on terror on trial,” said Joanne Mariner Human Rights Watch spokeswoman.

The CIA’s Milan station chief at the time, Robert Lady, was given an eight-year term, while the other 22 Americans convicted – one of them a US air force colonel – were sentenced to five years in prison.

Lawyers for the 23 Americans said they would appeal against their convictions.

The two Italian agents, who were convicted as accomplices to kidnapping, were given three-year prison terms.

The court also ruled that those convicted must pay 1m euros ($1.5m) in damages to Abu Omar and 500,000 euros to his wife.

If there is a treaty with Italy that allows collection of foreign judgments in the US, then the defendants could also have their assets frozen here to pay the fine.

AG Holder would set precedence: to revise the prosecution as a second defense having dismissed the terrorism charges against the defendants, and tainting all grounds for evidence into defense material. This international terrorist is going to a civil court where he will not be prosecuted, but doubly defended.

It really isn’t about the death penalty. It’s about the fact that the filthy lying coward has made the decision that these terrorists should enjoy all the protections of citizens. Put another way, KSM has all the same rights you have if you were to be put on trial. There is no reason for it and there is no consistency as to who gets civil trials and who is being tried by military tribunals. The USS Cole bomber gets a military tribunal while the guy who destroyed the Pentagon is going to NYC.

And beyond all that, where in NYC are you going to find impartaial jurors? Where in America will you find impartial jurors?

This administration doesn’t admit failure. The stimulus package is an unqualified success. Jobs are being created or saved in the hundreds of thousands. Healthcare reforem isn’t going to cost anybody any more than than they are paying now. Cash for Clunkers saved the environment…….

In short, the administration doesn’t have the humility to admit when they have made a mistake and they will move forward with these trials because they’ve already made the announcement.

Blathering on for the camera about a hypothetical situation is a lot different than real life, so perhaps Chuckie changed his mind once he actually thought things through — it has been eight years, some people do change their minds. He’s almost undoubtedly had some long conversations with Holder lately, and likely found the Attorney General of the Unites States persuasive.

Also: who cares? If anything you say can and will be held against you, why isn’t there a post about all the Republican Senators who completely recanted everything they said about how bad filibusters are, now that they’ve decided that their best re-elections strategy is simply to shut the Senate down?

Bill Bennett’s interviews confronting Holder’s prosecute-Bush/ACLU-”trust me” decision included Bill Krystol and Congressman Pete Hoekstra this morning.

As with all on yesterday’s Fred Thompson Show, EVERYONE unanimously agrees that Lindsey Graham roped Holder by the horns.

The Bennett bet is that Holder’s going to be forced to reconsider his death wish on America.

Obama failed to chest his cards on this gamble. This Obama/Holder determination to destroy our Judicial Branch will in turn destroy our entire nation’s self defense. And though Obama, Inc. hold at the moment the keys of authority, they do NOT have popular support, and they do NOT stand on the law. Rather, Obama is burning the law and fiddling in Asia while our nation burns as if he won’t get scorched.

Ironically, via his own decision, Holder has served his own head to America on a silver platter.

He must step down. He has lost ALL credibility. America will NOT swallow this, no matter how Obama serves it. And if Obama remains tied to Holder, Obama’s going to provide America with his own impeachment.

How are those NYC liberal progressives embracing their vote for CHANGE?! How does “We will NEVER forget” mesh with Obama’s “Quit complaining and get in line” antipathy for America expressed by his administration’s conspiracy to coerce a civil trial for the terrorist who masterminded and participated in the destruction of 9/11/01? Liberalism is a mental disorder. The NYC liberal voters bear the onus to right their ship and nip this ACLU travesty in the bud. They want closure, they’d better rope in and corral their own madmen and prevent their own loose canons from unleashing MORE evil.

Are $CHUMER’s days in office shortened or lengthened by his affinity for our tax funds in his pocket?

Again, this is NYC where money makes the world go around, where even if liberalism is a mental disorder, radicals are simply disturbed people who must be understood and forgiven because there are no crimes, just mistakes to bury in bribes, dust to dust.

The whole charade is absurd. Odinglenuts has basically said:

They will be given a fair trial, then executed.

What’s the point of a trial if there’s no possibility of acquittal? If his rationale is that “well, they’re guilty anyway, and will be found so, and sentenced to death”, what’s wrong with their guilty plea before a military tribunal?

Something stinks really, really badly, and I don’t think Americans like what is happening.

This just shows the weakness of Obama’s support on this. I think this could make him a one termer.

It is discouraging to have to support such stupid decisions and after a while it will be lip service to most on the left. The intensity that got him elected is already gone.

Even most of our trolls are not as intensively supportive as they once were.
