KSM, 4 other 9/11 figures to be tried in NYC

The Obama administration will send five of the 9/11 plotters to New York City to face a criminal trial for their part in the terrorist attacks that killed almost 3,000 people. Among the terrorists to be tried is mastermind Khalid Sheikh Mohammed, perhaps the most notorious detainee currently at Guantanamo Bay. The decision will raise questions about security — and what Obama is prepared to do if prosecutors fumble the case:

Self-proclaimed Sept. 11 mastermind Khalid Sheikh Mohammed and four other Guantanamo Bay detainees will be sent to New York to face trial in a civilian federal court, an Obama administration official said Friday.

The official said Attorney General Eric Holder plans to announce the decision later in the morning. …

Bringing such notorious suspects to U.S. soil to face trial is a key step in President Barack Obama’s plan to close the terror suspect detention center at Guantanamo Bay, Cuba. Obama initially planned to close the detention center by Jan. 22, but the administration is no longer expected to meet that deadline.

The New York case may also force the court system to confront a host of difficult legal issues surrounding counter-terrorism programs begun after the 2001 attacks, including the harsh interrogation techniques once used on some of the suspects while in CIA custody. The most severe method — waterboarding, or simulated drowning — was used on Mohammed 183 times in 2003, before the practice was banned.

Curiously, though, the White House has not abandoned military tribunals for some of the Gitmo detainees.  Abd al-Rahim al-Nashiri, one of the terrorists behind the attack on the USS Cole in Aden nine years ago, will not face a criminal trial but will have his case adjudicated by the military tribunals at Gitmo.  So will several other detainees, who will be named in by Attorney General Eric Holder later today.

So why bother to try the 9/11 “suspects” in the Big Apple at all?  One rationale for the split could be that Nashiri attacked a military target while the 9/11 Five attacked civilians.  However, the 9/11 plot also killed almost 200 people at the Pentagon, most definitely a military target.  That alone justifies a military tribunal rather than a criminal trial for KSM and the others.  Besides, if several of these terrorists get tried at Gitmo, trying the 9/11 plotters elsewhere isn’t going to close Gitmo any faster.

What do we get from having the 9/11 plotters tried in criminal court in New York City?  Well, we get to have the city painted as a big, bright target for terrorist action during the entirety of the trial.  Thanks to press coverage, which should be an order of magnitude more obsessive than the OJ Simpson trial in LA fourteen years ago, jihadists will come out of the woodwork to make a big international splash, or more likely a boom.  We also give KSM and his cohorts a big, juicy media platform for their bile.  That was one of their motivations for conducting the attack in the first place, and we finally get to deliver it to them.

Another rationale for exempting Nashiri has to do with evidentiary problems, as the Washington Post reports:

The case of one of the al-Nashiri is complicated by the fact that he is one of three detainees known to have been waterboarded during his interrogation. That means that some of the evidence obtained from him could be tainted. …

That leaves up to 75 individuals remaining at Guantanamo who could continue to be held under the laws of war because they are deemed too dangerous to release but cannot be prosecuted because of evidentiary issues and limits on the use of classified material.

That brings up a key question.  What happens if the judge throws out key evidence over nitpicky technicalities?  What happens if KSM and others get found not guilty because of gaps in the evidence chain resulting from national-security issues or “evidentiary issues”?  Will Obama let them walk away?  If that happens, look for a massive amount of anger to overwhelm the naive Commander in Chief.  And if Obama isn’t prepared to let them walk after a potential acquittal, then it makes a mockery of the criminal trial, and of the justice system itself.

These terrorists belong at a military tribunal, not the justice system employed for Americans to judge other Americans for civil criminal conduct.  Instead of giving these men the oblivion they deserve, we’re incentivizing further attacks on the US by giving them the biggest possible PR platform.  We may as well put them on TV and call it Dancing With the Terrorists, or So You Want To Be A Jihadist Martyr.

Update: As far as Nashiri goes (and I can’t believe it took me this long to remember it), the waterboarding issue doesn’t really fly as an explanation.  Why?  KSM got waterboarded, too, and Obama will put his fate in the hands of a criminal court.

Liberals can’t wrap their brains over the fact that terrorists can not be treated as ordinary criminals. Criminals aren’t incarcerated for pre-meditated crimes, but terrorists *have to be* because their crime usually ends up causing tremendous property damage and killing a bunch of people including themselves. If liberals are so concerned about common criminals becoming mis-identified as terrorists, then help us write the laws! Don’t put the entire country at risk over your stupid, irrational, moral-relativism.

Barack Hussein Obama is an absolute disgrace as president. These terrorists have not committed a crime, they have waged war upon the United States of America and violated the laws of war. They are not entitled to a civilian criminal trial. And as they are not part of any recognized military, nor in any uniform, they do not get the full protection of the Geneva Conventions. During WWII, a German submarine dropped off a few German soldiers on Long Island. These soldiers were out of uniform, and the two who surrendered themselves got life in prison, via a military tribunal. The rest got a death sentence that was carried out.

Not to mention, trying them in New York will not work. Any competent judge will have to move the trial to another location on “can’t get a fair trial in this town” grounds (too pissed off to think of the right words).

You cannot consider this engagement with Islamic terrorists to be a mere criminal matter. Our soldiers are not police officers, they do not collect evidence, preserve crime scenes, Mirandize prisoners or ask for search warrants.

Civilian criminal trials shows a certain level of unseriousness as to the existential threat posed by these terrorists and leads to either a lot of problems at trial or else a complete re-writing of rules of criminal procedure as well as the Constitution.

Dear Liar and His administration do not have the best interests of the United States in mind.

Once Obama and Holder actually figure out the down side to this option, let alone the NYC area Democratic pols like Chuckie Schumer, I’d be amazed if this trial starts any time within the next year, and possibly not until 2013.

Botch this in an election year and Obama could actually turn a good part of the northeast into Red States on the congressional and presidential level for at least a couple of years (News York liberals proved 16 years ago with David Dinkins and Rudy Giuliani that while they may love to show off their progressive and tolerant nature for the public, they’re not nuts when it comes to choosing appearing progressive over appearing to remain alive, and I’m sure voters in neighboring New Jersey and Connecticut would feel the same way).

This is simply an attempt by Obama to kick more crap on G.W. Bush.

The United States Government refused to prosecute Confederate President Jefferson Davis for treason after the Civil War. Why? Because they knew that Davis would use his trial to legitimize secession – and the Federal Government, having solved the question by force of arms – didn’t desire to give Davis the platform to do that.

This will give KSM and the others – not only a platform to legitimize their war on the United States – but they will also use the opportunity to put Enhanced Interrogation Techniques on trial. This is exactly what Obama and Eric Holder want to do – they really want some way to put G.W. Bush himself on trial, but they’ve failed to pry lid off that can – now they think they have a method.

And the gravy on the potatoes will come when KSM is either let off the hook completely or given a reduced punishment because of the way that evil duo of Bush and Cheney treated him.

This little piss-ant petty President has no plans, no vision, he’s bankrupt of all ideas. He’s a guitar player who can only play in one key – the BLAME BUSH KEY.

How many millions of dollars will be spent on security while this trial goes on? Money that could have been saved by keeping them at Gitmo and trying them there.

And BO gets his national emergency that allows him to suspend the Constitution, declare martial law and become king.

Do you folks really think that BO and the dems are so stupid that they would allow a criminal trial without good reason?

If KSM walks it will not only be the end of BO but of the dems and any progressive crap they have rammed down our throats. I just don’t see them willing to take the chance that he would walk so there has to be a power-play reason to do this.

If it is a civilian, criminal trial then that is up to the defendants. By going this route, KSM has the right to demand a jury trial. This is an utter betrayal by Dear Liar.

This will give KSM and the others – not only a platform to legitimize their war on the United States – but they will also use the opportunity to put Enhanced Interrogation Techniques on trial. This is exactly what Obama and Eric Holder want to do – they really want some way to put G.W. Bush himself on trial, but they’ve failed to pry lid off that can – now they think they have a method.

And the gravy on the potatoes will come when KSM is either let off the hook completely or given a reduced punishment because of the way that evil duo of Bush and Cheney treated him.

I agree with this in every aspect except the punishment KSM will receive. They’ll only try the guys they have a lock against. They get to bash Bush a bit and still produce a guilty verdict that’s politically popular.

They’ll be able to say “Look America, these trials worked. We upheld the values that make America great, unlike that terrible Bush guy, and still delivered justice.”

These terrorists belong at a military tribunal, not the justice system employed for Americans to judge other Americans for civil criminal conduct.

Bush understood this. Unfortunately, Dems in Congress (both houses) blocked him at every turn, and now one of them is in the Oval Office and they have the majority.

God help us all.

I still have a slim hope that enough outrage is generated that Obama will change his mind. He’s done it a few times before.

Are you all arguing, then, that the American justice system is so screwed that American citizens and courts can’t be trusted to deliver a fair trial and an accurate verdict?

Are you arguing that the people of New York should not have a chance to judge terrorists who committed crimes against them?

Are you arguing that we should try them in military court, because that would guarantee a guilty verdict and an execution?

Are you arguing that terrorists won’t be aware of the trials if they happen in Guantanamo and thus they won’t realize that it’s a good time to strike?

If we are arguing to the world that our system is fair, just and moral, and that we are morally superior to terrorists, isn’t it incumbent upon us to have a fair and open trial that reflects the U.S. Constitution and international law, not a trial that can be painted as a secret, Stalinist proceeding that has been rigged in advance?

Finally, don’t you think Obama, Holder, the NY U.S. attorney, Rahm, the Joint Chiefs and everybody else are at least as aware of the security, political and justice considerations as a bunch of bozos on a website?

Also, and this is a serious question, if the NY prosecution brings charges only for the NY attacks, won’t the military system be able to try them for the attacks on the Pentagon?
