Obama stonewalling Congress on Hasan?

Congress wants to determine what failures allowed Army Major Nidal Hasan to kill 14 people and wound dozens of others in a premeditated shooting spree at Fort Hood. The Obama administration has refused to cooperate into a probe to find those failures. Ben Pershing at the Washington Post wrote last night that the White House refuses to provide witnesses to Congress for hearings into the counterterrorism failure:
The first public congressional hearing on the Fort Hood attack will not include testimony from any current federal law enforcement, military or intelligence officials because the Obama administration “declined to provide any” such witnesses, according to a Senate committee source.
The Senate Homeland Security and Governmental Affairs Committee has released the witness list for its hearing “The Fort Hood Attack: A Preliminary Assessment,” scheduled for Thursday at 10 a.m. ET. The list includes four experts on terrorism and intelligence issues: retired Gen. Jack Keane, the former U.S. Army vice chief of staff; Brian Jenkins, a senior advisor at the Rand Corp.; Mitchell Silber, the director of analysis for the New York City Police Department’s Intelligence Division; and Juan Zarate, a senior advisor for the Transnational Threats Project at the Center for Strategic and International Studies.
But the list does not include anyone actively involved in investigating the Fort Hood attack, or anyone who might have been responsible for decisions made by various government agencies before the attack about whether to investigate the shooting suspect, Nidal Hasan. The Senate committee source said HSGAC Chairman Joe Lieberman (I-Conn.) had hoped to have witnesses from the FBI and the U.S. Army, but was rebuffed in his requests.
Barack Obama repeatedly promised to make his administration the most open and transparent in history. Accountability to Congress goes far beyond “hope and change” or any other campaign sloganeering. It’s required by the Constitution, and Congress has the right to demand answers from the FBI and the Army as part of their oversight of both.
Furthermore, Congress has no interest in “solving” the murder case. The military has the shooter. Congress has the duty to see why Hasan wasn’t identified as a risk before he picked up a gun and started killing soldiers. Why didn’t critical information get shared on Hasan, especially his correspondence with Anwar al-Aulaqi, a man suspected of an operational role in the 9/11 attacks by the Congressional Commission that studied them, as well as a known al-Qaeda recruiter and sympathizer? Are there any other soldiers communicating with Hasan or other AQ figures that the FBI and the Joint Terrorism Task Force has chalked up to “research”?
If nothing else, Congress could have asked the Army why they intended to deploy a psychiatrist who repeatedly attempted to violate patient confidentiality in order to press war-crimes charges against the soldiers he was treating:
Major Nidal Malik Hasan’s military superiors repeatedly ignored or rebuffed his efforts to open criminal prosecutions of soldiers he claimed had confessed to “war crimes” during psychiatric counseling, according to investigative reports circulated among federal law enforcement officials. …
Investigators believe Hasan’s frustration over the failure of the Army to pursue what he regarded as criminal acts by U.S. soldiers in Iraq and Afghanistan may have helped to trigger the shootings.
“The Army may not want to admit it, and you may not hear much about it, but it was very big for him,” said one of the federal investigators on the task force collecting evidence of the crime.
His last effort to get the attention of military investigators came on Nov. 2, three days before his alleged shooting spree, according to the reports.
Hasan made a number of attempts to inform on his patients to prosecutors, in at least one case signing e-mails “Praise be to Allah.” And no one in the Army thought this was a little weird? Does the Army routinely send combat soldiers to psychiatrists who violate their trust and the doctor-patient privilege? And even knowing all of this, the Army was about to send Hasan to a combat zone to treat even more combat soldiers.
That’s the kind of thing Congress needs to know, and the Army needs to explain. Unfortunately, Obama wants to stall those questions and keep from providing the answers.

No matter what Obama’s resaons, there is a sober reality demonstrated by the Fort Hood shootings and if it’s not faced up to, it will happen again. Obama seems unable to separate his personal needs and approaches to issues from the good of the country as a whole. As a President, he is shaping up as a failure largely because of this I think. Do you think these bad decisions come from him or from others? I wonder more and more.

Sure, the MSM might not cover them adequately, but at least people would begin to know that this White House is covering up some serious matters.

Just a thought: Maybe we really don’t want to know the answer why the Executive branch is stonewalling.
Of course, Occams Razor says the most likely reason is that the answer is highly critical of, if not devastating to, the civilians who run the military.

About 18 months ago, I remember watching Chris Matthews and Mike Barnacle discussing Obama in the Dem primaries.
Matthews pointed out to Barnacle a comment that an old Boston pol offered in evaluating any political newcomer. Two questions: Is he okay? Is he one of us?
My responses: Obama has never been okay. And he increasingly shows that he’s not one of us. What correct-thinking American does not want to get to the bottom of Fort Hood immediately?

Does anyone know what the following is about, it says it is a think tank “Homeland Security Policy Institute”, someone posted a link here last week.
Under “Homeland Security Policy Task Force” there is a “NIDAL HASAN, UNIFORMED SERVICES,UNIVERSITY SVHOOL OF MEDICINE” Page 29.
If rhis is a credible website, there are a lot of prominent people listed, then maybe this is why he doesn’t want an investigation????

Bush and Cheney should have processed the trials of the 9/11 terrorists detained at Guantanamo as THAT military tribunal setting was the only proper way of carrying out their Constitutional duties that they had the ability and opportunity to complete while in office.
My criticism is that Bush and Congress would conduct wars in Afghanistan and Iraq and FAIL TO PROSECUTE THE GUILTY AL QAEDA TERRORISTS captured and held “indefinitely” until the next potus released them.

The best case for the criminal cabal is that they are conducting a cover-up because the trail leads directly to the White House and the policies put in place since Jan 21, 2009.
But why is nobody asking how pseudo-soldier with no weapons training was able to kill and wound over 40 grown men and women, with a handgun, in a room filled with combat veterens whose every instinct tells them to close with an enemy and protect their comrades at all costs?
And he was eventually taken down by a civilian policewoman?
It strains credulity. We are to believe that hundreds of combat veterans were cowering in corners until a spunky gal showed up.
The initial reports had 3 shooters, but that noise disappeared within hours.
The attack was planned and coordinated by multiple people who were trained assassins.

Obama won’t send any witnesses to Congress for this shooting because this happened on his watch. Wait until KSM’s trial begins and Obama obliges them with every witness requested.
As ReaganRoxx said, the doctor-patient privileges are different in the military. Physician-patient privacy applies to the doctor, but not to the doctor as a military officer. If there is a conflict, the latter trumps the former.

It is kind of mind boggling. His silence on Iran. His failure to mention the fallen troops until after he’d given a shout out to others…it just seems like he gets things backwards most of the time. Flying out of DC when there were thousands of people in DC trying to make their voices heard. Calling out FOX news and playing favorites with the media. I don’t know if it’s intention or if he really isn’t very smart. I know a lot of people who can speak eloquently and appear to be very knowlegeable and “cool”, but they really aren’t very intelligent when it comes to doing the right thing.

“Far Left lawyers” have no standing within the Military to prevent or postpone the processing of a full fledged tribunal.
The Commander in Chief had the power and authority to have the captured terrorists processed through a military tribunal.
Bush blinked, waiting to exhale as it were. The buck stops in the Oval Office where it waited “indefinitely” for Bush’s administration to expire.
By failing to prosecute theh 9/11 terrorists, Bush also failed to set precedent for subsequent presidents to follow.

This reaction SHOULD have people SHOVING back to ask hard questions. This is the behavior of a man who knows he’s going to be busted hard for what he and his folks did. Obama’s fear that people will “jump to conclusions” has nothing to do with his outright hostility to investigation.
Obama has either been told someone close to him was warned of Hasan’s behavior before the shooting or something near to this. There is no other reason for him to be so adamant about Congress not investigating this massacre.
Had Bush behaved this way following ANYTHING Congress and the press would be killing themselves to get at the “real” information.
Think I’m nuts? Ask yourself WHY this president is so determined to stop this investigation. A case might be made for his fear for the poor benighted muslims, but, to be honest, I don’t buy it. This man doesn’t put himself out this hard for anything but personal reasons.

It still amazes me that the signs of suicide so blatantly apparent in Maj. Hasan went unnoticed by his peers. The giving away of posessions, telling people “You’ll not see me again” emptying out of safety deposit boxes. Admittedly, suicide by cop is plainly rare in soldiers. The signs of suicide were evident.
I hope the Army uses this, at the very least, as an opportunity to continue to emphasize suicide awareness in soldiers at all ranks. Suicide is not a junior enlisted problem, or an NCO problem, or an officer problem. It needs to continue to be addressed.

Nidal Hasan, was Homeland Security advisor on Obama transition team.
Now we have a little insight into why Obama said to not jump to conclusions about Nidal Hasan.
This man who killed and wounded the people at Fort Hood , Texas was an advisor to Obama’s Homeland Security team.

I don’t think that’s entirely true. Hasan was in the Army for a lot longer than that, and his advancement to his current position despite his Islamist leanings happened mostly before Obama’s election. Political correctness has been well-entrenched in government bureaucracy for some time, just look at the TSA searching grandmothers for terrorist weapons at airports. I’m sure this administration hasn’t done anything to reverse it, but they didn’t start it.

Correct me if my timeline is wrong, but didn’t the pro bono lawyers put a wrench in the prosecutions of the Gitmo detainees? Wasn’t this matter finally resolved back in 2006, when new military tribunal protocol was written?
There were many attempts by protectors of the jihadists and detainees at Gitmo that kept putting a kibbosh into a prompt resolution.

HI NOTAGOOL–A few comments on your post about the good Major and his shooting skills. He served as an enlisted man and went through Basic Training. And he took annual or semi-annual “refresher” shooting and had to get a passing score. And he signed up for more training–pretty normal for a military man in the Army or Marine Corps.

Google his pistol–an HK 57 (22 caliber) semi-automatic pistol. Holds 20 shots in the magazine–comes with 3 magazines–60 shots total. A light low recoil super high velocity bullet–round is designed for use in a submachine gun. Each shot probably went right through the first victim and hit a few more behind him. A very unusual weapon.

As a U.S. Army basic trainee long ago the sergeant taught us to think ahead in combat situations. Find cover and concealment, pick the most dangerous target first, move around, etc. The Jihadi Major was a trained shooter. And ONLY MP’s and police are armed on a military post–everyone else is guaranteed to be unarmed–except when on guard duty or on the shooting ranges.

You reference AG Holder’s law firm?
I recall the popular argument (not legally founded though legally promoted by Democrats) at that time regarded the authority of the POTUS to hold captured terrorists indefinitely, not whether or not they could be given a military tribunal.
Regardless of that argument, litigations instigated from outside of the military hardly hold precedence within the military that functions according to the tradition ofo military law. Since when does a member of Congress have the Constitutional authority to supersede the authority of the Commander in Chief within the Military to prevent the tribunal trial of a captured enemy guilty of acts of war on American soil against American citizens? Never.
What litigating parameters unsubstantiated by law and without precedent to date that the Commander in Chief CHOSE to recognize was a matter of convenience trumped as necessity. Politics, not authority. PC. Bush’s compassionate conservatism proved to be the lambs wool that camouflaged the promotion of liberal progressive agenda permeating the Military.
As Bush failed to order the military tribunals to proceed during his presidency, he set precedence for subsequent presidents to abstain from utilizing the POTUS Constitutional authority within the Military Tribunal judicial system.
Though enabled by decades of ignorant tolerance for radical Muslims particularly empowered by Carter forward, the 9/11 terrorism occurred under Bush’s watch. Fighting a war to defeat terrorists whom you refuse to try, convict and execute is a never-ending war of attrition against the USA, ironically self-destructive in the exercise of self-defense.
Yes, I know that Bush’s popularity was impeded by his political opposition that mounted their cumulative Democrat ass. And I know that Bush did his best to see through the War in Iraq. But if those guilty of starting the war are “indefinitely” jailed until the next potus is elected, the logic for war implodes into insane convolution: catch and release them while they kill us indiscriminately.
I argue that the Commander in Chief can indeed order a military tribunal to take place under his Constitutional Authority, most particularly during his own presidency, especially while the rules are not yet revised.
Wait? For what? For Obama to release the terrorists without prejudice.

By dragging the terrorists into the NY civil courts, Obama will provide the ground for his own impeachment. And Obama’s impeachment will occur long before the terrorists are given any civil court verdict.
Faith without works is dead. So press for the Military Tribunal, and demand that at the very least, the trials NOT take place in New York!

Granted, given what Hasan ended up doing and the other things we know about him, I think it’s likely that this was an inappropriate violation. I just don’t want anyone to jump to conclusions (not that anyone here would ever do that…)

The new urban myth going around is that there were legal reasons preventing the Bush administration trying the 9/11 terrorists in a military tribunal.
Not according to the record.
Not according to Mukasey via his Federalist Society speech, and The Fred Thompson interview given just now.
Not according to Sen. Obama who lectured specifically FOR the certainty of terrorists to be prosecuted in military tribunals with all the bells and whistles from the Senate Floor.
There are NO grounds for taking military terrorists to trial through the civilian courts.
That is why Obama is doing it. Jihadi Terrorists, free at last via Obama’s truncated dissolution of LAW.

And now the Obama Administration is stating that the National Security Council will be the sole provider of briefings to Congress. One source for information. One “story.” No dissent.
If this doesn’t signal blood in the water to those formerly known as news reporters, I don’t know what would.
If Congress doesn’t issue subpoenas to Army and Pentagon officials (and Hasan’s former superiors, fellow doctors, and patients) they are derelict in their duties. Of course, I hold out no hope in them doing the right thing.

Perhaps we agree in opinion. But for me, your presentation seemed confused, not that you don’t know what you meant, but the reader may not follow your thought. I’ve read the links. Where is the substantiation therein for your points of differentiation from Ed Morrissey’s posts?
The point that I responded to from your comment dealt with accusing Ed Morrissey of knowingly writing a bold faced lie to promote it.
Semantics? Hardly.
I have been a thorn in Ed’s side when he exposes his progressive biases to enable the further PC stage in America, or for being an agist along with Allahpundit preferring RINOs that include Mitt Romney as a potus candidate over Fred Thompson (they got their youthful potus: Obama), or for exposing his sinister character flaw towards men injured and paralyzed during a football practice when a destructive wind storm hit town. And when I attack Ed Morrissey’s errors, I argue, but with a completion of what I’m thinking and my basis for thought so as to state my case, not simply type a judgment.
So if you omitted something, finish typing what you were thinking.
Otherwise, I don’t follow.

We already are victims of Pres. Obama’s abuse of authority, referenced as authoritarian abuse of powers.
Obama’s Administration via the DHS has announced that his perversion of our judicial system targets all conservative Americans and veterans to be taken down first, denying law abiding citizens our unalienable rights, our Constitutional Rights, and any legitimate due process.
Pres. George W. Bush also ordered our armed forces to take on the rolls hampering a clear goal in war, confounding a clear victory, to be the laundry list of character roles abroad that Obama re-iterated himself in his official opening address to his/our troops in Afghanistan. They transformed our warriors into multitasking teachers, diplomats, mayors, friends, builders of nations WHILE ENGAGED IN WARFARE. Even FDR/Truman waited until AFTER WWII ended to decide to rebuild W. Germany and Japan, etc. GWB legacy in Iraq may yet become the nightmare that Michael Savage warns to beware, the uniting of the religious/political powers that Iraq and Iran do share in common. Iran’s Theocracy is set on it; as are those of its predominant Muslim sect within Iraq. America paid in blood, lives and treasure for today’s corrupt officials in Iraq to eat cake.
Do not fail to follow the armed forces that Obama funds with our taxes and foreign investors, building beyond what America has already; i.e., not simply the military and the law enforcement, both under the ultimate direction of this Chief Executive and Commander in Chief POTUS. Obama is no respecter of Constitutional Law or states rights. Democrats scream foul that private militias were contracted to police in war-torn foreign regions wherein our military were fighting warfare. But Obama’s forces are placing private FOREIGN armies to “police” flyover America’s heartland. Furthermore, as UN Security Council Chairman, Obama would further permeate the corruption between the US Military, NATO, and the UN.

My thoughts exactly! Something is fishy and they are definitely trying to hide it and protect someone. Like you say, why else wouldn’t you want to find out how this happened? Can they continue to deny Congress access to the people they need to question?

If you want to understand this and Obama’s stonewalling on this and Afghanistan and despert need for approval of Islamic powers, consider this; His native and first religion was Islam. He was raised with its teachings, he studied it in school, he knows the Koran better than the bible, he has never denounced his Islamic faith. He once state that the most beautiful sound in the world. He did attend a church that preached a radical black theology based on Christian doctrine, but one he could be comfortable with in because of it numerous and strong ties to Islamic groups. Most likely he belonged to the church because his wife did and for political posturing. He has not found a christain church in Washington. He has not visted a major christian church or cathedral, but took time to visit one of the oldest Muslim Mosque, at which he demonstrated that although he lacked knowledge of protocal all across Europe, he understood the protocal for entering the mosque. He bowed to the Saudi King, but the king is also the keeper of the two most holy mosques and notice that it was with bent knee. He sat by watched then supported the Islamic power in Iran. He has made two speeches to the Islamic world to try and get them to accept him as a friend rather than foe. His speech in Egypt showed he understood how to speak to a muslim crowd complete with the required references and protocals. He promised to pursue the war in Afghanistan using the same surge that worked in Iraq which resulted in our being able to hand over the war to the Iraq government. He did not understand that a surge would not work in Afghanistan. Further interferring with his plans is the government not being able to organize enough to accept the military reponsibilty. He is struggling now to find a way to get out of Afghanistan and a war against fellow muslims. The current plan seems to be to force the Afghanistan government to get it together by telling them we are leaving in the near future. That will cost more lives and hurt him politically for what that matters, but it will get him out of a war with muslims. Hasan’s jihadi is a problem for Obama. As noted, Hasan was an advisor that said what Obama wanted to hear; to stop describing Muslim terroist as terroist and refer to them as something less threatning that did not connect them to Islam or Jihadism. Now that it has happen, he is protecting his own image in the Muslim world and probably quiet policy changes that supported his goals. Perhaps he agrees with the muslim beliefs of Hasan. As for the civilian trials of the terroist, watch them walk as crucial eveidence is withheld that is needed to convict them or something like deportion after a conviction. Gimo’s biggest problem for Obama has been that it was a prison for Muslims. If he makes a second term look for concessions to Muslims on Shira law along the lines that he campaigned with his cousin Kenya for. The other side of his plate that he was mentored to achieve, is for socialism which he seems to want to pattern on Chavez socialism and Marxist communisum. God save our country is my prayer, but it seems those in power are hell bent on his destroying it.

Congress will take no stand of any kind against President Obama. Both the Legislative and the Executive branches of the United States government are currently being run by, and exclusively in the interests of, Democrats. If you expect to have any standing with these bodies as a mere Citizen, or any expectation that one Democrat will stand against another Democrat on behalf or mere Citizens, you are sadly mistaken.
However, this malicious cabal will be terminated, beginning next year. Democrats apparently have short memories, but we Citizens will deliver a sharp reminder, even though most Democrats will not require it again, in their new entry-level jobs in the private sector.
Go Sarah. Go kick serious ass. For the rest of us.
