9/11 mom confronts Holder: Why are you doing this?
posted at 5:30 pm on November 18, 2009 by Allahpundit
One more KSM post before we move on to other business. A riveting exchange here, not because it’s contentious but because it isn’t: Our heroine very politely stresses that she doesn’t want her son’s murderers given a soapbox to rant and rave, and Holder very politely tells her to trust in the justice system and the secret evidence that’s going to bury KSM. Which, again, is super, but doesn’t solve the problem of setting legal precedents that’ll be used by lesser terrorists against whom no super-secret evidence exists.
Beyond that, I want you to watch this clip because the meme du jour on the left — trumpeted by Kos, natch, but also echoed by The One in defending Holder’s decision to try KSM in Manhattan — is that it’s “cowardly” to worry about the trial turning into a propaganda opportunity for Al Qaeda. Presumably this woman is an exemplar of that “cowardice.” Nutroots idiots have made a habit over the years of accusing righties of being gutless about terrorism, even though they’re the ones who wring their hands incessantly about “creating more terrorists” by, say, using drones in Pakistan or waterboarding the guy who planned 9/11. But it’s one thing for the nutroots to do it and another for the Attorney General to do it. An embarrassing footnote from this morning’s testimony via Andy McCarthy:
Holder: “I am not scared of KSM.” Submitting a war criminal to a military commission is not an exercise in fear; it is an exercise in justice. We already know all about what kind of animal KSM is, thanks to the exrtraordinary information that has come out in the military proceedings and the CIA interrogations. You could fill a book a book with it, which the 9/11 Commission did. We don’t need to bear the risks of a civilian trial either to learn more about KSM or so Mr. Holder can show how brave he is.
I doubt Holder or Obama cares about using the justice system to prove how “brave” they are, but the fact that the same guy who said “failure is not an option” while blathering about fair trials thought it was a smart enough point to be worth raising in congressional testimony tells you what kind of hands we’re in here. Exit question one: Are we to understand from the “cowardice” accusation that the left sees no threat at all posed by jihadist propaganda, especially in a forum as visible as a Manhattan “trial of the century”? No problem with jihadist websites, say, or jihadist cable news channels, maybe operating right here in the U.S.? Don’t be cowardly now. Exit question two: Hey, Holder — when do these guys get their trial? Click the image to watch.

This is true, and is widespread on the left. I had a long exchange with Lou Young (NY CBS guy) on Twitter, and he pounded on the “you guys on the right are soooo scared” meme.

Bush wanted to try these people in the same sort of system we used for the Nazis, but it was guys like Holder who jumped in the middle of it and dragged it out for years. The only reason they are going ahead now is that they think it is a political benefit to them.

It is my understanding that Holders law firm, of which he was a senior partner, handled a lot of terrorist cases. As their defense. That in, and of itself just reeks of conflict of interest on this.
This isn’t about justice for the victims of 9/11, or their families. This isn’t about justice for the American people. This is about revenge. Against Bush, Cheney, the CIA, and anyone else deemed to be guilty of their own policies.
As for super secret evidence? I am no lawyer, but doesn’t the law require that any, and all evidence the prosecution has, has to be shared with the defense? If so, how long will it stay super secret? Are we sure Holder even passed the bar?

Where did Holder get the authority to make the decision to bring KSM to NYC? The Attorney General of the United States does not have the authority to order the military to release its prisoner to the civilian authority. Only the Commander in Chief has the authority to do that. Obama is trying to distance himself from his own decision. He is a coward and willing to sacrifice anyone to his ends. Hard to believe a Muslim will prosecute a Muslim. If he is aquitted Obama will blame Bush. Obama must be impeached.

to convict KSM they don’t have a choice but to bring Martial Law into the Civilan Court Room and uphold it. They have used Martial Law against KSM to gather evidence, to use in a Civilian Courtroom those measures will have to be upheld.
After KSM is convicted, he will appeal and the Appeals Courts will have to uphold things like No Miranda Warnings

Khalid Sheikh Mohammed (KSM) and other al Qaeda operatives will be put on trial in New York City civilian federal court. KSM, the mastermind of 9/11, is not an American citizen and never has been. Together with Osama bin Laden, KSM selected the 9/11 terrorists, arranged their financing and training, and ran the whole operation –from abroad. American and Pakistani intelligence forces captured KSM on March 1, 2003, in –Rawalpindi, Pakistan. Bin Laden had already declared war on the United States, and he remains free to this day.
Now, though, KSM and his co-defendants will enjoy the benefits and rights that the US Constitution accords to US citizens and resident aliens—including the right to demand that the government produce in open court all witnesses and accusers, including intelligence operatives, and all of the information that it has on them, and how they got it.
Trying KSM in civilian court will be an intelligence bonanza for al Qaeda and all hostile nations that will view the U.S. intelligence methods and sources that such a trial will reveal. Prosecutors will be forced to reveal U.S. intelligence on KSM, the methods and sources for acquiring its information, and his relationships to fellow al Qaeda operatives. The information will enable al Qaeda to drop plans and personnel whose cover is blown. It will enable it to detect our means of intelligence-gathering, and to push forward into areas we know nothing about yet which endangers all people world-wide.
This is not hypothetical. This is fact. During the 1993 World Trade Center bombing trial of Sheikh Omar Abdel Rahman (aka the “blind Sheikh”), standard civilian criminal trial rules required the government to turn over to the defendants a list of 200 possible co-conspirators.
In essence, that list was a sketch of American intelligence on al Qaeda. It was delivered to Osama bin Laden in Sudan on a silver platter within days of its production as a court exhibit. Bin Laden, who was on the list, could immediately see who was compromised. He also could get a jump-start figuring out how American intelligence had learned its information and anticipate what our future moves were likely to be at that time.
Hence, the civilian trial of “the blind Sheikh” most definitely later resulted in assisting Osama Bin Laden, KSM, and their co-conspirators to plan and execute the successful attacks on the World Trade Centers and the Pentagon on September 11, 2001 that resulted in the deaths of thousands of American citizens, American military personnel, and the destruction of two skyscrapers and part of the Pentagon. If not for the selfless sacrificial bravery of the passengers on United Airlines Flight 93, the destruction of our nation’s capital, or even the White House, would have been assured as well.
President Obama and Attorney General Eric Holder have to know this. How can they not know these things? But they are going forward with the civilian trial of KSM and his co-defendants in a civilian court in the USA anyways. They co-conspire to do this despite the grave danger of further death and destruction at the hands of terrorist’s and jihadist’s that the civilian trial will bring to American citizens, and the United States of America itself. Not to mention the judicial precedents and resulting case law that will tie up our courts and judges for years, and shred our Constitution, if KSM’s successful prosecution is already a ‘forgone conclusion’.
By going forward with this civilian trial of the mastermind of the most diabolical attack on America and American citizens at the hands of foreign enemies in history, they are directly responsible for all of the damage to our hard earned intelligence and our means of intelligence gathering that has, and currently still does, prevent further terrorist attacks in the US and abroad. The sacrifices of countless people whom have suffered and even died to keep America and our allies safe from further terrorist attacks since 9/11 will be for nothing.
By doing this, with knowledge aforethought and with specific intent, President Barack Hussein Obama and Attorney General Eric Holder are directly endangering untold numbers of Americans on American soil, and abroad, and have also therefore declared themselves enemys of the state in the process.
As a law abiding tax paying American citizen, I now demand the arrest and incarceration of Attorney General Eric Holder and the impeachment and prosecution of President Barack Hussein Obama as co-conspirators and enemys of the state.

The greatest danger posed in the trial of Khalid Sheikh Mohammed (KSM) isn’t that he will go free. The greatest danger is that he will be convicted and that during his appeals the courts will ratify all of the extraordinary measures used to capture and convict him. The great danger is that the courts will ratify the rough, inaccurate and ambiguous norms of martial law as applying to all civil criminal trials.
After a couple of decades of these court decisions reverberating throughout the legal system, we could end up living under de facto martial law.
