Bayh: Cloture vote, floor vote all the same

Harry Reid’s odd announcement this week on ObamaCare had some wondering whether he had agreement from moderate Democrats to support cloture, even if they wound up voting against ObamaCare when it came to the floor.  One of those moderates, Evan Bayh of Indiana, dispelled the notion that one would be significantly different from the other.  Bayh also warned that excessive fees and fiscal irresponsibility would doom his vote for either:

Sen. Evan Bayh (D-Ind.): Democratic leaders should be able to tell where Bayh is headed based on his vote on whether to move to a debate. The Indiana Democrat said Tuesday that he doesn’t see “much difference between process and policy at this particular juncture,” and that he’ll be “looking at those two things as one and the same.”

But Bayh said Tuesday that he’s not as concerned with the public option, saying he’s “more focused on is this fiscally responsible and what does this mean in terms of the premiums average families pay for those who currently have insurance.” Bayh said that Reid’s decision to reduce new fees on medical device makers has put his vote in play.

“Without that, they definitely would not have my support,” Bayh said.

This makes Reid’s move even more inexplicable.  All Republicans need at the moment are two Democrats to stop cloture, and one of those would balance Olympia Snowe — and with a public option, Snowe claims she’ll join Republicans anyway.  Losing Joe Lieberman yesterday was bad enough, but at least Lieberman is technically an independent.  Did Reid not check with his moderate Democrats to ensure they would remain on board?

Politico’s Manu Raju and Chris Frates also report that the two Senators from Arkansas are also in play for a filibuster.  Lincoln has already made her opposition to a public option plain, and says that she will not vote for cloture on a plan that includes one.  Now her fellow Democrat Mark Pryor says his vote on procedure will depend in part on Lincoln’s.  Ben Nelson, meanwhile, says he has no idea how he’ll vote because no one has produced a bill yet:

Sen. Ben Nelson (D-Neb.): Perhaps the most conservative Democrat in the Senate, Nelson said Tuesday that it’s “too soon” to say how he’ll vote, saying he wanted to see the official cost estimate and the language.

Asked if he could support Reid’s opt-out plan, Nelson said: “What is it? Have you read it? I’m not being feisty here. But nobody has read it other than the leader and some staff. That is the point.”

Will Reid’s bill get a CBO score before Reid offers it for debate on the floor?  Reid lost his Doctor Fix bill that would have hidden $250 billion in costs from the CBO, and that was before Reid added the public option onto the Baucus plan.  The CBO score will likely show Reid’s Frankenstein monster of a bill as a deficit buster, which will force Obama to either reject it or break his oft-repeated promise to do so on any bill that adds to the deficit.

That’s assuming it makes it that far, of course.  Nelson, Pryor, and Bayh have made it clear that they won’t back a bill that adds to the deficit, and all three won’t distinguish between procedural votes and floor votes on the bill itself.  That makes it look like Reid will be heading towards another embarrassing loss, just like the one he got on the Doctor Fix.

But if he’s sooooooo concerned about costs, how the hell is he not concerned about the public option????? Government run anything throws the term ‘fiscally responsible’ out the window and he knows it! Soaking the medical companies, who will then just pass along the costs to consumers is the least of our worries.

I don’t see how the Dems can credibly do anything on this bill when it was written in secret behind locked doors by only 3 senators and a member of the White House. But really, the real bill has yet to be written. What they have is just an outline.

How can they believe we are so stupid about the opt out option? Of course no state is going to pay taxes into a system and have their tax dollars shift to other states who don’t opt out.

I am really pissed they think we are this stupid. I hate them all.

I think Claire McCaskill is in play for a filibuster, too. Outside chance that Mary Landrieu is as well. Newly purchased democrat NC senator Hagan is hopeless. She’s as liberal as the man who purchased her chair, Chuck Schumer.

I cannot envision any circumstance under which Obama vetoes any healthcare bill. History says his promises mean nothing, and he is more than anxious to sign a bill and give a speech claiming that it is the greatest bill evah.

Clearly Reid is going down in flames no matter what happens. With one part of the troika gone, the other two (Pelosi and Obama) will be facing a prisoner’s dilemma. Expect to see Pelosi pushing Obama into this fray, since she has already staked her turf with the Public Option, whereas Hamlet on the Potomac has been sitting it out. Watch her and her flying monkeys start putting pressure on the great O to take a stand.

As much as I dislike him, Reid has been a boon to Republicans. Hopefully his Democratic replacement will continue to display the same rank incompetance and bumbling that we’ve grown used to from the current Sentate majority leader.

As Evan is my rep, i can assure you he is against the public option, he just cant come out and say it due to the liberal base in indiana. He is proud to be a fiscally conservative regarding budgets (dont ask me how as he voted for porkulous) but he also was bought and paid for by the insurance industry. He is going to stick with the spending issue because he knows that any bill will be a deficit buster so he can oppose it without having to oppose the public option per say.

Why did Reid go for the public option? They know that the Republicans and some Democrats will successfully filibuster any public option. Once they show the radical leftists that they cannot get the public option passed, they will drop it but make no other changes in the bill whatsoever. If the Republicans try to filibuster again, the media wing of the party will swing into action, decrying the Republicans as obstructionist. This will be used to justify the switch to a reconciliation approach where they only need 50 votes. It’s win-win-win; pacify the base, roll the Republicans, and get everything but the public option passed.

If Ben Nelson won’t vote for cloture before he knows what the bill will cost, then his vote is lost if Reid tries to push cloture before the CBO scores the bill, and it’s likely to be huge, meaning that Ben Nelson, Lieberman, and some other Democrats probably won’t vote cloture.

So if Ben Nelson, Lieberman, Bayh, and the two Arkansas Democrats (and possibly Landrieu of LA) don’t vote for cloture, does Reid actually think he can get 5 REPUBLICANS to vote cloture?

Besides, the “opt-out” option for states doesn’t really offer any advantages–the people in those states lose the government option, but still pay taxes for it, so there won’t be any takers.

Time for the next gimmick from Reid…while the opposition continues to grow. When will they take some advice from Hillary Clinton and just GIVE IT UP ALREADY?

Ignore everything else Bayh said… this is the important point. Indiana is home to Roche, Eli Lilly and several other major medical device makers.

Bayh doesn’t care one whit about “fiscal responsibility”, just look at his actions as Governor of Indiana. He DOES care about his campaign contributors.

That his actions now coincide with my desires is a happy coincidence. But it’s just that.

IMO the Senate and House are waiting on the results of Nov 3. The ones that are afraid are stalling for time I think. they want to see what happens next Tues and see if the which polls are correct. If VA, NY23 and NJ all go to reps looks for obamacare to go down in flames. If as is more likely Nj stays blue, Va goes red and NY23 goes blue or goes towards Dede they may continue with the bill. If all three races go blue obamacare will be passed within the week.

I hope they keep busting each others’ noses for months to come, and then the entire turdball plops down the drain in bitterness and acrimony, as is the most likely outcome. It’s so fragmented, and the leadership so weak, that there’s almost zero chance of passing anything but a bill that tinkers around the edges a little.

Look at it this way …

Dingy Harry is the Quarterback. Obama is the coach on the sidelines.

He’s been driving for the goal line for two quarters with the coach flogging him and telling him to get the ball into the end zone. But everytime he makes a first down – his linemen allow him to get sacked for 10 yards on the next play.

His linemen suck … the coach is beating the hell out of him … the crowd is rooting for the other team so what do you do?

You toss that ball into the end zone and pray that your guy catches it or the other team intercepts – because you’re tired and want to hit the bench.

That’s what this is – a “Hail Mary” into the end zone.

I’ll believe that when I see it. Until then this is all a game of charades with folks posturing, pretending to do their due diligence. Taking over 17% of the economy is just too large a prize for Dems and even some Repubs to pass up.

Here in Indiana, I can tell Evan Bayh that if he is the vote to kill this turkey of a bill, he’ll get the votes for reelection from conservities like me. If he supports Reid on this I’ll sell half of what I own to work for his defeat. Bayh, knows Hoosiers, and he knows this is not going to sell well at home.

I concur, although he pretty much lost me when he voted yes on Sunstein. I’ve always voted for Bayh, he has exercised good sense in the past. While I might (and probably will depending on his opposition) get over Sunstein and vote for him yet again, I WILL NOT get over his approving this bill. I will gladly join you in working towards his defeat.

Andre Carson – grandson of leftist Julia Carson (whose seat he took when she died) was on the local news this evening. He was really talking up the public option, how it will save money, yada yada yada.

I need to call Bayh in the morning to give him encouragement. I agree that there is no difference between the cloture and passage votes. If he votes for cloture and then against the final bill, that will count as a vote to pass it as far as his constituents are concerned. And he’s up for election next year.

My question is – if Hairy fails to get cloture, what will happen then? I can’t imagine that they will just drop it.

I believe they do want it to end at this point. I believe it’s obvious they aren’t going to get this thing passed. If they water it down too much (as far as they’re concerned) it will do more harm than good anyway because it won’t satisfy the lefties.

If they send the bill to the floor with a public option, it’s going to get defeated. The ultra lefties – Pelosi, Reid, etc., can say “we tried.” Those that defeat it can take credit for having beat back the beast. The ultra-left, then, can play the blame game by blaming the moderate DEMS and the right for creating pain and misery in the country. It’s the only way out where no one has egg on their face.

And to think these jackasses wanted that bill passed before August break. What a joke.

Same here. I believe the intensity of the calls and emails he’s been getting on this are getting through that thick pretty-boy skull. No matter how conservative he pretends to be (when convenient) he’s still a (D) and that means “deceit”. Never trusted him. Never will.
