“Please spare us talk of the ‘rule of law.’ If that was the primary consideration, the U.S. already has a judicial process in place. The current special military tribunals were created by the 2006 Military Commissions Act, which was adopted with bipartisan Congressional support after the Supreme Court’s Hamdan decision obliged the executive and legislative branches to approve a detailed plan to prosecute the illegal ‘enemy combatants’ captured since 9/11.
“Contrary to liberal myth, military tribunals aren’t a break with 200-plus years of American jurisprudence. Eight Nazis who snuck into the U.S. in June 1942 were tried by a similar court and most were hanged within two months. Before the Obama Administration stopped all proceedings earlier this year pending yesterday’s decision, the tribunals at Gitmo had earned a reputation for fairness and independence…
“Most Americans, we suspect, can overlook the legal niceties and see this episode through the lens of common sense. Foreign terrorists who wage war on America and everything it stands for have no place sitting in a court of law born of the values they so detest. Mr. Holder has honored mass murder by treating it like any other crime.”

Every time I see an image of the awe-inspiring Twin Towers at the start of Barney Miller, Spin City, Law & Order, etc., it makes my blood want to boil.
It always brings me back to the image that is still on the home page for the KSM thread; the towers engulfed in smoke. The sick feeling of knowing that you are watching people die comes vividly into focus again, and my resolve to vote for people who will protect our nation and our Constitution grows stronger.
All rationalization aside, the idea of holding a criminal trial for that vile POS instead of following through with the well-thought-out, Constitutionally (and otherwise) legal process that was painstakingly put in place makes me want to vomit.

I’m thinking Bloomberg needs a “Jihadi Task Force” to be assembled and paid for through Porkulus to quarantine any fanatics of the Mohammedean persuasion in town.
Our guys gotta know where they are and even if they don’t all suspicious behavior can be put on the WH web site to be tracked. /
They’ll likely insist on trial according to Sharia law anyway and demand a jury of their peers. That’s ok cause when all the Hajis show up in court they’re identified and arrested. I mean if they are peers, well, their guilt is already established, so use the proceedings to gather up the trash.
Then take em to ground zero and let all the families that lost loved ones on 9/11 stone them with pork ribs and rubble from the towers. Make sure it’s televised on Al Jezera.
And I’m being merciful, but just.

From Alinsky’s rules:
4. Make the enemy live up to his/her own book of rules.
Remember, in Obama’s mind, the United States is the enemy.
He is using our own system of justice against us.

I believe it is pretty darned obvious why Obama is doing this. HE wants to bring the terrorist to NYC, put on this big trial and then go around and claim that HE was the one who brought the terrorist to justice.
He wants to take credit for the conviction in a very public way. He is doing it for political reasons to (in his mind) telegraph that he is tough on terrorism.
What he doesn’t get is how it has already backfired on him. Bringing that terrorist to NYC will place millions of citizens needlessly at risk. He has place citizens at risk to have his little show in order to show what a tough guy he is.
He’s a jerk.

Revisit his upbringing, his associations, his espoused beliefs and all the other evidence. BTW, I have no doubt whatsoever that his academic record is sealed, not because of poor grades, but because it sheds light on his Marxism and anti-Americanism.

Right. But a radical bent on destroying a system attempts to hoist a system on its own petard, so to speak.
justltl on November 14, 2009 at 3:22 AM
This is a common technique of the left. One very common example is the left using even a very minor misbehavior by a conservative as a bludgeon to destroy them, while tolerating or even promoting said behaviors amongst themselves.
justltl on November 14, 2009 at 3:28 AM
An example would be how they brought down Trent Lott.
To do this successfully requires timidity and a weak spine on the part of the group being attacked (Republicans in the Lott example) and a supportive media to do the hounding.

The only AQ terrorist I want in a Federal Court is the one associated with the USS Cole bombing. He should be tried under 18 USC 1651:
As established by the 19th century SCOTUS and not overturned, the High Seas include being within reach of the High Seas even when at a port in territorial waters. Only once past a headland are you out of the reaches of the High Seas, which is what President Reagan attacked Qaddafi about. The port the Cole was at was in territorial waters, but also within the reaches of the high seas – all videos of that event show a wide, clear horizon of the seas and no headlands of any sort.
Establish al Qaeda as a Piratical organization, which is just terrorism on the High Seas, and all members of that organization are then Pirates and need only the simple membership with the organization to be tossed into jail for life. So when they get get captured by our military they get GC IV, Art. 26 treatment as spies and saboteurs or others committing war crimes, and if you pick up a member at home he goes away for life on the simple association with al Qaeda.
KSM should have had his second and speedy second tribunal and be at an end of his life by now. He mocked us for being unable to do that. He deserves no civil trial for his war crimes.
That would be ‘doing the right thing’. Active Jihadis get military tribunals; plotters and conspirators caught before hand go to life in prison, no parole, on simple finding of association, membership or working with al Qaeda.
We won’t do that, of course.
We are too ‘civilized’ to follow the actual rule of law.
ajacksonian on November 14, 2009 at 5:24 AM
Despicable – but it will provide ample reason to highlight Zero’s incompetence and detached from reality world views.
I wouldn’t be shocked at all to see this trial start off with Zero bowing to KSM.
My biggest fear is that al-Qaeda actually starts to play along with Zero and that sets us up for a bigger hit later.
I do worry about the people of NY during this trial. I don’t think they should be put thru this BS circus trial.
That decision is shameful and I hope NY does not suffer further for this administrations arrogance and callousness.

What about the jurors? One of the reason the Bush administration wanted to try these people in a military court was to avoid placing civilians at unnecessary risk. These people have families, what will happen to them if the jahadis figure out who they are?
And if it is a civilian court, why wouldn’t they find out?

Zero can’t decide on his next move in Afghanistan, but he is full of brilliance when it comes to attacking US… Scum.

BTW… I heard that there is a growing feeling along the lines of ‘can we have Bush back?’ Been there a lot lately myself. At least when we were attacked, Bush was a Commander… Not ’shout out to my peeps… Yo!’ Bama is such a low brow as a leader it would be hilarious if it were not life and death.

AQ represents no country, We are not at war with Afghanistan, these Horrorist are illegal combatants. They have no rights at all. They seek to destroy civilization. To give them same rights as US citizens, well is a very sad moment in US history. They belong in a military tribunal, at best.
Its also very stupid politically. Obama thinks he will be seen as a hero, who brought the Terrorists to justice. He will first have to change back the definition for Terrorism.
This trial will be a very big recruiting tool for AQ.
It looks like we might have Horrorist convention in NY. God Help US!!!

Is this somehow part of Cloward-Piven? Using a manufactured crisis (the noble trial of KSM) to somehow impune the United States and convince us to turn from our heritage? This administration is either incompetent or evil or all of the above.
Christian Conservative on November 14, 2009 at 8:26 AM
I won’t argue with that statement. But I will say that I firmly believe that everything this administration does is done in a deliberate way and is done to advance their agenda.
galvestonian on November 14, 2009 at 8:36 AM
ALL of the above!! I’m just not sure which one carries the most weight in this administration.
ladyhawke53 on November 14, 2009 at 8:39 AM
Actually, it’s not even part of the Presidential Oath:
The information below is courtesy of the Architect of the Capitol. It has been compiled by the Office of the Curator from contemporary accounts and other sources in the files of the Architect of the Capitol.
Each president recites the following oath, in accordance with Article II, Section I of the U.S. Constitution:
“I do solemnly swear (or affirm) that I will faithfully execute the office of President of the United States, and will to the best of my ability, preserve, protect and defend the Constitution of the United States.”
But then again, he’s not an NBC either. A systematic dismantling of our Constitution is underway, starting with his usurpation of the office. Add in the Czars who have power but no oversight, the takeover of the financial markets, and the “healthcare” legislation being rammed through (and the stalled “Cap and Trade”) and you have the recipe for “fundamentally changing America”. This decision is just the frosting on the cake and serves as the ultimate distraction. While an angry America is consumed with this discussion, the plan (Cloward-Piven) continues uninterrupted. And it’s working better than expected.
singer on November 14, 2009 at 8:51 AM
I really think the Holder decision is a poorly calculated political move. The administration thinks that they can get the base all pumped back up by actually putting the Bush Administration on trial. And think that when KSM and others walk out of the courthouse scott free, it will be the Bush administration that gets the blame. And I guarantee that is the way they will spin it.
Ain’t gonna work Barry. This travesty of a trial will go on well into 2010, and the results will probably happen right before the mid-terms. Guess who is going to suffer the most politically from the backlash?

Good for Krauthammer.
Mukasey made the same reference to the US double NAZI invasion of our east coast during WWII, pointing out that in fact they wore their uniforms during their invasion from their ship to our Atlantic shoreline specifically so that were they caught at their plans most vulnerable point (at entry) they’d enjoy the rules of the Geneva Convention and be taken POW rather than executed as enemies of the state committing sabotage. They buried their uniforms once reaching shore, were apprehended in civilian clothing, and within weeks were given tribunal and were executed prior to the judicial determination as to status, the civilian court determination did meet the same conclusions as the military tribunal. Mukasey reminded us that America knew how to make decisions then.
I remind today’s MSM that those whom the media tout as America’s Greatest Generation should be honored by the media exemplifying the right way today and reporting honorably rather than fomenting Obama/terrorist sedition.
flaming Obamao
Note the media defining the The Red Guard, who caused chaos during the Cultural Revolution in the 1960s.–CHAOS hardly does justice describing the brutal massacre of every person wearing eye glasses, of every person with an education, of every person with any personal possessions, of every person over the age of 30, of every person deemed “unworthy” of the new Owner, of every non-male baby or child after “One” allotted per family. GENOCIDE of every unwanted slave hits the Chinese Cultural Revolution closer to the mark, taking into account that those in power cast the die of which class/tribe/caste lived and which were exterminated. Don’t lie to tell me that the Chinese peoples don’t recognize their own distinctions racially/culturally one province from another, and harbor their own biases against others.
“Obamao!” Wearing the US Flag lapel pin backwards, no detail left untended.
The article said that the Chinese people would have no problem determining which one is Obama.
At least they aren’t claiming to be color blind.
They recognize the world’s new Mao. In the people’s exuberant honesty, their government ordered them to stop marketing truth for the sake of international PR. Too late. Cat’s out of the bag.
Obama, our worst nightmare. It isn’t surrealism, this is real expressionism. Munch’s “Shriek” and Berg’s “Shriek” permeate the “new world” USA with destruction through the same imperialist/Marxist forces as fomented last century, evolved into global governance. There will be no “new world” to escape the hell of Marx.
CHANGE WE CAN BELIEVE IN = ‘Abandon all hope, ye who enter here’, because those condemned to Hell have forever lost their chance of salvation [US Constitution].

This so called trial won’t even start for 4 years. If Holder is such a great prosecutor, you’d think he’d be ready before then. Maybe NY won’t be bankrupt after the Won bails it out and can afford all the extra security it’s going to take to protect these evil doers. Right now NY can’t protect squat.

I’m sick to death of the liberal crap I’ve here, defending KSM and America’s enemies.
Fine for you, then. Bring KSM to your leader’s trial. And when he walks, remember you libs own it.
Others like me, though, tend to think this way:

Which is also why you better be very afraid for your leader and your cronies in Congress. The political blowback, at the ballot box, is soon to smack you libs upside your empty heads. You libs think our tea parties are bad? Wait–just wait. Middle America hasn’t started yet. We’re only revving up, to come at you libs and smash you politically on every level.
Yes–mock me, libs. Mock the rest of us. You do so at your own political peril.

Cindy Munford on November 13, 2009 at 10:18 PM
I think we were doing a pretty darn good job in ‘extracting’ information from these nutjobs that were saving millions of innocent lives…..
Now that that is behind us, we can now begin the show trial in which KSM can get up on the soapbox in the shadow of the twin towers and explain to the world how America is evil and how this was justified.
By the time they are found guilty, the damage will have been done, innocent lives will have been compromised (jurors, judge, security) and the enemy will have had ‘their day in court’, granted the same rights as you and I.
Disgusting.
tatersalad on November 14, 2009 at 9:27 AM
Actually you couldn’t be more on target.
The athleticism demonstrated by Hussein during the deep bow is the highlight of his presidency. As it unfolded I thought for sure that Obama’s head was going to end up in King Abdullah’s crotch but Obama maintained his equilibrium until he was able to resume the posture of homo erectus, which for him is quite unusual.
Unfortunately, this athleticism was balanced out by the 50 foot girlie pitch at the All Star game that was so pathetic the cameras had to pan away to save his presidency.

Basilsbest on November 14, 2009 at 9:31 AM
I almost retched to see that photo. NO American president should ever bow to any foreign head of state.
Which further convinces me Obama is NO president of the United States.

Imagine the worst-case scenario: During trial in NYC, a suitcase nuke is detonated in lower Manhattan, rendering the city a radioactive ruin.
Results: KSM and the other defendants achieve their long-awaited martyrdom. World financial markets spasm/rebound out of control for months. The precarious, bankrupt US financial juggling act crashes to smithereens. Obama declares martial law. The 38 czars are revealed as his new shadow government, with a czar for every facet of his new statist utopia. The UN is suspended until it re-emerges in a new site a year (or more) later. Obama is overlord of the USSA, and he delivers this prize to the jurisdiction of the China-led New World Government.
Game, Set and Match.

Sorry if this is repetitive. But Charles K is the most articulate, consistent, widely viewed public daily opponent of Obama’s policies on a wide range of topics. His recent works (after stumbling around concerning the ‘anger’ at the tea parties and town halls) have been spot on. His star is very bright right now, when we need it most.

In response to Cindy’s question “As crazy as this move makes me, I have to ask….why didn’t W dispatch these folks before he left office?”
Karl Rove gave a great explanation the other day as to why the detainees are still at Gitmo. To my understanding, the Bush Administration wanted to keep the detainess from a trial for awhile in order to obtain information about possible future attacks. Then when they tried to move the detainees to trial, they were consistently blocked by trial lawyers and special interest groups.
Also, Bill O’reilly gives a great talking point on this on his 11/13 show. http://video.foxnews.com/#/11588319/talking-points-1113/?category_id=9ccf127ad00c53ab8708e18e946bf50e83958340
