It is as if liberals are arguing that the best way to display to the world our superior American virtues is to give KSM a fair trial in a civilian court with a predetermined outcome.
The outcome, they assure us, is indeed predetermined: ‘No way KSM could not be found guilty and eventually put to death.’
Seems strange. If the outcome is already known, what is the point of the trial? And how would such a trial be fair? Doesn’t seem to be such a great display of our superior American moral code to me.

Every non-sequestered juror will be susceptible to intimidation. I foresee threats to family members. The trial of KSM will likely take a year. The jury will not be sequestered throughout. There is plenty of time for mischief. The state may not get a fair trial.

If I wanted to change laws in this country, this would be the way I would do it. Obama owns the prosecutors and the defense teams. Think of it: defense teams of enemy combatants have been very left leaning lawyers. DOJ is owned by Obama and Holder. Motions are made, rulings are made, law is set.
With a defense team making the right motion at the right time and DOJ responding a certain way rulings will be made a certain way. New laws are then set. Welcome to Transformation.

Eric “The Coward” Holder has a despicable history with terrorists. Never forget his roll in the pardons of the FALN and Los Macheteros puerto rican terrorists, all 16 of them (I think that was the approximate number). Learn all the details of Eric “The Red’s” disgusting support for those murderers. Holder has a definite “legal” agenda/pattern that exposes his distain, not only of the laws of the land, but the American people also. How did this midget weasel zipper ever get tapped for positions in the Office of the Attorney General? And he kept getting promotioned too – right to the top! I’ve got quite a few really good guesses. Oh, and he even did some legal work for ex Illinois governor Hot Rod Blagojevich and the recently croaked (cause of death: aspirin and rat poison-sure) Christopher Kelly. Humm…… Eric’s got some really serious ‘splanin’ to do. Little Eric is part of the this administrations rot from within. The “bend over backwards to give every possible benefit to the accused” mentality of the Warren court planted the seed which yields this fruit.
“Guilty as sin, but free as a bird”, reportedly crowed one Bill Ayers, a beneficiary of this version of justice. One Orenthal Julius Simpson, with the help of the best defense money could buy, managed to turn the trial of himself for murder into the trial of the LAPD for racism.
We have a group of avowed enemies of the United States who plotted to murder thousands of Americans, and who would gladly do so again. They kicked off a war that killed thousands more and rejoice over it.
By using our own overly compassionate attitude toward criminals instead of victims against us, it appears that the best team of defense lawyers oil money can buy will use every trick in the book to see that they walk free.
This must be the new strategy in the War on Terror: to make our enemies laugh themselves sick.

I think Obama looks at this as a win-win for himself and his political philosophy. Out of the trials, he gets two possible outcomes:
1) KSM and others are convicted. Win for anti-terrorism. BUT, during the trial, Bush and others are dragged through the mud resulting in propaganda for the libs. In addition, in order to achieve a conviction, the what, where, why, and how of intelligence gathering techniques are revealed — resulting in a win for Obama’s other buddies, those who revile and hate the US OR
2) KSM and others are acquitted. As someone else pointed out, Obama can’t let KSM walk, so he’s going to have to over-rule the judiciary and/or go around its decision. This will occur with the approval of the majority of the American people — some of whom will point out that this was foolish to begin with, but will still support whatever legal shenanigans are used to make sure KSM. Actually, I think this is the outcome Obama and the statists in his administration would prefer. He gets to set a precedent for setting aside a judicial decsion, for putting someone in double jeopardy, and essentially subverting the American legal system. He will do this with the approval of the majority of the American people because of the situation. But, once the precedent is set, it sets him up for other such abrogations, a little at a time, thereby eventually relegating the Constitution to an “interesting historical document” that served well in its day, but is no longer relevant in our more complex, advanced society. Obama gets the other wins stated above in addition.
The cynical part of me wouldn’t be surprised if they set conditions up for decision 2 because they benefit more from it.

I was thinking that just for fun I’d try to defend/explain Obama’s action here — but I’m just totally stumped.
Can he really think he knows how this will play out? The uncertainties are boundless, the dangers real.
Their announced confidence in a conviction is so breathtakingly ignorant because conviction isn’t the main issue — it’s safety. Besides, if they’re doing this to demonstrate America’s “fairness” then STFU about how sure you are of a conviction.
You’d think they would have thought through the possibilities before making this step but it’s pretty obvious that they haven’t.
I think about how hot and incredulous I am about this but I live a thousand miles from NY — the locals must be flipping out. I guess the celebration over the Yankees is history.
The only idea I have in his 0′s defense is that he may know something we don’t. Is there anything that anyone can imagine that could explain this?

The part about “once people get reminded what KSM did” makes me think that this whle thing will backfire on Obama. People have been falling into a 9/10 mentality, this will remind thjem of 9/11. Preople have forgoteen that they liked Bush (he had a 90% approbval rating after 9/11), this will remind them why they did. People are already missing Bush due to O’s failures up til now, I can only imagine what they’ll feel after this. Cheney’s approval rating has already climbed.
Hey, O, bring it. Americans are already angered at just the thought of a federal trial for KSM and your poll numbers will fall because of that alone; but when people see this show on TV everyday, are reminded of 9/11 and what they liked about Bush, your numbers will tank. Go ahead, make my day.

I was just thinking about how unpleasant the Carter years were. The misery index was very real, but I don’t remember feeling like Jimmy hated America…he just had wrong ideas and was naive and clueless about how to govern and lead America. He was a fool, but America overcame! This time, it’s different. There is an obvious hatred for America coming from Obama & Company. As I read & listen to everyone trying to justify or figure out whether Obama is doing this intentionally or if he is simply a fool, I find myself praying harder than I ever have before…please let him just be a fool.

No, he makes the US a world-wide laughing stock by showing how our justice system can be so easily subverted. He then rescues *his* image both at home and abroad by “not letting such an abuse stand”. The rest of the world is pretty much already statist, so they nod sagely and agree with him, he only alienates those who already like us and whom he cannot stand.

On the Miranda theme, I think that would be the best possible outcome: the judge just throwing the case out on the first day. In a perfect world, he could even say explicitly “this court has no authority to try this case.”
There’s no way KSM makes it all the way through to a guilty verdict anyway, not without the trial being reduced to a farce that the Left, which has collectively been reduced to a one-track-mind on how it perceives state-sanctioned punishment, could (rightfully) decry as a disgrace. This would just further drag us down the road of effete navel-gazing in the face of an existential enemy, as if the findings of a US court have (or have ever) been concerned with factual reality rather than protecting the citizen-defendant’s benefit of the doubt.

KSM isn’t being put on trial – America is.
This “trial” is meant to show Americans the reason why you deserve to be hit by terrorism – allowing Obama to totally submit, as a penance to the Islamic world.
