Palin-haters to release lookalike attack book on Nov. 17
posted at 8:38 pm on October 21, 2009 by Allahpundit
Via Gateway Pundit. November 17 is the same day her own book drops, of course. Further evidence of how obsessively the left hates her or just a bunch of lefties looking to make a quick buck by piggybacking on her buzz? Both, of course! Behold the ingenuity of capitalism:
Going Rouge is compiled by Richard Kim and Betsy Reed, two top editors of the left-leaning weekly The Nation, and includes essays by Nation regulars like Katrina vanden Heuvel, Naomi Klein, and Katha Pollitt. It’s the first release from OR Books, a fledgling outfit founded earlier this year by publishing veterans John Oakes and Colin Robinson that “embraces progressive change in politics, culture and the way we do business,” according to its website.
I realize that this anti-Palin book is a paperback and probably won’t be stocked anywhere near Palin’s hardcover memoir in bookstores, but are these jackets look too similar to be, well, fully kosher? At the very least, might some hockey-mom-loving conservatives be confused enough to pick up the wrong book? You betcha!
Good question. My memory of trademark law is rusty so the intellectual property lawyers in the audience are invited to treat this as a final-exam fact pattern in the comments. Can the entire layout of a book cover qualify as a trademark for legal purposes? Even if it can, doesn’t the subtitle “An American Nightmare” on the cover of the lefty book defeat the argument that the design is confusing? (If not, is there some sort of “parody” defense?) In the mad rush to the bookstore next month, some Palinistas are bound to grab the evil twin instead of Sarahcuda’s own book, but after a few angry returns I’m sure store managers will move to keep the two titles separate and distinct somehow. Exit question: Will the “evil twin” become a bestseller too as lefties snap up copies to try to counter her hype?

Haha…I get it….”Rouge”. Because she’s a woman and she wears makeup.
The real question is, “Why do liberals hate women?”
*I’m aware it’s not a logical conclusion, but, those sorts of leaps of logic seem to work for the crazy lefties (they get called mainstream and normal) so, I figured I’d give it a try.

Actually, it’s a good idea. And a reminder for the Meghans and Frums and their “play nice” crap. I remember during Bush Kerry how I could post that cover of “Unfit for Command” and my online lefty friends would just fume.

I think all you have to show is that they intended for there to be a mixup… and it’s pretty obvious that they’re tying to confuse people…
Palin and her people should ignore it though… but I don’t think her publisher has her interests at heart(an editor there published an anti-palin book)… and I wouldn’t be surprised if someone there sued…

It’s even stronger smelling than that.
I reckon Sarahcuda’s book will hit Number 1 on the NYT bestseller list. And, like Michelle, they won’t review it no mater how much the aging school girl Dowd screams and shouts for the gig.
Anders on October 21, 2009 at 8:45 PM
Look, if you listened to Van Jones’ keynote address last year to the netroots, you’d understand why they are attacking her so much. They’ve learned their lesson, they know what happened to Carter and why, and they know how Reagan benefited from it, and pushed back the progressive agenda by at least twenty years. They wont let that happen again. I don’t know if Palin would be as good as Reagan, neither do they, but they sure as H-E-double hockey sticks aren’t going to wait to find out.

Don’t tell me the Far Left isn’t scared of Going Rogue.
I predicted that the Far Left would do anything within its power to sabotage the book launch on November 17th. since they have apparently given up the idea of burning down the publishing house the hext best thing is to create chaos in the book launching by offering a “substitute”.
Of course we can expect the standard fare from the Far Left that Palin didn’t write the book, that Sarah is a sockpuppet of the right-wing extremist Lynn Vincent, or that her book “rambles”.
technopeasant on October 21, 2009 at 8:46 PM

After I’m done with them, they will separate the books.
I will then check on it the following day.

The entirety of trademark law and trade dress law (look up trade dress… most lay commentators on the law miss that whole area) is to prevent consumer confusion as to the source of the work. This is designed to create consumer confusion. This is the type of thing that trademark and trade dress should protect against. The only problem is that the courts have interpreted the satire/commentary exceptions to such an extent that it devours the rules.

Even if they did have a cause to sue, it seems like damages would be hard to prove. Book covers aren’t proprietary and there’s no clear defamation. Probably isn’t worth the time or the “we got sued for this book” publicity.

I don’t think the fake book isd going t fool too many people. I think that this just might be what makes a lot of people finally come to the conclusion the the Hatefilled Left is nasty, vicious and mean.
This is nasty middle school stuff and I just don’t see anyone I know who voted for Obama being okay with the hate and the smearing going on of Sarah Palin.

She looks great on both covers. I guess they just couldn’t find a bad picture of her.
The Nation is on the far left (it was one of the last overtly Stalinist periodicals before it fired Alexander Cochburn) but it was–even when it was Stalinist–intellectually serious.
Sarah Palin has shorted out the brains of the left-wing elite. They will sacrifice their credibility in order to try to hurt her.
One more reason to love Sarah Palin.

Indeed. They let the secret out too soon. Btw. now and the 17th all the talk shows, TV, left and right, will talk about it.
Might sell both of them better, but surely one will stink and one will be earned. Good people just know the difference btw. right and wrong.
Schadenfreude on October 21, 2009 at 9:07 PM
It won’t work, for the simple reason that bookstores are not going to put the two together and risk the wrath of customers who accidently pick up the wrong one.
The fake book will be relegated to some back shelf, if it’s even sold at all. A bookseller is not going to appreciate a publisher attempting to dupe their customers.

This is an act of desperation by an insane, demented, and delusional group that’s out of real ideas. After all these years of their rhetoric and propaganda, they have failed in their quest to change hearts and minds. Now, they’re stuck.
