EPA putting the brakes on coal

Almost two years ago, Barack Obama told the editors of the San Francisco Chronicle that anyone who wanted to open a new coal-burning electrical plant would get “bankrupted” by his policies. They may not even get the coal to burn, thanks to the EPA. The Washington Times’ Amanda Carpenter reports that the agency has held up scores of surface mining permits in an action that will get the attention of coal-producing states — and their Senators:
While campaigning for the Democratic presidential nomination, Barack Obama said his cap-and-trade tax plans would “bankrupt” anyone building a coal-fired power plant. Although those taxes haven’t materialized, the Environmental Protection Agency has put the brakes on 79 surface mining permits in four states since he was elected.
The EPA says these permits could violate the Clean Water Act and warrant “enhanced” review. But the agency went even further last week, announcing plans to revoke a permit for the Spruce No. 1 Mine in West Virginia – a move that has caused anxiety among coal-state Democrats about the future of the industry under the Obama administration. …
Although his favored cap-and-trade bill hasn’t yet been passed, West Virginia’s Democratic Gov. Joe Manchin III, who supported Mr. Obama’s candidacy, called the EPA moves part of a stealth campaign to stifle the industry.
“Right now, my belief is that they’re trying to kill off surface mining through regulation what they cannot get done through legislation,” Mr. Manchin told MetroNews Talkline, a West Virginia call-in radio program, earlier this month. In West Virginia, 23 permits are being held up, with other affected states being Kentucky, Ohio and Tennessee.
Speaking of Senators, West Virginia’s Jay Rockefeller is none too pleased at this action, either:
“I am angry with the EPA’s announcement that they will use veto power to revoke the authorized Spruce Mine permit in Logan,” he said. “It is wrong and unfair for the EPA to change the rules for a permit that is already active.”
To get cap-and-trade past a cloture vote, Obama will need Rockefeller and fellow WV Democrat Robert Byrd. That’s not likely as long as the EPA attempts to hamstring the coal industry through heavy-handed regulatory encroachment. But cloture isn’t the real problem. Coal states have elected a number of Democrats, from Indiana to Ohio to Pennsylvania to West Virginia, none of whom will get re-elected if they kneecap their states’ economies by allowing the Obama administration to bankrupt the coal industry — especially through EPA overreach.
ObamaCare has its difficulties with moderate Democrats, but this creates another layer of difficulty for the White House. ObamaCare would probably pass narrowly in the Senate if it could get past a cloture vote, which is why Harry Reid has threatened reconciliation to avoid the procedural hurdle. Cap-and-trade may wind up not having 50 votes in the Senate, thanks to the EPA and the economy-killing approach the Obama administration is taking on coal.

Boucher represents coal country, of course. but he thinks he is in safe district.
If i didn’t plan on spending all next election cycle, 2010, trying to rid the 5th CD, Virginia, of Dem, Tom Perriello, I would drive out to the mountains of Virginia to campaign against Boucher.

And Southeastern Ohio is also in that group. Southeastern Ohio is almost always a lock for Democrats because they are hill dwellers. If there would have been any racism stopping Obama from getting to the White House, it would have been from Southeastern Ohio Democrats, but I guess that didn’t happen.

I hate this sort of thing. One of the distinguishing features of the United States, even against many other Western nations, is the impartial rule of law. But that concept has suffered under Obama, as shown by this story here. Miners are finding it harder to get permits simply because the current government doesn’t like them. That’s the whole story. The government may cloak it’s actions in law, but this seems to be a case of the administration wanting to do something and then trying to find justification for it, rather than impartially applying the laws on the books.

So far in the last 3 years, since the dems took control of congress, the enviro types are celebrating the stopping of 100 coal fired plants from being built.
The irony is most of them would have replaced plants that are very old and would have resulted in a net lowering of pollution.
The Dept of the Interior has been nothing but a roadblock for drilling permits and leases and the EPA is considering adding other restrictions on coal fired plants.
Their idea of green energy has no way they can produce enough to replace even a few of the plants they have blocked.

Well that quote about bankrupting the coal industry and energy prices skyrocketing didn’t get out there until right before the election. And even then, people who didn’t frequent FoxNews, Drudge, or the blogs never would’ve heard about it. That Biden clip about “no clean coal” didn’t get much run either.
We have a severely uninformed electorate. Unfortunately they don’t get it until it hits them in the wallet. And by then it’s too late since we’re all getting screwed.
On the subject of energy though, is this adminstration doing anything positive in that area? Seriously, there’s no offshore drilling(unless we’re paying Brazil), no nuclear power plants, no refineries, no so-called green jobs, and now they’re blocking coal.

Come on, folks: this is absolutely no surprise.
Obama has his Regulations Czar, whose job is to find every way to push the radical left agenda, including closing down fossil fuel businesses, as soon as possible. Obama stated clearly: Coal companies will be bankrupted if they try to expand, and electricity rates will shoot up.
November 2010 is important for another reason: If Republicans can take over the house they can conduct hearings into all of these areas in which Obama wants to move by regulation rather than legislation.

The EPA jumped on that bandwagon when they started distating all sorts of policy in order to regulate the illusory “pollution” of CO2. Our new CAFE standards came to us by virtue of the dreaded CO2, and not anything to do with oil. California’s new emission standards (allowed when The Precedent signed the executive order encouraging states to try and kill everything in sight by competing regulation over any stupid thing they each wanted) were also CO2-based and not related to anything actually involving oil or cars.

There is good evidence to suggest that Tom Perriello did not want to vote in favor of Cap and Trade. A caller to Rush’s show indicated that an office guy at Perriello’s place said this, but then Tom went ahead and did it anyway (maybe got his arm twisted).
Then, he went out in front of the C-ville city hall with some greenie group to defend both him and his vote.

Enjoy those plug-in cars, but don’t count on getting a recharge without a long wait for a government permit, because the Obamacrats are implementing a nation-wide power shortage. In California, you’ll probably have to prove residency and political affiliation to get on the Recharge list.
There will have to ba a Residence Inn at every plug-in station.
It’s looking more and more like the only solution will be the 2010 elections followed by Impeachment and the “Omnibus Repeal of Foolish Legislation and Regulation” act.

I don’t know about PA, but here in Ohio the Republican party had shot itself in the @ss, not just the foot. There was a scandal with the state treasurer, Tom Noe, who’s now in prison for embezzlement, former governor Bob Taft had to plead guilty, while still governor, to a misdemeanor charge of not reporting $6,000 in gifts. Plus you’ve got Cleveland & Toledo which are Democratic strongholds, along with, to a lesser extend, Columbus. The Ohio GOP needs a thorough housecleaning.

Before the Nov. 2008 election, the American people were warned about the radical nature of an Obama administration. But thanks to members of the MSM, those warnings were ignored, downplayed or made light of. This revelation is one more example of Obama’s radical agenda. Funny how Colorado, with the biggest coal deposits in the country, is exempt from this scheme. If I didn’t know any better, I’d say The Won was playing politics, trying to complete the transition of that state from deep purple to blue. Plus punishing WV for going against him last year, and OH for backing Bush in ’04. But I’m sure he’d never play politics with our energy policy like that!

I’m going to put on my liberal hat here and applaud this Administration. You can argue over the propriety of yanking a permit that had already been granted, but given what these permits are producing I’m not real worried about the poor coal companies getting screwed a little bit.
As a Kentucky native, I would be happy if this Administration did figure out a way to completely ban surface mining of coal. Unless you’ve seen a strip mine — and especially the way they do it now, which is called “mountaintop removal” because that is exactly what it does — you have no idea how it devastates the environment. My husband is also an environmental lawyer who has prosecuted a few Clean Water Act violations involving surface mining and some of these mines are just Third-World level grotesqueries. People living near them have their water ruined for generations. It’s virtually impossible to do mass-scale mountaintop removal mining without a substantial amount of runoff ending up in streams and rivers.
Underground coal mining is dangerous and slow, and far more costly than surface mining. Returning to it will increase the cost of coal and of the electricity that is generated by burning coal. But it is far better for the environment and it has provided thousands of good jobs for generations of Kentucky and West Virginia miners. The coal industry now doesn’t give a damn about them or the environment in which they live. This fight is not over jobs, because strip mining doesn’t use people, it uses machines to do most of the work.

We’ve already shown that we don’t really need to pay attention to that pesky constitution. What comes next? Well, if they don’t co-operate, let’s disregard that pesky Senate thing too. What do all these checks and balances really do, anyway? They get in the way of hopenchange, that’s what! /sarc
Looks like Obama might not need Senate cooperation on climate change; he can do all the damage* he needs to do to cripple our economy through executive power and the EPA.
* At this point, I do think the economic damage is intentionally inflicted. Afterall, you can’t be a millitary superpower if you aren’t an economic one, too.

What the long term goal is to force as many people back into cities for environmental as well as political reasons.
Get rid of those suburban congressional districts made of white GOP middle and upper class voters. Make them move into a “diverse” city that needs to tax their income to shore up its crumbling tax base and can have districts drawn to dilute their votes. They can take public transportation to work.
And the burbs go back to prairie grass.

Ironically, Cap and Trade may have a more harmful effect on Obama(Don’t)Care. Heavy-handed government intervention on industry (GM, Chamber of Commerce, etc.) is now pro-forma with this Administration. He’s going to start losing moderate Dems on this issue and it will have an impact on that cloture vote for healthcare.

Because it can’t be said often enough:
West Virginians voted OVERWHELMINGLY for McCain/Palin. We understood what Obama would do to Coal.
All three of our House members voted AGAINST Cap and Trade – and both Byrd and Rockefeller have already stated they will vote AGAINST Cap and Trade.
Don’t lump us in with OH, PA or VA.
