Jim Moran: Daniel Pearl’s family is un-American

That’s certainly the conclusion one can draw from two stories over the last couple of days. Rep. Jim Moran (D-VA), who pushed Barack Obama to bring Guantanamo Bay detainees to the US for criminal trials, says that criticism of the decision is “un-American”:
Rep. Jim Moran (D-VA) has strong words for the Republicans opposing Attorney General Eric Holder’s plan to bring five 9/11 suspects to New York City to face trial.
“They see this as an opportunity to demagogue,” he said. “They will seize on any opportunity to do that, and that means they’ll even take a stand that’s un-American.”
“It’s un-American to hold anyone indefinitely without trial,” Moran added. “It’s against our principles as a nation.”
Maybe Moran missed this story from The Hill. The family of journalist Daniel Pearl, murdered and beheaded by none other than Khalid Sheikh Mohammed himself, took that same “un-American” stand that Moran blasted:
The family of slain Wall Street Journal reporter Daniel Pearl expressed disappointment with the Obama administration’s decision to try the professed killer of their son, alleged 9/11 mastermind Khalid Sheikh Mohammed, in a civilian court. …
“We are sorry to learn of the Justice Department decision to try KSM in a NYC Federal Court.
We are respectful of the legal process, but believe that giving confessed terrorists a worldwide platform to publicize their ideology sends the wrong message to potential terrorists, inviting them in essence, to resort to violence and cruelty in order to gain publicity.
We believe that justice is better served if the trial of KSM, the confessed murderer of Daniel Pearl, be held in closed session.”
It’s actually rather amusing to see someone complaining about demagoguery in one breath and accusing his critics of acting “un-American” in the next.
Apart from that, what’s really striking about the statement is the abject stupidity of it. Congress authorized military tribunals or commissions to adjudicate the cases of those captured as war criminals, which means they would have had an opportunity to challenge the government case in the same setting America has always used for war criminals — military tribunals. Moran seems to forget that the Nuremberg trials were in fact conducted by the military, not by American civil courts, and no one has seriously suggested that those didn’t work as intended. In fact, they’re usually the standard by which other efforts are measured.
Jim Geraghty notes that this did not escape the notice of Moran’s challenger, Matthew Berry:
“It is wrong for Congressman Moran to question the patriotism of the millions of Americans who believe that terrorists such as Khalid Sheikh Mohammed should be tried by military commissions rather than in civilian courtrooms. Furthermore, Congressman Moran’s comment reflects a basic ignorance of American history. Military commissions were used to try war crimes during the Revolutionary War, Mexican War, Civil War, Spanish-American War, and World War II. The use of a military commission to try Khalid Sheikh Mohammed would have been entirely in keeping with American history and tradition.”
Was Barack Obama un-American when he endorsed military tribunals for KSM in 2006?
Update: Some irony-challenged commenters are objecting to the headline. No, Moran did not specifically call the Pearls un-American, but he called anyone who objected to criminal trials un-American. I’m pointing out the demagoguery and applying the Moran standard in a manner that should embarrass Moran, but probably won’t. And for those who didn’t get it, try reading the first sentence of the post.

This weekend and today, I’ve heard a lot of this “the Bush administration had eight years blah blah blah…”
The math doesn’t add up. Terrorists struck on 9/11/01. Forgive me, but when did we catch KSM and the other four for whom Holder is crying rivers? It certainly wasn’t in 2001. Once caught and processed, the Bush administration undertook military commissions based on procedures developed for Nuremburg and since–a logical place to start, no?
Anyway, let’s analyze which NYC and DC megafirms offered up pro bono defense counsel to poke holes in the initial commissions all the way to the Supreme Court. If I recall, they won a nominal victory that sent Congress back to the drawing board, and they and Bush eventually enacted legislation to address the concerns.
And don’t forget this past 10 months of nose-picking is on Obama, who halted the commissions for these terrorists, pending his and Holder’s “expert” review.
So, please, shove the “Bush had eight years” meme up the next liberal’s a**. Ignoring all the liberal legal-sniping, Fall 2001 (certainly too early) throug fall 2008 doesn’t equal eight years.

Moran represents the very left-wing communities of Arlington and Alexandria, VA (my hometown), which make up VA-8. His district used to be much larger, but the GOP legislature decided he was going to get re-elected for the forseeable future in 2000 and redistricted him down to the blue precincts, giving the rest to the purple-pink (as it were) VA-11.
Please spread the word. Moran needs to go. Any donation to his challenger is a contribution to restoring a small bit of sanity to Northern Virginia.

I used to follow trials. I caught on to a lot about how both sides work. This will one unmitigated PR disaster that will reopen wounds.
That is truly why I was horrified that the left didn’t make Obama accountable in the primaries for the race card played.

According to the Geneva convention, enemy combatants captured in battle, can be held until the war is over and proper cease fire/surrender documents have been signed.
Of course treating them as enemy combatants gives them way to much credit, since they have violated every standard set by the Geneva conventions for determining combatant status.
They don’t wear uniforms. They deliberately hide amongst civilians. Etc. Illegal combatants, according to the Geneva conventions, can be shot on sight.

If you follow Campaign Spot blog from Jim Geraghty, you’ll quickly learn about Moran. He has a long record of nuttiness. Moran was once accused of assaulting his girlfriend, after his wife booted him out of the house, and he’s on record for blaming “the Jews” for al Qaeda disliking America. He has been several times been accused of taking money, in big numbers, from defense contractors to whom he later (as in days later) steered contracts. He once physically restrained an eight year old in a parking lot, wrongly claiming the child had tried to steal his car and the Police had to be called to get him to back off. He gets reelected because he comes from a very safe Democrat district, so only when he faces a primary challenge will he change.

By Moran’s stated logic, the Pearl family is therefore un-American.
Anyone who can parse simple logic can see exactly what Ed is saying. It is not a distortion.
Perhaps a journalist (of the old-school variety, now extinct) might have sought comment from Moran before running with a story.
But this is a blog, and anyway, I’d bet my paycheck that Moran will simply ignore requests for comment/clarification.
My opinion is that the headline is emminently fair.

Maybe Moran and others of his ilk should be rounded up and made to watch the videos of KSM happily slowly slicing Pearl’s head from Pearl’s still living body.

First off, you’ve got to understand that they’ve gerrymandered such a safe district for the guy that he is not particularly vulnerable. Virtually every flaming liberal in Northern Virginia falls within this bastard’s district- it’s why he can beat up eight-year-olds and stay in office.

How could anyone be more despicable than you? You’ve already tried and convicted your own service members of war crimes by your comments on this very forum. Yet you want to give fair hearings to non-uniformed combatants who we had every right to execute on the battlefield after captured in accordance with the Geneva Convention.

Moran’s comments are aimed at his Party’s own base and whatever hangers-on remain of independents. He’s also late in the game on the matter of KSM coming to a civilian trial; he apparently had to think about what to say.
Not just Republicans are unhappy with the decision to keep KSM from facing a military tribunal, but that’s how some want to paint the matter, and with a broad brush. Moran’s statements are what I call early damage-control, like before the torpedoes hit the ship.
If KSM walks, there is going to be nationwide anger at Obowma and the Dems for backing this truly bad decision by Obowma’s crony running the DoJ. Hell, if that trial becomes a sounding board for AQ propaganda, a lot of Americans are going to be flaming mad long before the verdict comes down.
Moran’s partisan, highly-charged comments are the first try the libs in this country are going to make to soothe the ruffled feathers of the population. The plan is to slander, so any dissidents are automatically invalidated during the debate.
