Greg Hengler picks his favorite moment from the House debate on Saturday as the moment that Rep. Peter Roskam (R-IL) asked the question that could easily have been asked twenty years ago today at the Berlin Wall. If the ObamaCare proposal is so good, why do you have to imprison people who don’t want to participate?
We’ve heard from the best and the brightest all afternoon, and not a one of them have answered why it is that you have to criminalize people to coax them into a plan that’s so fabulous. It makes no sense. … The other side, with all due respect, with all the adjectives and all the flourishing speech, have failed to answer that question.
Why can’t they answer? They can’t. They need to force people into the system in order to spread the costs more evenly to everyone, which is why the House took the blatantly unconstitutional path of federal mandates for health insurance. They want to solve a problem involving 13% of the American population by burdening the 87% that doesn’t have the problem at all, rather than looking for a way to reduce health-care costs for 100%.
Ronald Reagan gave a brilliant speech in June 1987 in demanding that Mikhail Gorbachev “tear down this wall,” but he could just as easily have asked Gorbachev to answer this question: If Communism is such a benefit to its people, why do you have to force people to participate in it? The answer: Statism always requires force, and it always strips people of liberty. It always comes with handcuffs. That’s how we know it’s coming.

The point of all leftist efforts is to give them more power over you. The particular vehicle of implementation isn’t that important to the Left – they’ll take socialized health care, carbon taxes, or speech codes, whatever comes easiest.

The scheme gets worse every time one looks and the support drops…If the Senate takes its time and pushes the scam into next year, the level of bravery from dems in districts that strongly oppose the scheme will be notably less.

These leftover 60s radicals have not seen civil disobedience like they are going to see if they try to throw people in jail for not buying health insurance. There will be a movement of libertarians and even anarchists calling on people to drop their policies and refuse to participate. Is the government going to start sending jackbooted thugs to our doors to force us into this? Are there enough prisons to hold all of the new refuseniks?

I watched the WHOLE debate on CSPAN on Sat. The Dems told WHOPPER after WHOPPER after WHOPPER at the podium. I knew they were liars, but my jaw hit the floor at the parade of 200+ crooks. These people must be PARIAHS in their home towns. NEVER let an opportunity pass to CALL THEIR CROOKED ASSES OUT! Restaurants, movies, stores, malls, out for a walk, ANYWHERE. Do you not see where we’re going? Why should the government FORCE things like health insurance on people? Shouldn’t people have the right to say yes or no to health insurance like this? Or perhaps the government should enforce who should marry who and what the punishment for marrying outside of your kind, what job you should have, where you should live.
It’s a slippery slippery slope and this country has just took its first step down the hill.
(and no I’m not suggesting the Dems are Nazis, but it’s getting to be a close run thing)

I remember when that decision came down following a few forums that had a lot of lefties.
Since they didn’t actually RTFA they started off declaring this was a major abuse by those damn conservative justices and it just showed how we needed more liberalism.
I helped to point out the leftist block on the court had rendered the decision the state can take anything from you for any reason they can make up. The leftist reaction was interesting – some shut up, but a few completely reversed themselves. Whereas Kelo had been an abuse, now it was a poor decision, but better then what these leftists imagined that Scalia and co would have come up with were they a majority on the court.
The leftist ability to justify *anything* is astounding.

I plan on personally “opting out” and going to jail. But before that I will sell everything convert to gold, hide it, only my wife will know where it is. This way the IRS cannot confiscate an asset they can’t find.

Here’s a question:
I agree that Congress has no Constitutional power to force everyone to buy health insurance.
Does Congress have the Constitutional power to pass a 2.5% tax on your income, and waive that tax if you have health insurance?
If so, what’s the difference between that, and what Congress did?
If not, why not?

A free people will choose the best option for themselves; a good option needs no stick to prod the recalcitrant. Ruling a free people is difficult, if the people do not desire the same ends as the ruler.
Of course, ruling a slave population requires the use of the goad. That way, the ruler can force the population to perform as the State wishes.

The argument in question has nothing to do with the Constitution and actually never even mentions the lawfulness of the payment in question. It’s simply an argument saying if the state punishes you for not doing it, it must be statist. Which is a bad analogy considering our tax system.
