<blockquote>The Geneva Convention does NOT protect enemy combatants any more than the US Constitutional Rights apply to non-US-citizens.

I think you mean the Geneva Convention does NOT project <em>illegal</em> combatants.

It doesn't and the fact that we are extending the protections to the illegal combatants / detainees while at the same time refusing to hold others accountable for their violations of the GC makes a mockery of the GC and what it was trying to establish - protections of the civilian populations.
What incentives does any future enemy have to follow the GC with our soldiers? None. Thus we get desecrated bodies of POWs who were executed without trial.
I think we should enforce the Geneva Convention - including the summary execution of illegal combatants in the field. And make it perfectly clear to everyone what we are doing, why, and the fact that such measures are practically demanded of the GC.

When the Supreme Court decided Hamden v. Rumsfeld, they participated in activism from the bench.

I remember well the progressives liberally arguing the falsehood that the justices decided to choose as their basis to vault themselves above their given station in our Constitutional Republic.

<blockquote>An unusual aspect of the case was an amicus brief filed by Senators Jon Kyl and Lindsey Graham, which presented an “extensive colloquy” added to the Congressional record as evidence that "Congress was aware" that the [McCain] Detainee Treatment Act would strip the Supreme Court of jurisdiction to hear cases brought by the Guantanamo detainees. Because these statements were not actually included in the December 21 debate, Emily Bazelon of Slate magazine has argued this was an attempt to mislead the court.--Wiki, <a href="http://en.wikipedia.org/wiki/Hamdan_v._Rumsfeld" rel="nofollow">Hamden v. Rumsfeld</a>
</blockquote>

It would appear that the Supreme Court presumes self-vested authority in military tribunals of non-US-citizen enemy combatants that are not Constitutionally granted.

<blockquote>U.S. Attorney General Eric Holder expressed confidence that <a href="http://pajamasmedia.com/blog/how-hard-will-it-be-to-convict-khalid-sheikh-mohammed/" rel="nofollow">the cases were strong</a></blockquote>

All the worse, to squander strong cases against the 9/11 terrorists in the wrong venue, refusing the nation prosecution of the terrorists in the traditional Constitutionally designed military tribunal vs. civil courts for enemy combatants of war--specifically wrong to demand the place be the civil courts in "biased" NY where the terrorism occurred.

Obama's mistakes are intentional, "PREJUDGED" for greatest destructive impact. Destabilize the USA--change Obama believes in.

<blockquote>Not prosecuting, i.e. keeping these terrorists in indefinite detention at Gitmo, just may have been the only safe policy.

Nichevo on November 18, 2009 at 4:35 AM</blockquote>

"the only safe policy"

SAFE so long as nothing CHANGED, no change of the guard, no change of venue, no change in leadership or authority.

But <em>change</em> was in the works during Bush's administration as his growing turncoat Congressional opposition made clear. Closing Gitmo was in the works against Bush's administration, as was the redefinition/revision of the definition of "torture".

AS IF from the Oval Office the Bush Administration had no idea who Obama was.

Bush passed the buck, handing it to Obama, knowing full well the travesty to come under Obama's watch.

Mukasey is making it clear that Obama is handling the prosecution of terrorists without Constitutional regard. Evidently he was prevented by the President from facilitating the substantiation to make the military tribunals of the 9/11 terrorists occur under Bush's watch.

The military is historically obtuse. During WWII Gen. Eisenhower wanted an expert in transportation on his staff planning for D-Day. The Army drafted the expert and determined since he was working on transportation he must be sent to the proper service school. There he studied transportation from the books he had written and arrived in GB after his schooling was complete, as was D-Day. When it comes to the military and government in general, don't necessarily blame stupidity on incompetence or some nefarious reason, when strict compliance to rules and regulations, and now PC attitudes, are a bureaucracy's way of CYA. I've seen it up close and personal way too often, even in private industry, and a major reason why I retired early.

When the moderate and reserved Bill Bennett reflects the appearance of an Obama cover-up at Ft. Hood, Ed Morrissey makes note to consider adjusting the "wait and see" position that's fixed on progressive erosion of the record.

One intrinsic handicap that progressives suffer is the constant need to revise records and fabricate whole cloth for the mode of the day.

Obama will not "prejudge" until his cover-up case is complete. No one asked Obama to prejudge. So for Obama to persistently reiterate that word "prejudge" which he introduced for the media is his current mode of DISTRACTION. Obama is accusing everyone of being prejudiced as if his projection of evil upon justice makes justice evil. The only insistence to "prejudge" comes from Obama's administration/media that insists Hasan is NOT a terrorist because there's no such thing as the <em>urban myth</em> "terrorist".

<blockquote>“Far Left lawyers” have no standing within the Military to prevent or postpone the processing of a full fledged tribunal.

The Commander in Chief had the power and authority to have the captured terrorists processed through a military tribunal.

Bush blinked, waiting to exhale as it were. The buck stops in the Oval Office where it waited “indefinitely” for Bush’s administration to expire.

By failing to prosecute theh 9/11 terrorists, Bush also failed to set precedent for subsequent presidents to follow.

<blockquote>Please someone enlighten me as to how we can go over his head. Will Congress have to take a stand on this?</blockquote>

Congress will take no stand of any kind against President Obama. Both the Legislative and the Executive branches of the United States government are currently being run by, and exclusively in the interests of, Democrats. If you expect to have any standing with these bodies as a mere Citizen, or any expectation that one Democrat will stand against another Democrat on behalf or mere Citizens, you are sadly mistaken.

However, this malicious cabal will be terminated, beginning next year. Democrats apparently have short memories, but we Citizens will deliver a sharp reminder, even though most Democrats will not require it again, in their new entry-level jobs in the private sector.

Go Sarah. Go kick serious ass. For the rest of us.

Let me apologize for my choice of language. I agree with you that there are investigations that need to happen and relationships that need to be scrutinized. Just having a bad day...

Please. Get a grip. Have you done any research on this at all? This is why so much of the REAL criticisms can't get through to the populace....because mouth-breathers like you fill the channel with obviously and easily refuted lies.

Even Jerome Corsi had the following to say:
<blockquote>"Hasan is being reported as a participant in the GWU Homeland Security Policy Institute's Presidential Transition Task Force, not as a member, noting the group was a university think-tank, not part of the Obama administration official transition team."</blockquote>

The information below was sent to me by a friend.

Nidal Hasan on Obama's Security Task Force..............

Now we have a little insight into why Obama said to not jump to conclusions about Nidal Hasan and why Congressmen were not briefed before the press leak.

This murdering Muslim Terrorist who killed and wounded the soldiers and civilians at Ft Hood, Texas was an advisor to Obama's Homeland Security team. Look on page 29 of the Homeland Security Institute link below.

I wonder how many more skeletons there are to come to of the cupboard. Who else is there in the government or its numerous advisors or Czars that will harm our country and citizens?

http://www.gwumc.edu/hspi/old/PTTF_ProceedingsReport_05.19.09.pdf

Go to page number 29, scroll down toward the bottom on the Left Column
He is listed under "THINKING ANEW- SECURITY PRIORITIES FOR THE NEXT ADMINISTRATION", as Nidal Hasan, Uniformed Serv ices University School of Medicine (8TH DOWN ON LEFT COLUMN PAGE 29).

Please send this link to everybody on your email list. The world needs to know who Obama really is. This is very scary guys.

When ever i hear any liberal talk about
openess, fairness, or transparency
I know to run for the hills
duck into my foxhole
and prepare for an onslaught of lies
distortions and outright treason..

and here we go again..

Now obama and the democraps
who all screamed about 9/11 and the truth commission report
or the so called rush to judgement..

now all of a sudden are covering up for an islamic jihadist traitor terrorist,,

Tell me it isnt so..

If you want to understand this and Obama's stonewalling on this and Afghanistan and despert need for approval of Islamic powers, consider this; His native and first religion was Islam. He was raised with its teachings, he studied it in school, he knows the Koran better than the bible, he has never denounced his Islamic faith. He once state that the most beautiful sound in the world. He did attend a church that preached a radical black theology based on Christian doctrine, but one he could be comfortable with in because of it numerous and strong ties to Islamic groups. Most likely he belonged to the church because his wife did and for political posturing. He has not found a christain church in Washington. He has not visted a major christian church or cathedral, but took time to visit one of the oldest Muslim Mosque, at which he demonstrated that although he lacked knowledge of protocal all across Europe, he understood the protocal for entering the mosque. He bowed to the Saudi King, but the king is also the keeper of the two most holy mosques and notice that it was with bent knee. He sat by watched then supported the Islamic power in Iran. He has made two speeches to the Islamic world to try and get them to accept him as a friend rather than foe. His speech in Egypt showed he understood how to speak to a muslim crowd complete with the required references and protocals. He promised to pursue the war in Afghanistan using the same surge that worked in Iraq which resulted in our being able to hand over the war to the Iraq government. He did not understand that a surge would not work in Afghanistan. Further interferring with his plans is the government not being able to organize enough to accept the military reponsibilty. He is struggling now to find a way to get out of Afghanistan and a war against fellow muslims. The current plan seems to be to force the Afghanistan government to get it together by telling them we are leaving in the near future. That will cost more lives and hurt him politically for what that matters, but it will get him out of a war with muslims. Hasan's jihadi is a problem for Obama. As noted, Hasan was an advisor that said what Obama wanted to hear; to stop describing Muslim terroist as terroist and refer to them as something less threatning that did not connect them to Islam or Jihadism. Now that it has happen, he is protecting his own image in the Muslim world and probably quiet policy changes that supported his goals. Perhaps he agrees with the muslim beliefs of Hasan. As for the civilian trials of the terroist, watch them walk as crucial eveidence is withheld that is needed to convict them or something like deportion after a conviction. Gimo's biggest problem for Obama has been that it was a prison for Muslims. If he makes a second term look for concessions to Muslims on Shira law along the lines that he campaigned with his cousin Kenya for. The other side of his plate that he was mentored to achieve, is for socialism which he seems to want to pattern on Chavez socialism and Marxist communisum. God save our country is my prayer, but it seems those in power are hell bent on his destroying it.

Agreed; But there is supposed to be "separation of powers". It doesn't appear that there is at this time;
This P.O.S. is pushing the limits of the Constitution; And the thing I find unacceptable is, there's no fail-safe.
