Pelosi: Jail time “very fair” for failing to buy your patriotic ObamaCare coverage

It’s very fair to send people who disregard the federal mandate to buy health insurance to prison, Nancy Pelosi says, because otherwise they’ll assault citizens … with a bill for medical services … or something. Apparently, the occasionally unhealthy have become such a security risk that we need to imprison them for opting to pay their own way. Infidels Are Cool has the key exchange::

Pelosi: … The legislation is very fair in this respect.

Of course, the other option is to make people responsible for paying their own bills. Nothing requires us to pick up the tab for people in clinics or emergency rooms, especially those who can afford to pay their way. This is the point that Pelosi and her statist colleagues seem to forget. People who choose not to buy coverage even though they could afford it assume the risk of paying out of pocket — and that may be a very rational choice, as it is most unlikely that those people would use $3,000 a month in medical services, which is what their insurance would cost now.

If nothing else, it reminds us that statism always comes with handcuffs, and those cuffs always get explained by either fairness or patriotism. In this case, Pelosi uses both.

Mine too. A quick afternoon/evening read. But I think it might be telling of our futures. Liberals, I don’t think would intend to treat prisoners like the men of the “104th”. But the amount of people they will have to imprison because of not wanting or not being able to pay for their healthcare and the people they’ll need to imprison because of being in opposition to their politics will necessitate it. A failed economy won’t permit the lifestyle of present day criminals. Socialism and Communism always have fallen into this disrepair.

Ironic! Honest Americans who just wanted to be left alone to make their own way in this world will be treated worse than real criminals who have broken real laws.

It’s a reminder that we’re just avoiding the term fascism because it implies a repressive government. but all forms of statism are repressive.

The only way for the government to control a free market is to take away the freedom. Otherwise, people would just bypass the harmful new rules. Fascism may start off as “nice” and “fair,” but it always ends up the the government tightening its grip on individuals.

Can we call Obama a fascist yet? How about Pelosi?

I don’t know what kind of markup they charge for bullets, but even if they put a hundred in me, it should cost you less than even a week or two of prison.

I didn’t see anything in the final House bill that talked about penalties. There is a requirement to pay a 2.5% tax on your income if you don’t have qualified health insurance coverage at all times during the year (the tax is limited to the amount of a standard insurance premium). Since that’s a tax, you could go to jail in some situations if you don’t pay your taxes or file your returns when due.

FYI: The 2.5% tax is imposed on everyone in the US except non-resident aliens. That would technically mean that illegal immigrants who have income above the standard deduction and personal exemption amounts would have to pay the tax and file returns if they don’t have health insurance.

–If everyone is required to have health insurance or pay a fine, why couldn’t hospitals stop providing free health care to the uninsured (subject to the next sentence)? If someone is chosing to pay the fine instead of buying insurance, why couldn’t hospitals require those people to provide their social security card (or something similar) address, and proof of financial responsibility (perhaps a credit card or cash deposit) before providing any services?

The Supreme Court allows administrative “punishment” of ranchers, pilots, pharmaceuticals, and stockbrokers for noncompliance on the grounds that folks can be citizens without necessarily practicing those fields; if one “volunteers” to be a rancher, pilot, pharmaceutical or a stockbroker, then you volunteer to be subject to FAA, FDA and SEC regs and penalties.

It allows for administrative “punishment” in tax cases because the Constitution was amended to specifically allow for the collection of taxes.

Where’s the constitutional authority to do an end-run around the 4th and 8th amendment and have every adult in America subject to a ‘penalty’ fine, unless they prove compliance?

If Pelosi and the President believe the American people are in line for “punishment”, let them define a CRIME, set forth a fine, and then prosecute and prove people guilty beyond a reasonable doubt before exacting the penalty. This is a bill of attainder against the entire adult population of America.

And as with the Walpin fiasco, these guys are too stupid to commit their crimes in secret. They defined the purpose of the fine as a “penalty” not a revenue tool. The Bill of Rights limits your capacity to punish, dorks!

First, if Democrats really care about people buying health insurance that can afford it but choose not to buy it, why not just amend the Federal Bankruptcy Code? They can make medical bills to individuals who have not purchased health insurance a non-dischargeable debt, similar to Student Loans. Then, everyone with health insurance would not get stuck paying others’ bills. The ones who racked up the bills would be forced to eventually pay the bills themselves.

Second, it amazes me that Pelosi is willing to put US citizens in prison for not buying health insurance, but she is unwilling to pressure the Executive Branch into deporting illegal aliens who violate our country’s immigration laws and steal others’ identities to work.

Ah, yes. ONLY those people who have PLENTY of money to buy insurance, but choose not to.

Like a family earning 45,000. a year already on a limited budget making the mortgage payments and keeping up with the expenses for the car, groceries and utilities. Nothing for extras like wardrobe, toys, vacation. Yet somehow, 1/4 of their income that is already spent staying afloat is now mandated to be re-allocated to pay for what PELOSI determines is adequate health care, so adequate that Pelosi refuses to accept it for herself. But according to Pelosi, if you earn $45,000/year you have plenty of money to pay for the health insurance that she has mandated. You still have $33,000. to “spend” staying alive, so quit whining and get in line.

EMTALA legally, and ethically – people are treated. There are also DSH where the medically indigent are treated – but both bills (House & Senate) plan to slash their funding so as to shut them down. No one has any idea how the treatment for the medically indigent will be reimbursed – other than the Feds will try to pass it on to the states or counties which house the largest county hospitals.

If the government can punish you with jail time for not buying health insurance, can it also punish you if you abuse your health?

If I sign up for the government option but I live off Marlboros, McDonalds, and MD 20/20 – thereby putting my health risk – what consequences would I have to face from my health insurance provider? Would I be hit with premiums as I would be with private health insurance provider? And if I can’t afford to pay the higher premiums, then what?

Calm down — these “prison sentences” are a myth: The only people who’d face penalties are those who have plenty of money to buy insurance, but choose not to, says Karina Newton at Speaker Pelosi’s official blog.
And, frankly, they should be penalized: “Right now, every insured American family will pay $1,017 a year in insurance premiums just to cover the medical expenses of the uninsured. That’s $42.7 billion this year – or $1,354 per second.” And most of those who’ll get punished will find their cases handled by the IRS, which generally uses a “civil process” to settle “delinquent” payments, not jail time.

Liar. The criminal penalties can apply from discovery of nonpayment if the IRS wants to throw the book. And they are always there behind the “civil process”. And you don’t pay a penny for the uninsured who pay cash, so whoever the anonymous author of that statistic was, is also a liar.

Which is even worse…they can pick and choose who to prosecute depending on whatever standard?
So if you choose to send your kid to a private school, instead of buying health insurance, then you can be arrested because you have the money, you just used it “wrong”.
And if one of their wealthy buddies doesn’t, but one of their wealthy enemies doesn’t also…they pick and choose whom to prosecute. Not on who is breaking the law, but who they decide is breaking the law.
Kind of like if you are poor and rob a bank that’s okay…but if you have a few bucks that is bad?
What has happened to our country…besides the liberals have the vote…just answered my own question…

What I’m wondering is, what have they and are they doing behind the scenes where they can do all this stuff and easily get away with it…in other words, being able to stomp out any muss or fuss (opposition)quickly and decisively? If nothing else, it reminds us that statism always comes with handcuffs, and those cuffs always get explained by either fairness or patriotism. In this case, Pelosi uses both.

I get a stereo effect on this tape – the inquisitor’s voice is exclusively in the right speaker, the Speaker’s on the left (appropriately enough.)

I don’t remember ever having this effect before on a news clip. Is it typical?

It’s so striking that it made me wonder at first whether the voice was spliced in (although it’s clear in the tape that she’s responding to the question asked).
