Palin-haters to release lookalike attack book on Nov. 17

Via Gateway Pundit. November 17 is the same day her own book drops, of course. Further evidence of how obsessively the left hates her or just a bunch of lefties looking to make a quick buck by piggybacking on her buzz? Both, of course! Behold the ingenuity of capitalism:
Going Rouge is compiled by Richard Kim and Betsy Reed, two top editors of the left-leaning weekly The Nation, and includes essays by Nation regulars like Katrina vanden Heuvel, Naomi Klein, and Katha Pollitt. It’s the first release from OR Books, a fledgling outfit founded earlier this year by publishing veterans John Oakes and Colin Robinson that “embraces progressive change in politics, culture and the way we do business,” according to its website.
I realize that this anti-Palin book is a paperback and probably won’t be stocked anywhere near Palin’s hardcover memoir in bookstores, but are these jackets look too similar to be, well, fully kosher? At the very least, might some hockey-mom-loving conservatives be confused enough to pick up the wrong book? You betcha!
Good question. My memory of trademark law is rusty so the intellectual property lawyers in the audience are invited to treat this as a final-exam fact pattern in the comments. Can the entire layout of a book cover qualify as a trademark for legal purposes? Even if it can, doesn’t the subtitle “An American Nightmare” on the cover of the lefty book defeat the argument that the design is confusing? (If not, is there some sort of “parody” defense?) In the mad rush to the bookstore next month, some Palinistas are bound to grab the evil twin instead of Sarahcuda’s own book, but after a few angry returns I’m sure store managers will move to keep the two titles separate and distinct somehow. Exit question: Will the “evil twin” become a bestseller too as lefties snap up copies to try to counter her hype?

Technically, it is neither copyright nor trademark infringement. It falls under common-law business protection.
The bottom line is childishly simple: if the design causes confusion among potential customers (and assuming Palin’s cover came first, which of course it did) then she wins. And no; parody is no defense whatsoever for that.
The good news is that Palin wouldn’t be limited to suing just the unemployable moonbat who typed “liars are lying liars” ten thousand times and called it a book. She could sue the publisher, distributor and every bookstore that carried the ripoff.

First, I am quite happy to post at all. My Internet access slowed to a crawl today.
Second, as I contemplate the events of the last few days, I am struck by the “hurl everything, including the kitchen sink” nature of much coming from the left, and I am left to conclude that a movement needing to resort to such tactics is unsustainable in the long run. They simply do not have enough momentum.

Thoughts:
I personally think the type of people who will purchase Sarah’s book are too smart to fall for such garbage.
Looking at the NYT Best Seller List, I haven’t seen liberal/Marxist/anti-Conservative books flying off of the shelves. I predict this one will quickly be in the clearance pile. I hope they gets sued to top things off.
I think I’ll take my copy with me to family get togethers with my husband’s family. They’ve been especially obnoxious since the Obama presidency. I’m not so rude to read in front of company, but it will be sticking out of my purse.

It isn’t just the cover design that is close enough to be confusing; it isn’t just that the two books are coming out on the same date; it’s also that the book titles are almost identical. One book says “Going Rogue : Sarah Palin”. The other book says “Going Rouge : Sarah Palin”. To me, this just SCREAMS “yes we want to undermine sales of Sarah Palin’s book.” And yes, unless this leftwing knockoff is taken off the market, we’re going to hear stories about people buying the wrong book by mistake.
Surely HarperCollins’s lawyers are looking into this as we speak.

To answer the exit question, yes this book cover can and most likely will be taken to court over and will be won as a violation of copyright. This is so similar and obviously done with intent to deceive, that any properly sober judge will slap an injunction on the release of this smear book.

BTW her book goes back and forth between #1 and #2 @ Amazon for 23 days. Publication is still a month away. If Katrina and her crowd sell 5% of what Palin sells it will be a miracle.
