I’m afraid I’ll have to disagree. If the case against KSM and his cohorts result in acquittals, hung juries or, especially, dismissal by a sitting judge for the numerous violations of rights involved in his capture and detention – they will go free. You are underestimating both Obama and Holder’s dedication to the Left and its deeply held, bizarre beliefs (1)about due process and (2) that the “War on Terror” is a terrorist action by the US. A man who bows in subservience to a Saudi king and the son of Hirohito will have problem doing this. Make a note that you heard it here first.

Why wouldn’t lawyer use Obama’s statement as a means to demonstrate that KSM cannot possibly get a fair trial if acquittal would not mean his freedom?

I would not be in any way surprised if someone tries to kill him at the trial. I’m sure they will let some of the victims’ families into the courtroom, and I’d bet at least one of them would be willing to sacrifice their freedom to see justice served. It will become an even more distinct possibility if it becomes clear that KSM is going to be acquitted.

Eric Holder felt the same way right after 911. That the terrorist should have limited rights given the offense and the Geneva convention. BUT then his colleagues began getting some of the vermon as high dollar clients and all of a sudden they’re victims.
This is the greatest opportunity to make public “torture methods” and make the Bush administration look evil even if it means giving away important secrets. Even if it means giving foreign terrorists american civil rights. Even if it means some of the terrorists getting off-won’t matter Barry’ll just lock’em back up-constitution now just a piece of paper to be Hoped and Changed.

I don’t see how this prosecution is even possible. Even if you get past the Miranda problem, and I don’t see how you do, there are the rules of evidence and there isn’t really much of that other than heresay. Even a really bad lawyer could get confessions and any other information gained by interrogation and waterboarding thrown out due to cohersion of confession rules. KSM was a conspirator and an illegal combatant in a foreign country. The whole idea of subjecting him to a civil penal system is insane. The whole reason military tribunals exist is that you don’t have miranda and other such rights on a battlefield. And for all those misguided lefties who complained that these terrorists were not treated according to the Geneva Convention, I would agree with them in a way. The whole purpose of the GC was to lay down rules for the conduct of warfare. KSM was not fighting under any countries flag or in uniform. That makes him an illegal warrior and just like a spy, they can be shot on a battlefield.

I’m going to toss out a real bomb here. I think KSM and his pals are going to get the case thrown out of court. And for all those people who say that he could be re-arrested on other charges, consider this: Once you put them in the Civil court system, you don’t have the autority to hold them without charges and a speedy trial. You will have to either convict or release them in a reasonable amount of time. That being the case, I think KSM will walk free because all of the things that he could be charged with will fail because of the differences between a military and civil justice system. And I don’t think you would ever get a judge to condone putting them back into the military justice system. This is a HUGH, well, I was going to say mistake, but I don’t really believe that. I think it is Holders very intention to see these guys walk free. He, just like our president, has a lot of sympathy with muslim terrorists.
