It’s the actions that were constitutionally questionable. I am not aware that simply interning the prisoners there was a violation.

Your statements seem inconsistent. First you seem to imply that the very existence of Gitmo facility is based on circumventing the Constitution, but then you seem ok with detaining people there indefinitely. Am I missing something other than an administration change?

Would you care to actually name the portion of the constitution, the section of US law, and the section of international law that was broken by holding prisoners of war in a prisoner of war camp?

The Miranda rights largely affect any confessions, they don’t make the whole arrest unconstitutional. But, since any KSM confessions that exist were likely the result of torture, they’re not admissible anyway.
