How is only giving civilian trials to the guys you know you can convict, and holding the rest in detention either indefinitely or sending them through a tribunal not the definition of a show trial?

Why is this necessary, to try KSM in New York? Why not a federal court in Nebraska (if at all)!
Some say Obama wants to prove that our justice system is the best in the world. No, what he wants is to undermine the system by forcing it to “live up to its rules”.

They can’t, and they know it. I’ve been trying to get some kind of answer all day. There’s nothing other than flat out partisan vitriol supporting this decision.
It’s like the administration’s stance on Honduras, only several orders of magnitude worse. I tried for weeks to get any of our lefties to provide some logical reasoning behind that position. They couldn’t then, and they can’t now.
But rather than admit it, they’ll stick to petty attacks on tangential points or avoid the thread completely.

“A show trial” that minimizes terrorism and berates Bush is grotesque, and that’s exactly what Team Barry wants. Holding these trails in New York to embarrass Barry’s political predecessors and detractors, while simultaneously providing terrorists with ample legal means to suppress evidence, change venue, etc., is an unbridled dishonor to the 3000 Americans massacred on 9/11.
Barry should be tried for crimes against all humanity.

This is true. But I don’t think he can pull it off. He will be lucky if he can get the economy back to where it was when he got the job. The truth is Bush might be starting to look pretty good to some folks in the months ahead…maybe that is why Obama wants to enlist the aid of his terrorist buddies to trash the man in open court.

I won’t pretend that I know what goes on inside the head of a New York liberal, but one has to think that the horror of being in Manhattan that September morning will override their stupor.
What the terrorists were attacking were the very concepts that are enshrined in the document that Obama has just cloaked them in.
It is not an act of magnanimity to extend constitutional rights to enemy combatants – it is an act of folly.

Yes, I think that is the idea, but I am wondering how much damage it will do and who it will do it to. After the shooting at Fort Hood people might not be feeling all that concerned about what the CIA did to KSM and his friends. It will do more damage in that it will give the terrorists a theater in which to play out their nasty little drama. The propaganda for their ilk will be a real shot in the arm to AlQaida.

If the CIA hasn’t gotten rid of all the tapes yet I hope they are on it. Does anyone think that someone will find a reason in this trial to release the rest of the Abu Gariab (sic?) pictures? I know it doesn’t have anything to do with these folks but the WH has been dying to get them out in the public. He needs something to remind folks that they were unhappy with Pres. Bush.

I know that Obama wants to remind people that they were unhappy with Bush, but in the months following 9/11 Bush’s approval rating was almost 90%. Bringing the whole thing to Manhattan might also make people remember Bush standing on that pile of rubble with the blow horn in his hand. That is something Obama might not want them to think about.
As for the pics, who knows? But no one died at Abu Ghraib, the same can not be said for Ground Zero. Those are the pics the people will see. Who knows, maybe they will play scenes of that day, scenes of people jumping from the building.

I think Obama looks at this as a win-win for himself and his political philosophy. Out of the trials, he gets two possible outcomes:
1) KSM and others are convicted. Win for anti-terrorism. BUT, during the trial, Bush and others are dragged through the mud resulting in propaganda for the libs. In addition, in order to achieve a conviction, the what, where, why, and how of intelligence gathering techniques are revealed — resulting in a win for Obama’s other buddies, those who revile and hate the US OR
2) KSM and others are acquitted. As someone else pointed out, Obama can’t let KSM walk, so he’s going to have to over-rule the judiciary and/or go around its decision. This will occur with the approval of the majority of the American people — some of whom will point out that this was foolish to begin with, but will still support whatever legal shenanigans are used to make sure KSM. Actually, I think this is the outcome Obama and the statists in his administration would prefer. He gets to set a precedent for setting aside a judicial decsion, for putting someone in double jeopardy, and essentially subverting the American legal system. He will do this with the approval of the majority of the American people because of the situation. But, once the precedent is set, it sets him up for other such abrogations, a little at a time, thereby eventually relegating the Constitution to an “interesting historical document” that served well in its day, but is no longer relevant in our more complex, advanced society. Obama gets the other wins stated above in addition.
The cynical part of me wouldn’t be surprised if they set conditions up for decision 2 because they benefit more from it.

Did KSM commit a crime on American soil? Even the conspiracy being what it was, and coming to fruition, means that he led to crimes being committed, but did he, in fact, commit a crime within the Constitutional reach of our courts? I do not believe he did, therefore, even though Holder is ‘guaranteeing a conviction,’ I don’t think he can get it.

That is why they passed the Military Commissions Act in the first place…to get past all the lawyers who were gumming up the works. From the gitgo they had lawyers arguing with them about everything they tried to do and after the Hamdan decision from the Supreme Court they had to write legislation to satisfy the Justices as well. It was a long haul just to get to the place where they could try them.
