HuffPo, Rick Sanchez retract phony Limbaugh quotes

No harm in admitting the lie now that his NFL bid’s dead. First, via the Standard, comes this belated HuffPo postscript to a post that’s three years old:

And now here’s Sanchez, kinda sorta apologizing — on Twitter — for airing the bogus slavery quote on his show earlier this week:

Proof that Limbaugh’s threat to sue people over this is being taken seriously? Eh, I doubt it. As I said before, it’s really hard for a public figure to prove defamation. He’d basically have to show that his accusers knew the quote was false and published it anyway; both HuffPo and Sanchez would reply that they didn’t know and were merely lazy, sloppy, negligent reporters in relying on published sources for a quote that they hadn’t fact-checked. The retractions, I suspect, are motivated less by fear of being sued than as a lame nod to journalistic ethics. “See, we correct our highly incendiary errors. …Eventually.”

Meanwhile, it’s safe to say that the Journal’s solved the mystery of why Olbermann, of all people, came to Rush’s defense a few days ago:

What happened here, and is happening elsewhere in American life, is that Mr. Limbaugh’s outspoken political conservatism is being deemed sufficient reason to ostracize him from polite society. By contrast, MSNBC’s Keith Olbermann, who fires off his own brand of high-velocity, left-wing political commentary but lacks Mr. Limbaugh’s sense of humor, appears weekly as co-host of NBC’s “Football Night in America.” We haven’t heard anyone on the right say Mr. Olbermann’s nightly ad-hominem rants should disqualify him from hanging around the NFL. Al Franken made it all the way to the U.S. Senate on a river of political vitriol…

It is no secret that this country’s politics has become intense across the ideological spectrum. Rush Limbaugh lets his listeners blow off steam and then get on with the rest of their day. But if the people who claim to worry about such things want to see a truly angry right develop in this country, they should continue to remain silent while the left tries to drive Rush Limbaugh and others out of American political life. If that happens, the NFL by comparison will look like an afternoon tea.

You would be hearing complaints about Olby now if he’d joined the chorus against Limbaugh, but Kayo was one step ahead of the game this time. Is Soros?

Our local paper still carries Ann Coulter along with a selection of pundits of the Right & Left. In the Letters to the Editor section you never see anyone asking for a left leaning pundit to be discontinued but there isn’t a week that goes by that someone doesn’t get the panties in a twist about the Right and demand that the paper stop carrying them. Ann is usually the target.

I’m not sure this was about politics (this being the decision by the NFL to shut Limbaugh out) as much as it is an example of good old fashioned cowardice by US corporations.

Money talks, the fear of losing money shouts and whether Rush was a conservative or a cub scout that was going to be the decisive factor.

Sure, the yelling and screaming by the left fed into that fear. But that fear is apolitical.

That doesn’t really work in a court of law. The one place where he might have a shot is MSNBC. They cited James Farrior, a football player on the Steelers roster, as their source for the quotes. Literally cited him as the source, meaning they realized the quotes were almost certainly bogus but wanted to run them anyway, and needed some kind of citation to do so. So they cited a football player.

I honestly think he should sue anyway, even knowing he would lose, just so this type of thing won’t set a precedent. I honestly never thought I’d see the day, even given everything that happened during election season last year, where major outlets would run unsourced, unverified ‘quotes’ as fact just to smear a guy. That’s a scary place, no matter which side of the aisle you’re on.

I can’t remember the name, but on O’Reilly, they named the name, of the man to whom these false statements came from. Obviously blatant lies, and yes….the damage is done. Those weren’t apologies, just retractions, and basically saying…we can’t prove it…..yet.

Rush should sue, and I may try to call his show, and encourage him to do so. We all should. Enough is enough with this crap!!!

In Times v. Sullivan:

For a public official (or other legitimate public figure) to win a libel case, the statement must have been published knowing it to be false or with reckless disregard to its truth, (also known as actual malice).

Either they knew it was false OR they acted with reckless disgregard to its accuracy.

Not both.

I don’t think it’s a lawsuit they are worried about. They have opened themselves up to the same scrutiny and Rush has a megaphone that he briefly used against Sanchez yesterday. “Actual malice” is not impossible to overcome. Carol Burnett nailed the National Enquirer for millions a long time ago after they called her a drunk. Not checking facts, when you’re a reporter, isn’t much of a defense, IMO.

Again, the standard as I understand it for defamation of a public figure in the US is that the plantiff either has to show that the defendant knew the state was false when they made it or that they acted with malice or reckless disregard for the truth when they made the statement.

That’s a mighty tall hurdle.

While public figures have a harder time making slander and libel claims, they are not denied all access to redress in the courts. Generally speaking, claims of invasion of privacy are more difficult for public figures to make, but claims of slander or libel with actual malice are often allowed to go forward, and the courts have found that gross failure of due diligence to check facts is an indicator of malice.

Since this all started because people passed on the lies from Wikipedia, other people might want to edit the Wiki articles on Rick Sanchez, Jesse Jackson, Al Sharpton, etc. with quotes they “find.” I heard somewhere that Sharpton said it should be legal to have sex with 12-year-old girls? Send the Wiki link to Rush and he could read it on the air. Hey, it came from Wiki, so it must be true.

The test, IIRC, is whether the publisher, here broadcaster “entertained doubt” as to the statement’s validity. That could be easy to prove if Sanchez said something along those lines.

Do not be too quick to write off Rush’s chances to sue. Yes, it can be difficult, but as for impossible, just ask Lucy!

Meantime, various outlets like CNN, have lost even more credibility in this episode. Do not be surprised to see Sanchez looking for a new job in the near future.

Idiots. They know litigation is coming. Remember, this is both libel (written defamation) and slander (spoken defamation). They also know that there is no reasonable defense. Rush has kept every spoken word in archives and their fact checkers are now puckering.

Last night I said Rush wasn’t one to sue. He doesn’t need any financial award. He will be redeemed by stomping these putrid, venomous hate filled snakes out of existence using all legal remedies available. This should include the employers and the financiers of those that spewed forth their venom with vigor but without forethought or fact checking.

Their attempt to discredit one of America’s most talented and articulate members of society, has been an epic fail. Openly admitting their guilt is icing on the cake.

Jury Trial. Nothing less.

I’ve been saying, for a while now that I hope the Republicans are taking notes because the Democrats are giving them lessons on how to run Congress when you’re in the majority and I fully expect them to put the Democrats in their place after the 2010 elections.

Now, the liberal media is setting the standard, as far as comments are concerned, and I sincerely hope we hold them to it. The new standard appears to be you can quote anything, without checking it and then, if the agrieved person makes a stink, you check in then and, if they threaten to sue, you retract it, sort of.

I fear for our country if this is what our schools of journalism are teaching as the new standard. These people should be ashamed of their conduct, in this affair, and apologize profusely. If they don’t I hope Limbaugh sues them for so much money, he ends up owning them.

I would think that for ‘journalists’ to completely fail to source the quotes and repeat them in any event would acting with reckless disregard as to the quotes’ truth or falsity.

It cannot be the case that just because Rush is assumed to be a ‘divisive’ character that gives journalists license to believe he could have made the statements . . . and therefore they were not acting in reckless disregard. If that sort of excuse is upheld, it will truly be open season on any public figure that holds what the statists regard as ‘controversial’ views. I hope he does sue; this type of behavior should be nipped in the bud.

Last night I said Rush wasn’t one to sue. He doesn’t need any financial award. He will be redeemed by stomping these putrid, venomous hate filled snakes out of existence using all legal remedies available. This should include the employers and the financiers of those that spewed forth their venom with vigor but without forethought or fact checking.

No, Rush certainly doesn’t need the money – but I get the feeling from listening to him the past few days that this time, they’ve pushed it too far. He can afford just as many, and just as pricey, lawyers as any of his detractors can. I think he’ll sue, just to get the whole disgusting clump of lying media worms out in the open, where they can’t slink away.
I hope so.
