KSM, 4 other 9/11 figures to be tried in NYC

The Obama administration will send five of the 9/11 plotters to New York City to face a criminal trial for their part in the terrorist attacks that killed almost 3,000 people. Among the terrorists to be tried is mastermind Khalid Sheikh Mohammed, perhaps the most notorious detainee currently at Guantanamo Bay. The decision will raise questions about security — and what Obama is prepared to do if prosecutors fumble the case:
Self-proclaimed Sept. 11 mastermind Khalid Sheikh Mohammed and four other Guantanamo Bay detainees will be sent to New York to face trial in a civilian federal court, an Obama administration official said Friday.
The official said Attorney General Eric Holder plans to announce the decision later in the morning. …
Bringing such notorious suspects to U.S. soil to face trial is a key step in President Barack Obama’s plan to close the terror suspect detention center at Guantanamo Bay, Cuba. Obama initially planned to close the detention center by Jan. 22, but the administration is no longer expected to meet that deadline.
The New York case may also force the court system to confront a host of difficult legal issues surrounding counter-terrorism programs begun after the 2001 attacks, including the harsh interrogation techniques once used on some of the suspects while in CIA custody. The most severe method — waterboarding, or simulated drowning — was used on Mohammed 183 times in 2003, before the practice was banned.
Curiously, though, the White House has not abandoned military tribunals for some of the Gitmo detainees. Abd al-Rahim al-Nashiri, one of the terrorists behind the attack on the USS Cole in Aden nine years ago, will not face a criminal trial but will have his case adjudicated by the military tribunals at Gitmo. So will several other detainees, who will be named in by Attorney General Eric Holder later today.
So why bother to try the 9/11 “suspects” in the Big Apple at all? One rationale for the split could be that Nashiri attacked a military target while the 9/11 Five attacked civilians. However, the 9/11 plot also killed almost 200 people at the Pentagon, most definitely a military target. That alone justifies a military tribunal rather than a criminal trial for KSM and the others. Besides, if several of these terrorists get tried at Gitmo, trying the 9/11 plotters elsewhere isn’t going to close Gitmo any faster.
What do we get from having the 9/11 plotters tried in criminal court in New York City? Well, we get to have the city painted as a big, bright target for terrorist action during the entirety of the trial. Thanks to press coverage, which should be an order of magnitude more obsessive than the OJ Simpson trial in LA fourteen years ago, jihadists will come out of the woodwork to make a big international splash, or more likely a boom. We also give KSM and his cohorts a big, juicy media platform for their bile. That was one of their motivations for conducting the attack in the first place, and we finally get to deliver it to them.
Another rationale for exempting Nashiri has to do with evidentiary problems, as the Washington Post reports:
The case of one of the al-Nashiri is complicated by the fact that he is one of three detainees known to have been waterboarded during his interrogation. That means that some of the evidence obtained from him could be tainted. …
That leaves up to 75 individuals remaining at Guantanamo who could continue to be held under the laws of war because they are deemed too dangerous to release but cannot be prosecuted because of evidentiary issues and limits on the use of classified material.
That brings up a key question. What happens if the judge throws out key evidence over nitpicky technicalities? What happens if KSM and others get found not guilty because of gaps in the evidence chain resulting from national-security issues or “evidentiary issues”? Will Obama let them walk away? If that happens, look for a massive amount of anger to overwhelm the naive Commander in Chief. And if Obama isn’t prepared to let them walk after a potential acquittal, then it makes a mockery of the criminal trial, and of the justice system itself.
These terrorists belong at a military tribunal, not the justice system employed for Americans to judge other Americans for civil criminal conduct. Instead of giving these men the oblivion they deserve, we’re incentivizing further attacks on the US by giving them the biggest possible PR platform. We may as well put them on TV and call it Dancing With the Terrorists, or So You Want To Be A Jihadist Martyr.
Update: As far as Nashiri goes (and I can’t believe it took me this long to remember it), the waterboarding issue doesn’t really fly as an explanation. Why? KSM got waterboarded, too, and Obama will put his fate in the hands of a criminal court.

Which is why KSM’s lawyers can probably keep his case on appeal forever – it’s not hard to claim he didn’t get a fair trial or that some procedure of civil law wasn’t followed by the military etc.

I have a feeling they will deeply regret this decision. Their ideology keeps them from regretting most of their weong-minded ignorant decisions. I’m sure on this one, the enemy will make dam sure they regret it. Holder is truly loving the attention. I just realized, he wants to be America’s second black president. Unbelievable, one man of his experience and stature could be this ignorant.

I am proud to be an American (Texan-American that is). I love this country. I cried this morning watching a 12 year old boy who bravely alerted the police to how many guns and hostages a man had taken at his school because he learned his skills and bravery from his military brothers and the Cub Scouts. That is America – brave, smart and quick to act.
However, I have no respect or trust for our current leadership. This is just unbelievable! But, again, my pride of being an American comes through with the fact we are a peaceful democracy, I have a voice and can vote come November 2010 to help change the direction my country is heading down.

I don’t see how the Yousef and Blind Sheikh trials incentivied anything that happened afterwards, most of the bombings after the first trials in the 90s were overseas. I don’t see a historical example to back that up.

(1) The buildings were designed to withstand multiple aircraft impacts.
(2) The fires burned neither hot enough nor long enough to weaken, much less melt, steel.
(3) If the steel had weakened, it would have brought about a very gradual, asymmetrical sagging, not a complete, abrupt and total “collapse”.
(4) The towers were turning to dust from the top down.
(5) It would have required the equivalent of 2.4 Hiroshima-sized bombs to bring this about.
(5) There were explosions in the subbasements 14-17 seconds before reverberations from the alleged aircraft impacts.
(6) These explosions drained the sprinkler systems of water lest they extinguish the modest fires.
(7) Heavy-steel-construction buildings like the towers are not capable of “pancake” collapse.
(8) WTC-7 came down in a classic “controlled demolition” at 5:20 PM.
(9) The hit point at the Pentagon was too small for a 100-ton aircraft with a 125′ wingspan and a tail that stands 44′ above the ground.
(10) There was no massive pile of debris: no wings, no tail, no seats, luggage, bodies. Not even the engines were recovered.
(11) The official trajectory–flying just above ground level at over 500 mph–is not even aerodynamically possible.
(12) The videos don’t show a Boeing 757, which would have been very conspicuous.

It is also a diversion from the healthcare debacle–trying to bring back Bush hatred. They are losing the independents and want to refresh their memories as to why they voted for Obama.
It is all a ruse, and a political ploy, costing poor New York even more money. It is like they are having to pay twice for 9-1-1.

So if they were imprisoned or put to death by a tribunal, that would have changed anything? The jurisdiction didn’t matter. In fact the idea behind 9/11 was much Yousef’s idea, it was a variation to the Bojinka plot, when foreign intel agencies heard the news on 9/11 they thought it was Bojinka carried out. WTC was going to remain a target until it came down, the trials didn’t change that.
The strange thing is that when ISI got Yousef, KSM was supposedly in the same building, just not in the same place and got away.

Why not? As a federal judge your job is totally safe until they take you out of your chambers feet first, you’d have the greatest security measures possible, and you’d be the toast of the left. There really is nothing to analyze here-either we allow ourselves to be destroyed or we go on the offense and defeat them. Islam is in a perpetual war against us non-muslims until it rules the world…its time that we fight this war properly and win. More than our freedom is at stake, its the Enlightenment, democracy and modern civilization.

I expect KSM to be convicted of something and get five years less time served plus five years probation. Obama will tell us that this proves criminal courts will convict, and the world will be wonderful.

This is all about sending a message for the Boy leader.
- He hates the silly notion of the “war” on terror and feels it should be a law and order issue. He has no interest in winning in Afghanistan or Iraq, he just doesn’t want to be there and by declaring 9/11 a civilian law and order issue he paves the way to run away from Bush’s War on Terror.
- He and his leftist inner circle hate Bush and his policies, presumably more than the terrorists themselves. He feels this is the best way for him to target the CIA with Bush/Cheney being collateral damage even if it risks some of these Terrorists going free on technicalities. Guantanamo will be closed, and a warning shot will be sent to consevative hawks in power that whenever a liberal gets back to power, they will get even. The ACLU and the rest of the leftist base will be pleased.
This is such a boneheaded move politically that will haunt this President for the rest of his term that I am confident he is 100% subservient to the most extreme of left wing interest groups. In the middle of his all important healthcare agenda he allows something like this to break? I am very concerned what else this President will push on us because it seems political survival isn’t too much of a concern to him at the moment. Change will be coming fast and hard.

you’re right, but think in terms of the jihadist mind and the lessons of recent history. What motivated KSM and Zawahiri when the blind sheik was tried and imprisoned is now a factor again. As long as a trial and incarceration goes down in Gitmo, KSM is an abstraction in the mind of the jihadi sympathizer, while NYC is accessible, a media hub, a symbolic target. This is a bad move on many levels.

Another thing, I have no idea why Abd al-Rahim al-Nashiri is being tried on Military Tribunals. Is Hasan being tried there as well? Both of them had military targets?

No way that this should be in a civilian court. The actions of these terrorists were acts of war and should be treated as such. My question is why they haven’t already appeared before a military tribunal and been convicted and executed.

I should be clear – I have no idea if Nashiri’s confessions were actually false or not. Nobody does, since he was tortured to give them. That’s why you don’t use torture.

If these vermin were captured in the US by civilian law enforcement, the Feds should be trying them. Hell, if they were caught by law enforcement anywhere in the world and extradited, I can still see them being tried in civilian court.
But they were caught by military forces during military operations in a combat zone. The military should be trying them.
